Council was called to order by Mayor Large with all Co~ncilmen present except Mr. Reid. Minutes of the regular meeting of July 9th and the adjourned meeting of July 23rd were read:::and approved. ltr. Lammers and LIr. Estes appeared before the Council wi th reference to moving a house to a location on 15th Street between Lawrence and Lincoln Streets. This matter was referred to the Building Inspector. . I.~ The Finance Committee, by Councilman_Hendershott, Chairman, reported the following bills to the Council with a recommendation that they be allowed, and motion was made, seconded and carried that warrants be drawn for same. Motion was seconded and carried. . -- ~ r"" 298 . ---_. - - - .- -- --- - ___. _._ - ~ I _ ___ - - - - -.- - -- - ~ .. .. -- - - - - -- - .-- -- _.- - - .--- --- ,---- - - ~ -- ~ .-.-" - ., - - ----- -- -- -- c. ___ - -- - -- .. -_. --- -,.. -- - - -.. -- ~ -.- - - -- Mr. Zumwalt also called attention to'the following matters: That it had been suggested that a Stop sign be placed at 16th Street between Lincoln and I t,t" Lawrence'Streets on account of fast driving on a narrow street; that the McMurphy '""".b'ii~ barn on West 8th Avenue between Charnel ton and Lincoln Streets was being torn '''IC~ ~"f :~ down; and that the matter of condemning the building at. 245 lTadison Street, in which Attorney Wintermeier was interested, should be continued with a suggestion that Mr. Wintermeier box in the building. This matter was laid over for two weeks. Councilman Reid appeared in Council at this ti me . Councilman Harris of the Park Board recommended that the City allow an accou~t of $13.50 for brick to be used in the construction of the fLr~places, and that provision be made for the construction of four stoves at Skinner's Butte Park, and one in Hendrick's Park. Also that the Park Tender is badly in need of a. car, particularly as a means of conveying S.E.R.A. workmen back and forth to jobs in t he park. The recommendations of Councilman Harris were adopted by the Council, including an instruction to Councilman Bond to endeavor to purchase a car for the required purposes at a price around $200.00. . I The Police Committee, by Chairman Simon, recommended the approval of the application o,f J'.Uller and Sylvester for a beer license at the place formerly known as Jake's Place at 746 Par}{ Street. On motion the recommendation was adopted. Report of the Fire Department for the Honth of June, re port s 0 f the Police Matron for June and July, and of the Engineer and Police Department for July were read and filed. . 11 The application of F. J. Park for a transfer of his woodsawing license from 1446 Lawrence Street to 1256 West 8th Avenue, investigated and approved by the II Chief of Police, was on motion approved by the. Council. A protest was filed from the Library Board, supported by oral protest from h I Fred Fisk and two members- of the Board of the First Christian Church, with j reference to establishing a wood yard East of the Library building, and Mr. Dugan, I the party proposing to install the business appeared before the Council and stated , that,in view of the opposition he would make no attempt to use the lot. No action I was taken. A petition for the vacation of the alleys runlung East and West and North and South between lOth and 11th and Charnelton and Lincoln Streets was read and a Resolution directing the Recorder fo file the petition and publish and serve notices as required by law, and fixing a time for hearing objections for September 24, 1934 was read and on motion duly seconded and carried was adopted. RESOLUTION I 'WHEREAS , the property owner owning the property between the , streets Charnelton and Lincoln, on the East and West, and lOth Avenue e West and 11th Avenue West, on the North and South, has presented to the Common Council a petition praying fore the vacation of the alleys running East rold West, and Horth and South through said block, said . petition particularly describing said alleys. , Therefore " BE IT RESOLVED BY THE COMHON COUJ:JCIL- of the Ci ty of Eugene that I the City Recorder be and he is hereby directed to file said :petition and 110 issue, publish and seTve notices as required by law, notifying I c ,all persons that the petition is set for hearing of all objections, I on the 24th day of September, 1934, at 7:30 o'clock P.M. in the office I of the City Recorder in the city hall in Eugene. This being the time for the hearing of protests, remonstances, and objections against the proposed condemnation of the building at 526 Willamette Street, and due notice having been giyen, the matter came on for hearing at this time, and lVLr. N. R. Gaylord appeared before the Council and spoke at length in opposition to the proposed proceedings, after which the following Resolution was read and a motion made, seconded and carried to adopt the same. ( RESOLUTION This matter coming on to be heard before the Common Council of the City of Eugene, pursuant to notice, on the 13th day of August, 1934, at 7:30 o'clock P.M., of said day in the office of the City Recorder of the City of Eugene, in the Ci ty Hall of said Ci ty in I Lane County, Oregon, and it