M. June 24, 1935. Council was called to order by Mayor Large, with all Councilmen presen~ except Reid. i Sealed bids for the sale of $30,500.00 Refunding Assessment Bonds E, from Camp & Co., Inc. , Hess, Tripp & Butchart, E. M. Adams and Company, and Ferris & Hardgrove, were opened and read and the Finance Committee retired to consider said bids. They returned later with the recommendation that the bid of Camp & Col, Inc. be accepted. Motion was made and seconded to accept the Finance Committee's recommendation, and the ayes and nays were called. Councilmen voting aye 7 , nay none, absent Reid. Dear Sir: For $30,500 legally issued general obligation Refunding Assessment Bo~ds "E" of the City of Eugene, Oregon, to be dated August 1, 1935, and maturing 4p6,000 on August 1 in eaBh of the years 1936 to 1939, inclusive, and $6,500 on August 1, 1940, in denominations of ~pl,OOO each or multiples thereof, bearing interest at the rate of 3%per annUm, both principal and semi-annual interest payable at the office of the City Treasurer at Eugene, Oregon, we will pay you at the rate of $100.27 for each $100 in bonds and, in addition thereto, accrued interest to date of delivery of said bonds to us. We attach hereOto our certified check for $610, same to be held by you and applied as part payment on the bonds if awarded to us; otherwise, to be returned upon I demand. It is agreed and understood that, before taking up and paying for any of said bonds, you are to furnish us with the final approving opinion of Messrs. Teal, Winfree, McCulloch, Shuler & Kelley certifying as to the legality of the above described bonds; and, if for any reason the same is not forthcoming, the attached check is to be returned to us immediately. An Ordinance accepting the bid of Camp & Co., Inc., for the purchase of Refunding Assessment Bonds "En , of the City of Eugene, in the sum of $30,500..00, and fixing the rate of interest on said bonds, was read the first time and'passed I its second and third readings by title under suspension of the rule, by the unanimous consent of the Council, and was placed upon its final passage. The ayes and nays were called, Councilmen voting aye 8, nay none,absent none. The Ordinance was declared passed and numbered 8428. Mr.. C. F. Hyde, in behalf of the American Legion, presented a proposal to the Council as follows: That about 20 handicapped men listed on the S.E.R.A. rolls, whose services could be procured by merely paying the insurance wht~h would amount to about *12.00 or ~f15.00 per month, could be used as traffic checkers. Checking speeders, cars going through stop streets, etc. They would have no authority to make atrests, but they would report to the Chief of Police, and after . a certain number of offenses the matter could then be brouaht to the attention of ..... Mr. Hy.de felt this would be a very beneficial move toward making the city safe for children, pedest- rians, and other. car drivers. The Mayor pointed out the fact that the S.E.R.A. I Committee did not think so much of the idea. The Mayor asked the Chief of Police what his re-action was, and he reported the he could not see too much value in W such a program, but felt that he had not had the opportunity to give it much .~ consideration. The Mayor then called on Councilman Simon who reported that his ~t., Committee had been working on diffenent forms of programs in the hopes of organ- ~n.~,' izing a voluntary citizens traffic checking body who would operate by number only. They would call the police station, give their number, the license number of the car operated, and the violation. The police would notify the individual of the offense, and on the second offense be would be brought into court. Mr. Hyde pointed out that if they adopted theli.merican Legion's program it would undoubted- ly take approximately 20 men off the relief rolls, and it would be very nice for the city to do that. Councilman Simon said that he did not see where he could spare the $12.00 0~$15.00 per month frpm his budget to take care of it. It was pointed out by Mr. Hyde that this would be a very well expended amount of money, inasmuch as it would go directly to the citIzens of Eugene who need it. Council- man Harris moved that this be referred to the Police Committee with power to act. - Motion was seconded and carried. Mr. Svarverud addressed the Council in behalf of Mr.,A. N. Kemery relative to a petition to the Board of Appeals regarding the construction of a lean-to shed at the rear of his factory at 1802 East 13th Avenue. The report of the Board of Appeals was to deny this