'I'he City Recorder presented the minutes of the ad journed meeting of June; 22nd and no ob j ec.tions appear lng the same were ordered filed. Mr. Coldren asked the council for permission to move a barn now located in the r.ear of the Oregon .Hotel to the property line of the same lot, agreeing to shingle 1 and paint the same. Upon motion made and seconded it was ordered that Mr. Coldren be granted this permission under the supervision of the Building Inspecto~. .... The Finance Committee, by Chairman Hendershott, presented the following bills to the Council with a recommendation that they be allowed and motion was made and .... seconded that warrants be drawn for the same. Wentworth, Treasurer 1.50 Central Heating Company 3.48 Standard Oil Company of Calif. 284.20 - The Fire and Water Committee, by Chairman Bond, reporting on the petition - seeking removal of the used ca~ lot located on west Broadway west of Charnelton, stated that he had called upon Fire Chief Nusbaum to inspect the premises and the Chief had reported the existence of approximately one foot of saw dust covering the entire lot and in addition many individual piles scattered throughout the place. Due to the sawdust becoming saturated with oil and grease, it was determined that " 3 this constituted a fire hazard and should be attended to at once. Mr. Calkins stated that nothing could be done t6 prevent the owners from conducting the business but the City is permitted to demand removal of the existing debris. The matter was again referred to the Fire and Water Committee with instructions that Mr. Oaks, , proprietor of the used car lot, be asked to remove all sawdust from the place. Cow~unication from the Board of Appeals recommending reclassification of Lot 3 Block 5, Shelton's First Addition from a Single Family Residence to Light Industrial, 4 at the request of the Manerud-Huntington Fuel Company, was presented and the re- commendation of the board was approved upon motion made and seconded. . Communication from Dean Wayne L. ~orse, dated June 23, 1936, informing the council that he no longer desired to be considered a member of the civil service ..... I 5 commission, was presented before the council, but no action was taken, indicating that his resignation had not been accepted and is still to be considered for the position. Communication from S. M. Calkins, City Attorney, revealed that he had inter- , viewed Lucille Dunn Dyott with respect to the Lot on 8th Avenue West which the -.. 6 council wished cleaned up and Mrs. Dyott informed him that she and her mother had abandoned the property. The City =ttorney was requested to get a deed to the city from the Dyotts. 7 Reports from the Police, Engineer, Fire and Eugene Municipal Ai~ort for opera ti6ns,during the month of June were presented and ordered filed. - Communication, together with a diagram, was presented from 1. E. Al1umbaugh, petitioning the council to take over the sewer line from the back of his residence "- 8 at 1260 Patterson Street in the alley between Patterson and Ferry Streets to the 12th Street main sewer. The matter was referred to the Sewer Committee, City En- gineer and City Attorney. .. Petition from the Eugene Realty board requesting the council to set the exam- 9 pIe by having the weeds cut on the lots owned by the City of Eugene, was presented - and ordered filed. Mr. Harry F. Johnson addressed the council on behalf' of a petition decrying the methods pursued by the State Milk Control Board, pointing out the needy condi- tions existing in many families and asked that as many of the restrictions concern- "'- ing the keeping of cows within the city limits be waived except those necessary to maintain sanitary conditions. He also stated that he believed $10.00 per year as a license fee for the maintenance of a single cow was too great. The recorder 10 pointed out that the license per cow for one year was $1.00. Mr. Reese, addressing the council, asked the members to register strenuous objections to the State Milk I Board in regard to the raise in milk prices. At this time Mayor Large arrived and I took the chair. The entire matter was ordered indefinitely tabled on the basis that I the Health Board should have been presented with these problems prior to its pre- sentation to the council. Petition for paving an alley between Potter and University Streets from Nine- teenth to Twentieth Avenues was presented to the council. ~he City Recorder was - instructed to write Mr. W. o. Swan, explaining that the city is unable to get bids for jobs so small that they can not be bonded and that contractors as a rule do not 11 accept warrants for payment of the same. It was decided that if the parties desir- ing the paving of the alley, would secure the necessary payments in full for the job to be done, the council would be glad to take the responsibility of supervision. 