January 28, 1935. ClJ :'J'; ~~ I I'Ilinutes of the adjourned meeting of the Common Council, held at the hour of 7:30 o'clock P. M., January 28th, 1935. Council was called to order by 1~yor Large, wi th all Councilmen present except Rei~ and Hende rshot t. The Judiciary Committee, by Chairman Harris, reported o~ the letter from John J. Scrivner, asking for the 'Waiving of interest on city liens on hi~ property located at 1873 East 15th Avenue, and moved that it be not granted. Mot~an was seconded and' carried and the Recorder instructed to notify Mr. Scrivner of the decision. The Judiciary Committee, by Chairman Harris, also reported on the letver from Mr. Stanley asking for the waiving of interest due on improvement assessments against Lot 6, Block'21, College Hill Addition, and it was moved, seconde(l and carried that this also be rejected, and the Recorder instructed to notify Mr. ~tanley of the deoision. At this time Councilman Hendershott appeared in Council. The Fire and Water Committee, by Chairman Bond, asked for two weeks more time to study the situation of the lighting of. West Park Street~ The additional time was granted. The Health Committee, by Chairman Zumwalt, moved to condemn the building at 1708 Lawrence Street. Motion was seconded and unanimously carried. . The Health Committee, by Chairman Zumwalt, moved to condemn and immediately tear down the present oity jail, (at this time Councilman Reid appeared in Council) and the ayes and nays were called. Councilmen voting aye, Zumwalt and Harris. . Nay, Lamb, Hendershott, Reid, Simon, Bona. and Carlson. Mr. Rees addressed the Council at this' time, and commended the Council's action on postponing the condemn- a ti on of the jail. Councilman Simon moved the. t the Mayor appoin t a commi ttee to look in to all phases of the jail si tua tion, and the motion was sec onded and carried Mayor Large appointed the following to constitute the Committee: Dr. Simon, Dr. Harris, and Arthur Hendershott. . The Health Committee, I)y Chairrnan Zumwalt, reporte~ the deliberation on the milk and milk products ordinance, and stated that they recommen(led a $?O.OO flat license fee for a distributor and/or producer-distributor, and that'would allow one truck, and an additional fee of $20.00 for each additional truck. ~roducers fee to be $1.00 annually. Retailers fee to be $2.50 annually; and recommended that the meat fee be collected by the Inspector, and that an annual meat retailers fee be placed at $2.50. Upon motion, seconded and carried the recommendation was adopted, and thecmilk and milk products ordinance and the meat ordinance were - I referred to the Ci ty Attorney for the amendments necessary. . Mr. Zumwalt reported a list of firms dealing in milk prOducts who heretofore have paid no fee. After discussion by the Council, and upon motion it was unan- imously decided that this subject be referred back to the Committee to bring in a report at the next meeting. . The Sewer Committee, by Chairman Reid, recommended that the proposed plumb- ordinance that had been referred to this Committe~ at the last Council meeting be ta bled. Mo tion was made, seconded and carried to adopt thi s recomrnendati on. The SUbject of the M.S. Barker property on the East sidecof Jefferson Street near the Sou thern Paoific track, was referred to the Sewer Comllli t tee. ';.;' .. . I. It was moved, seconded and carried that the Plumbing Ordinanoe be amended to provide for five membe rs Ins tead of three, and be c onsti tuted as follows: One master plumber, one journeyman plumber, the Building Inspector, and two freeholders I The matter was referred to the City Attorney to draw up the amendments. I The Sewer Committee, by Chairman Reid, brought up the matter of connecting the catch basin with the storm sewer on'Villard Street at the corner of 15th Avel East, at an approximate cost of $27.09. Motion was made, seconded aTId carried that this be approved. 1 T.he Police Committee reported ~avorably at the present time on the petitions a~{ing to make West 11th Avenue a through street. The POlice Committee also reported unfavorably on the petition for a one hour parking zone on Park Street. i It was moved, seconded and 'carried that a stop button be placed on the South side of 13th and High Stree.ts, and the Recorder was instructed to secure prices on thi s bu tton. .. ~ r338 I . I c. ., . \ i The Police Committee, by Chairman Simon, recommended the approval of liquor licenses for Charles M. Munson, and J. V. Blch; that the application of L.. G. Lasater be rejected; and that the application of Ray Sherwin be held up for further consideration. On motion duly seconded and carried his recommendat- ions were adopted. . The Recorder at this time brought up' the subject of granting"a license to Delmer Dietzman for Taxicab service, and the Police Committee reported that. according to the interpretation of the Recorder's Office the Police Committee had no jurisdiction. The Recorder stated that as far as his office was concerned that any new applications for taxi licenses would be referred to the Police Committee for their reoommendation before a license would be issued,.' The :Mayor asked the Police Committee to bring in a decision on the Deitzman