M." December 28" 1936. Mayor Large called the meeting to order; C1 all councilmen were present. ,.,.,.;. The minutes of December' 14, 1936 were presented and ordered filed' as th~re were no corrections appearing. Mr. W. E. Poole, 2477 Kincaid, asked that Alder Street between 24th and 25th and 25th east be graded and put in shape for the winter as the street at present is in almost impassable condition. The matter was referred to the Street Committee. Councilman Lamb stated that the grader was being operated on the east side of the ....1 city and would undoubtedly cover that location before long. Councilman Harris, 'chairman of the Judiciary Committee, recommended acceptance " I of the quitclaim deed offered to the city by Lawrence T. Harris and wife Jennie B. ~" - Harris covering lots 9r 10, and 11, Block 2, Croner's Addition. Upon motion made an ~.....' --, ......2 seconded, the recommendation of the Judiciary Committee was duly approved. It was the recommendation of the Judiciary Committee that upon payment of $21.90 by E. F. Keller on assessments against lot 9, Block 2, Fairmount Addition that the interest from August 4, 1929 be cancelled. Upon motion made and seconded ,3 this was duly approved. Councilman Harris asked that the refund of $2.98 being claimed by Mr. L. F. Wood be granted as it was discovered that Mr. Wood had overpayed the city on assess- I menta covering lot 6r block 2, John Christian's Addition~ Upon motion made, 'seconde /4 and carried the recommendation of the Judiciary Committee was unanimously approved. Dr. Harris reported that in accordance with the request of the council, com- ......5 munication to the widow of Captain Thompson had been mailed. Resolution directing the City Treasurer to cancel claim of $12.33 interest upon the West 100 feet of lot 9, Block 1, Lizzie Luckey Addition which property is I I owned by E. S. Evenson, was presented and upon motion made, seconded and carried / " was duly approved. RES 0 L UTI 0 N WHEREAS, a claim has been made by the City of Eugene for $1..33 which is claimed as interest against the West 100 - feet of Lot 9, Block 1, Lizzie Luckey Addition, for paving Olive Street, and WHEREAS, E. S. Evenson holds a receipt in full, principal and interest, for this identi~al claim, and no claim is made by the City for unpaid prinCipal on the lIen Therefore BE IT RESOLVED by the Common Council of the City of Eugene that the Treasurer be and he is hereby directed to cancel . the claim for $18.33 interest now claimed. I The claim of F. B. Dunn, as reported by Councilman'Harris, was referred to / 7 the Judiciary Commi ttee and Ci ty Attorney for c'onsideration. The $330.00 offer of Mr. G. R. Blair on the east 60 feet of lot 12, Block 20, east 50 feet of south 40 feet of Lot 11, Block 20. all in College Hill Park Additio was rejected and a counter-offer of $600.00 extended to Mr. Blair. Upon motion /8 made and seconded, the recommendation of the Finance Committee was approved. The $500.00 offer of Hobert Campbell for property described as Lot 10; Block , Shelton's 1st Addition was refused and a counter-offer of $1000.00 extended. Upon /9 motion made and seconded, the recommendation of the Finance Committee was approved. Councilman Hendershott, chairman of the Finance Committee, recommended that I the $400.00 offer of Mr. J. D. Campbell for lot n, Block 7, Hollenbeck's Addition /10 be rejected. and a coun,ter-:-offer of $500.00 be extended. Upon motion made, seconded and carried, the recommendation of the Finance Committee was duly accepted. The City Recorder presented a letter from Amy'D. Ziegel in which she tendered her withdrawa~ on the offers she had previously made for Lot 9, Block 1, Hendrick's /11 Amended Addition and Lot 3, Block 4, Hollenbeck's Addition. In discussing the proposal of widening Willamette Street from Eleventh to Seventeenth, Councilman Lamb, Chairman of the street Committee, reported that the lien situation comprising that territory was in very good condition.' Mr. Lamb stated that there would be an added expense to I ,.....- f'Cllthe general tax roll of the city should such an improvement be contemplated due to '~i:~1 the fact that the ci ty owns the properties whereon the Ci ty Hal-I and Public Library [ I are situated. In addi tion the ci ty is responsible for the payment of all inter-- sections. Such an improvement would not only involve paving of all streets but also the curb and sidew~lks because widening of the street would have to be "from the / crown of the present street and in order to secure proper fall the leveling of the 12 prasent curb and sidewalk would have to be changed. Mr. T. C. Bradley asked that an estimate on the proposed project be secured before proceeding with the construction. Hathaway stated that many of the signers of the petition signed jfor the improvement without due consideration of the cost to be entailed but felt (14 I that the great majority ~ere totally in favor of it. il Mr. Frank H. Seal said he had signed the petition and was 100% for the .