Mayor Large called .~ present except Mr. Reid. 2 The minutes of the meeting held January 25, 1937 were presented and as there 'were no corrections appearing, they were ordered filed. \ 3 Mr. Wenda 1 Van Loan introduced.to Mayor Large and members of the common council Dr. E. L. Gardner, newly-appointed city and county health officer. Dr. Gardner pre s.en ted a deta i 1 ed report to counci Iman A. C. F'arr ington, chairman of the Heal th Committee, who in turn is to make whatever recommendations that he might deem advisable. \4 City Attorney Calkins, on behalf of the Judiciary Committee, reported concern- ing the claims of the ~outhern Pacific and At~orney H. L. Weinrick, representing several parties, for refunds due on assessments having been paid for paving of Franklin Boulevard. It was pointed out that assessments were mad,e in 1920 and on March 30, 1925 a resolution was passed by the common council granting a 22% .refund for assessments on said improvement. The Judiciary Committee recommended the pas- sage of a resolution cancelling the resolution granting said rBfund. It would merely place the claimants in the position of having to bring suit to establi~h ~hei rigl1t and the city at that time would attempt to show cause why said refund was not due. As city attorney, Mr. Calkins could not now advise the council that it was legal to grant refunds and that the action of 1925 therefore was not right. If said refunds were granted by the council, payment of same would have to be made from a special levy and that, further, if these refunds were granted, the council would undoubtedly be faced with such claims on all other property along said im- p~ovement. Further) any refunds that had been made under said resolution should be re-assessed. At tnis time the Recorder presented a resolution rescinding the former and upon motion made and seconded it was adopted by unanimous consent of the council. RES 0 L UTI 0 N BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF EUGENE, that that certairi resolution passed by the council March 30, 1925, and recorded in Book 7~ Page 578, regarding refunding 22% of the paving cost of Franklin Boulevard, be and the saILe is hereby rescinded, and set asiae ~ and held for naught. 5 At this time Councilman A. A. Reid arrived. City Attorney Calkins presented a sketch of a proposed apartment house and business dwelling to be located at 7th and Lincoln Streets. Mr. J. o. Olsen is contemplating erecting the proposed building. Mr. Calkins pointed out that. this location was not in an industrial zone and Mr. Olsen h3d appealed t~ the Eoard of Appeals and Planning Commission and his appeal had been denied in both instances and that he had been requested to present an ordinance amending certain sections of the original zoning ordinance so as to permit the construction. Considerable discussion followed. It was the opinion of the council that the Olsen request. be. granted. The ordinance was read the first time and passed to its second and third readings by title under suspension of the rule by. unanimous consent of the council and was placed on its final passage. The ayes and nays were called, councilmen voting aye, Lamb, Hendershott, Reid, Eond, Carlson, Hanns, Page and Farrington; nay, none; absent, none. The ordinance was declared passed and numbered 8501. Correction of erroneously segregated assessments on property described as the north 65 feet of lot 10, block 21, Huddleston's Amended Addition, o0ned by Isaac and" Jessie Park, was recommended by the Judiciary. Committee. ' Upon motion made and /7 seconded the recommendation was unani~ously approved. The Judiciary Committee recommended that the assessments on the east 142 feet of lots 1, 2, 3 in Huddleston's Addition remain at the original amount of $22.45. Upon motion made and seconded the recommendation of the Judiciary Committee was: . unanimously approved. /8 /9 The Judiciary Committee was granted power to settle claims brought against ' the" city for injuries received in sidewalk accidents in amounts not to exceed ,the sum of $100.00 in anyone case. It was pointed out that the city is about to face three possible suits as a result of sidewalk falls due to^defective sidewalks. The JUdiciary Committee was asked to make a search of the costs entailed to carry insurance for protection of the city against sidewalk claims and to report /10 at the next meeting. ..... "... 568 . 1. Mr. S. M. Calkins, City Attorney, asked for an additional two weeks for consideration of President Boyer's request for amendment of the city ordinance to prohibit the operation of sound cars on or adjacent to the campus, except after three o'clock in the afternoon. The purchase of a mimeograph machine at a price of $205.00, half of which cost the Eugene Water Board is willing to share, was again brought up for discussio by councilman Hendershott, chairman of the Finance Committee. The Gity Recorder was asked to ascertain if there is sufficient money available in the various de- partments to warrant purchase of the machine. The $616.04 offer of A. L. Brown, 293 Monroe Street, for property described as lot 16, block 2, Sladden's Addition, with a down payment of $100.00 and $10.00 per month with interest at 6% per annum on the unpaid balance, was accepted by the Finance Committee. Rodman for the 5-acre tract near 23rd and Willamette Street was denied and a counter-offer of $1500.00 recommended by the , Finance Committee. Upon motion made and seconded, the recommendation was duly ac- 14 cepted. + The offer of M. H. and o. L. Hoselton in the sum of $465.00, ~ash, for Lot 4, Block 8, Hollenbeck's Addition, was rejected and a counter-offer of $650.00 re- commended by the Finance Committee. The recommendation was unanimously approved. , I ~511 I: I Councilman Hendershott, chairman of the Finance Committee~ reported the folIo - ing bills to the council with the recommendation that they be allowed and motion was made and seconded that warrants be drawn for the same. Councilman P. J. Hanns, chairman of the Fire and Water Committee, was granted permission to expend an additional $40 or $50 from the city hall building fund for paint and calcimine for completion of re-construction work in