Minutes of the adjourned meeting of the Common Council held at the hour of . 7:30 olclock P. IvI., July 22, 1935. Council was called to order by Mayor Large with all Councilmen present except Hendershott and Reid. Mr. Cully, Secretary of the Eugene Chamber of Commerce, addressed the Council on the subject that the Council authorize by Resolution that the City Planning Commission be permitted to continue with their program on tpe relocation of the Southern Pacific Railroad tracks, moving them down close to the river, whi ch of course, would automatically eliminate all grade crossings, and which would necessi- tate a flood control project at the same time. Mr. Cully read the Resolution as suggested and pointed out further that there is absolutely no financial commitment by the adoption of the Resol~tion. . At this time Councilman Reid appeared in Council. . . - - Mr. Prescott addressed the Council, pointing out that the City of Eugene had everything to gain and nothing to lose by this program, and there would be in the neighborhood of one-half million dollars spent if this program was carried out. Councilman Zumwalt thought this would be a good thing. Councilman Reid questioned the feasibility of it. Councilman Bond thought this should be done inasmuch as we are not committing ourselves. Councilman Carlson could see absolutely no reason why such a Resolution should not be passed, and he therefore, moved the adoption of it. The motion was seconded by Councilman Lamb, and carried. RESOLUTION . RESOLVED, THsT THE Planning Commission of the City of Eu~ene be and it is hereby authorized to I submit a petition and brief to the State Highway Commission, and/or other interested governmental agencies making representations as to the necessity \ - of eliminating the major grade erossings across the Southern Pacific Railroad. tracks at the intersection of said tracks at High Street, Eighth Avenue East, East Broadway, Eleventh Avenue East and Thirteenth Avenue East, and the minor north and South crossings at Alder, Emerald, Agate, Columbia, Villard, Orchard and Walnut Streets, in the City of Eugene. ..' Said crossings are highly dangerous and in- convenient and the Planning Commission is urged to make every effort to secure the elimination of these crossings. -O- At this time Councilman Hendershott appeared in Council. Stanley St~venson, President of the Eugene Chamber of Commerce, addressed the Council upon the situation existing on the Skinner Butte Memorial Park. He stated that there seemed to be very little cooperation, and absolutely no head to see that I the butte ~as watered and the plants saved. He hoped that the Council would do something right now about it. c. v. Simon addressed the Council in behalf of the Leeion and other Veterans. He said that they felt that someone had laid down on the job and they wanted some responsibility placed and some action taken now. Dr. Faust, Commander of' the Spanish War Veterans, addressed the Council pointing out that they had started a very enViable program and it was one that should not be ne81ected. The Mayor asked Councilman Bond, Chairman of the Fire and Water Committee, if he had a report to make on it, and he stated that he 'had none. Councilman Carlson felt that there must be some way of getting at this question and answering it to the satisfaction of all parties concerned. He felt that the Committee that had been handling it should go ahead with it. Councilman Lamb expressed his regret that the Butte was in the shape that it is in. Mr. Con Dillon felt there should be a special committee appointed to look ~i after this, due to the fact that it was a real project and not just an ordinary Council Committee subject. Councilman Reid susgested that this be referred to the Park Board. Councilman Carlson was appointed by the Mayor to serve on a committee which would consist of representatives from the various civic organiza- 11 tions. Councilman Carlson accepted and said he would be very glad to do what he Ii could. Lir. Judd Stauffer addressed the Council and thanked the Mayor for appoint- ing Mr. Carlson for this job, and stated that it was recognized that if they wanted anything done and Mr. Carlson could be appointed to handle it that it would be ) done. I I Councilman Carlson ~"]as at this time excused to go with the Committee to talk , to the ~ater Board on the Butte situation. Mr. Graham Smith presented plans to the Council for the proposed erection of ;. a building at 8th and ~illamette Street for Clarence filcox, and expressed his I regret that he had to leave before the discussion of the subject in the Council, I but left the plans for approval. II Councilman Bonc;l, Chairman of the Fire and ~ater Committee, asked for more II time on the proposed fire alarm system. Ii Councilman Bond reported that his Committee had looked into the request of ,I :j 1Ir. Seymour for a permit to erect a sign out over the street, and wanted this 'I I: referred to the Board of Appeals. Mr. Hendershott pointed out that Mr. Bond and :1 himself had decided that 3.S far as the COIDITittee was concerned the sign should II stay right where it is, but wanted to refer it to the board for final decision. I. li:ot ion was made, seconded and carried to refer it to the Board. !I Councilman Carlson returned from- the Commi ttee meeting and he addressed the II Ii Council, and expressed his regret that the gentleman had spoken to the Council the '.'my he had. It was the first time he had ever met hirn~ and he wanted it 'I understood that as far as he was concerned he had full confidence in his brother I I, ,I Councilmen, and that all did the