Council Chambers, Eugene, Oregon I July 8, 1935. : "". oj ...;J !-- ...,.,.. Minutes of the regular meeting of the Common Council held at the hour of 7~30 o'clock P. M., July 8, 1935. Council was called to order by Mayor Large, with all Councilmen present except Mr. Reid. Minutes o~ the regular meeting of June lOth, the adjourned meeting of June 24th, and the special meeting of June 28th, 1935, were read and approved. Mr. Chester Johnson of 7101 North Lombard Street, Portland, Oregon addressed the Council, asking for a special permit to peddle caramel korn from house to house. He pointed out that the fee of $18.00 per month as provided for in the ordinance would be too much for him to pay, inasmuch as he is only going to work on the part time basis and attend the University. He stated that he would be willing to pay a license on the percentage basis. This was referred to the >j), Judiciary Committee to report back. , , Darle:'Seymour addressed the Council asking for permission to hang a sign across the street. He pointed out that some months ago he asked the Council for such permission and it was denied, due to the fact that there was an ordinance prohibiting such, but since that time the Councll had allowed the Heilig Theatre to construct a neon marquise to the edge of the'sidewalk, the Mayflower Theatre ! permission to construct one, and the Eugene Hotel Coffee Shop to hang a sign under- neath the Hotel sign which extende across the street. Mr. Seymour stated that it was his belief that if such a privilege is to be granted to one it shou+d be granted to all, and if refused one it should be refused all. The Judiciary Committee, by Chairman Harris, moved that the City Attorney and ....- I i City Recorder prepare a petition to the County Court asking for permission to establish a l3ity of Eugene Dog Control Officer,' \/vhich would take effect as of January 1, 1936, and it was so ordered. I The Judiciary COIDrrlittee, by Chairman Harris, recorr~ended that the Oregon Electric Franchise Ordinance be re-written. This recommendation was accepted, and the ordinance was held over for further consideration. . The Finance Commi ttee, by Chairman Hendershott, reported the following bi,lls to the Council with a recommendation that they be allowed, and motion was made and seconded that warrants be drawn for same. Councilmen Bond and Lamb reported that the car and truck for the Police and Street Department respectively had been purchased, and asked that the bills for the same be included in the bills allowe~. The Recorder stated that the wood was ordered on the request of Chairman I Lamb of the Street Conwittee, and Mr. Lamb stated that it was very necessary to II have dry wood for the paving plant, and that is why that wood was purchased. I The Street Committee, by Chairman Lamb, reported that they had purchased a , I I Ford V8 Truck for the Street Department, as per the lowest bid. The Health Committee, by Chairman Zum~alt, moved the condemnation of the old buildin~s on the property at 309 Madison Street. This motion was seconded and carried. . At this time Councilman Reid appeared in Council. Councilman Zumwalt then presented a proposition for the establishment of a playground and park between Moss and Villard, and Garden and Franklin. He pointed out that he had pledges of $181..00 from the surrounding neighbors for the purchase of that land, and that the taxes and a~sessments on the property made a total of ~~53l..37, exclusive of del inquent intere st. 'l'his amount could be I subtracted from the amount that Mr. Soults was asking for the property, thus the I price to the city would be very reasonable. This matter was referred to the Park I Board for their consideration. Councilman Zumwalt then reported that in r~gard to making the Milk Inspector a full time employee as recommended by the Health Board, he had not had an I opportunity to meet with the Health Board or his COIT@itteeto discuss it with them, but he understood that Dr. Helterline was not ih favor of a full time job, that I he'might be employed part time by the city of Springfield as well as Eugene, At this time Dr. Hesse, representing the Health Board, addressed the Council, point- ing out the necessity of a full time inspector. This position is not only to be 0 a milk Inspector but also a Health Inspector. It had been demonstrated that it was impossible to maintain the standard that should be maintained for the City of Eugene by a part time employee. The Health Board was at the present time working on a plan for raising the difference necessary to employ Dr. Helterline on a full time basis. He pointed out that the proposed salary v!ould be $3,000.00 per year. On motion this request was granted. W Ct."") The Police COlI'.Jllittee, by Chairman Simon, moved that the application of Elmer :....