M~, February 23, 1937, City Hall, Eugene, Oregon. Mayor Large called the meeting to order. All councilmen were present except Mr. Reid. :iJI. ~"Jr 'v ; *1 2 The minutes of' the meeting held February 8, were presented and as there were no corrections appearing, they were ordered filed. ....t-. '(' ~~.",' Mr. Fred Getchell asked the council for permission to construct a four-apart- ment building in Lot 2, Block 2, Lizzie Luckey Addition to ~ugene which location is between 18th and 19th on the west side of willamette btreet and about one-half block out of the apartment zone. Discussion of the matter was deferred until later in /3 the evening. Coupcilman Lamb, chairman of the Judiciary Committee, asked that consideration of insurance bids on sidewalk insurance protection be deferred until a future meet- ing. l /4 In regard to the request of R. S. Shelley for cancellation of city liens against Lot 4, Block 3, walnut Park Addition, letter from City Attorney Calkins ex- plained that with~ut first making an inspection of the deed and title no recommenda- /5 tion could be made~ The matter was left in the hands of the Judiciary Committee. The JUdiciary Committee was asked to confer with the members of the Park Board and bring in an ordinance covering the matter of trees and shrubs in parking strips ./ 6 adjacent to intersections. I' The following dealers were granted the privilege of obtaining wine and beer licenses as a result of the recommendation of the Police Committee; Package store I Class "B" License, Doc's buffet, Kalph & Stanley, Dtores #1 and #3, RiCh'S Cigar Store, Cosmo Uigar Dtore, rercy's Place; Ketail rackage "A" was recommentled for Jack's Gafe ~Earl Dimmons) and a transfer of r'ackage liB" from Bell to lVlartilla lBell's Basket lirocerYJ along with a transfer of a r'ackage "B" and Hotel from Yount to Behnke and Burr lCafe Del Rey) was recommended. The recommendation of the Com- mittee was upon motion made and seconded duly approved. /7 /~ Upon motion made and seconded, recommendation of the Police Committee for permanent suspension of officer Henry Gallagher from the police force of the city of Eugene effective February 17, 1937, was duly approved. /9 Councilman r'arrington, chairman of the Health Committee, stated that the re- I port of Dr. ~. L. Gardner, 'Health vfficer, had been read in full. The council I asked that the report be filed. . I The Health Committee, by Councilman Farrington, reported that no steps nad I been taken to determine the adequacy of r'~ank Boeh renting property located at North Clark between Madison and Ash at $2.00 per month as the party in question could not be located. /10 /11 Councilman ~arrington reported that he nad received a complaint regarding an I unfinished basement at 20th and Hilyard btreets wnich was proving to be a distinct hazard and menace to children and should be remedied. Upon motion made and seconded I City Attorney Calkins was instructed to prepare papers for condemnation and it was so ordered. Counci lman Hendershott, chairman of the Finance Committee, reported:':tha t James A. Rodman had made a counter-offer of $1100 for property located 23rd and Willamette Street and it was the recommendation of the Committee that this offer along with the others submitted by Mr. Rodman be declined and this recommendation 112 was duly approved. The Finance Committee was asked to consider the offer of J. Ray Chapman for Lot 9, Block 1, Croner's Addition in the sum of $300.00, payable $100.00 cash and the balance at the rate of $25.00 per month with interest at the rate of 6% ~13 payable each month on the unpaid part of the principal. The $58.55 cash offer of H. A. Metcal't for the east 10 feet of the west 110 feet of Lot 10, Blo~k 4; Kelsey's 2nd Additfon was left in the hands of th~~inance /14 Committee for consideration. City Attorney Calkins stated that he had prepared a statement concerning the proper disposition of the $34~023.08 cash surplus carried over from the General Fund and had mailed a copy of his opinion to Mayor Large, Councilman Lamb, President of the Oouncil, Oouncilman P. J. Hanns and the members of the Finance Committee. The Finance Committee was pot prepared to make a report and discussion was held ~ntl1 the following meeting. /15 16 At this time Councilman A. A. Reid arrived. ..... ~572 ~ The Council sustained the action of the Board of Appeals to permit R. E. 17 Veltum to build a machine shop at the SW corner of 2nd and Polk Streets. (/~ The Council sustained the action of the Board of Appeals to permit B. J. ~~8 I Clark to remodel a two-story house at 1691 Mill Street for an apartment. ~. The request of Mts. F. P. Mitchell for the