request. It vms pointed out by Mr. Kemery that this foundation for his forge base had been constructed prior to the time that this ordinance went into effect, and pointed out that all the neighbors there had no objection to it, and as a matter of fact they wanted it there, as the building would look better with it. The Mayor asked Mr. Clubb to report on the Board of Appeals' action, and he pointed out that the Board took their attitude because of I the terms of the Zoning Ordinance. ~ Mr ~ Carlson spoke on behalf of granting him this privilege. Councilman Lamb said he could not find any fault with the Board of Appeals, but at the same time he thought the Council should give this consider- ation. Councilman Hendershott moved that the report of the Board of Appeals be rejected and the reouest be granted. Motion was seconded and carried. I Mr. Stocker of Castelloe and Stocker Electric Company presented a plea for 'the privilege to construct and install a marquise at the old Colonial Theatre, now named the Mayflower. An Ordinance permitting the Mayflower Theatre, at 784 Eleventh Avenue East, to construct a marquise larger than that allowed by the building code, was read the first time and passed its second and third readings by title under suspension of the rule by the unanimous consent of the Council, and was placed upon its final passage. The ayes and nays were called, Councilmen voting aye 8, nay none, absent none. The Ordinance was declared passed and number ed 8429. Mr. Stocker also presented a request for permission to hang a small sign underneath the Eugene Hotel electric sign which now hangs across the intersection of Broadway and Pearl streets. Councilman Harris moved that this be referred to the Building Inspector with power to act. Motion was seconded and carried. f,1r. r.'. D. Bennett presented a petition asking that their particular district, North and ;':est of Grand street, be changed under the Zoning Ordinance from an Industrial District to a Residence District. He stated that there wasn't a single business house there, it was all residences, but there is now being constructed . a lumber yard, and 11 of the property owners had Signed the petition. This was referred to the Board of Appeals and the Engineer's Office was instructed not to issue a permit for the construction of the lumber yard until further notice. The Judiciary Committee, by Attorney Calkins, reported that any time that the people of Eugene wished to prevent dogs from running at large, all they had to 1../ do was get 20 signatures on a petition, and the matter would be referred to the people to vote on at the next election. Councilman Harris asked for further time regarding the change of the collection of dog licenses. The Finance Committee, by Chairman Hendershott, moved that the claim of Mary Morgan, :In Dr. Han"\j.s'.Office, for an injury received by falling.on the sidewalk, in the amount of $8.85 be allowed. Motion was seconded and the ayes and nays were called, Councilmen voting aye 8, nay none, ~bsent none. This bill covers $5.00 for x.:..ray and ~~3. 85 for medic ines and dress ings. I The Fire and Water Committee, by Chairman Bond, asked permission of the Council to permit the Drive-In-Market on ~illamette to install a large flood li~ht for use at night. On motion duly seconded and carried this request was granted. Chairman Bond also asked for permission to have the Fire Department chairs repaired. On motion duly seconded and carried this request was granted. Chairman Bond ~anted to kno~ what had b~en done concerning the claim of Mrs. Cook for a broken arm caused by a fall on the s. idevmlk, in vvhich there was an expense of about $59.00. Attorney Calkins stated that the Committee felt that . there was no liability in this case. No action was :~,~ taken in the matter. I .,' u ~ The Health Committee, by Chairman Zumwalt, reported that at 1753 Columbia .."I~ Street in the alley and partly on private ground there was a fairly good sized hole where garbage and trash had been dumped. He asked that the Street Department haul some di rte and fill this in. 1 Councilman Zumwalt brought up the matter of the Street Department cutting parking strips on Fairmount Blvd. No action was taken by the Council at this time. ! Councilman Zumwalt asked for the condemnation of the following buildings: I The one on Lot 6, Block 6, Gross Addition, the East one-half of the old Prazer foundry, and the Seaver furniture hospital. Motion was made, seconded and carried to start condemnation proceedings against these buildings. The Police Committee, by Chairman Simon, recommended