Counc i 1 was call, ed to order by Mayor~ ~1 Large, with all councilmen present except Reid and Simon. Minutes of regular meeting of September 14th were read and approved. Attorney E. O. Potter, defending his client, Joseph Vogl, asked for cancel- \ 1 1ation of sewer assessment against the following described property: The West 50 feet of the following descripti~n: I Beginning at a point 60 feet North of the point where the 'west line of Lawrence Street intersects the North line of 19th Street, and running thence West 150 feet, thence North 60 feet, thence East 150 feet, thence South 6Q feet, to the place of beginning in the City of Eugene, Oregon. tt It was pointed, out that an abstract of title had been prepared by the Lane County - Abstract Company and it had been reported QY the City Treasurer that there were no city liens against the property. 'rhe matter was referred, to the Judiciary Com- mittee, City Attorney and City Engineer for adjustment. Mr. H. W. Petrick's request for amendment of the zoning ordinance to allow construction of a retail lumber and shingle business on property described as Lot 9, Block 1, Pairmount Amended Addition, was referred to the Board o~ Appeals __ 2 with the understanding that if prior to the next meeting of the council the Board of Appeals makes a recommendaotion for adoption of this request., that Mr.. Petrick could proceed without formal acceptance by the council. Upon motion made and seconded, it was so ordered. I co~man Harris, chairman of the Judiciary Committee, reporting on the I J. W. Maltman request, recommende~waiver of interest. The Judiciary Committee 3 also acted favorably on the T. A. Stivers' request, recommending waiver of five "- per cent penalty and extra amount of interest on certificate of foreclosure., I Upon motion made and seconded, report of the Judiciary Committee was adopted. vCity Attorney Calkins asked for further time in considering the request of the Southern. Pacific Railroad Company. Councilman Hendershott, chairman of the Finance Committee, requested the city recorder to present to the council the various offers for city property, and they were presented as follows: v Offer of $750.00 by D. :Jr: Mains for property "Beginning at a point _ 255.5 feet south of the southeast corner of Lot Nine in Huddleston's Addition to Eugene, run thence 48 feet south, thence 66 f~t, thence 66 feet to the place of beginning" was rejected. Mr.. Raymond H. Fawver's offer of $919.00, $100.0U down and $10.00 per month fo~ the same property was ~n motion made and seconded, accepted. The sum of $500.00 cash by Irvin D. Custer for Lot 17, Block 5 ~ Blair Street Addi tion, was re jected. The, Recorde.r was ~struc ted to collect $15..00 per month rent for said premises. O~r of Claude Loper for Lot 6, Block 2, Tiff's Plat was acce~ed. Mrs. Ida M. Stough'S bid for the same property was rejected. Lynn F. McDonald's offer of'$550.00 for lot 4, block 2~ West 6th Street Addition was upon motion made and seconded, rejected. Upon motion 41 made and seconded, city recorder was instructed to collect $10.00 rent per month . for the same. Offers for lots 7 and 8, block 11, Hendrick's Amended Addition were 4 three in number, as follows: Kieth Fennell, $1000; W. H. Goddard, $1000; and Frank J. Anderson, $1000. All were rejected. The recorder was instructed to col- lect $15.00 rent for the property. Offer of Dr. Wm. H. Dale for lots 5 a~6, Gross Addition was upon motion made and, seconded, rejected. Kathryn Barney's offer of $300 for lot 2,Block 6~ R. F. Scott's Addition was referred to the Finane Committee. Further time was granted councilman Sam Bond, chairman of the Fire and Water , 5 Committee, for removal of lamp standard in front of the Rex Theatre. At this time Mayor Large reported that on Sunday, the 27th of this month, he had received a long-distance telephone call from Governor Martin, in Salem, asking the city of Eugene for cooperation in the present fire emergency on the coas ;1' by sending any possible available equipment to the scene of the disaster. Mayor Large's failure to contact councilman Bond, chairman of the Fire and Water Com- 6 I mi ttee, dis cussed the matter wi th councilman Lamb and it was determined that they should send one of the service trucks. The truck is now stationed at Coquille. Upon motion made and seconded, the council extended unanimous approval to the Mayor for his action. Counci Iman Zumwal t, chai rman of the Health Comml tte.e, moved that 2000 feet of 3 ,x 12 lumber at $10.00, per M be purchased from Joe Johnson for use at the 7 City Dump Grounds and it was so ordered. . In regard to condemnation of house at 19th and Orchard Streets, Councilman ~ Zumwalt, upon investigation, recommended dismantling of the building. However, 8 before condemnation papers are served, city attorney Calkins is to determine whethe condemnation can be effected without the actual proceedings. I t.,..,...' .,.- Councilman Zumwalt reported that the Telephone Company was willing to place ~ f9 a toll telephone in the Rest Cottage and pay the city 15% of the monthly receipts. C:jl Upon motion made and seconded, Mr. Zumwalt was given permission to act,in whatever {..:; way he thought best. ,--. '-'~ Mayor Large stated that he had been requested by a number of people to station a traffic-control officer at the intersections of Willamette Street and '-- 10 Broadway between the hours of 5 P. M. and 6 P. M. and the council agreed that such action should be taken. Letter from Mr. O. A. Prince protesting paving assessment in the sum of $189.58 and interest amounting to $72.62. .on property deseri bed as: "West 60 feet of the following described property: Beginning at a point l44~ teet south of the in- tersection of the west .line of Pearl Street with the south line of third street, ~ Eugene, running thence south along the west line of Pearl Street 114 feet; thence 3' North 81 degrees 30l west 140 feet; thence north to the south line of the E. H. Mc- 11 Allister tract; thence east 140 feet to the pIece of beginning," was referred to the Judiciary Committee, City Attorney and City Engineer. Complainant asserts that this