The minutes of the regular meeting of the common council held at the
hour of 7:30 o'clock, P. M., June 8, 1936. Council was called to order by Mayor
Large, all councilmen present except Harris, Simon and Reid. The City Recorder
pre~sented tbe minutes of May 25th and no objections appearing the same were ordered
filed..

At this time Mr. Wendell L. Van Loan introduced Dr. A. N. Johnson, new
county-city Health Officer to the council. Councilman Zumwalt reported that he had,
talked with Dr. Johnson and they had discussed the presentation of an ordinance
requiring examinat~ons of food handlers. He asked that the council come to an unde -
standing with Dr. Johnson as to what was expected of him in the way of services by
the city. Dr. Johnson stated that it would be impossible for him to set aside any
particular day simply for city services. He, however, assured the council that the
city of Eugene would receive all services possible. He pointed out that he has
already had a considerable number of cases concerning nuisances as a result of the
handling of garbage and that he is doing considerable work on communicable diseases
As a matter of fact he handles all that work within the city and that he is willing
to submit a program to the city as soon as sufficient time has elapsed for him to
gain a true analysis of the same. Mr. Van Loan stated that the set-up as to the
Health situation in Lane County is this: Dr. Johnson has a separate office and is
the city Health Officer as well as the county Health Officer and Dr. Romig is the
County Physician and that now under the charter amendment which provides that the
city health officer is the chairman of the Health Board, Dr. Johnson will call
meetings and get things under way, and Dr. Johnson will be expecting the cooperati n
of Dr. Helterline on much of this work..

At this time, Councilman Reid arrived.
The Judiciary Committee by Councilman Reid, reported favorably in behalf
of the Campbell and Turnbull request for cancellation of certain city liens. Mem-
bers of the council pointed out that this was a deviation from the usual ~ocedure
and decided to hold this matter fOT another two weeks.

The Judiciary Committee reporting on the Eugene Morning News Safety Cam-
paign felt that this was a matter for the entire council to act upon and it was
moved and seconded that the proposal be indefinitely tabled and it was so ordered.

The Judiciary Committee reported that they felt the H. T. Wiltshire off'er
was good.. At this time Councilman Hendershott stated that Mr. Wiltshire had called
on him before the meeting and stated that he was willing to split the difference
4 I between his offer of $500.00 and what the city actually has in the pronerty, the
II amount now being ~6l5.43 and the present Wiltshire's offer being $557:7.2. 'It was
l moved and seconded that this offer be accepted and the Mayor and City Recorder be
~ instructed to sign the necessary papers and it was so ordered by the council.

The Finance Committee recommended that warrants be drawn for the bills
as presented. The ayes and nays were called, councilmen voting aye, six, nay,
none, absent, Simon and Harris:

Fire and Water Committee by Chairman Bond reported that he had been unable
6 to contact the proprietors of the Western Box Company and inasmuch as they had once
stated that if the city felt they should be paid for the hydrant, that it was his
recommendation that the city remove the fire hydrant and valve and cut the water lin
off at the city limits and this motion was carried.
\ Police Committee by Councilman Bond reported that a system had been worked ou
7 I for the use of the patrol car by the dog catcher and engineering department.
It was the recommendation of the Police Cornmi td3ee that the ~p5.00 investigatio
fee paid last year by the Carroll Drug Store and Lucky DeBurgh Cigar Store be denied
8 The application had been made in 1935 and they are now asking for a refund in 1936
'I which means it would have to come out of this year's budget. The recommendation of
the police commi ttee was unanin,ously approved.