appearing to the council that complaint~ have been made by residents and proprietors of business houses situated near the property herein described, and reports have been made by the Chief of Police, the City Attorney, the Chairman of the Health Committee, the Fire Chief and the Building Inspector, declaring said .buildin to be dangerous buildings in fact, and dangerous buildings under the provisions of Ordinance No. 8292, and a nuisance, the Council thereupon proceeded to a hearing, and examined various ~rsons upon behalf of the City, including various city officers, and members of the Council who had . inspected the building, and the defendant N. R. Gaylord appeared before the Council and presented his side of the controversy, and \~s given opportunity to present any and all testimony, arguments and statements on behalf of himself and wife, and the Coungil after having heard all remonstrances, protests and objections and being fully advised in the premises, at this time makes its findings, as follows: ~ 'First that the said building be and the same is hereby declared to be a~,dangerous building as a matter of fact, and also the same is I hereby.declared to be a dangerous building as lefined by Ordinance No. 8292, adopted by the City of Eugene, on the 9th day of May, 1934. - Second that said building be and the sarne is hereby declared / to be a pUblic nuisance. That it cannot bB made safe and sanitary. Fourth, that is the judgment of the Council that the buildings should be removed and abated. Fifth, that the building is not being put to any useful purpose I and it should be,forthwith vacated, and should be immediately torn down and removed completely. . II The buildings are situated on Lot 4 and the South 10 feet of Lot One, Block 3, of Skinner's Donation to Lane County, an Addition to I Eugene, Oregon, and are located in the business district of Eugene and I I I surrounded by business houses, and al~e within the fire limits and I are I Ii cannot be repaired under the city ordinances except by complete re- construe ti on. That the greater portion of said buildings were formerly used as a rooming house but have not been used or occupied for the past II sevel"'al years. That no insurance is being carried upon said buildings, I II and no inc ome is derived from the~~ That both of said buildings are I Ij frame structures, one of which is a two story building, and said II buildings are in a bad state of disrepair. That there is danger of '1 t , timbers falling and injuring persons at any time. That said buildings are in such close proximity to the surrounding buildings that they constitute a serious fire hazard to said other buildings. Tha t the larger building is heated by an old stove and stovepipe in the front room used as a shop and there is no electric lighting, and the re is \ very great danger of fire from the illumination used. That it is impossible to lock up said buildings and they constitute a lurking 11 place for tramps and disreputable characters. That the rooms are filled with rubbish and ill smelling mateTials, whidh is a breeding place for germs and disease qnd is a meance to the health of the surrounding cO~TIllnity and to the City of Eugene, That the buildings constitute a veritable trap for children on account of broken boards in the floors, and the possibility mf falling timbers, and is an attract- II ive nuisance. II The Common Council of the City of Eugene the refo re orders and directs I that said buildings be removed and the nuisance abated, and the City I I Recorder is hereby ordered and directed to give fifteen days notice to I n. T. Gaylord and Laura M. Mayor Large named a cou~ittee of Councilman Lamb, Edwards and Bond, with the suggestion that they take up with Mr. Chambers and Hr. Gaylord the pOSSibility of arriving at some agreeable solution of the proposed condemnation of the Gaylord Building. Engineer, Clubb expressed the need of a special shovel operator at the Airport at a cost of $4.00 a day for the remainder of the month, and with an understanding that the Sand and Gravel Company will pay a half of this cost the Council author- ... , ized the sum of ~34. 00 tome e tit s half of thi s expense for the balance of the , man tho f Augus t . 11ayor Large explained that the various parties interested in the proposed chal~e of the mill race near the Anchorage were not able to get together on a <'I). definite plan at this time. ~v ~~')~ The discussion of the situation of the Eugene Packing Plant, of which ,~ \'" fZ ?omplain~ was made at th"~ last meeting of the Coun?il on,account of the noisy l"'-VtJ ice machine, was had by Lir. Ivlosher and Attorney Whitten Swafford, who appeared , \~ for the owners of the plant. No action was taken. Y:~~ v Councilman Hendershott called attention to complaints regarding the noisy and improper conditions surrounding some of the beer parlors, and COlUlcilman Simon, Chairman of the Police Committee, stated that his cownittee would invest- igate any such complaints. A general discussion on the subject was had and no action taken. I On motion the Council adjourned to meet on the 27th day of August, 1934, at 7:30 o'clock P.M. R. S.
