Minutes of the regular meeting of the Common Council held at the hour of
7:30'0'clock P. M., May 13,1935. Council was called to order by Mayor Lar~e,
with all Councilmen present except Reid.
Minutes of the regular meeting of April 8th, and the adjourned meetings of
April T2th, 13th, and 22nd, 1935, were read and approved.
Sealed bids for the sale of $137,000.00 Refunding Assessment Bonds C, and
~~55,479.l6 Refunding Assessment Bonds D, from E. M. Adams & Company, and a joint
bid on the j55,479.l6 from Baker, Fordyce, Harpham Co. and Hess, Tripp & Butchart,
were duly opened and read, and the Finance Committee retired to consider the bids,
and returned with the recommendation that all bids be rejected. This recommend-
ation was unanimously approved by the Council.

At this time Councilman Reid appeared in Council.
The Judiciary Committee, by Chairman Harris, reported adversely on the
proposition of Lottie N. Rugh to deed to the City a lot at the corner of West
Broadway and Van Buren Streets, and this report was accepted.
The Judiciary Committee, by Chairman Harris, reported adversely on the
Burton Nelson claim, as a result of an accident on Birch Lane. This report was
also approved by the Council.
The Finance Committee, by Chairman Hendershott, prisented a letter from
Fred Wentworth, City Treasurer, asking the Council to ratify the transfer of
$24,725.00 in Home Owners' Loan Bonds to the General Bond Sinking Fund instead
of selling them as previously authorized. This transfer was unanimously approved
by the Council.
The Finance Committee, by Chairman Hendershott, reported the following
bills to the Council with a recommendation that they be allowed, and motion was
made and seconded that warrants be drawn for same. The ayes and nays were called,
Councilmen voting aye 8, nay none, absent none.

The Finance Committee, by Chairman Hendershott, moved that the interest.
rate on all city warrants be reduced to 4 per cent. Motion was seconded and
carried.

The Fire and Water Cow~ittee, by Chairman Bond, recommended the install-
ation of a light at 13th and Van Buren Streets in accordance with petition for
same. Motion was made, seconded and carried to approve this recommendation.

The Fire and Water Committee, by Chairman Bond, also recommended, and the
Water Board was informed, that the Council would furnish water, if they would
install a temporary system on the lower side of Skinner's Butte Park.
The following Resolution was presented concerning the planting and water-
ing of shrubs in the center parkings of Agate and Villard Streets, and motion
was made and seconded to adopt same. The ayes and nays were called, Councilmen
voting aye, Hendershott, Reid, Zumwalt, Harris, and Carlson. 'Nay~ Lamb, Simon,
and Bond.

RESOLUTION
'.
Since residents along Agate and Villard Streets and
other interested citizens are planning to give to the City
suitable evergreen shrubs for planting the eighteen foot strips
in the center of said streets;
Be it resolved that when such shrubs are provided for
either or both of said streets, the City Council agrees to have
them suitably planted and cared fo.rty the Park Board, and to
provide the necessary water during the summer months to promote
vigorous growth, so that there may be a permanent attractive
ribbon of green in the center of Agate and Villard Streets.

Mr. Keeney, of the Eugene Garden Club, asked the Council to set aside a
week as Clean Up Wee~, and upon motion duly seconded and carried it was ordered
that the last week in May be so designated.
The Health Committee, by Chairman Zumwalt, recommended the condemning of
a barn at 13th and Je~ferson Sts. Upon motion his recommendation was approved.

The Park Committee, by Chairman Carlson, asked the Council to determine
who was to be the responsible party in the control, management and expending of
funds in the City Parks. The City Attorney was asked for his opinion, and he
stated that the Park Board had full co.ntrol. Chairman Carlson stated that from
now on any and all expenditures would have to be subject to the approval of the
Park Board and not himself.

The Police Committee, by Chairman Simon, presented an application from the
Cosmo Cigar Store for a Retail and Package Beer license, and moved that the
same be approved by the Council. Motion was seconded and carried.
The Police Committee, by, Chairman Simon, presented a form of ordinance
on"the pin and ball machines without any recommendation. This opened the dis-
cussion, and Councilman Lamb stated that he was in favor of a smaller distributor'
license, and Councilman Carlson suggested that the m'stributor and the operator
each be licensed ~pl.OO a month per machine, and thus pointed out that the city
would not be creating a monoply, and the city would be giving the small operator
a fair chance. At this point the following individuals addressed the Council on
the subject: Mr. Roberts, Mr. Dalton, Mr. Bucknum, and Mr. Ray Sherwin. The
Mayor ordered this matter returned to the Comirlittee for two weeks, at which time
they are to bring in a recommendation.