- !project. At the same time he felt that the city should avail itself of the new !! zoning law which requires set-backs for build ings not less than seven. feet. The, , Ii entire matter was placed in the hands of the Street Committee for further considera- 15 I tion. ' !i Permission was granted ,the Fire & Water Committee, at the request of I ' ~ I Councilman Bond, to purchase two batteries and two tires for the trucks in the 16 I Fire Department. , I I Upon the suggestion of Mayor Large and upon motion made and seconded, the / I Fire and Water Committee was granted power to act with respect to the possible 17 11 purchase of fir'e hose before the end of the year. Ii Councilman Reid, Chairman of the Sewer Committee, reported that the city I was badly in need of a new sewer drag. He stated that the Sewer Department had been using one on trial which they had found completely satisfactory and recom- I Ijmended its purchase. Upon motion made and seconded purchase of the equipment was : duly approved. It was determined that the balance of funds in the budget of the , [I Sewer Department would be used as a payment down and the balance to be paid in the 18 I year 1937. . I !j Councilman Bond, at the request of Dr. Simon, chairman of the Police , II Committee, presented the list of applications for renewal and original beer and 19 Ii wine applications. I Mr. Deburgh pointed out that inasmuch as the council had definitely increased the gran~ing of Class. B License, he felt that the Rainbow and the Club Cigar Vl Store were entitled to theirs. Upon motion made by 'Councilman Hendershott and duly -Q1 seconded that Class B Licenses be granted to Club Cigar Store, Rainbow and Cafe Del . ....:"' ;-,~ ,20 Rey, if the latter wished it, and this motion was carried and approved. . '.." ,-,,:>' Clarence Wilcox, proprietor of the White Palace'Restaurant, asked the council for a Hotel and Restaurant License for his place of business. Upon motion made by Councilman Hendershott and seconded by Lamb the balance of the recommenda- , 21 tions on beer and wine made by the Police Committee, as 'presented, were approved. After due consideration the Police Committee, by acting chairman Bond, re- commended that the police radio be purchased from RCA through the local agency, H. W. White Electric Company. A price of $1750.00 is to be paid with a payment of $750.00 down and $1000 to be paid when the installation is completed and accepted. It is further agreed that the equipment is to be maintained by the. city without \ charge for a period of ninety days after installation. The recommendation of the .. 22 Police Committee was unanimously approved. ~ Councilman Bond recommended that the Police Committee be empowered to pur- chase ~ome badly needed furniture from the emergency fund for the police headquarter . It was discussed whether or not such steps could be taken as they did not believe that this could be considered as an emergency. Attorney Calkins pointed out that the council as a levying body could transfer funds from the emergency fund to the Police account. ,Upon motion made and seconded, funds were ordered transferred ~rom the emergency to the Police fund and the Police Committee empowered to act to the /23 extent of $150.00 and this motion was unanimously approved. M'r s. w. H. Maxham, member of the Park Board, presented a report showing the work done by the WPA in 1936. She reported that Federal Funds amounting to ap- proximately $9,586.00 were spent on the parks during the past year. Councilman Carlson stated that he felt the citizen members of the Park Board deserve exception- al praise for the work thei had accomplished this year. Upon motion made and / 24 seconded, a vote of thanks was extended to the Park Board for th~ir fine services. I At this time discussion was opened by Councilman Bond with respect to Dale Croner's status on the force of the fire department. Mr. Bond stated that he had contacted two members of the Commission for their opinion in regard to amending the ordinance to read three months instead of six months service prior to passage of the civil service ordinance and one commissioner voiced definite disapproval with the other taking no stand at all. Mr. Zumwalt stated that Mr. Croner had visited I him on a number of occasions, and he felt that if the ordinance is amended that in . the future actions of similar nature will have to be taken by the council. Council- man Hendershott stated that the history