Minutes of the adjourned meetin8 of the Common Council held at the hour of
7:30 o'clock P.M., May 29, 1935. Council was called to order by Mayor Large,
with all Councilmen present except Reid and Zumwalt.
Sealed bids for the sale of $137,000.00 Refunding Assessment Bonds C, and
$55,479.16 Refundin8 Assessment Bonds D, from E. M. Adams and Company, and a joint
bid on the $55,479.16 from Baker, Fordyce Co., Hess, Tripp & Butchart, and Federal
Securities Company, were opened and read, and the Finance Committee retired to
consider said bids. They returned later with a recommendation that the bid of E.
M. Adams and Company be accepted. Motion was made, seconded to accept the
Finance Committee's recoID~endation, and the ayes and nays were called, Councilmen
voting aye 6, nay none, absent Reid and. Zumwalt. The bid referred to being set out
in full as follows:

your city, delivered to us in Portland, Oregon, to be dated July 1, 1935, and to
mature as follows:

delivery to us for each $100 par value of bonds.
For $55,479.16 legally issued General Obligation Refunding Assessment bonds liD"

payable at the office of the City Treasurer, Eugene, Oregon,
WE WILL PAY $100.371 and accrued interest from date of bonds to date of their
delivery to us for each $100.00 par value of bonds.
This bid is made subject to the City of Eugene furnishins us with the approving
opinion by Messrs-. Teal, Winfree, McCulloch, Shuler and Kelly of the legality of
said bonds.

This bid is for immediate acceptance and prompt delivery of said bonds.
We hand you herewitp our certified check in the sum of $3,850.00 as evidence of
our good faith in complying with the terms and conditions of this bid which is to
apply as part payment upon delivery of said bonds to us. Said creck is to be
immediately returned to us if this bid isnot accepted.

At this time Councilman Reid appeared in Council.
The Pol ice Cormni ttee, by Chairman Simon, recommended the approval of the
beer application of Mrs. Ella Brownson, who is taking over a licensed place at
143 E. 11th. Motion was made, seconded and carried to accept this recommendation.

The Police Committee, by Chairman Simon asked for an additional two weeks
on the pin and ball machine ordinance.

Councilman Hendershott reported regarding the investigation of an alley,
known as the Herring Alley, between 5th and 6th Street from Lincoln to Lawrence,
II stating that this alley has never been dedicated to the city and there were not
enough abutting property owners who wanted it dedicated. Upon recommendation the
matter was tabled.

Councilmen Hendershott reported that Mr. Harrison who has been cutting the
gras~ at the aviation field would like to have a three year contract for this
work, with permission to seed the field, and after consideration his request was
denied, but he is to have the privilege of cutting it year by year as formerly.
The Police Cormnittee, by Chairman Simon, reported that office Quinn is on a
ninety day leav~, and moved that Ray Nevers be placed on the payroll as of May
1, 1935, to take Mr. Quinn's place, at the same salary as the other patrolmen,
and that a warrant be drawn for him at the regular time that others are drawn.
Motion was seconded and the ayes and nays were called, Councilmen votins aye 7,
nay none, absent Zumwalt.

Reports from the Police Matron for the months of March and April, and the
Eugene Public Library's report for May, were ordered filed.
A petition from the Richfield Oil Company for permission to erect a petroleum
products distributing plant on First street was read, and Mr. H. O. Hicholls,
representing the Company, was present and set forth the conditions. On motion
duly seconded and carried their p.etition was granted by the Council.
A communication from Frederi,ck D. StricI~er, State Health Officer, in which
he stated that upon inspection o~ the city jail he found that it did not comply
with specifications laid down by the state laws, was ordered filed.
A communication from John W. Connaway concerning a refund of $6.77 on the
reassessment of properties abutting upon the alley between Onyx and Emerald from
20th to 21st, was presented and was referred to the Judiciary Committee for
investigation.

