W Minutes of the adjournedmmeeting of the Common Council held at the hour of ~~ 7:30 o'clock P. M., August 29th, 1935. Council was called to order by Mayor Lange, -',<, with all Councilmen-present except Reid and .Carlson. Sealed bide for the sale of $113,000.00 Refunding Improvement Bonds "G", from Hemphill, Fenton & Campbell, was opened and read, and the Finance Committee retired to consider said bid. They returned later with the recommendation that the bid of Hemphill, Fenton & Campbell be accepted. Motion was made and seconded to accept the Finance Committee's recommendation, and the ayes and nays were called. Councilmen voting aye 6, nay none, absent Reid and Oarlson. The bid referred to being set out in full as follows: ~ " Portland, Oregon .. August 29, 1935. Oity Oouncil of Eugene, Eugene, Oregon. I Gentlemen: For the legally issued $113,000. principal amount City of Eugene Refunding Improvement Bonds Series "G", to be dated September 15, 1935, issued in denominations of $1,000. each, $11,000. thereof due September 15, 1936, and $11,000. due on the 15th day of 'September of each succeeding year to and includ- ing September 15, 1944, and $14,000. due September 15, 1945, bonds to bear interest at the rate of 3 3/4 % per annum, interest payable semi-annually on the 15th days of March and September of each year, principal and interest payable at the office of the Oity Treasurer in Eugene, Oregon, we will pay $100.031 per $100. par value thereof, plus accrued interest to date of delivery to us, said I bonds to be due. on the above-mentioned dates without right of prior redemption. We are attaching hereto our certified check in the amount of $2,260.00, representing 2$. of the par value of bonds bid for. H. Hemphill : . AOCEPTED: I I I n Mr. Gordon Wells addressed the Oouncil on the subject of cancellation of interest on assessments against property held by Mr. Harry Gordon. He pointed, out that at the time Mr. Gordon purchased the property the owner, Mrs. Nelson, checked the taxes and assessments, paid.the taxes in full and was assured that all assessments were paid. Mr. Gordon then checked and found the same condition, and purchased the property. He now finds that he has considerable in the way of asseEsments against the property. He is willing and ready to pay the principal of the assessments but prays the. Oouncil for release from the interest. This 'I matter was referred to the Finance Oommittee, Oity Engineer and Oity Attorney. i Oouncilman Lamb, Chairman of the Street Oommittee, reported that they were notified of a very bad condition existing on Woodland Ave., which is a continuation of 15th Avenue East. The property owners served by this avenue wished the same widened and put in better condition. This was referred to the Street Oommittee and Oity Engineer. Oouncilman Bond, Ohairman of the Fire and Water Oommittee reported that they had received figures on the cost of a fire alarm system, which would amount to $42,800.00 for the equipment. This was referred back to the Fire and Water Committee to look into. I. ' I :tj At this time Councilman Reid appeared in Council. "I Mr. Terry asked for permission of the Council to tear down two buildings at the corner of 25th and Alder Streets, which belong to the City. This was referred to the Health Committee. II Councilman Simon, Chairman of the Police Committee, presented a beer i application from Mrs. Mary Thomas at 40 West 7th. On motion seconded and carried jl the ?pplication was approved. He also presented the application of H. B. Yount of the Del Rey Cafe, for a wine license. On motion, seconded and carried this application was not approved. The petition of Mr. N. O. Nielson for the erection of a chicken house at 1009 West 1st Avenue, was, on motion, granted. II Petition from the Walters-Bushong Lumber Co. concerning the construction of . 'I I; an over-heat blow pipe, was presented, and referred to the Street Committee, I Judiciary Committee, and City Attorney. I , I Communication from the Sign Board of Appeals was presented by W. C. Clubb, I , I allowing the seymour Cafe to raise their sign and extend it if necessary. , I i A communication from the Planning Commission recommending the establishment , Ii of the business district on East 13th Avenue bounded on the West by the alley II between Agate and Columbia Streets, on the South by the South line of the second I! lot South of 13th Avenue, and on the North by the railroad tracks~ was on motion accepted. Their recommendation that the light industrial district lying on Polk II Street between Cross Street and Railroad Blvd. be and remain as it now is zoned, Ii was also accepted by the Council. I' I I An Ordinance accepting the bid of Hemphill, Fenton & Campbell for the purchase i I of Refunding Improvement Bonds "G", of the City of Eugene, in the sum of $113,000, I I and fixing the rate of interest on said bonds, was read the first time and pa~sed [I its second and third readings by title under suspension of the rule by the unanim- II OUB consent of the Council, and was placed upon its final passage. I An Ordinance regulating the use of power speakers, calIia-pes, and other noise making, music making