M., August 12, 1935. Council was called to order by Mayor Large, with all Councilmen present except Hendershott, Reid and Zumwalt. Minutes of the regular meeting of July 8th, the adjourned meeting of July 22nd, and the adjourned meeting of August 5th, were read and approved. Mrs. Delmer Dietzman of the Blue Line Cab Company, upon whom the City Attorne had served notice of hearing on August 9, 1935, concerning the cancellation of their taxicab license, was called upon at this,time to present her case to the Council. At the request of City Attorney Calkins this matter was referred to the Police Committee to enable a more complete and adequate hearing at a future date. .' At this time Councilman Hendershott appeared in Council. The application of Mr. Jos. Schuss for a Package Store Class B. Wine LicBnse was,presented, and Mr. Schuss addressed the Council stating that he would operate a high grade store and would carry a large selection of 8tock~ Upon motion of Chairman Simon and seconded by Councilman Bond the application was not approved. Mr. Dar1e~'Seymour pointed out that he bad made application to the Council four weeks ago for permission to hang his sign across the street, and he was wondering what the answer to his application was. City Engineer Clubb'pointed out,that this had been referred to the Sign Board of Appeals, but that he had been unable to get the Committee together. Councilman Carlson'urged that ,matters of this nature shou~d be given immediate consideration. Mr. H. Parsons, a Realtor, addressed the Council concerning the problem of I putting in a sew~r at the extreme end of West Sixth Ave. Mr. Clubb pointed out that the present sewer is too close to the ground to extend it to the end of Sixth, and it would be necessary to construct a new line. I Mr. Svarverud addressed the Council on the proposition of cleaning the Amazon, and stated that he was soing to appear before'the County Court to get them to take care of their share of it. Mr. Clubb pointed out in this case that it would be necessary for the County to lengthen and deepen the ditch. Councilman Lamb point- ed out that the City had always cleaned it every year. -- , At this time Councilman Reid Eq:> peared in Council. Mr. N. O. Neilson addressed the Council in behalf of a request he 'had presented to the Zoning Board of Appeals regarding the erection of a chicken house at 1009 1st Avenue West. The Boardts recommendation was read at this time to deny the request and Councilman Lamb moved that the report be adopted.' The motion was seconded by Councilman Hendershott and the motion carried. Mr. Neilson was requested to bring in a petition from the mrrounding neighbors, and the ,Council would be glad to reconsider his request. The Judiciary Committee, by Chairman Harris, reported on the application of .' the Alpha Corporation for damages in the amount of $100.00 for alleged errors made in the Treasurer's Office on the following described property: "Beginning at a point in the north line of Ninth Avenue West one hundred ten (llO)'feet east of the intersection of said north line with the east line of Almaden Street, from which point run north clOe hundred fifty (150) feet, thence east 50.57 feet, thence south one hundred fifty (150) feet and thence wes,t 50.57 feet to the place of beginning, in Eugene, Lane County, Oregon.o, and recommended that this claim be denied. Motion was made, seconded and carried to adopt the recommendati6n~' - ~ -" ,r.. ..... Chairman Harris, of the Judiciary Committee, asked for further time on the proposed ordinance for Franchise with the Oregon Electric Company. This request was granted. ~ ..- .-' '. Chairman Hendershott, of the Finance Committee, reported the following bills to the Council with a recommendation that they be allowed, and motion was made I and seconded that warrants be drawn for same. Bond ' 9.73 Ed Jensen 28.29 Chairman Lamb, of the Street Committee, reported on the fire at the city barns, and asked if it would be possible to get a project in immediately to the Government for rebuilding. This matter was referred to the Street Committee. City Engineer, and Building Inspect0D, with instructions to proceed immediately with completion of plans for the project. Proposed plans were presented and members of the Council looked them over. I The Recorder was instructed to have Dr. Helterline, Milk Inspector, make a . complete check on all livestock in the city to determine whether or not they had all paid their licenses. . I The Fire and Water Committee, by Chairman Bond, recommended that the request II for a street light at the corner of 2nd and Jackson Streets be denied. Motion was I' made, seconded and carried to accept the report. Simon , of Branstetter-Simon Chapel, for an installation of a flood light to shine directly I on his place of business. On motion, seconded and carried this request'wa~ denied. -, ......" ,W The City Recorder, upon motion, seconded and carried, was requested to call W for bids for 500 feet of 2~ inch, Underwriter's Guarantee Fire Hose. Bids to be .