As to the Police Radio, it is still being determined whether or not the city
9 can operate under the state system~
The Police Committee recommended that parking meter proposition be tabled and

The Recorder presented a communication from Dr. E. T. Helms asking for waiver
of certain assessments on property located on the SE corner of 11th and High Streets
11 Ellsworth First Addition, Block 3, Lot 10 CD) was referred to the Judiciary Commit-
tee, City Attorney and City Enginee~~
Communication was presented from C. V. Simon concernine; assessment on Lot 1,
12 Block 8, ~alter & Seiffert Addition to Eugene was presented and referred to the
Judiciary Committee, City Attorney and City Engineer.,
Communication was presented from Mrs. C. A. Wiggins concerning the use of
property belonging to the City, lying south ~. 20th street facing bouth Willamette
13 Street and the ofLer made by Mrs. Wiggins was accepted by the council subject to the
city's sale or use of the same and the Mayor and City Recorder were instructed to
prepare the necessary papers and sign the same.

Communication from Mr. Robert M. Fisher, Jr., manager of the executi.ve com-
mittee for the Florence Bridge Dedication and rhododendron Festival, expressing thei
14 appreciation to the city council for their use of the street banners during their
recent celebration was presented and ordered filed.
Communication from the Board of Appeals for a permit to wreck the Patterson
15 School Building, leaving a part of the basement and remodeling it for the storage of
School supplies, recommending that this re~uest be granted, was presented and the
recommendation of the board was denied.

Report from the Chief of Police for matters referred to him at the previo s
meeting was presented and approved. Councilman Bond pointed out that in regard to
II ,,; the Chief's investigation of the Pierce Machine Shop nuisance that he had been in
La1 there himself and it was his belief that Mr. Pierce had provided the necessary

~~. Monthly reports were presented from the Police, Fire and Engineer Depart-
ment together with the Eugene Public Library monthly report and statement concern-
l~ ing repairs allowance and insurance fund and the same were ordered filed.
The Recorder presented a statement from Mr. G. M. Calkins, City Attorney,
to the effect that he had paid Mrs. Pollie Wilson in full of her $500.00 claim by
the payment of it34.00. It was moved and seconded that a warrant be drawn for the
18 payment of this surn to Mr. Calkins. The ayes and nays were called, councilmen
voting aye, six, nay, none, absent Simon and Harris.
B~d was opened for the repair of the bear ~age as provided for in an ad-
vertisement. One. bid only be ing had for the sum of $683.30. Counc i IIllan Carlson of
19 the Park Board moved the bid be denied due to the fact it was in excess of the
amount of money available for that ~ork. It was seconded and so ordered.
F. G. Walters and Sadie D. Walters having tendered to the city a deed for
the following described real estate: Lot 3, and the East 15 feet of Lot 4, Block,l,
20 Re-plat of College Hill Park according to the Plat thereof on file and of record
in the office of the County Clerk of Lane County, Oregon, thereupon the following
resolution was unanimously adopted by the common council to-wit:

Be it Resolved by the Common Council of the City of Eugene that in
Consideration of F. C. ~alters and Sadie D. Walters deeding said
property to the City of Eugene, absolutely and unqualifiedly, that
the City of Eugene hereby directs the City Recorder and Mayor to
enter into an agreement of option with the said F. C. ~alters and
Sadie D. Walters with regard to
Lot 3, and the East 15 feet of Lot 4, Plock 1,
Re-Plat of College Hill Park according to the
Plat thereof on file and of record in the office
of the County Clerk of Lane County, Oregon.
granting them until June 1, 1937, the right to purchase said property
at the price set opposite the same in the contract of option, together
with interest thereon from this date until said option is exercised,
and in case said option is not exercised before June 8, 1937, said

City of Eugene, absolutely and unqualifiedly, and in consideration of
the payment to the City of Eugene by the said Netta Kress Pennington of