or speech making devices upon the streets of the City of I Eugene, and requiring a license therefor, was read the second time and passed its third reading by title under suspension of the rule by the unanimous consent I , of the Council, and was placed upon its final passage. II II A petition from the Barber's Union asking for an Ordinance limiting the Ii operating hours of the Eugene Shops, was referred to the Judiciary Committee and " i! Payne, Agent l4l~7l Bids for the improvement of Willamette Street- between 15th and 16th, were opened and read as follows: . City of Eugene Maintenance Dept. $ 22.75. Motion was made and seconded to accept this bid. The ayes and nays were called, Councilmen voting aye 7, nay none, absent Carlson. Councilman Zumwalt, Chairman of the Health Committee, reported that the Caretaker at the Comfort Station, Mr. Shrode, was ill, and that he had hired Mr. W. H. Robertson to take his place as of August 12th, and asked that he be placed on the payroll at the same salary that Mr. Shrode was getting. Motion was made and seconded to place Mr. Robertson on the payroll at $15.00 per month and the ayes and nays were called, Councilmen voting aye 7, nay none, absent Carlson. 'I ' Mr. Allen Pitts of 132 H. 5th Street asked for permission to use the old lumber in the building at 192 Washington Street to repair the other building on that lot. This was referred to the Building Inspector. I Councilman Lamb asked that the City Engineer be instructed to re-establish the lin~s at 2nd and Water and Ferry Streets, and it was so ordered. Petition was presented from the Eugene Dairy Association asking that the City establish the butterfat content of milk on the same basis as that of the Federal Government and State. The Eugene Natural Milk Producers Associat_ion presented a request that the present City Ordinance on milk be not changed. Mr. Johnson and Mr. Reese addressed the Council pointing out that the ordinance should be left as it now is. Mr. Getchell, Mr. Viles, Mr. Sorenson, and Mr. Hill addressed the Council in behalf of changing the Ordinance, stating that they would either have to reduce the butterfat content of milk or increase the price to the consumer. Mr. Hill pointed out that the Health Board had brought this situation to bear in that they wished to put on a full time inspector, and that one of the two things would have to be done to bring that about. This was referred to the Health Board. tt- Councilman Lamb, Chairman of the Street Committee, opened the discussion concerning the purchase of a building site, or the construction of a building on the present owned property for the city barns. The Street Committee recommended that the Daniels property and building at the North end of Olive street be purchased from the United States National Bank for $10,000:.00. The bank will take any form of paper for the property, to bear interest at the rate of four per cent. Mr. Reid stated that he had talked to the bank officials on the subject and that they were ready to deal. Mr. Calkins pointed out that ther.e had been an act passed which enabled the City Council to go to the extent of $10,000.00 in creating an Indebtedness, and he had talked to the attorneys of the Bank and they would accept the city's obligation. City. Engineer Clubb nresBnted an estimate of the cost of building a shop and shed at $7,000.00, and reported that it would cost $750.00 to repair the Olive I Street building if purchased from the bank. The Mayor pointed out that on any building construction he was sure the City would be able to receive 4.5 % grant from the Government, and that this would help labor. Mr. Lamb pointed out that the present site Is not a good one for the shops, and the only other property that the ~ City owns is kmown as the Mathews property, but felt that this would be too far out. Mr. Hendershott moved that the Street Committee continue negotiations with the Bank and make them an offer of $7,500.00 including repairs. This was seconded and carried. Councilman Zumwalt presented the Rroposition of purchasing from Mr. Soults the property on Franklin Blvd. for a Park. Mr. Hendershott moved to reject the It offer of Mr. Soults. The motion was seconded and the ayes and nays were called, Councilmen voting aye, Hendershott and Bond. Councilman Harris then suggested . ro.; I that Mr. Soults be asked to appear with a blue print showing the property, and ~\: his offer to the City, and this was so ordered. I / ::~~~ Mr. Hinkley, representing Mr. Hockley of the P.W.A. ., was presented to the ,,f Council and he reported that any P.W.A. projects would have to be submitted before September 3rd. Mr. Reid suggested that the plans for- a sewage disposal plant be submitted and he so moved. Motion was seconded and carried. Mr. Hendershott asked concerning the Fair GDounds, and it was reported that th.1s was up to the County. It was reported that as far as an election is concerned to issue and sell bonds, an election could be held at some future date. Councilman Hendershott then sugges.ted the building of a city natatorium. Councl1manLamb moved for a combination project of the construction of city barns and a new city jail.