12 Statement from W. The work was reported as acceptable; therefore Councilman Hendershott moved and motion was seconded that this amount be included 12 in the regular June bills and a warrant be drawn for payment of the same. An Ordinance amending Section 3 of Ordinance No.. 8469 enti tIed "An Ordinance providing a system of Civil Service for paid firefighters, in the City of Eugene.", which ordinance was passed by the Common Council on the 13th day of April, 1936, and approved by the Mayor on the 20th day of April, 1936, had its second reading and " 13 passed to its third by title by unanimous consent under suspension of the rule and was placed on its final passage. The ayes and nays were called. Councilmen voting aye, six; nay, none; absent, Simon and Harris. The Ordinance was declared passed and numbered 8477. An Ordinance amending Section 1 of Ordinance'No. 662 of the City of Eugene, passed March 26, 1907, and approved March 29, 1907, providing for five appointive 14, members of the Park Board, from whom a Chairman shall be chosen annually by the mem- - Ibers thereoC passed its third reading and was placed on its final passage. The ayes and nays were called; councilmen voting aye, six, nay, none, absent, Simon and Har- .' ris. The Ordinance was declared passed and numbered 8478. Communication from H. G. Openshaw, offering the city $300.00 for property 10- 15 cated on 27th and Columbia, was presented. Inasmuch as the city does not possess the" property in question, it was determined that Mr. Bond or Mr. Openshaw contact Mr. w. ~'. Reed who it is believed might deed the same to the city. The City Recordep presented to the council the various pieces of property on 16' which the city must pay taxes to Lane County prior to July 27, 1936 in order to protect its own interest. After a great deal of discussion, the matter was placed -- in the hands of the Finance Committee and City Engineer with power to act as they see fit in the securing of an appraisal of the same. An Ordinance reclassifying Lot 3, Block 5, Shelton's First Addition to Eugene, on the Zoning Ordinance map of said city was read the first time and passed its se- 17 cond and third readings by title by unanimous consent under suspension of the rule - and was placed on its final passage. The ayes and nays were called, councilmen voting aye, six; nay, none, absent Simon and Harris. The Ordinance was declared I passed and numbered 8479. An Ordinance amending Sections 3 and 9 of Ordinance No. 8425 of the City of Eugene, entitled "An Ordinance to license, tax and regulate certain games and mech- anical devices used therein; and declaring an emergency.", passed by the Common Council May 29, 1935, and approved by the Mayor June 4, 1935, had its first reading - and passed its second and third readings by title by unanimous consent under sus- pension of the rule. Consid~rable di~cussion was had at this time as to whether or not the city should ask for $5.00 or $4.00 per month and whether the 10-ball Pin an Ball and Digger machines should be taxed under the same classification. It was felt that $2.00 per month would be sufficient. The question finally came to a vote. I Councilmen voting aye, four; nay, Reid and Zumwalt, absent, Simon and Harris. It wa l~ pointed out by the City Attorney that due to the fact that there had been a dis- , senting vote at the night of its inception, the emergency clause would not be ef- I fective until after the expiration of thirty days. Councilman Reid moved that re- consideration be had and Zumwalt moved that it be seconded and the motion was car- ried. The' proposed ordinance was placed on its final passage. The ayes and nays were called, councilmen voting aye, six; nay, none; absent Simon and Harris. The . Ordinance was declared passed and numbered 8480. '~ I Rebonding application of Mrs. W. C. Hall, $281.79 was presented and ordered 19 accepted. Application of Mr. Wintermeier which was a qualified application was ~ referred to the City attorney. I At this time the City Recorder presented the audit of Mr. C. A. Horton, Ae- countant of the city books for the year 1935, reading sections under Comments and I Recommendations, attention was called to the depletion of the Improvement Bond Sink- I ing Fund and the same was referred to the Finance Committee who was instructed to " I confer with Mr. Horton to clarify the exact situation. The recommendation that the Treasurer deposit each day's receipts intact upon motion made and seconded was un- animously approved. The recommendation concerning the proper operation of the re- volving fund was unanimously approved. Paragraph concerning the payment of coupons in Eugene that are payable in New York was presented and the same referred to the I 2 , Finance Committee to discuss with Mr. Horton. Recommendation that the Milk and Meat I Inspecto~ issue receipts for all collections and turn over the funds monthly was ap- proved. It was unanimously approved by members of the council that a joint meeting be held between the Eugene Water Board and the Common Council to settle definitely the question of the long delinquent $80,814.65 in general fund warrants and excess appraisal value. Mayor Large being instructed to set the day for the meeting, sig- nified July 20th as the date unless otherwise notified. I RESOLUTION .