M., October 13, 1936. Council was called to order by Mayor ~~ Large; all councilmen were present except olmon, Zumwalt, and Carlson. Minutes of meeting of oeptember 28th were presented and as there were no objections, they were ordered filed as read. Mr. Whitten ~wafford, defending his clients Anthony and Florence H: Van Lydegraf, offered as a matter of compromise the sum of $64.89, principal and what- ever penalties lawfully accrued in settlement of sidewalk claim against the ~ 50 h~ feet, lots 12 and 13, Block 11, Fairmount. The matter was referred to the Judiciar (11 Committee and City Attorney for study. Mrs. William Pierce, 1257 Adams Street, addressed the council, asking that I assessments made on certain property that she owned be transferred to property she acquired. It was explained that such steps could not be taken as the city charter ~ provides that assessments be made against the property and not the individual. It ~ / was moved by Councilman Lamb and seconded by Hendershott that the request be denied 2 and it was so ordered. City Attorney Calkins stated that the present segregation ordinance should be repealed and a new one prepared which would leave to the judgment of the coun- cil as to whether or not certain proposed segregations should be allowed. Mr. Cal- 3 kins will present the ordinance at tbe next meeting. Judiciary Committee by Chairman Harris recommended denial of the Joseph Vogl request and the O. A. Prince request brought up for discussion at the former / meeting. The Mrs. William Mills' request for additional time for payment of assess ments, was granted. It was moved and seconded that the recommendation of the 4 Judiciary Committee be approved and it was so ordered. Finance Committee presented letters, written by Lane County Clerk, ~. B. Dillard on hUgust 8th, notifying the city that they had received offers on the fol- II low ing descr i bed properties: Lot 17, Block 5, Blair Street Addi tion; North 100 I [II feet of Lot 1, Block 5, Croner's Addition; Lot 59, Foster's Addition; N. W. corner I of the intersection of 11th and Almaden Streets. On August 25th the city tendered ,I the county a check for t80.46 this amount being the exact sum of taxes for which I! the county had foreclosed the liens~ but the county had not issued the deeds. Mr. I Calkins ruled that the entire amount of taxes would have to be paid in order to get II tpe deeds. Councilman Hendershott suggested that since the sum of $89.46 had been I paid that the recorder be instructed to draw a warrant for the difference, which \ amounts to $307..14 in order that we may get the deeds to the property. Hendershott s j I motion was seconded, and the ayes and nays were called, councilmen voting aye, five 5 J nay, none; absent, Simon, Zumwalt and Carlson. Ii Ii At the request of Councilman Hendershott, the recorder presented the follow ing offers on lots 7 and 8, block 11, Eugene Hendrick's Amended Addition, located at the Northwest corner of the intersection of 17th and Charnel ton streets: / Kieth Fennell, $1240.02; E. C. O'Neeland J. M. Hall, $1350.00; John J. Rogers, ! $1243.10. Upon motion made and seconded the offer of E. C. O'Neel and J. M. Hall 6 , was ac'cepted. ,. II -~ , Councilman Hendershott made the motion that the city call the balance of tt. - Funding Bonds due, namely, the sum of $78,650.00 and that the General Bond Sinking 7 1 Fund be used for payment of the same. The motion was seconded and it was so ordere . II I Councilman Hendershott, chairman of the Finance Committee, reported the following bills to the council with a recommendation that they be allowed and II motion was made, seconded and carried that warrants be drawn for the saine. Barney for Lot 2, Block 6, R. F. Scott's =ddition, / in the amount of $300.00, was duly seconded, and the matter placed in the hands 9 of the city appraisal committee to determine the value of the property. Chairman Lamb of the street Committee made a motion that truck traff.ic be re-routed. fhe new route from the south would follow by way of Franklin Boulevard at the intersection of 8th street, west on 8th to Pearl street, thence north on ./ Pearl street to 5th and west on 5th to the junction of the Pacific Highway north. 10 This motion was se~onded and approved. . Councilman Lamb also suggested that the managers of the local bus service I be contacted and mention of re-routing their downtown route be made, so that the ! busses would operate on Olive and Oak Streets rather than on Willamette street. / This was referred to the Police Committee, Street Committee and City Engineer and f 11 I they are to make the necessary investigation. Fire and 'fiater Commi ttee by chairman Bond requested installation of S.treet I light at 22nd and Hilyard streets and the removal of lamp standard in front of Rex Theatre, the cost of the removal to be borne by Mr. McDonald. It was moved and ./ seconded that the recommendations of the Fire and Water Committee be adopted and it 12 was so ordered. Councilman Bond, acting chairman of the Police Committee, recommended trans- / fer of retail beer license and package store class "AU license of