privilege of installing windows '~ in the west wall of a proposed additional story to their store building at 380 west l~ 13th Avenue was recommended by the Board of appeals and sustained by the council. /' The request of Hall Petroleum Co., Inc. for a permit to erect a lUbricating building as an addition to the Richfield Service station at 1287 Lawrence Street was recommended by the Board of Appeals on the condition that the plans meet the 20 I approval of the Board. The action was upheld by the council. ( I r'" '-- <,'", : l,./ The request of Eugene Construction Company by Fred Getchell for a permit to erect a four-apartment house, costing approximately $10,000 on Lot 2, Block 2, ,21 Lizzie Luckey Addition was referred to the Planning Commission. Repprt of the Library for the month of January and Police Matron for months 22 of December, 1936 and January, 1937 were presented and ordered filed. The Recorder reported that DeWitt W. Dormer had withdrawn his offer of ,23 $500.00 for lots 26 and 27, Block 27, Fairmount Heights Addition. Petition requesting one-hour parking limit for vehicles on Eighth Avenue West between Olive and Charnelton ~treets was,presented and Chief of Police Bergman stated that the signs originally there had been destroyed and would be replaced as ,24 soon as possible. - An ordinance amending Ordinance No. 8439 of the city of Eugene entitled "An ordinance regulating the use of power speakers, calliopes, and other noise-making, music-making or speech-making devices upon the streets of the city of Eugene, and requiring a license therefor.", passed by the Common Council August 29, 1935, and approved by the Mayor September 3, 1935 by adding a new section thereto, being Section No.5-A, was read the first time and passed to its second and third reading by title under suspension of the rule by unanimous consent of the council and was placed on its final passage. The ayes and nays were called, councilmen voting aye, Lamb, Hendershott, Reid, Bond, Carlson, Hanns, Page and Farrington; nay, none; ab- 25 sent, none. The ordinance was declared passed and numbered 8502. Ah ordinance fixing regulations upon the ownership and use of bicycles in the city of Eugene, providing a penalty and declaring an emergency, and repealing all ordinances in conflict herewith had its third reading. At this time the City Recorder, at the request of Mr. Barette, local citizen, presented the bicycle ordinances ?ecured from the cities of Albany, Corvallis and oalem; Discussion followed. !he ordinance as read was placed upon its'final passage. The ayes and nays were called, councilmen voting aye, Lamb, Hendershott, Reid, Bond, Carlson, Hanns, Page and Farrington; nay, none; absent, none. The ordinance was declared passed and numbered 8503. 1 I !I 2611 I I Chief of Police Carl Bergman reported ~hat the bees belonging to Jim Parker on Lawrence ~treet between 13th and 14th had been ordered removed out of town. l7 I i. 12811 I Resolution direct1ng the City Treasurer to pay the sum of $438.00, principal and interest, due the bouthern'Pacific as a result of overpayment out of any District Improvement Funds on hand and to make any necessary transfers of District Improvement Funds either interest or principal in order to furnish this money was presented and duly adopted. The ayes and nays were called, councilmen voting aye, Lamb, Hendershott, Heid, Bond, Garlson, Hanns, Page and Farrington; nay, none; abse t, none. . RES 0 L UTI 0 N WHEREAS, on May 24, 1926, the ~outhern Pacific Company paid $9825.59 on account of the paving of railroad boulevard an d a later reassessment placed the amount at $9,540.49, making cent from the date of payment until February 23, 1937, ,is I an overpayment of ~285.l0. Figuring the interest at 5 per $152.90, making a total of $438.00 that is due the bouthern Pacific on account of said refund, Therefore, Be it resolved by the Common Council of the City of Eugene . ~I\ *t=- I .. X. Schaefers, George B. Schaefers, C. J. bchaefers and A. T. bchaefers deeding said property to the City of ~ugene, absolutely and un- qualifiedly, that the city of Eugene hereby directs the City Recorder and Mayor to enter into an agreement of option with the said F. X. Schaefers, George B. Schaefers, C. J. bchaefers and A. T. bchaefers with regard to the property described in said option, a copy of which is hereto attached, granting them until March 27, 1938, the right to pur~hase said property at the price set opposite each lot or part of lot in the contract of option, together with interest thereon from March 27,1937, until said option is exercised, and in case said option is not exercised before March 27, 1938, said