I :~ Minutes of the regular meeting of the Common Council hel~ at the hour of 7:30 o'clock P.M., October 14, 1935. Council was called to order by Mayor Large, with all Councilmen present except Reid and Zumwalt. Minutes of the regular meeting of September 9, the adjourned meetings of the 19th and 26th, 1935, were read and approved. I The Judiciary Committee, by Chairman Harris, reported adversely on the Mack Sherman request, asking for damages in the amount of $24.00 to his car in a I collision with the fire truck. Motion was made, seconded and carried to accept I the Committee's report. I I The Finance Committee, by Chairman Hendershott, ,reported that the Wiltshire offer for Lot 4, Block 5, Hollenbeck's Addition for $250.00 was too low, and in ,- I his opinion this property would be worth in tbe neighborhood of $1000 in the near · future, and he, therefore, recommended that the offer be turned down. On motion duly seconded and carried this recommendation was accepted. I Councilman Hendershott reported that the electrical inspection bill for September was somewhat higher than usual, and called on the City Engineer to explai the same, and he reported that in his estimation it was too much money. Wentworth, Treas 411.15 The Police Committee, by Chairman Simon, reported that he had been asked for permission to put up a sign in front of the U. S. Recruiting Office, and this , was, on motion, denied. Councilman Simon opened discussion on the condition of the Drive-In-Market on Willamette Street, and after considerable discussion it was decided that Mr. Horn . of that Market should appear before the Counc~l at the next meeting and explaint the situation. Councilman Bond at the request of Councilman Lamb presented the proposition for the city barn. The daniels property at the North end of Olive Street was presented as follows: Building and Lot complete $4,500.00 $10,000.00 Cash City Property in trade 1,500.00 I Bal. over, a period of 4 yrs. $4.000.00 I at $1000 each yr. without Int. 10,000.00 The building, leaving a half interest in the party wall was' offered for $ 8,000.00 Cash 4,500.00 City property in trade 1,500.00 I Bal. in 1 yr. 'without interest 2.000.00 $8,000.00 After considerable discussion among the Council; some holding that they probably should rent space until they could determine definitely whether or not the City could receive Federal aid in a project of this nature; and others holding that this is a very good investment and should be taken advantage of irnnediately. Mr. H. W. Reynolds addressed the Council expressing the opindJon that the City probably owns enough property now, and it would be a tremendous aid to labor to labor and local merchants if the city would build its own place. Councilman Reid moved that the Council accept the first proposal of $10,000.00. T~e motion was seconded by Councilman Harris, and the ayes and nays were called, Councilmen voting aye, Lamb, Hendershott, Reid, and Harris. Nay, Simon, Bond and Carlson. Absent Zumwalt. The Mayor returned the problem of financing it to the Street Committee. Councilman Bond reported that they had an offer of $10.00 for an old bell that was no longer in use, and $500.00 for an old Buick Fire truck. Motion was made and seconded tffit these be sold for the above amounts, and the ayes and nays were e' called. Councilmen voting aye 7, nay none, absent Zumwalt. The Recorder and Fire Chief were ordered to complete negotiations on the fire:, truck. A communication from H. L. Edmunds, Manager of the Eugene Branch of the United States National Bank of Portland, addressed to Fred Wentworth, City Treasurer, concerning acknowledgment of the change of parties of contract on interest payable the City of Eugene on funds deposited in the local branch, was presented, and on motion duly seconded and carried, was unanimously approved. I Garbage bond in the amount of $500.00 from Philip Hohnstein, dated October 1, 1935, was presented and on motion accepted. Application of Mrs. Carma Gibbens for a rooming house permit was presented and on motion granted. I Councilman Bond asked for two weeks more time on the petition for lights at I 24th and Alder and 25th and Kincaid Streets. This was granted. A letter from'C. L. Wallace, asking for permission to build on the Southwest corner of Lot 6, Block 11, Henderson's Addition, was referred to the Zoning Board of Appeals. A letter from Robert C. Hall, concerning some assessments, was presented and I referred to the Judiciary Committee and City Engineer. Oil Oompany to erect a super service station on. their property at the Northwest ~~ corner of 13th Ave. and High Street, be granted. On motion this report was I ~,~ accepted by the Counc i1. , 0 -4 . ~ Communication from F. L. Burbee of Portland, Oregon, concerning a contract for the Municipal Airport was presented, and referred to the Judiciary Committee. . ,Con~unication from G. G. and Clara R. Stratton was read, stating that they I are charged with four feet more frontage on their lot at 1228 Olive Street than their deed calls for. This was referred to the City Engineer. Reports for the month of September 1935 from the City Engineer, Fire Depart- ment and Police Department were presented and ordered filed. An Ordinance granting a franchise to the Walters-Bushong Lumber Company