case at the next Council meeting. Councilman Hendershott reported that there had been some complaints received about the condi tion of the alley between 5th and 6th Avenues from Lincoln- to Lawre ce Streets. Mr. Clubb stated that there was no alley platted in this block, but the same has been used as an alley f.or a number of years. The mat ter was referred to the Street Committee to see if it is advisable to either close or open the alley. The annual report of the City Engineer was read and filed. A petition was read asking the Council to consider the widening of East 11th Avenue to 56 feet. Dr. Helms addressed t1;re Council in behalf of this petition, and after considerable discussion the petition was withdrawn and-returned to the petitioners for their further consideration. An Ordinance to provide for the regulation of taxicabs' and vehicles for hire, other than regular street bus service, operated between fixed termini, and providing for the licensing of the same, and for a permit for drivers of vehicles for hi re, was read the: first time and passed it s second and third readings by title under suspension of the rule by the unanimous consent of the Council, and was placed upon its final passage. The ayes and nays were called, Councilmen - voting aye 8, nay none, absent none. The Ordinance was declared passed and numbered 8402. A c~mmunication was read to the Council asking them to memoralize Congress to consider the Townsend Plan of Old AgetlPensions. - I t was moved and seconded to be tabled, but due to the intensity of the feeling on the subject the ayes and nays were ordered called, and Councilmen voting aye, Hendershott and Harris. Nay, Lamb, Reid, Simon, Zumwalt, Bond, and Carlson. It was moved, seconded and carriedtha t this matt er be refe rred to a special c ommi t tee to be appointed by the Mayor. The Mayor announced that he would make the appointment a little later, and the Commit tee would report back at the next meeting. ' A petition was presented for the repealing of Ordinance<No. 8388, or the University liquor zone~ Ordinance repealing Ordinance No. 8388 entitled "An Ordinance creating a zone around the University of Oregan in which it shall be unlawful to sell alcoholic liquorsrl, passed by the Co~on Council April 9, 1934, and approved by the Ma.yor April 10, 1934, and declaring an emergency, was read the first time, and upon motion was read the second and third times. The ayes and nays were called, Councilmen voting, aye, Lamb, Hendershott, Reid, Bond, and Carlson. Nay, Simon, Zumwalt, and Harrls. The motion was declared los.t due to the attempt to pass it on the same night introduced, and the Attorney states that it requires a six to two vote. The Ordinance was laid over for the 2nd reading on February 11th. Sealed 'bids were opened at this time for the audit of the 1934 City accounts C. A. Horton $179.50, Percy W. Brown, $188.00, and Wm.'Whitfield & Co. of Portland force account. Councilman Carlson raised the question of the advisability of the Ci ty employing a Certified Public Accountant, and after some discussion Council- man Zumwalt moved that the bid of Mr. Horton of $179.50 be accepted. Motion was seconded and the ayes and nays called. Councilmen voting aye 8, nay, none, absent none. I . The subject concerning the tax sale of property filed by Lane County on which the Ci ty holds deeds was brought up. The taxes on this property amounting to $1,757.66. Motion was made and seconded that these deeds be protected, and tha t the Recorder be au thorized to draw a warrant in the above amount in payment of these taxes. The ayes and nays were called, Councilmen voting aye 8, nay none. An Ordinance directing the Mayor and Recorder of the City of Eugene to deed certain property to the public for street purposes, was read the first time and passed its second and third readi~s by title under suspension of the rule by the unanimous consent of the Council~ and was placed upon its final passage. The ayes and nays were called, Councilmen voting aye-8, nay none, absent none. The Ordinance was declared passed and numbered. 8403. Ackerman for the return of-$5.00, liquor license investigation fee, upon report of Chief Bergman that no investigation had been made and that Mr. Ackerman had m~ved outside the city limits, was on motion d~y seconded and carried granted. w ~ ..t.,", ':. )....... The Mayor brought up the matter of the apparent excessive cost of heating th~;._ City Hall under the present system, and it was moved, seconded and carried that a Comrni ttee be appointed to discuss the question wi th the Water Board. . The .Mayor referred the matter to the Fire and Water Committee. '- City Attorney Calkins stated that he had received communication asking for the at.titude of the City Council upon pending legislation concerning making it mandatory that all cities of 5,000 or more population submit to the proposition of civil service examinations on their pOlice and fire department employees at the next primary or general election, as a special proposal. It was moved, seconded and carried that the Recorder communicate with Lane County's Representat- ives and Senators as being unfavorable to the bill. . On motion the Council adjourned. C. M.
