I Minutes of the adjourned meeting of the Common Council, held at 7:30 o'clock P. M., February 25, 1935. Council was called to order by Mayor Large, with all Councilmen present except Mr. Reid. The M~yor called for citizens presentations, and Mr. F. L. Cook presented a Resolution from the Ministerial Association of the Lane County Dry Association, stating that the responsibility for drinking must rest upon the shoulders of the city fathers in case the zone is repealed. Mr. Gordon Wells, spokesman for Gossers, College Side Inn, and the Oregana, pointed out in detail that the liquor ordinance .is unconstitutional. Mrs. Elder addressed the Council and pointed out that there was such a small percentage of students tha.t were buying beer in these places and we should consider the majority. She then introduced Mrs. Devereaux who read some personal letters from mothers over the State. Rev. Higginbotham pointed out tha.t the City of Eugene would be endangered if the liquor zone is repealed, due to the fact that we have a habit" of treating, which causes ordinary cont~olled individuals to become addicts to liquor beverage. ' Barney Clark, a student, addressed the Council and stated that a majority of the students came to school not to be placed in a dry zone, but wanted to be treated like ordinany human beings. Mrs. H. C. Saunders addressed the Council stating that in a discussion of this nature we should not place money before the future lives of our young students Charles Devereaux, a High School student, pleaded for a dry zone for the sake of the young people. Gene Allen addressed the Council, bringing out the point that as far as a student Choosing between Oregon and Oregon State, that had very little leeway as "the State Board of Higher Education has arranged the curricula in such a manner tha there is practically no choice. Bert Mustoe stated that as far as the zone was concerned he knows that both the wets and the dries in the zone want that zone repained. Mr. Devereaux address- ed the Council, pointing out that Eugene has had to struggle too long a time against the Oregon State College to give them any additional advantage by repeal- ing our dry zone. Mrs. M. Y. Warner addressed the Council asking that temptation be removed from the University of Oregon students, and that we should consider the, educational rather than the commercial. Upon motion of Councilman Lamb, the Ordinance repealing Ordinance No. g3gg entitled "An Ordinance creating a zone around the University of Oregon in which it shall be unlawful to sell alcoholic liquors. ", passed by the Common Council April 9, 1934, and approved by the Mayor April 10, 1934, and declaring an emergency; having been read the required number of times, was voted upon. Ayes and nays were called, Council~en voting aye, Lamb, Hendershott, Bond and Carlson. Nay, Simon, Zumwalt and Harrie. Absent Reid. The Ordinance was declared passed and numbered g407. Mrs. Elder thanked the Council for the very serious consideration that they had given this problem, and Mr. Landaker took the opportunity to thank the Council for not permitting the recent Scout Circus to show on Sunday. At this time Councilman,Reid appeared in Council. At this time the Recorder was requested to read the following Resolution: RESOLUTION Whereas the Common Council has had under consideration I the matter of the retention of a zone around the University of Oregon in which beer shall not be sold, and petitions have been presented by citizens of Eugene favoring retention of the zone and Urging that it be discontinued, each group basing their contention upon the welfare of the student body, and Whereas, the welfare of the student body is peculiarly the charge of the University of Oregon and their trained . social workers, ~ r 346 . r J ; C,i~ ~ ~-"-J 7-~ "'" NOW, THEREFORE, Be It Resolved by the Common Council of the City of Eugene, that it hereby endorses any official action taken by the authorities of the University of Oregon, either for or against the sale of beer wit~in th~ University District, and ~he Re~order is hereby directed to forward all pending applications, otherwise satisfactory, for license in said area to the Oregon State Liquor Commission with a copy of this r~solution, and to forward a copy of the Resolution to the management of the University of Oregon. I . Upon motion the ayes and nays were called, Councilmen voting aye, Lamb, Hendershott, Bond and Carlson. Nay, Reid, Simon, Zumwalt, and Harris. The Mayor voted aye, declaring the Resolution passed. Professor DeCou spoke on the Park situation in the City and read a letter from the Park Board and Park Improvement Committee, and Councilman Bond was asked for his report. Mr. Bond asked for two weeks additional time for further investi- gation. This time was granted. . The Judiciary Committee by Chairman Harris, reported on their meeting with the Water Board and State Industrial Accident Commissioner on the proposition of I compensation rates, and recommended that the City do whatever the Water Board wishes. This recommendation was adopted by the Council. The Judiciary Committee also recommended that the Auctioneer's Ordinance be amended to reduce the annual license fee for auction houses from $100.00 to $60.00. The Judtciary Committee introduced the subject. of a letter that they had received from Mr. John Fields, assistant Recorder and Treasurer, concerning the , condition of the City's Lien Docket records. After considerable discussion the Mayor appointed the Judiciary Committee, City Attorney, and City Recorder to bring I in a report as to what should be done on this subject. The Finance Committee, by Chairman Hendershott, at th~-request of the 'Recorder, moved that the $1,757.66 paid to Lane County to cover taxes on certain pieces of property for the protection thereof, be drawn from the Emergency Fund of the B~dget for 1935. The motion was seconded and carried. ~he F~re and Water Committee, by 9hairman Bond, bmught up the subject of needing fire hydrants and valves to complete work being done by the City Water Board, and after considerable discussion it was determined by the Council upon motion made, seconded and carried, that the money for these hydrants and valves should come trom the following items of the Fire ~epartment Bud~et: Hydrants, Hose, and Equipment-Repairs & Renewals. The Fire and Water Committee reported that additional time is needed for the investigation of the City Hall heating system. The Health Committee, by Chairman Zumwalt, asked for continuation of time on the investigation of additio~al license fees. ,Councilman Zumwalt introduced Mr. Keller who presented