of the Croner family showed that they were respectable and that steps should be taken to protect his job. Mr. Carlson felt that something should be done if it is within the province of the council to do it. Attorney Calkins pointed out-that the ordinance ,could be amended and made retro- active. Mr. F. J. Reese addressed the council, speaking on behalf of Mr. Croner~ I and pointing out that he was an efficient and qualified worker and should be retaine . He asked the council to do everything in their power to protect him. Mr. Lamb " requested Attorney Calkins to present the proposed ordinance which is an amendment f'" 2 5 to 8469. . An Ordinance amending Section 8 of Ordinance No. 8469 of the City of Eugene entitled "An Ordinance providing a system of Civil Service for paid firefighters in the City of Eugene.t1, passed by the Common Council Apri"l 13, 1936, and approved by the Mayor April 20, 1936, and declaring an emergency, was read the first time and passed to its second and third readings by unanimous consent of the council under suspension of title and was placed upon its final passage. The ayes and nays were called, councilmen voting aye, Lamb, Hendershott, Reid, Simon, 'Zumwalt, Bond, Harris and Carlson; nay, none; absent, none. The ordinance was declared passed and numbere /26 8498. . At this time Mayor Large made the following appointments for position in the fire and police departments, employment effective January 1, 1937~ For the Police Department the following were selected: Leonard Kearney, J. 'S. Willcox and I E. R. Nevers; Fire Depart~ent: C. A. Bradway, J. V. Green~ Robert A. Johnston and w. C. Volz. Upon motion made and seconded, the appointments were approved by the I ../ 27 council. At this time the City Recorder presented a financial statement of the City of Eugene with suggestions as to the future needs. A copy of the report is on file /28 in the office of the City Recorder. The Recorder presented a communication from attorney W. W. Harcombe regard- ing an injury received by a pedestrian in a fall on the bridge crossing the Amazon /29 river on Willamette Street. The matter ~as placed in the hands of the Judiciary Committee and City Attorney .for action. . The Josephine R. The communication was ordered tabled. I Letter from Dr. A. N. Johnson, Health Officer, submitting his formal resig- II nation as Heal th Officer, effective January ~, 1937, was presented and upon motion '331 made and seconded was'accepted. Offer of Mrs. Rose Butler in the amount of $850.00 for all of Lot 6 and 7 in r34 I Block 4, Kelsay's 2nd Addition was presented and referred to the city attorney. . '" I Communication from Elden F. Cross asking for special permission to erect a modern service station on the South 80' of Lot 6 and a portion of Lot 7, Block 12, ~. '35 4 Packard's Addition was presented and ordered tabled. I ' I Petition requestlp.g that the property abutting on Miami Lane be improved by '36 grading and graveling was referr~d to the Street Committee and City Engineer. " Mr. C. A. Horton was given the contract for the annual audit of the City Books at a cost of $364.00. Upon motion made and seconded, it was unanimously ap- proved. One other bid of $400 was submitted by Percy W. Brown. The audit is to be 137 I completed by March 1, 1937. Renewal of the Municipal Airport Contract was referred to the City Attorney ,38 and Judiciary Committee. ,II City Recorder was instructed to call for bids for city's ga~oline needs for 39 I the year 1937; the bids to be opened on January 11, 1937. Resolution authorizing the Mayor and Recorder to enter into an agreement of lease and option with Emma D. In regard to pin and ball machines, City Attorney Calkins stated that the v'1 present state statutes are all that are necessary to protect the machine owners c..rt from the operations of players who are said to cheat the devices, and that the .. ~t ." City Recorder was granted permission to accept the first quarter license fees ...._~ ........45 on Pin and Ball machines. The matter of planting shrubs and trees in parking strips was placed in' the /46- hands of the Park Board. Councilman Zumwalt asked tl;1e council to approve expenditures of money neces- sary to make 11th Street east to west a through street. No action was taken and I 47 the matter was held indefinitely. ~ A change from the use of gas to electricity for the purpose of heating water for the fire department employees was ordered as it was determined that such a /48 change would mean a considerable saving to the city. At this time CG>!J,ncilmen Simon, Zumwalt and Harris expressed their appreciation to the common council for the fine spiri t of cooperati-on experienced by them during 49 their terms of service with the council.