option shall terminate and all rights of said F. X. Schaefers, George B. Schaefers, C. J. L. bchaefers and A. T. bchaefers shall be lost. Letter from Adjutant Ford together with a report showing the amount of I work accomplished by the balvation Army for the past four months was presented. A Ilrequest was made for a grant of $250.00 or $300.00 to carryon the relief work until Ithe middle of APril,. Councilman Hendershott ,moved that ~250.00 be drawn fDom the I relief fund on behalf of the balvation Army. Rodman and r,escinding the forIDer proposal made by Linden G. Leavitt was presented and duly adopted. The Recorder's Office was ordered to return to Mr. Leavitt the check for $1000~ made as a down payment, with a Irletter notifying him of the cancellation of his contract. lt is fully understood th t IIMr. Rodman is to provide the city with deeds for 23rd avenue going through siid 13811 property. . , , RES 0 L UTI 0 N WHEREAS, heretofore Linden G. Leavitt made application to the city of ~ugene for the purchase of certain lots in Block 30, Driverton I Addition to ~ugene, and deposited with the City Treasurer his check for $1000.00 as earnest money, and the city of ~ugene passed a resolution adopting his proposal conditioned that deeds should be provided for 23rd Avenue going through said property, and . ~ r I . Leavi tt was unable to comply\<with his part of the contract and has failed 'and neglected so to do, Therefore CJl ""-J ' yT BE IT RESOLVED by the Common Council of the City of Eugene that the proposal of Linden G. Leavitt for such purchase be and the same is hereby rejected and any contra~tual relations are here- by rescinded and the Treasurer is directed ~o return to the said Linden G. Leavitt the check for $lOOO~OO. Be it further resolved that the hereto attached contract with James A. Rodman for the purchase of Lots 1, 2, 3, 4, 5, 6r 15 and 16 of Block 30, Driverton Addition, be and the same is hereby adopted and ratified by the city of ~ugene, atid the Recorder and Mayor be and they are hereby directed to execute the same on be- half of the city and to make delivery thereof upon the payment by James A. Rodman to the city of $977.93. Mayor Large reported that the State Legislature had turned down the program or the League of Oregon Cities for a refund to the cities on the gasoline tax. He stated that a bill had been intwodoced providing for a separate municipal accountin by the ~tate Industrial Accident Commission as it has been disclosed that cities ar paying apportionment far in excess of that of any other contributor, based upon their losses. Mayor Large asked that a'resolution be approved by the council and copies of the same transmitted to the Lane County delegation with an urgent plea that they support the measure. A resolution was presented and upon motion made and seconded was duly approved: RES 0 L UTI 0 N WHEREAS, studies made by the Bureau of Municipal rtesearch of the University of Oregon, has disclosed that cities are paying to the ~tate Industrial Accident Commission apportionment far in ex- cess of that of any other contributor, based upon their losses, Therefore, BE IT RESOLVED by the common council of the city of Eugene, that the bill introduced by ~enator Angell, providing for a separate municipal accounting by the otate Industrial Accident Commission, receive the endorsement of this municipality, and the Hecorder be and he is hereby directed to transmit to the Lane County De- legation a copy of this resolution; that this resolution further constitute a request that said delegation support the measure. Mayer Large reported that the League of uregon Cities succeeded in killin the bill that would have reduced the city's share in dog license commissions from ,40 eighty to fifty per cent. Councilman Bond, chairman of the Police Committee, reported that on the evening of February 1'7, 1937, Chief of ~olice C. F. Bergman, acting under authority of Hule-XXII.L, bection I( of the [{ules of the Civil ~ervice Commission, did then and there suspend ufficer Henry Uallagher from the police force of the city of ~ugene. The Police Committee in a special session held uaturday, ~'ebruary 20, 1937, with City Attorney ~. M. Calkins and Chief of ~olice Bergman in attendanc , did after due deliberation of the charges made by Mr. Bergman, determine to recom- mend to Mayor Large and members of the Com~on vouncil the dismissal of officer Gallagher under authority of Rule XXIII, 0ection 2 (a) and (b). Therefore, we the Police Committee of the Gommon vouncil of the city of ~ugene do hereby recommend the adoption of the above report and upon motion made and seconded the question of /1 I !