the approval of a beer ~ I application for Edward C. Adams, 49 E. Broadway, who is taking over an already 41 I ~icensed place. Motion was made, seconded and carried to accept this recommendat- ion. ' /11 Chairman Sin,on reported that there was an individual who wanted to establish I a brake testing machine, and suggested that an ordinance could be passed requir- I ing the citizens to have their brakes tested twice a year. This matter was referred to the City Attorney and Judiciary Committee to make report. The proposed contract of lease between the Private Flyer's Association, by 'I Yale E. Smith, and the City of Eugene, was ae;ain brought to the attention of the I, Council and was held for further consideration. The Council granted them permiss- ion to use the building until action-was determined. 'f ~hree reports of the Board of Appeais were presented and approved as follows: I' The request of Foster-Kleiser for permit to erect an additional poster-panel 12t x ~251 on Lot 2, Block 2, Henderson Addition facing Franklin Blvd. and North of 11th jl Ave. Eas.t in Zone R-2, be granted. I\.. request of W. L. Kincaid that a number of II properties owned by him in Eugene be reclassified as Business Properties, be denied The request of Homer A. Soults for an additional lumber shed at 1845 Franklin Blvd. be granted. ; \ A petition from C. B. McGirr of Portland, for the erection of a super service I station at 8th and Willamette was presented and held for further consideration. A letter from Bayard T. Merrill, 1522 Orchard Street, for permission to have full charge of the vacant lot next to his property, and which belongs to the city, was read and referred to the Ci ty Attorney to draw up a lease. " ~. An Ordinance authorizing the sale of Refunding Irrprovement Bonds F was presented, and discussion opened by City Attorney Calkins, pointing out that this would cover 15 years rather than 11 as the previous issues. The Mayor felt that the life of the bonds should be made 10 years, and not to exceed the program follow~d on the others. Councilman Carlson pointed out that the City was doing so much rebonding over a short period of time that the total yearly requirement would increase the tax levy quite a bit. The Recorder pointed out that each and every series that were refunded would have to have a separate sinking fund therefor and the Budget Committee each year would include in the tax levy a suf':ficient amount to cover principal and interest on each of the sinking funds to make up the difference because of uncollected liens. Mr. Ha~n of E. M. Adams and Company i addressed the Council and pointed out the fact that the shorter the life of the I bonds the ~etter.the rate of,int~res~. I II The Recorder reported that the Bee Line Company had been paying the City a rl proportion of the towing charges collected on call~ received from the Police \, Department. . Ii The 1934 Annual report of the Eugene rater Board was presented and filed. An Ordinance granting to the Oregon Electric Railway Company, a corporation, its successors and assi~ns, the franchise or right to lay, construct and maintain railway tracks, and to operate trains and cars thereover, and to transport passengers, freisht, mail, baggage and express thereon, and to erect, construct, maintain and operate power, telephone and telegraph lines in the City of Eugene, Oregon, w~s read the first time and referred to the Judiciary Committee. /.~' A communication, from the City Treasurer regarding the transfer of securities held to guarantee funds on deposit, from the Safety Deposit Vault in the United States National Bank in Eugene to the custody of the First national Bank in Portland, Oregon, was read and referred to the City Attorney in order to determine the proper legal action. The anplication of S. S. Simons for rebonding delinquent assessments in the J" amount of ~p195.35 ~as presented and on motion accepted. The following sealed bids for the purchase of a new car for the Police Department were opened and read: I Brown Motor Co. $438.00 Scherer Motor Co. $590.00 Ford 430.00 Lane Auto Co. 738.00- 773.00. Chevrolet 350.00 Shultz Co. 600.00 On motion of Councilman Simon this matter was referred to Cbu~cilman Bond with power to act. I A letter from the State Relief Committee giving a report of the man hours supervised by their bureau for the week ending June 24th was read and filed. A letter from the Board of Health was read and refer~ed to the Health Committee. A letter from the Bureau of Labor concerning electrical contractors etc. was read and referred to the Water Board.