I Councilman Carlson pointed out that the only difference between the present
ordinance and the proposed ordinance providing for five appointive members of the
Park Board, from whom a Chairman shall be chosen annually by the members was that
instead of the retiring mayor being the chairman of the commission, the commission
which would consist of five members would select one of their members with the
23 recommendation to the mayor for his or her appointment as chairman. The wording of
the ordinance might possibly be interpreted that it would be solely up to the mayor
to appoint the particular person recommended by the commission, so Mr. C~rlson sug-
1gested that this ordinance be held until the next meeting before passing on the
same and it was so ordered.
Ordinance adopting the system of civil service now in force in the city of
Eugene for paid fire-fighters, as a system of civil service for the policement of
the city of Eugene was presented. The ordinance merely provided that the policemen
would also be included under the ordinance passed previously for the firemen. It
passed its second reeding by unanimous consent of the council and under suspension
of the rules. Durins the third reading, councilman Reid objected, stating that he
felt' this.suggestion deserved more consider~tion and be placed in the hands of the
committee for further study. After considerable discussion and when it was moved
that the rules be suspended for the third reading and no adverse vote being had, the
ayes and nays were called, all present voting aye, except Councilman Reid who ans-
Iwered "not voting". Question then arose as to whether or not the ordinance was
24 passed and the council determined if the city attorney ruled that the ordinance was
not passed properly, then it would be held for its third and final reading at the
next meeting, otherwise said ordinance would be in full force and effect. No dis-
senting of vote arpearing, as to the passing of said ordinance to its second and
third reading in the night of its first initiation in spite of the fact that Council
man Reid did not:vote, said ordinance is considered in full force and effect and
numbered 8475.
The Recorder presented the offer from G. ~. Van Winkle for the purctlase of
251 Lot 6, Block 2, Tiff's,Plat in the amount of ;~IO.OO and the council unanimously
I rejected the offer.
The Recorder presented complaint concerning smoke nuisance at the \oi.uality
26 Laundry on 10th between ~illamette and Olive and this was referred to the City
Attorney.

The Wity Engineer recommended that the city of Eugene purchase an aerial illap
of the city of ~ugene for the sum of $25.00 and it was moved and seconded that this

Councilman Zumwalt nresented the problem of eliminating an unsightly conditio
on West 8th Street between Olive and vharnelton Streets on property that belongs to
281the Dunn estate. After considerable discussion the questio~ was turned over to the
city attorney who is to contact Mrs. Dyott to see that it is properly removed and
the sidewalk be properly repaired.

position to the council for the wiaving of interest on an.assess~e~t as a result of
a gentleman's agreement between himself and some former ,~Ity of~lclal and this was
29 referred to the Judiciary Committee, City t'.ttorney and CIty EngIneer. The property
in question is Part of Lot 8, Block 8, Bladden's Third Addition.
~ Councilman Bond then reported on the matter that had been referred to the Fire
~]J and Water Committee for watering of the i;?kinner Butte Memorial Park, stating that th
';:-4 committee had met with Mr. McArthur, Superintendent of the Eugene I','ater Board and th t
Ge the T;"'ater Board had agreed to lay an extension to the pipe now on the south side of
the Dutte and to install an auxiliary motor which would furnish enough pressure to
water all of the plants SUfficiently. The Water Board intimated'that the cost ofsu h
an extension would total approximately $600.00 and before they would go ahead, they
wished an expression from the council that in the future there will be a sum suf'-
ficient in the budget of the city to properly care for the irrigation and the gener 1
care of the plants. Councilman Lamb pointed out that it would require extra help
( but in his estimation this assurance should be given. In the discussion that fo1-
?1, lowed among the counc ilmen, it deve loped that it might be possi bl e ,for the Superin-
tendent of Parks, Mr. Sullivan, to use VVPA help. Mr. Sullivan reported that at the
!present time he had two men working, but he had been ordered by the Park Board to
complete a wall before doing anything else and therefore the men were not available
for watering and caring for the plants. Mr. Carlson suggested that this matter
be taken up with the Board and he was positive that it could be satisfactorily
handled. Motion was made and seconded that the proposal of the ~:~ter board be ac-
cepted on the condition that the Park Board guarantee that the help necessary for th
proper care of the park be had and it was so ordered.