work assigned them. Il i! Mr. Warnock addressed the Council and stated that he was not representing II any organization, but he ~anted the Council to kno~ that Mr. Stauffer's remapks II were uncalled for, and that he would see that the subject was reported to the I) Commanderls Council. II Councilman Bond reported that he had received a petition for a street liGht at the corner of 2nd a~d Jackson Streets, and asked for more time to look into it. )1 [I The Health Committee, by Chairman Zumwalt, moved to condemn the building at 245 Madison Street. Motion WijS seconded and carried. I Counc i lman ZU..Ill1!.fal t then asked for condemns. t ion of the old Mercy Hospital, and the Eayor presented a communication he had received from the Mt. St. J'o seph IS Home fQr the Aged, asking for permission to tear the hospital down. After con- siderable discussion, Councilman Zumwalt moved that it be condemned. There was no second to the motion and the subject was therefore continued. '. I The Recorder reported that he had received several complaints from the excess- ive use of East 3roadway in front and neighboring the Hoffman Hotel as bus terminals. I I , COIT@unication was read from the Board of Appeals in which they recommended II the grantinr. of a wood yard permi t on West 13th Avenue bet\"Jeen Jefferson Street II and the Fair Grounds. On motion the report was accepted by the Council. I 11 Communication from the Eugene Water Board ~as presented to the Council in I which they have reduced the rate of Ii per kilowatt hour to 3/4~ for electric heat in the City Hall. This reduction effective as of January, 1935. Councilman I i Hendershott moved that this reduced bill for the six months heat in the amount of $679.20, be^allowed. Councilman Lamb seconded the motion and the ayes and nays were called, Councilmen voting aye 8, nay none, absent none. I I A communication from the Eugene Transient Bureau, showing the amount of men , I furnished the City Park Board for the Workls Project, was read and ordered filed. I .. Another proposed ordinance of franchise to the Oregon Electric Railway Co. , was read the first time and referred to the Judiciary COl1lI!:ittee and City Attorney. I It was pointed out that the City should get a minimum annual fee, ask that there be no double tracks on ~est 5th, and that the hours of operation in the city limits be limited. I The ReGorder reported that no action had been taken by the Planning COIlli."TIission concerning the changing of the Zone on Grand Ave. from an Industrial Zone to a ~ Residence Zone. '00 ....--.. ':;'1'1 The Recorder presented the McGirr petition for erection of a service station ...... on 8th and Willamette Streets, which had been held for further consideration, and reported that in conversation with Mr. Vinson, of the Portland Trust and Savings Company, that as far as they were concerned they were only dealing with Mr. McGirr and they would not deal with any other person until McGirr's petition was acted upon. After considerable discussion and after having questioned Mr. Wilcox upon his ability to erect a building on this corner, Councilman Hendershott moved that the McGirr petition be denied. The motion was seconded by Mr. Lamb, and the ayes and nays called. Councilmen voting aye 6, nay Marris and Carlson, absent none. The Recorder wanted the Council to go on record authorizing the change of the payment for the U. S. Labor Bureau from F. L. Armitage to the National Re-employmen+ .~ I Service. On motion, seconded and carried this authorization was made. I It was reported that the Juvenile Gfficer had been appointed by Lane County, I and upon motion, seconded and carried it was determined that the City's allowance to this office should be paid to Lane County each month. The Recorder asked that the Council go on record as authorizing the calling of ~?2l,000.00 of the $175,000.00 Park and Terminal Bonds. Upon motion, seco.nded and carried this authorization was made, and the following numbers were drawn by lot by the Re~order: 7 , 12, 18, 22, 23, 31, 32, 34, 35, 56, 58, 62, 73, 103, 106, 115, 126, 133, 147, 156, 160. Standard form of Government Lease between the United States of America and the City of EU3ene for the office occupied by the Internal Revenue Collectors, was presented, and motion made and seconded to authorize the Mayor and Recorder to sign the same. The ayes and nays were called, Councilmen voting aye 8, nay none, absent none. -I An Ordinance amending Section 1 of Ordinance No. 8428, entitled.: "An OrdinancE accepting ~he bid of Camp & Co., Inc., for the purchase of Refunding Assessment Bonds fiE", of the City of Eugene, in the sum of ~30,500.00, and fixing the rate of interest on said bonds. " passed by the Common Council of the City of Eugene, June , 24, 1935, and approved by the Mayor the 27th day of June, 1935, and declaring an emergency was read the first time and passed its second and third readings by title under suspension of the rule by the unanimous consent of the Council and was placed upon its final passage. The ayes and nays were call~d, Councilmen voting aye 8, nay none, absent none. The Ordinance was declared passed and numbered 8431. Mayor Large presented the Airport program, pointing out that there were between $200 and ~300 needed to complete the lighting at the boundary of the field. Dr. Harris objected very strenuously to this, stating that the City was not getting anything out of. what was put into it. It was finally moved and ~econded that this be granted, and the money be paid out of the Aviation Fund. The ayes and nays were called, Councilmen voting aye 8, nay none, absent none.
