COUNCIL CHAMBERS, EUGENE, OREGON August 10, 1936 I The minutes of the r'egular meeting of the common council held at the hour of ;~ 7:30 o'clock, P.. M.., August 10" 1936. Council was called to order by Mayor Large '':~ with all councilmen present except Simon and Zumwalt.. "w Gordon Wells spoke regarding Ethel Etter injured on the swing in Hendrick's 1 Park and this matter was referred to the Judiciary Committee, City Attorney to ~ consult with Mr. Wells regarding the case. <,\- ," '. ....._.w Mr. Wells also asked for an ordinance giving the Terminal Taxi Company sole _.'.. 2 privilege of operating taxicabs in the city of Eugene. 'L'his matter was referred ""- to the Judiciary Committee and City Attorney. City Attorney Calkins and JUdge E. O. _Potter, members of the Planning Commissio , 3 explained a proposed change of zoning system at 11th and Mill Streets and asked if there were any protests from the council regarding the same. After some discussion, ""- the Planning Oommission said they would report later in the evening to the council. .. Mr. C. A. Wintermeier, local attorney, spoke regarding his assessments on Lot 7, Block 8, Hollenbeck's Addition. He claimed that his assessment for paving 17th 4 Street was not against this lot at the time he purchased it and asked that the in- _ terest on the assessment be changed so as to start at the time the Reassessment Ordinance was passed instead of the time when the Imprbvement was m~de. This re- quest was denied by the council. Percy Patterson addressed the council concerning a trade for certain lots that he wished to make with the council. He offered all the lots in Block 6, except ~ 5 Lot 7; Lot 3 in Block 5; 2 lots in Block 2 and all of Lot 4 in Block 1, and 9-10 in Bloc.k 3 if the counci 1 would cancel his af1sessment on Lot 8 in Block 3., This me t- ter was referred to the Judiciary Committee and City Attorney. I Councilman Hendershott of the Finance Committee, presented the bills for the 6 I month of July with a recommendation that warrants be drawn for the same. This was referred to the , Fire and rater Committee to report at the next council meeting. /~ Dr. Harris of the Health Committee, spoke regarding the new county health unit that Dr. Stricker had recommended and which had been adopted by the County. 8 \ This new Health Unite consists of seven members. After .some discussion, it was 'decided to refer this matter to the Health Committee and the Recorder was instructed to ask Dr. Johnson to attend the next council meeting and explain the situation fur- l i ther. I I Councilman Hendershott requested that the council keep in mind the needs of 9 II the Playground Commission when they are disposing of property owned by the city and if there are any of these pieces of property that would be suitable for playground . 'luse that they be kept for that purpose. He also spoke regarding the Swimming Pool . which had been considered for the last four or five years. He said he though a I[ WP11- grant might be secured to build a natatorium and after some discussion he was instructed to take the matter up with the County Court and see what might be worked ! out with them in regard to plans for the same. He also mentioned the fact that Mrs. I Misfeldt who owns the property in the park back of the Butte would be glad to trade that piece of property to the city for some other piece of property better situated where she might have better access to streets and bus service down town. On motion of .councilman Bond this matter was ordered turned over to the finance committee for consideration. . 10 The Ohief of Police reported that the fire hazard at the Used Car Lot at Broadway west of Charnelton had been eliminated and it was his recommendation that \ the barns located between 3rd and 4~h on Jackson and VanBuren should not be con- demned by the city. On motion the report was adopt ed by the council. I I II Regular reports for the month of July were presented from the Police, Engin- Iljleer, Public Library and Fire Departments and the same were ordered filed. I Reporting on the Texas Compa~'s request for a perm~t to install Ie} 3000 ~;gallon underground gasoline storage tanks, referred from the last meeting, Gouncil- 12,man Bond stated that these tanks had been installed before the application was made I and that the City Engineer had simply doubled the price of the permit and the mat- ter was settled. 131 C~ierof Police Bergman reported favorably on a Hotel License to Mrs. C. A letter from the Eugene Hospital asking for a "quiet zone" around the Hospital was read and the Street and Police Committee were instructed to have signs ordered 15 and placed at the proper places in the vicinity of both the Eugene and Sacred Heart 161 Hospitals.. - A letter, by Wm. G. White, requesting application for beer license for the Eagle's Lodge was referred to the Police Committee for further consideration. A,letter from S. J. Bakerr offering a bid of $708.65 for lots 7 and 8 in Block '. 