Brigg's and Peck's I Cafe. Upon motion made and seconded, recommendation of Police Committee was ap- 13 proved. Councilman Bond stated that he had received a request from Mrs. Eunice A. Studley, 291 West 10th Avenue, for permission to mark off curb with yellow paint in front of her residence so that she might have access to her prop~rty at all hours of the day. In the discussion that followed, it was pointed out that if such a re- J quest were granted to one party, that the city would have to submit to all si~ilar 14 requests. H. w. Petrick's request for reclassification of lot 16, block 7, amended ~'J11 plat of Fairmount addition, referred by the council to the Board o~ A~peals was ",... considered and the Board recommended that the request be denied. lhe council uphel ~ the Board's recommendation. A letter was received from J. H. Bramely asking for a permit to make some alterations in the house at 1101 ~ightb Avenue West and allow him to~move the store 1 which he has been conducting for a number of years from one room to another. The 18 Board recommended that this request be granted. The council made no objections. The council approved the Board's recommendation that the east 43 feet of Lots 1 and 2, Block 1, Lizzie Luckey Addition; lots 9 and_lO Block 3, Whitney's Addition be changed from R-2 to B-2 classification. Mr. .t.. H. Lorence personally ~. appeared before the Board on behalf of the Simmons Motor Company asking for a re- classification of the temporary used car lot on Wlllamette street at 17th ~venue inoorder to erect a commercial building to better accommodate an increase of their 19 business; the plans for any such building to be approved by the Board of Appeals. . " Fred Porter's request for waiver of interest of $16.20 on property des- I cribed as "The west 10.67 feet of the north 106.67 feet of Lot 1, Block 5, Camp- Jy bell's First Addition. Complainant asserts that he knew nothing about the pre- I tended assessment. The matter was referred to the Judiciary Committee and City 20 Attorney. . .. I . 1 Communication from Lane County =bstract Company, together with check for I $32.60, to cover assessment on the east 60 feet of Lot 1, Block 20, Gross Addition to Eugene, was rejected by the council. Inasmuch as the total sum against the ~ property in question is $39.28, the council, in conformity to its. previous actions, !I felt that the deduction of accrued interest and costs would not be justifiable; 21li hence check for $32.60, payment of principal, was. not accepted. I . Reports for the.month of September were received from the polia~ Department Library, Lane County Health Unit and City .t.ngineer. Upon presentation to the c~n- 22 cil and approved, they were ordered filed. I . City Recorder was instructed to communicate with Perry Price, Juvenile II Officer and request that he submit to the council a monthly report of the activitie 231' of his department. . I If City Recorder requested that the council grant permission for refund of license fee paid by Mr. Burns and Tuttle for the operation of, a taxi cab service I in the city of ~ugene. Due to the fact that the parties are not able to meet 1 certain requirements of the city's ordinance, revocation of the license is re- 24,1 quested. The recorder's request was granted. II City Attorney Calkins stated that he would bring in a written report at the ~ next meeting concerning the ~outhern Pacific Company's request for refund of monies 25~ paid on certain assessments. .-a I Resolution authorizing the Mayor and City Recoraer to make, execute and I deliver to the respective owners of properties along 19th Avenue which the city undertook to widen from 66 feet to 84 feet, and later found it impossible to widen the entire area so that there are certain properties widened to a street width of 84 feet interspersed with other properties not so wide, and for the purpose of con- stituting the remainder of the street east of Patterson Street of a consistent I width, it is necessary that certain 9 foot strips on said street be returned to the I )1 owners so that the properties will all conform, was presented, and upon motion 261 made and seconded, the resolution was duly adopted and deeds to be executed. II II An Ordinance levying assessments for paving the alley running north and A south between Potter -and University Streets from 19th to 20th Streets in the city 27\ of Eugene, Oregon was read the first time and laid over. I An Ordinance providing for the construction of a sewer, as follows: Begin- 1 I ning at the main city sewer lying in the alley between WillametteStreet and Oak Street in the city of Eugene, between 0eventh Avenue and Eighth Avenue, thence to the property herein described, being an eight inch sewer serving the property here- in, all in the city of Eugene, Oregon; and declaring an emergency, was presented for its first reading and passed to its second and third readings under suspension I of the rules by unanimous consent of the council. The ordinance was placed on its JI final passage; the ayes and nays were called, councilmen voting aye, five; nay, non . , ab sen t~, Simon, Zumwalt and Carlson.