A communication from Roy C. Andrews and Dean Onthank, concerning brush piles
and rubbish which has been dumped on the south side of Riverwood Ave. ~n Kincaid
Park, was read and referred to the Chief of Police.
A letter from Mr. DeCou, Chairman of the Park Improvement Committee, th~nking
the Council for their cooperation. in the improving of the City Parks, was read
and ordered filed.
An Ordinance declaring and defining as nuisances the maintenance in open
years of dismembered parts of automobiles and machinery, waste material and
rubbish; providing a penalty and declaring an emergency was read the first time
and passed its second and third readings by title under suspension of the rule by
the unanimous consent of the Council and was placed upon its final passage. The
ayes and nays were called, Councilmen voting aye 7, nay none, absent Zumwalt.
The Ordinance was declared passed and numbered 8424.

An Ordinance to license, tax and regulate certain games and mechanical
devices used therein; and declaring an emergency was read the first time, and
Councilmen Simon and Bond opposed certain sections of this ordinance, namely, that
of not having an annual license for the distributor of the machine. Various
licenses were suggested, ranging from $15.00 to $100.00 per year." Councilman
Carlson opposed this very strongly, pointing out the fact that $2.00 per month
that this ordinance provides was all the traffic could bear, and that an increase
in the fee would automatically bring about a decrease in the machines operated and
thereby decrease the city's revenue. Councilman Simon moved that this ordinance
be amended as follows; An annual distributor's license fee of $10.00 for a maximum
of 10 machines, and $1.00 for each machine above the 10, payable in advance. The ~,,~
motion was seconded and the ayes and nays were called, Councilmen voting aye 6,
nay Carlson, absent Zumwalt. The Ordinance then passed its second and third
readings by title under suspension of the rule by the unanimous consent of the
Council and was placed upon its final passage. The ayes and nays were called,
Councilmen voting aye 6, nay Carlson, absent Zumwalt. Although Councilman Carlson
was opposed to the annual license fee feature he realized that his vote would hold
this subject up for anothev two weeks for passage, and he, therefore, asked for
reconsideration of the vote and moved that the ordinance be given its second and
third readings again. His motion was seoonded and carried, and the Ordinance was
read again the second and third time by title under suspension of the rule by the
unanimous consent of the Council, and was placed upon its final passage. The ayes
and nays were called, Councilmen voting aye 7, nay none, absent Zumwalt. The
Ordinance as 'amenaed was declared passed and numbered 8425.

A claim from Mayr Ellen Morgan in the amount of $7.81 covering expense incurred
in an accident by reason of a fall on the sidewalk, was presented and referred to
the Finance Committee.

Mayor Large brought up the subject of foreclosure proceedings on delinquent
liens, and Councilman Hendershott asked that all this be held up for 30 or 60 days
until the lien docket check is completed. Upon motion this was postponed for 30
days.

An Ordinance authorizing and directing the issuance and sale of Refunding
Bonds.to be designated "REFUNDING ASSESSMENT BONDS Ell,' for the purpose of redeeming
paying and retiring certain bonds issued pursuant to applications to pay assess-
ments in installments, which bonds are redeemable at the option of the City of
Eugene, and are designated Series A-J, bearing interest at 5 3/4 per cent, in the
principal sum of $30,681.53 and maturing August 1, 1942; and directing that said
bonds be called for redemption, and declaring an emergency, was read the first
time and passed its second and third readings by title under suspension of the rule
by the unanimous consent of the Council and was placed upon its final passage.
The ayes and nays were called, Councilmen voting aye 7, nay none, absent Zumwalt,
Th~ Ordinance was declared passed and numbered 8426.
The application of Emmett E. Parks for a ,Furnished Apartment House permit at
7th and VHllamette Street was pr esented and on motion granted.
The application of Mrs. M. Huffman for a Roomfung House permit at 571 Willame-
tte Street was on motion granted.
The Recorder was instructed to get a statement from the County Treasurer
concerning the interest received on delinquent taxes since 1931, in order to make
a check and see if the City has received its share.
