HomeMy WebLinkAbout05/11/1936 Meeting r"" 466 . I Council Chambers, Eugene, Oregon May 11, 1936 ~~ The minutes of the regular meeting of the common council held at the hour of r:~ 7:30 o'clock P. M:., May 11, 1936. Council was called to order by Mayor Large, all ~: councilmen present except Simon and Reid. I Professor Edwin T. Hodge formerly of' this city addressed the council concern- ing the assessments claimed upon a portion of lots 3 and 4, in block 30, of the original plat of Fairmount. Mr. Hodge pointed out that on three different occasions, the city treasurer had informed him that his property was free of all incumbrances and asked that the council instruct the treasurer to cancel the assessments in 1 question. Dr. Harris, of the Judiciary Committee, stated that he believed Mr. Hodge would have to be held responsible for the assessments. Mayor Large requested that the committee, City Attorney and City Engineer be granted another two weeks to further study this problem. At this time Councilman Reid appeared. . The Judiciary Committee, by Dr. Harris, reporting on the NYA Program, asked for an additional two weeks time due to the fact that the faculty committee members had 2 been unable to call a meeting. Mrs. J. L. Elsensohn's request for waiver of assessments on lot 14, block 11, 3' II Fairmount Addition, was denied. The Judiciary Committee reporting on Mrs. Polley ~ilsonls claim for damages sustained in a sidewalk fall, stated that an offer had been made to Mrs. Wilson for 4 settlement, but as yet they had not received an answer from her and the matter was held for further consideration. It was the recommendation of the Judiciary Committee that the chicken and bee ordinance stand as it now is and that the proposed ordinance be tabled. The recom- 5 mendation was approved by the council. Councilman Hendershott of the Finance Committee presented the bills for the I month of April with the recommendation that warrants be drawn for the same. The Health Committee, by Chairman Zumwalt, moved that the barn located in lot 8 3, blpck 16, Milligan Donation be comdemned. It was seconded and so ordered. . At this time Councilman Zumwalt entered a complaint concerning the noisy con- ditions existing at the beer parlor located on East Seventh Avenue. He asked that ir anything could be done to abate this nuisance that it would be appreciated. Councilman Bond asked what disposition had been made concerning the barn located in the block bounded by Jackson, Van Buren and Third and Fourth, that had previously been condemned. The City Attorney stated that condemnation papers 10 were in the process of completion. 9 Councilman Hendershott asked if anything had been done concerning the removal of the Foster and Kleiser sign on the property located at "West 130 feet of lot 7a, Foster Addition" and wanted to know if a lease had been entered into with the Lumbe~ Company who wished to improve that location. Councilman Bond reported that the Lumber Company had improved the parking strip and were waiting until the com- 11 plete removal of the sign in order to improve the other and that as soon as these conditions were met with that they would enter into a lease with the City of Eugene. The City Recorder was instructed to write a letter to Foster and Kleiser immediatel asking for the removal of the sign. I 12. Councilman Zumwalt then reported that the drinking fountain at 7th and Willamette had to be repaired at a cost of $4.50 and wanted to know from which fund this was to be paid. Councilman Lamb reported that at previous times the Eugene Water Board had reported to them that they would not keeptup the r~pairs on drinkin fountains, therefore he made a motion that this be paid from the emergency fund and it was seconded. The ayes and nays were called. Councilmen voting aye, Lamb Hendershott, Reid, Zumwalt, Bond, Harris, Carlson, nay, none, Absent, Simon. 1 The Police Committee, by acting Chairman Bond, recommended the transfer of 13 the liquor license of the Manhattan Cafe to John Frederick, Jr. Councilman Harris at this time suggested that the council extend their vote 14 of thanks for the manner in which the council minutes were being handled~ Chief of Police, C. F. Bergman, stated that he had given specific orders to his traffic officers to ~ag all cars using 6th and Oak Streets for purposes of 15 marketing their wares. He also reported that he had contacted the manager of the Wardrobe Cleaner's and that they had removed the steam exhaust which was causing such a nuisance to pedestrians. .- 16 It was moved and seconded that the $5.00 deposit of the Carroll Drug Store and Lucky Store (Cigar) be returned to them. The ay~s and nays were called. Coun- cilmen voting aye, Hendershott, Reid and Zumwalt; nay, Lamb, Bond, Harris and Car- lson. The subject was referred to the Bolice Committee for further consideration. Communication from the Private Flyer's Association was presented, asking the Council's approval of the proposed air meet. Mr. Sanders addressed the Council, stating that if thePFA had waiver froID the Federal Government that they claim the have and if a IDeet is to be conducted by the Oregon State Inspector..then it is 17 perfectly satisfactory, otherwise he is opposed to it. It was moved and seconded that in the future all communications concerning the airport should come before the council through Mr. Sanders and it was so ordered. I 18 A communication from the Eugene Kiwanis Club, praising the present city ad- ministration for its efficiency and accomplishments was presented and ordered filed. A copy of the same being distributed to all the councilmen. The B. T. Merrill property located on Orchard street, being a part of Lot 1, Block 12, F'airmount Addition has an unpaid assessment of $28.89 with interest from June 1, 1914. When the Orchard Street assessment for Paving was paid up by the Home Owners' Loan Company, they overpaid $17~48, deducting this amount from the principal of the unpaid sidewalk leaves a balance of $11.41, which the Treasurer is instructed to cancel. 