~'-' :.~ WHEREAS, the City of Eugene has been notified of an allocation of ,s;p ::. public moneys to be expended in the acquisition of property and - the erection of additional postoffice building facilities, and WHEREAS, it is found necessary that a portion of an alley shall I be appropriated to said use and the persons owning property ab- utting upon said alley are the Federal government occupying the I present postoffice property, and F. L. Chambers owning and occupy- . ing a lot which is to be also appropriated for the erection of 0 I said structure, and I WHEREAS, it is necessary that a vacation be had of that portion of the alley to be utilized for said post office building~ Therefore BE IT RESOLVED By the Common Council of the City of Eugene, that a hearing ,is hereby called to be held in the Council Chambers in the City Hall in the City of Eugene on the 24th day of August, 1~36~ at 7:30 o'clock P. M.. at which time there will be presented I for passage an ordinance vacating the alley running East and West I through Block 3 of Skinnerfs Donation in Eugene, Lane County, I Oregon, insofar as the same abuts upon and lies between Lots 4 and 5 of said Block 3. And the City Recorder be and he is hereby directed to publish a notice in the Eugene Register-Guard, which is hereby designated as the city official newspaper for such purpose, once each week for four successive weeks, and to post three of such notices in the most public places in said city. . Such notice shall describe the alley sought to be vacated giving the date of this Resolution and the fact that it was submitted by the Common Council, together with a statement that any objections or remonstrances made in writing and filed with the City Recorder prior to the time of the hearing will be he~rd and considered, and the Recorder is further directed to cause to be posted at each end of the proposed alley vacation a copy of said notice which shall be headsd "Notice of Street Vacation". The notice shall be I published in five consecutively weekly issues of said newspaper, and the costs of the publication shall be defrayed by the City. Councilman Bond brought up the subject of condemnation of barns located . 30 I between 3rd and 4th and Jackson and Van Buren. Upon motion made, seconded and carried, the Mayor was authorized to con- fer with Mr. John Fields, Deputy Recorder, to select the proper man to handle the 31 lien dockets when consolidation of offices becomes effective._ Recommendation from the Treasurer~s Office that the practice of taking -.... 32 property descriptions over the telephone and reporting the information inquired about be discontinued, was presented and upon motion made and seconded it was so I ordered., The recommendation in full appears as follows~ I "The Council believes that the practice of taking property I descriptions over the telephone and then reporting back I over the telephone the condition of the liens against these descriptions is detrimental to the best interest of the CIty and orders that this practice be discontinued. I The records of the City Liens are always open to the public and the City stands ready to help in furnishing any information that may be desired. Where it is neces- sary to in order to file deeds for record at the Court House the ~ity is willing to furnish signed statements as to the condition of the liens against any particular piece of property, but other than that parties wanting informa- tion regarding city liens will be required to get the in- formation,from the City Records. It is also ordered that where different segregations of -- liens as they now stand are wanted that the party desiring this information leave a signed statement, on blanks that will be furnished by the City. In this way there will be no misunderstanding as to the proper description for the segregation." 33 Resolution was presented providing the consolidation of the treasurer's, --.... . Engineer's and Recorder's offices as follows; and the same upon motion seconded was adopted: RESOLUTION WHEREAS, The arrangement of the city offices is not conducive to a coordination of their respective activities in such a manner as to render to the city the most efficient and economi- cal service, Therefore BE IT RESOLVED by the Common Council of the City of Bugene that I the Building Inspector's Office be and it is hereby ordered to carry forward to completion the proposed alteration as shown by the plans and specifications of the building inspector, in such a manner that the office of the Recorder, City Treasurer and City Engineer shall be aligned in one general office composed of . the present Recorder's office the Council Chambers and the City , ....