Chairman Simon brought up the subject of the unsightly condition between
Garden Ave. and Franklin Blvd. in the way of an auto wrecking house maintaining
a rubbish heap. This was referred to the Health Committee, and they were instruct
ed'to bring in a report concerning this at the next regular meeting of the Council
Chairman Simon further asked for permission to spend $35.00 or $40.00 to
make minor repairs on the city jail in order that the Police Department mig~t
use the same as a temporary detention room. Motion was made, seconded and
carried to allow this expenditure.

Chairman Simon asked that the Police Department be instructed to clear
'Zone I of the City of all night parking, and this was so ordered.

The proposed contract of lease between the City of Eugene and Yale Smith,
President of the Private Flyers Association, concerning the use of the administra-
tion building at the Airport, was read, and held over for further consideration.
Reports for the month of April from the Police Dept., Fire Dept., Eugene
public Library, and Milk Inspector were ordered filed.
The renewal bond in the amount of $500.00 for H. S. Elliott, as garbage
hauler, was ordered accepted and filed.

A letter from the Eugene Ministerial Union opposing the granting of a
Sunday Oircus license was read and ordered filed, /in view of the fact that
special permission had already been granted on May 1, 1935 for the Al G. Barnes
Circus to show on Sunday May 19, 1935, by the following vote: Aye, Hendershott,
Bond, Harris and Carlson. Nay, Lamb, Reid, Simon and Zumwalt. The vote be:tlmg
a tie, the Mayor was called upon to vote, and he voted aye.
A letter was read from the Lane Oounty Fraternal Oommittee inviting all
members of the Council to their Oonvention being held on Wednesday May 15th.
Councilman Lamb and Simon spoke very favorably of this Oonvention.
A letter from Hawkins & Roberts, Inc. in which they asked for a rebate of
interest in the amount of $6.02 on an assessment for Grading and Graveling the
Alley for the East 100 feet of Lot 1, Block 27, Gross Addition, for the reason
that they were not informed of this assessment, was read and upon motion duly
seconded and carried was ordered tabled.
A letter from the University of Oregon, asking for permission to close 13th
Ave. from Kincaid to University Street during the nights of May 29, 30, 31 and
June 1, 2, and 3, for the purpose of an outdoor play to be given by the drama
department, was read and upon motion duly seconded and carried, permission was
granted.
Applications to rebond delinquent assessments were presented, and on motion
duly seconded and carried were accepted as follows:

An application from John N. Freeman to conduct a rooming house at 858 Pearl
Street, okayed by the Ohief of Police, was on motion granted.
An application from Fred Adler for a woodsawing lot at the corner of
Broadway and Taylor Sts., upon adverse report of the Chief of Police, was not
granted.
An Ordinanc~ authorizing and directing the City Recorder of the City ~
Eugene, to re-advertise for bids for the sale of Refunding Assessment Bonds e, and
Refunding Assessment Bonds D, was read the first time and passed it s second and
third readings by title under suspension of the rule by the unanimqus consent of
the Council, and was placed upon its final passage. The ayes and nays were called,
Councilmen voting aye 8, nay none, absent none. The Ordinance was declared passed
and numbered 8421.

The City Attorney brought up the subject of re-advertising for bids carry-
ing the approved opinion of Teal, Winfree, McCulloch, Shuler, and Kelley-,of
Portland, Oregon. Motion was made and seconded to re-adv?rtise in this manner,
and the ayes and nays were called, Councilmen voting aye, Lamb, Hendershott,
Simon, Zumwalt & Harris. Nay, Reid, Bond and Carlson.
An Ordinance permitting the cutting of curbs at 288 East Broadway and 720
Oak Street in excess of the restrictions of Ordinance No. 7753, was read the first
time and passed its second and third readings by title under suspension of the
rule, by the unanimous consent of the Council and was placed upon its final
passage. The ayes and nays were called, Councilmen voting aye 8, nay none, absent
none. The Ordinance was declared passed and numbered 8422.

Councilman Lamb called attention to the fact that the W~ers~Bushong Lumber
Company has High Street in front of their mill covered with sawdust all of the
time, and pointed out that some action should be taken to correct this. The
matter was referred to Councilman Simon.
On motion the Council adjourned to meet on Wednesday, May 29th, at 7:30
o'clock P. M.