to extend a blow pipe across High Street at the site of the Company's plant, between Fourth Avenue East and Fifth Avenue East, in the City of Eugene, was read the second time and held over for the third reading at the next Council meeting. . The Mayor called for discussion in behalf of the hearing on the condemnation of the building at 245 Madis6n Street, and none appearing the following Re&olution was read and adopted: II RES 0 L UTI 0 N This matter coming on to be heard before the Common Council of the City of I ! Eugene pursuant to notice on the 14th day of October, 1935, at 7:30 o'clock P.M. I of said day, in the Council, Chambers in the city hall in the city of Eugene, and I ,I it appearing to the Council that complaints have been made by residents living near the property herein described, and reports have been made by the Chief of II Police, the City Attorney and the Chairman of the Health Committee, declaring I said building to be a dangerous building in fact and a dangerous building under II the provisions of Ordinance No. 8292, and a nuisance. II I The Council thereupon proceeded to a hearing, and examined various persons on I behalf of the city, including various city officers and members of the Council who 'I II had inspected the building, and all those appearing at said hearing were heard I r and ~ere given opportunity to present any and all testimony, arguments and state- II ments on their behalf, and the Council, after having heard all remonstrances, I protests and objections, at this time makes its findings, as follows: , First, that the said building be and the same is hereby declared to be a .- dangerous building, as a matter of fact, and also the same is hereby declared to be a dangerous building as defined by Ordinance No. 8292, adopted by the City of Eugene: on the 9th day of May, 1932. Second, that said building be and the same is hereby declared to be a public nuisance. Third, that owing to the delapidated and dangerous condition thereof, and its general condition of disrepair, it is impossible to renovate, reconstruct or repair the building, and it cannot be made safe and sanitary. I Fourth, that it is the judgment of the Council that the building should be 1\ removed and the nuisance abated. "- That the shingles are dry and curled up and the interior is filled with rags and other combustible material. That there is no sewer connection and it is a breeding place for disease. That all of the windows and doors are broken out, and although it has been attempted to board up some of them, the building can be easily entered and it constitutes a hangout for tr8J.!lps and disreputable characters. That said I building is also an attractive nuisance for children to play therein. . The Common Council of the City of Eugene therefore orders and directs that said building be removed and the nuisance abated, and the City Recorder is hereby ordered and directed to give fifteen days notice to Manluf McBee, Merle McBee and Neva Gibson, the owners of said building, requiring them to remove said building and abate the nuisance within twenty days from the expiration of the fifteen days .. notice, and if they fail so to do, that the Council shall thereupon call for bids and order and direct by Ordinance the removal of the building, and assess the cost thereof upon the property benefitted, as provided by said Ordinance No. 8292. Adopted by the Common Council this 14th day of October, 1935. I -0- The Recorder presented a proposed Resolution on the Water Board Bonds, and it/ developed that there were four ways to present it to the people for their ~ consideration as follows: 1. Assumption by the Water Board of the principal and inter~est on the Water Bonds now held by the City of Eugene, in the amount of $93,340.45. 2. The assumption by the Water Board of the principal and interest on the Water Bonds now held by the City of Eugene, in the amount of $93,340.45 as of the date of their assumption by the City of Eugene. 3. The assumption by the Water Board of $61,489.44 principal, and interest on the full amount of $93,340.45 now held by the City of Eugene. 4. The assumption by the Water Board of $61,489.44 principaY and interest. e: Upon motion this was referred to the Budget Committee to be brought up at the meeting of October 30th, at which time they will stipulate which form they wish the Council to present to the people. I The ,Mayor presented the proposition of the Sewage Disposal Plant, and after consider,able d,i'scussion and pointing out of the amount that would have to be expend~~'befo~e we would be able to present this to'the people for a vote, and the question a~ to whether the people would approve such a proposition at this time lead'to th~ moti6n that the Sewage Disposal Plant be dropped. Motion was seconded and the ayes and nays were called, Councilmen voting aye, Lamb, Hendershott, Simon, Bond, Harris and Carlson. Nay, Reid. Absent Zumwalt. The'Recorder was instructed by the Council to write a letter to the Eugene Wate.r:/,;Board, asking them for the usual 25 per cent discount on ci ty bills for 1936 ~:'::i',\ r-.' I ;',' The Recorder was also instructed to write a letter of apprecl~tion to the' Fire Dhief and members of the Eugene Fire Department for their good done in behalf of the Fire Prevention Program.