is the first notice he had received indicating that there was any assessment ag~~nst the property and asks for waiver of the interest. . Letter from Mrs. William Mills asking for extension of time for payment of ~ principal, $338.22 and interest in the sum of $182.63 on the 30 feet of the north- 12 east corner of lot 1, block 1, Chamber's Addition to Eugene, was referred to the Judiciary Committee, City Attorney and City Engineer. Request of Dr. Fred N. Miller for the spreading of gravel on a road construe ~ ted at his own expense was brought before the council in the form of a communicatio . Councilman Lamb moved that the city offer to haul and spread any and all gravel tha 13 Dr. Miller might purchase for the iffiprovement of the road. It being understood tha Dr. Miller is to make all arrangements for purchase of thegravel and ~he city is to only haul and spread. This motion was seconded and the Recorder was requested I to inform Dr. Miller of the council's action.' .. I Application from Robert Burns and Howard Tuttle for license to operate a ~ i taxi-cab service in the city of Eugene, was presented and councilman Bond requested 14 an additional two weeks for definite consideration. \' Recommendation of the Board of Appeals to issue a permit to Mr. and Mrs. ~ 151 George Turnbull for the erection of a duplex residence at 1536 Thfrteenth Avenue East, being in an R-l district, was sustained by the council. . I Refusal to accept the request of Leroy Woods for reclassification of distric ~ from University Street to Moss Street and between Thirteenth and Fifteenth Avenues 16 I as an R-2 district by the Board of Appeals, was not altered by the council. . The council accepted the Board of Appeal's refusal to grant a,permit to E. -- J. Iddings to erect an addition.to his garage at 643 Oak Street, this location bein 17 in Fire Zone 2 and situated among apartments. II Al Stien of st ien Brothers , appeared before the Board with the plans and . II specifications for ,a dormi tory addition to the bacred Heart Hospi tal, the stair '-- i details of which do not conform ,to the Building Code. After agreeing to make some 18 II changes in the stair details ,the Board would recommend to the counci 1 that the ij permit be granted. The council made no rejections to the action made by the Board I of Appeals. I Resolution from the Eugene water Board declaring that the accounts between I the water Board and the City be deemed settled and closed, was presented as follows: -- I RES 0 L UTI 0 N - y , - WHEREAS, a claim has been submitted to the Eugene Water Board for certain sums claimed to be due the City of Eugene, one item of said claim being for $57.970.98, arising out of the construction of a power plant by the City Council before the organization of the I Eugene water Board, and the other item of $22,.843.67 arising out of an appraisal of the Skinner Butte Park property, together with in- I terest thereon for many years, and I! . ". ,. . .--_. ---- -- - - --' ---------- -~--- - - - -- -- -- .-_. - - - - - -- - - -- - -, , ,- - - - - _. --- - --- '. - -- ~---_._---- _. -- . ... ~ ~- .. . ---- ___n _ - WHEREAS, the Common Council has by resolution duly adopted on September 14, 1936, declared that it believes that both claims I are stale, and that the~e has been mutually reciprocal and helpful relations between the City of Eugene Proper and its Ul Water Board during all the years, and that it is neither de- ~ sirable nor just that they should be ruptured or endangered by .....j these claims, some of which are twenty-five years old, and :.:,/ J WHEREAS, the Common Council, by resolution, as above stated, has - - declared that its claims, be and are thereby withdrawn, with the understanding that the Water Board shall likewise withdraw its counter-claims, and has by said resolution declared that the accounts between the Water Board and the City are deemed settled and closed, and that the usual helpful and reciprocal relations ~ between the Council and the water B08,rd shall, continue as her.e- tofore. NOW THEREFORE, be it resolved by the Eugene Water Board~ in special session held this 25th day of September, 1936, that it . fully concurrs in and approves the Common Council's resolution above referred to, and hereby agrees that its above named counter- f claim is hereby withdrawn, and that both City claim and water Board counter-claim are therefore deemed settled and closed. . Durkee, Driggs' cafe, 453 WillametteStreet, was referred I 21 to the Police Committee for approval or r~jection. I ~ '", Resolution and contract permitting Mr. ~. M. Murray to erect a building up - to the property line of 11th street with a provision that at any time the city of 22 Eugene shall widen 11th street that the building shall be dismantled back seven, /, feet and that no damages shall be claimed by Mr. Murray or his successors in in- terest, except for the land taken, was read and upon motion made and seconded, I approved. Resolution reads as flollows: RES 0 L UTI 0 N The Mayor and City hecorder of the City of ~ugene be and they are hereby authorized and directed to enter into an agreement with J. M. Murray respecting the East 80 feet of Lots 2 and 3, Block 18, MUlligan's Addition to Eugene, Oregon, permitting the said J. M. Murray to erect a building up to the property line of 11th street, ,. with a provision that at any time the city of Eugene shall widen 11th ~treet that the building shall be dismantled back for seven feet, and that no damages Shall be claimed by said J. M. Frederick & Marvel Krogh 68.74 Question was brought up by councilman Bond in regard to receiving a franch,ise from the Oregon Electric Railway Company. Since it was pointed out that the Oregon '.......... I 24 Electric would be unable to pay anything in the form of a franchise, that the best policy would be to hold them without one and in the meantime if we wished, we could use that as a means to secure whatever the city thought proper. City Engineer Club was instructed to contact the officials of the Oregon-Electric Railroad Company r and to make definite arrangements with them for the proper repair of Fifth Street.