a petition asking that certain pieces of property be condemned, and on motion duly seconded and carried it was so ordered. I . The Printing Committee, by Chairman Carlson, stated that they had looked into the purchase price of plat book covers for the Engineer's Office and recommended that the order be granted to the Koke-Chapman Printing Company at the price of $4.95 for each set. This recommendation was adopted by the Council. The Sewer Committee, by Chairman Reid, brought up the subject of the M. S. Barker property, and after thorough discussion and upon statement of the City Attorney that inasmuch as the city has title to the property it was up to Mr. Barker to secure that title before the Council had any right to act. On motion duly seconded and carried the matter was tabled. The Police Committee, by'Chairman Simon, presented the application for a new taxi service license to be known as the Terminal Taxi Service, owned by Lester Grove. On motion duly seconded and carried, the Recorder was instructed to issue Mr. Grove a 1935 license. J. Robinson, Newton S. Smith, and C. C~ Campbell. Motion was seconded and carried that these applications be approved. Chairman Simon then presented the application of Glen Simon for.' a liquor license at the old Ackerman location, 2lg3 Franklin Blvd. Upon motion, seconded and carried it was turned over to the Police Committee with power to act. (This application was later approved) Chairman Simon then presented two, bills of $g.OO each to E. R. Nevers and M. J. Witbeck, for special police duty at McArthur Court during the Lane County Basket Ball Tournament, and recommended that they be allowed.. The motion was seconded and the ayes and nays called. Councilmen voting aye g, nay none, absent none. At this time Councilman Harris very strenuously objected to the ,payment for special police service for such work as that concerning the Lane County Basket Ball Tournament, that it is a waste, and that it was the duty of Lane County to provide that service. Dr. Simon then took the floor and spoke in behalf of such a practice, and very emphatically approved such courtesies as we are able to show the people of the surrounding territory of Eugene. Councilman Harris again objected on the basis that it was a foolish expending of money. Councilman Hendershott favored Dr. Simon 's statements. C;., ;~ ,~ . The ayes and nays were called, Councilmen voting aye g, any none, absent none. The Ordinance was declared passed and numbered g4Qg. An Ordinance amending Ordinance No. 561 of the City of Eugene, entitled "An Ordinance to regulate and impress a license upon auctioneers within the City of Eugene, and to impose a penalty for violation thereof; and to repeal Ordinance No. lt67 entitled "An Ordinance to impose a license upon auctioneers, to impose a penalty for violation thereof and to repeal Section 21 of Ordinance No. 99", and to repeal Section 21 of said Ordinance No. 9911, passed by the Common Council. and approved by the Mayor on June 12, 1905, by reducing the license of auctioneers of the first class to $60.00 per annum, payable in advance each four months, was read the first time and passed its second and third readings by title under suspension of the rule by the unanimous consent of the Council, and was placed upon its final passage. The ayes and nays were called, Councilmen voting aye, g, nay none, absent none. The Ordinance was declared passed and numbered glt09. In accordance with Ordinance No. glt04 reducing the milk license for distribut@ ors, it is necessary to refund $10.00 each to Virgil Liles and A. McMaster, the only two paying their annual license before the Ordinance wentointo effect. Motion was made and seconded to refund the above amount and the ayes and nays were ca~led. Councilmen voting aye g, nay none, absent none. Upon motion of Councilman Lamb, duly seconded and carried the Mayor, Engineer, and City Attorney were requested to attend the next meeting of the State Highway Commission to present the claim of the City for the re-surfacing of West 6th Avenue and Broadway from Willamette to High Street. The monthly report of generaili expense for the City for the periOd ending January 31, 1935 was ordered filed. A communication was read from C. S. D1l10n, 60mmander of the Commanders Council of Lane County, concerning a water system necessary for the preservation of the trees planted in the Butte Park. This matter was referred to the Park and Fire & Water Committee for investigation. Upon motion of Councilman Lamb, duly seconded and carried, contracts were ordered drawn between the Eugene Sand and Gravel Company and the City of Eugene, and Emeru & Ransom Agency and the City, which 1s to state any or all of the City's requirements for 1935. . The Recorder read a letter from the City Treasurer concerning the Prince property, and the same was referred to the Judiciary Committee and City Attorney. I . . ~ ~348 . On motion duly seconded and carried, the Recorder was, authorized to buy three Korstad Directories. ~ ., ';"~,.,... Attorney Calkins discussed a proposed ordinance excluding certain territory from Ordinance No. g3gg, and it was ordered tabled. City Attorney Calkins presented a proposed zoning ordinance whibh had been prepared and presented by the City Planning Commission. Motion was made and seconded that the Ordinance be read in full. The ayes and nays were called, Councilmen voting aye g, nay none, absent none. An Ordinance to create or divide the City into Districts within some of which it shall be lawful, and within others of which it shall be unlawful to erect, construct, alter or maintain certain buildings, or to carryon certain trades or callings, or within which the height and bulk of future buildings shall be limited, and providing for setback lines, and providing for a penalty for the violation thereof, was read the first time and laid over, at which time a public hearing was called for the, next, regular Council meeting night. The Police Committee was ordered to enforce the Ordinance concerning the placing of signs on parkings. / . The City Engineer's Office was ordered to see that all abandoned cuts in sidewalks were brought back to normal. Councilman Hendershott int~~duced Mr. Thompson and Mr~ Privot, Councilmen from Springfield, who exterided an invitation for a return visit. ' . A Resolution memorializing the Congress of the United States to pass, and the President of the United States to approve, if passed, the General Pulaski's Memorial Day Resolution now pending in Congress, was read and referred to a Committee composed of Councilmen Bond, Lamb, and Carlson, for their consideration.