-- Roberts for a wine license be rejected. Motion was seconded and carried. He also moved that the application of R. F Johnson for a retail beer license at 842 11.: . Park Street, which is a transfer, be granted. Motion was seconded and carried. The Recorder reported that the total interest turnover on delinquent taxes to the City of Eugene since 1931, and including 1935 to date was $10,176.21. The report from the State Fire Marshal on inspection of the city jail was read and filed. .A letter from F. Wentworth, Treasurer, askinG the Council to authorize the call of Series A. D. Improve~ent Bonds, was read and on motion duly seconded and carried this authorization was made. .-e A letter from t. 1..; Knickerbocker, on the subject of dog control in Lane u. Coun ty , was read and ordered filed. A communication from the Public Library and others asking that the property east of the library be kept clean, was read and the Recorder instructed to contact Mr. L. ~L '{j'a tson, owner of the property, and see if this could be taken care of. Reports for the month of June from the Eugene Public Library, Police Depart- ment, Fire Department, Engineer, and the May and June report from the Police Matron were read and ordered filed. A report from the Board of Appeals, concerning the petition of W. D. Bennett and others, asking for a reclassification of their district, was read, in VJhich they recommended that this petition be referred to the Planning Commission with a recommendation that the Industrial Zone be changed. On motion it was so ordered. I A report from the Board of Appeals, concerning the petition of T. J. Teng to increase the size of his store building at 1704 Moss Street by extending it to the Street property line, was read with their recommendation that such request be . J.. , 11 t this time Mrs. Teng addressed the Council stating that they had been reJecl.>eo. taxpayers for several years and they had kept their property in good condition, and it was very necessary that they be ~ lowed to enlarge their building. It was pointed out that the neighbors had no objection to this change. Couneilmen Reid and Simon thought this should be granted. It was moved that the report of the Board of Appeals be rejected and the petition be granted. Motion was seconded fu~d carried. A petition from the Alpha Corpo~ation of Tacoma, Washington, concerning the payment of damae;es in the amount of $100.00 on alleged errors made in the Treasurer's Office, v'!as presented and referred to the Judiciary Commi ttee to report back at the next Couneil meeting. The oetition 6f C. H. McGir~ for a permit to install a service station at 8th " and Willamette Street was again brought up, and a letter from the Oregon Insurance Rating Bureau was ~ead in which they stated there would be no increase in rates. .~ A letter from the Commissioner of Finance of Portland was read, introducing Mr. McGirr. Crruncilman Carlson then introdueed Mr. McGirr to the Council, who address- ed them on granting him a ~rmit to ereet such a station. Couneilman Hendershott pointed out that aLl of the surrounding business men were very much opposed to such a permit, and he also pointed out that there was another party interested in ereeting a restaurant building on that corner. Mr. Clarenee Wilcox told the Council that he had second option on the property, and if Mr. McGirr was not granted a permit for the service station he ~ould ~robably lease it. After considerable discussion back and forth, Mr. Lamb moved that the McGirr petition be denied. Mr. Zumwalt seconded the motion, and after further di~cussion Council- Lamb withdrew his motion. CounCilman Harris moved that this be held up until the next Council meeting for further consideration. Motion was seconded and carried. An Ordinance authorizing and directing the issuance and sale of Refunding Bonds to be designated "REFUNDING DiIPROVE11ENT BONDS F", for the purpose of redeem- I ing, paying and retiring certain bonds issued pursuant to applications to pay assessments in installments, ~hich bonds are redeemable at the option of the City of Eugene, and are designated Series A. D., bearing interest at 5i per eent, in the principal sum of $194,186.03, and maturing February 15, 1937; and directing that said bonds be called for redemption, and declaring an emergency, was read the first time and passe~ its second and third readings by title under suspension of the rule by the unanimous consent of the Council, and was placed upon its final passage. The ayes and nays were called, Councilmen voting aye 8, nay none, absen.t none. The Ordinance was declared passed and numbered 8430. Councilman Hendershott pointed out that the Smeed Hotel operator had reported . to him that he could not get cooperation in keeping the street clear in front of his hotel v'Ihere it was set off with the yellow strip. Attorney Calkins pointed out that this ~as just a eourtesy and there was no way of enforcing it. . Mayor Large reported on a system of an automatic fire alarm for the City of Eugene, and referred the same to the Fire and Water Committee for investigation.
