Minutes of the adjourned meeting of the Common Council, held at the hour of .'-..~ 7:~0,o'clock P.M., November 25, 1935. Council was called to order by Mayor Large, '..... with all Councilmen present except Reid and Harris. . Councilman Bond, Chairman of the Fire and vTater Commi ttee, recommended to the ! Mayor the appointment of Dale Croner to take the position made vacant in the Fire Department by the resignation of Jack Hayes, as of December 1, 1935. The Mayor accepted the recommendation and appointed Mr. Croner. Motion was made, seconded and carried to confirm the appointment, and the Recorder instructed to place Mr. Croner on the Payroll as of December 1, 1935 and draw a warrant for his salary at the same time other salaries are paid. Councilman Zumwalt reported that they had given one elk to the Salvation Army . for Thanksgiving and they wanted another one for ChristmaB, and that they would get rid of the third one. Councilman Zumwalt moved at this time that the bear herd be reduced to two, bears. This was seconded and carried. Councilman Hendershott pointed out that Mr. Gus Peret of Yoncalla had loaned one of these bears to the City, and he should be contacted before disposing of his bear. The Recorder was instructed to write Mr. Peret. At this time Councilman Harris appeared in Council. Councilman Harris, Chairman of the Judiciary Committee, asked for more time on the theatre situation and the Airport lease. This was granted. I A communication from Mrs. Hettie J. Robinson, Jr. , concerning her claim for I damages for injury received from a fall on the sidewalk in front of the Methodist I Church, 1liaS read as follows: $100.00 general damages; $17.50 Doctor bill; $16.00 house help; and $4.00 laundry. Total ~137.50. This was referred to the Judiciary I 60mmittee and City Attorney. A communication from the Zoning Board of Appeals recommending that the request of Orlan L. Crabtree to bank about 60 cords of wood at his residence at 1130 West 6th Ave., be denied. Motion was made, seconded and carried to adopt thds recommend ation. The report of the City Engineer and City Attorney on the Hawkins and Roberts request for the cancelJation of interest on assessments on the West 40 feet of the South 80 feet of Lot 15, Block 7, Gross Addition, was presented, and upon their recommendation, it was moved, seconded and carried to deny the request. The summary of the Eugene Water Board claim for placing the rental of their quarters by the City at $150.00 per month, was presented and it was moved, seconded and carried that their report be adopted. At this time Councilman Reid appeared in Council. . Reports f or the months of September and Oc t'ober from the Pol ice Matron were presented and ordered filed. Communication from Representative C. F. Hyde was presented to the Council, concerning his receipt of the memorial to the State ~egislature by the Council. An Ordinance ordering a special election for submitting to the electors of the City of Eugene, at such special election to be held on the 31st day of January, 1936, the following proposal: "Shallthe Common Council of the city of Eugene adopt a system of civil service for its fulltime paid fire fighters, and make all necessary provisions therefor? II , was read the first time and discussion was lead by Councilman Lamb. He wanted to know if this had to be voted on at the next election on January 31, 1936. The Mayor stated that it coUld be postponed. Councilman Lamb then expressed the opinion that this should be postponed. Council- man Carlson pointed out that it was his underBtanding that this had to be voted I on at this time, and if the Imv read that~'way the Council should abide by it. Mr. Jaclc Haye s, representing the Firemen's Association, addressed the Council stating that this Association was responsible for the enactment of this law, and that the intent of the Legislature at the time of its passage was that this should be voted on at the nett general olection as a special measure, but if there was a special election in the meantime it should be voted on then. Councilman Carlson asked the City Attorney to explain Chapter 122 of the 1935 Session Laws, and he did so, pointing out that was worded that it must be done at this corning special election, but he also pointed out that the Council was a legislative body such as the legislature itself, and that they could probably do as they saw fit about it, and the only recourse would be by mandamus action through the courts ordering the Re~order to place the same upon the ballot. Councilman Hendershott moved that it be put on the ballot, I '.~~ and Councilman Carlson seconded the,motion. The Mayor then pointed out that this -?:..... was in form of an ordinance and they would proceed with it in that manner. The e Ordinance wa& passed its second and third readings by title under suspension of the ~ rule by the unanimous consent of the Council, and was placed upon its final passage. GC The ayes and nays were called, Councilmen voting aye 8, nay none, absent none. The Ordinance was declared passed and numbered 8449. An Ordinance declaring the intention of the Common Council of the City of EU8ene to make a reassessment of the cost of paving Fourteenth Avenue from Willamette Street to Alder Street in the City of Eugene, as the same abuts upon the properties hereinafter described, and fixing a time and place for holding a meeting of the Common Council at which all protests against such reassessment shall be heard, and directing the giving of notices, was read the first time and passed its second and third readings by title under suspension of the rule by the unanimous consent of tl~ Council and was placed upon its final passage. The ayes and nays were called, Councilmen voting aye 8, nay none, absent none. The Ordinance was declared passed and numbered 8450. . II I The Recorder pointed out that petitions were ready for circulation on the $1.00 a year for city light and Water service, and the Water Bonds amounting to $93,340.45. Councilman Simon made the remark that these petitions would most certainly be filled and there would be no difficulty at all in Eetting signatures. I Councilman Carlson reiterated Councilman Simon's statement, and the Mayor expressed the opinion that inasmuch as the City was holding a special election on January 31, 1936 that if the Council wished to reconsider their former action and by Resolution place these questions on the ballot, they still had ample time, and he could see no reason why they should not do it. After a short discussion the follow I ing Resolutions were read and Councilman Simon moved and Councilman Carlson seconded the motion that the Resolutions be adopted, putting these two measures, as the petitions now call for, on the ballot at the January 31, 1936 Special Election. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: BE_ IT ENACTED BY THE ELECTO~S OF THE CITY OF' EUGENE, OREGON: Section 1. That the Common Council of the City of Eugene be and it is hereby directed and authorized to determine what light and \Vater shall be furnished to the City of Eugene for serving I streets, parks, public plJices and all service required by the city I itself. Section 2. That the Eugene Wat~r Board be and it is hereby , directed to furnish to the City of Eugene for its streets, parks and public places and for all city uses, electric light and waterF including installation and maintenance, to the extent and amount determined necessary and convenient by the Common Council of the City of Eugene. Section 3. That the charge to be exacted by the Eugene Water Board for the foregoing service is hereby fixed at $1.00 per . year. Section 4. That all acts and parts of acts in conflict here- with be and the same are superceded by this act and repealed insofar , as they conflict herewith. l BALLOT TITLE. Eugene adopted at the general city election held in the City of Eugene April 6, 1914, be and the same is hereby repealed ins6far only as it conflicts with the provisions of this Act. Councilman Simon brought up the subject of 19th and Willalnette Streets as a traffic hazard, and thought that it ~as the proper thing to do to make East 19th as it enters Willamette a stop street, and remove the stop sign from Wi11amette I at 19th, thus making Willamette Street a through street. Councilmen Zumwalt, I Bond and Carlson all endorsed this. Councilman Zumwalt moved that East 19th I Street at its Willamette junction, be made a stop street, and make Willamette a through street. Motion was seconded and carried. ~ Councilman Simon suggested putting stop signs on the other streets coming into Willamette beyond 19th. I 11th Street and several other streets were suggested as possible streets for the use of stop signs to better traffic conditions. ' Councilman Har~is moved that the City place speed limit signs of 25 miles per hour at all entrances to the City. This was seconded and carried. On motion the Council adjourned. C. M. Bryan, .