171 11, Hendrick's Addition was rejected by the council. Mary J. Vaughan 166.36 The Recorder reported receiving a letter from Lane County .Clerk, W. B. Dillard, 18 stating that they had received offers on Lot 17, Block 5, Blair Street Addition; North 100 feet of Lot 1, Block 5, Croner's Addition; Lot 59, Foster's Addition; and certain property at the Northwest corner of the intersection of 11th and Almaden -.. Streets~ described in metes and bounds. The matter was -referred to the Finance, City Attorney and City hngineer with power to act. I The bids for floor covering that had been advertised were opened and as there I Was only one sealed bid this being from Rubenstein"s Furniture Co., and one open '" 19 bid from Twin Oaks Builders Supply 00, these bids were considered by the council an ordered rejected.and the Engineer was ordered to have the floor of the council cham bers sanded and finished with varnish or paint. At this time the Planning Commission reported favorably on the change of the ~ zoning at the four corners of intersection at 11th and Mill Streets so as to allow " this property to be used for commercial purposes. This recommendation was adopt ed 20 by the council and the city attorney was directed to draw the property ordinance for this and report to the next council meeting. A request from George York that he be allowed to build a garage at the NE corne of 20th and Onyx Streets within 4~ feet of the lot line was read. The Building Cod 21 requires that the garage be back 16 feet from the lot line. This request was re- ..... I ferred to t~e Board of Appeals to report at the next council meeting. , On motion by Mr. Bond the Recorder was instructed to collect rent for the house . 22 on city owned property and also for a woodyard being maintained on one of the lots. -.. Councilman Lamb spoke regarding the condition of the parking and sidewalk space at the Foundry on 8th and Ferry Streets. He stated that various materials such as 23 wood, iron and boiler parts were kept there continuously and after some discussion --.. the Chief of Police was instructed to see that this place was cleaned at once and s kept. An Ordinance requiring spark arresters and smoke consuming devices upon com- 24 mercial smoke stacks in the City of Eugene was read the first time and laid over. A resolution was passed authorizing the signing of a lease between Ben F. Dorri 25 and the City of Eu~ene for equipment stored in the city's warehouse at 5th and Oliv - Streets. Therefore ~1 . r BE IT RESOLVED by the Common Council of the City of Eugene that upon the payment of the~ack rental now due the city for storage on said equipment, that the Mayor and City Re- I corder be and they are hereby authorized and directed to I enter into a lease for one year with the owner of siid equipment, at a rental of $8.00 per month, payab~e in ad- I vance. . At this time Councilman Hendershott was excused. " ~ Councilman Bond reported that a few minutes after Mr. Arthur F. Richards had imade his payment on the city lot at 3rd and Lincoln, he discovered that what he 2611 thought was the street on the south was property- that belonged to the S. P. Railroad I] Company and that the building code for this district req~ired that the building be 'r set back 8 feet fr~m the property line on both the north and south side of this lot. Mr. Richards said that this did not leave him sPace enough to erect the building I ~e had pl~nned on and on motion it was voted to allow him to set back his building on the north side of the lot only four feet from the lot line. Councilman Bond referred to papers being scattered on Broadway between Willa- mette and Oak Streets and said the condition of the pavement was such that this 271! paper stuck to it and made it very unsightly 'especially to tourists. No one seemed ,.) to know where the paper was coming from and the' matter wasreferred to the Chairman ii of the Police and Street Department to look into the matter and see that it is stopp d. I " 'I I, Councilman Harris brought up the matter of the third member to serve on the :1 ',: Civil Service Commission for the fire and police departments. After some discussion i;Councilman Harris placed for nomination the names of Harry B. Ruth, William East and II Dr. James D. Barnett, Head of Political Science, University of Oregon and Councilman 28)\ Bond nominated Clyde Johnson for the position. On motion Dr. Barnett's name was ! ordered voted on and Councilman Lamb, Reid and Harris voted aye; Carlson and Bond, il naye; Councilman Carlson later changed his nay vote to aye and Barnett was elected.