19 Ii' City Attorney presented the proposal of Loyall R Rugh, Martha and Lottie N Rugh whereby they would give the city deeds of Bargain and Sale for certain pieces .... BE IT RESOLVED by the Common Council of the City of Eugene, that in consideration of Lottie N. Rugh and Loyall R. Rugh deeding certain properties to the City of Eugene absolutely and unqualifiedly, that the City of Eugene hereby directs the City Recorder and the Mayor to enter into an agreement of option with the said Lottie N. Rugh and Loyall R. Rugh with regard to the respective pre~ises, granting theln until June 1, 1937, the right to purchase said property at the prices set opposite the same in the contract, together with interest thereon from this . date until said option is exercised, and in case said option is not exercised befor June 1, 1937, said option shall terminate and all rights of the said Lottie N. Rugh and Loyall R. RUgh shall be lost. Communication from W. C. Clubb, City Engineer, concerning the operation of a 21, shop in the rear' of 972 Eighth Avenue West was presenteq and motion was made and j seconded to table the same. Communication from the Park general budget. was Dresented and '* J-u- ~~~~. Communication from the Board of Appeals was presented and in regard to the request of Mrs. Emma C. Preston, motion was made and seconded that she be given the same type of a contract as that now held by Mr. Stanley Stevenson except that the removal clause be for one instead of. five years and it was so ordered. Ooncerning the RS tl'ynd and the JJ Martin request the Board recoITllI,ended its approval and denied the request of Russell D Evans, requesting a permit to move a store room to another location on the same lot at 536 11th Avenue. Report of the Bui0ding Inspector for the month of April was presented and ordered filed. Report of the Fire Department was presented and ordered filed. Communication from the District Safety Inspector of the WPA, holding the Works Progress Administration harmless in case of property damage or public liability due to operation of any of its trucks on a WPA project was presented and upon motio made and seconded the Finance Committee was ordered to contract for the necessary insurance on trucks being used by WPA workers. Mr. Calkins reported upon the proposed contract by the United Air Lines and the City of Eugene with the recommendation that the contract be approved with Mr. 26 Sanders acting as co-signer with the city and it was so ordered. Bids were opened for Police Radio and the same referred to the Police Committe 27 to refer back at the next meeting. The bids were as follows: Terminal Radio Shop, 521 Willamette Street~ $995.95; Al Wolfel Radio KORE, $950.00; Seattle Radio Supply, $116&.00; H. ". White Electric Company, 1850.00; Castelloe & Stocker, $1500.00 , I Communication from the Western Box Company was presented and referred to the 213 I Fire and Water Cornmi ttee for report at the next meeting. I 291 I I I i Application for Hotel License at 65 East Broadway was presented from Joseph I and Jane Tannler. The license having been approved by the Chief of Police, on motio 30 made'and seconded, it was approved by the council. ! Resolution was presented for the leasing of space in the City Hall Building, , to the U. S. Treasurer pept., for its use as an Internal Revnnue Office and it was Iii unanimously passed. A bill was presented to the city from the Phi Kappa Psi Fraternity in behalf 0 a claim from Williamson Plumbjng Company for repairs to their sewer, the amount being $19.50. It was reported that Mr. Williamson feels that the city should pay this instead of the fraternity. The same was referred to the Sewer Committee to report at the next meeting. Counci Imen vo ting aye, seven, nay, none, absent, Simon ./lgJ' :3 "3> The contract between Mr. R R Hughes and the City of Eugene for the management of the Ci ty Dump Grounds is to be dated as of i."lay 1, 1936 and to expire as of 35 April 30, 1937 and a salary of $30.00 per month to start as of May 1 and it was so ordered. Councilman Bond reported that Mr. Zimmer who had previously complained con- . cerning certain 6onditions existing at the Pierce Machine Shop had not be~cleared 36 up and Mr. Calkins stated that he would write them immediately asking them to abate the nuisance. 37 Councilman Hendershott reported that fifth street is badly in need of repairs. 38 The Police were ordered to check mufflers on all trucks and to checl< the speed at which they were driving through the city. 39 Inasmuch as the appraisal committee had not reported concerning the two pieces of property under consideration, Councilman Harrts <;lsked that their report be kept confidential. But this ques'tion was held over for.d'~cision at the next meeting. The Mayor reported that the Lane County Relief Committee would like to rent quarters in the city barn for the storage of their supplie5 and that they are will- ing to pay $25.00 per month and that they will furnish all labor if. the city will furnish the material to make certain alterations necessary. The Mayor was ordered to continue negotiations with this committee and reach a satisfactory agreement. 40 41 I Councilman Harris at this time reported that the nomination for members to the civil service commission would be held for two more weeks at which time they would know whether or not the police would be under civil service as well as t~~ firemen. On motion the council adjourned to meet May 25, 1936 at 7:30 P. M. C. M.