-~ r -, opened at the adjourned meeting of the Council on August 29th. Councilman Bond reported that Mrs. Cook did ,not wish to settle Ber claim for injuries receiv~d from a fall on a sidewalk for $52.50, but would accept $100.00 as full and final settlement. After considerable discussion by the Council it was determined that Mrs. Cook settle for the amount originally approved or nothing at all. the Recorder presen~ed the application of Mr. G. L. Todd, 939 East 20th Avenue, for a claim in the amount of $6.00 for repairing glasses which were damaged in a fall sustained on the sidewalk at 1945 KincaId Street. Councilman Harris, moved that this claim be denied, and Councilman Reid seconded the motion. After .' considerable discussion, a vote was called for by the Mayor and the ayes and nays were called, Councilmen voting aye, Harris, Nay 6, absent Zumwalt. The motion was declared lost. Councilman Simon then moved to pay the claim, and the motion was seconded by Councilman Bond. The ayes and nays were called, Councilmen voting aye 6, nay Harris" absent Zumwalt. Chairman Carlson of the Printing and Park Committee reported a request from tpe Park Board for the building of a new and larger bear cage in Skinner's Butte Park~ and he requested that this be left with him for time to contact the Park Board and find out exactly what they want. Councilman Carlson put the question to the Council that the Mayor name Mr. Lock, Assistant Superintendant of the Transient Camp, to be supervisor of all transient help that the City is using, and after discussion this was granted. Upon motion, seconded and carried, Councilman Carlson was named ~s the City's representative to have control of this group. The City Recorder presented the proposition from the Sigman-Fell Insurance I Agency giving rates covering Public Liability and Property Damage on the 'Police, cars. The Recorder pointed out that this Agency will furnish exactly the same insurance as ~e have been receiving,for $21.15, whereas we have been paying $79.60. Upon motion, seconded and carried the Council ordered the Policy for the Plymouth Coach to be placed with this company. Councilman Hendershott asked thl;it a COIonli ttee be appointed to investigate the insurance situation. The Mayor appoint,ed the Finance Committee. '. A report of the Zoning Board of Appeals recommended that the City Council request the Planning Commission to hold a meeting at onee to consider the re~ . classification of 13th Avenue East, and recommended to the Council that a special permit be granted to Ira Sawyer to erect a frame dwelling structure ,on the'top of his one story concrete store building, located at 782 West 4th. On motion duly seconded and carried the report was adopted by the Council. Reports for the month of July from the Police Department, Fire Department, City Engineer, Milk Inspector, and Public Library were -read and ordered filed. e: Report from the State Relief Committee on the man hours furnished the City from the Eugene Transient Bureau for the week of July 22, 1935, was read and'ordere filed. .. ~ - .-........ ~ An Ordinance directing the Mayor and City Recorder to execute a deed,'- of"'" correction on behalf of the city for certain properties acquired by the Water Board was read the first time and pass~d its second and third readings by title under suspension of the rule by the unanimous consent of the Council and was placed upon its final passage. The ayes and nays were called, Councilmen voting aye 7, nay none, absent Zumwalt. The Ordinance was declared passed and numbered a433. An Ordinance author1zing and directing the issuance and sale of Refunding Bonds to be designated "REFUNDING IMPROVEMENT BONDS GO, for the purpose of redeem- I lng, paying and retiring certain bonds issued pursuant to applications to pay assessments in installments, which bonds are redeemable at the option of the City of Eugene, and are designated Series A. G., bearing interest at 5~ per cent, in the principal sum of $113,013.70" and ma'tur1:ngc;March 15, 1938; and directing that said bonds be called for redemption, and declaring an emergency was read the first time and passed its second and third readings by title under suspension of the rule by the unanimous consent of the Council, and was placed upon its final passage. The ayes and nays were called, Councilmen voting aye 7, nay none, absent Zumwalt. The Ordinance was declared passed and numbered 8434. Allen and Margaret Allen, was read the first time and passed its II se~ond and third readings by title under suspension of the rule by the unanimous Ii cQpsent of the Council, and was placed upon its final passage. Allen and Margaret Allen, in the City of Eugene, Oregon by directing the City Recorder to advertise for bids for the construction of said I improvement in accordance with such plans and specifications, and notifying I I property owners when and where the bids therefor will be mpened and cons~dered, . The City Attorney reported that the following buildings on which condemnation I proceedings have been started are to be t2rn down by the owners or ones in charge of the property in the near future~ 245 Madison Street, Seavers Furniture I Hospital, and Frasier property on the millrace. A letter was read from Mayor J. H. Miller of Junction City inviting represent- atives of the City of Eugene to attend their Jubilee to be held August 16th to celebrate the last of the city's indebtedness.