the fire department kitchen. Councilman Bond, chairman of the Police Committee, recommended. that the fol- lowing dealers be permitted tb obtain Package store Class "A" Licenses: O. H. Bray & Son and L. L. Leavitt Grocery. Package store Class "B" Licenses were granted to T. W. Harris lTed's) and a transfer of an original application for retail beer license from John C. Johnke to ~arl A. Simmons lJack's Cafe). It was moved and seconded that the recommendations be approved-and it was so ordered. Package "BrI licenses being held for consideration are: J. A. Seely, Doc's Buffet; Ralph & Stanley #3, Rich's Cigar Store; Chas. S. Pratt, Cosmo; P. ~. Bucknum, percy!s Place; and Package store class "A" License, Earl A. Simmons, Jack's Cafe. Councilman Hendershott reported that west 5th street was in a deplorable con- dition. Councilman Carlson and Bond both agreed that some action must be taken immediately for its repair. City Attorney S. M. Calkins was asked to communicate with the Oregon-Electric Company. The council sustained the action of the Board of Appeals in recommending that a special permit be granted to Franklin Auto Parts Co., for the erection of a parts shed on their premises at 1873 Franklin Boulevard provided the structure be placed 21 on that portion of their property which is within the limited business district. The request of Frank Cothrell for a permit to erect a workshop on the rear of his lot located at 1126 Taylor Street which is in a single family residence distric 22 was denied by the Board of Appeals and the council sustained this action. Request from R. S. Wynd for permit to erect a greenhouse at 371 10th Avenue ~est, being an apartment house district, was denied by the Planning Commission and 23 ordered filed by the council. Request of J. O. Olsen Mfg. Company to erect a store building at the northeast corner of 7th and Lincoln was denied oy 'Cne Planning Commission and ordered filed by the council. ' 25 Eugene Sand and Gravel request for permit to erect and extend the wrecking house and yard at Franklin Boulevard and Villard Street, northerly almost to Garden Avenue was denied by the Planning Commlss'ion and ordered filed by the counci . Letter from B. S. Shelley, 417 Miner Building, requesting cancellation of all city liens against property described as Lot 4, Bk 3, Walnut Park Addition was presented and referred to the Judiciary Committee and City Attorney. Letter from DeWitt W. Dormer increasing his former offer of $400 to $500 for lots 26,27, Block 27, Fairmount Heights Addition, on which property the council had placed a price of $676.40, was referred to the Finance Committee. 28 Letters from Senators H. C. Wheeler and 'E. A. McCornack airing their views in regard to refund to the cities on the gas tax was presented and ordered filed. 29 Activity reports from the Engineer, Police and Pire Departments for the month of January, 1937 were presented and ordered filed. Petition requesting that immediate action be taken to remove the bee hives be- longing to Mr. J1m Parker on Lawrence Street between 13th and 14th was ~esented /30 and the Chief of Police, Carl F. Bergman waS asked to investiga~e. ~570 /.. An ordinance fixing regulations .upon the ownership and use of bicycles in the city of Eugene, providing a penalty, and declaring an eme~gency, and repealing all ordinances in conflict herewith, was read a second time and held over for discussion 31 and final passage at the next meeting. , w 1 :: i The Health Committee was asked to determine the adequacy of Frank Boeh rent- ing property located at North Clark between Madison and Ash at a rental price of 32 $2.~0 per month and placing thereon a two-wh~el trailer house for living quarters. '" . , Councilman P. J. Hanns moved that the council take proper steps to place the _~ $34~023.08, cash surplus, in the general fund into the sinking fund for payment of ~. principal and interest on Improvement Bonds. Mayor Large did not believe this :~ could be done and asked City attorney Calkin~ for an opinion. Mr. Calkins stated '.- that he could not make a definite decision upon such shQrt notice, but his opinion off-hand was that this one account was all surplus of moneys not expended in 1937 and other excess collections, but that it would be impossible to use this account for any of the 1937 requirements or to set it aside in a sinking fund without first going through a regular budget procedu~e. It was further his opinion that this fund could be invested by the Finance Committee so that additional income might be had, but that when the budget for 1938 is prepared that amount of tax levy would be reduced by this sum of money. The matter was referred to the Finance Committee and City Attorney for further discussion. ,:.iIiI. ~ (33 \. Councilman Hendershott stated that it was compulsory that anyone desiring.to cut down trees in any locality in the city of Eugene should first get permission {34 from the Park Board. It .was the recommendation of the council that all gasoline contracts, hereto- fore submitted, be executed by the Mayor and Reconder on the condition that each contract contain the two following clauses: (1) the city reserves the right to purchase any or all of its gasoline needs; (2) in'event of reduced prices, the city is to receive the benefits of the prices. It was understood that the city will \ Imake its purchases as nearly as practicable on an equal gallonage basis from the 351 various companies~ ' . ' II Letter from James A. The county has a claim against this for $227.98 and the city a claim of $1200 and seven years delinquent interest. Offer. $600. I Lots 9 to 12 inclusive, .Block 19, College Park Addition. County has a claim of $230.04. City claim amounts to $2300, plus 8 or 9 years delinquent interest. These lots have been appraised at $300 each and the corner at $600. Offer $1300. Lots 1 to 6, incl, Block 26, College Park Adaition. The county has $270..38 and ci ty $3000 plus accumulated interest. Offer. $1700. Lots 10, 11, 12, Block 26, College Park Addition. I Councilman Page suggested that warning signs be placed at the intersection of \ 11th and Polk Streets to help cut down the speeding of cars. This was referred to 37 the Street Committee.
