M., March 8,1937, City Hall, Eugene, Oregon. Mayor Large -I called the meeting to order. All councilmen were present except Messrs. Hendersho~ and Reid. The minutes of the meeting held February 23 were presented and as there were 2 no corrections appearing they were ordered filed. Councilman Lamb, chairman of the JUdiciary Committee, reported that as a result of a conference with the Park Board and City Attorney Calkins, it was de- termined that the Park Board proceed with the provisions contained in the ordinance /3 regulating planting of' trees and shrubs in parkways in the city of Eugene. Due to the fact that R. S. ~helley has not shown the city that he is the legal owner of Lot 4, Block 3, walnut Park Addition, no steps could be taken by the Judiciary Committee to consider his request for cancellation of liens. I , ' ; '. /4 The council refused to grant the $42.00 claim of Conie Jorgensen, which ,amount is claimed by the claimants attorney, Harlow L. Weinrick, as an error in I 5 assessment. This action was unanimously approved. The council likewise refused to grant the $76.68 claim of P. W. Davis, whic amount is claimed by the claimant's attorney, Harlow L. Weinrick, as an error in I 6 bookkeeping. Action was unanimously approved. Claimants Hobert vv.' Earl and J. R. Jennings, represented in writing by at- torney Harlow L. Weinrick, were granted a refund of $29.85 and $20.69 respectively, which amounts represent errors in assessment segregation. Upon motion made ,and I 7 seconded this action was approved. The Judiciary Committee was granted an additional two weeks to consider' 1 iabi 1 i ty insurance ,on sidewalks. , / 8 9 At this time Councilman Hendershott arrived. Councilman Hendershott, chairman of the Finance Committee, reported the following bills to the council with the recommendation that they be allowed and motion was made and seconded that warrants be drawn for the same. The Finance Committee declined to accept the $600.00 offer of David C. Baird for the north 110 feet of Lot 5 and the west 6 4/5 feet of Lot 4, Block 8, Scott's Addition as the city's interest amounts to $11~4.00. A counter-off?r of $1500.00 was extended for the consideration of Mr. BaIrd. The recommendatIon of 11 the Committee was upon motion made and seconded duly approved. I The $58.55 cash offer of H. A. Metcalf was likewise denied and a counter- offer of $70.00 extended. Upon motion made and seconded, the recommendation of the ~2 Finance Committee was unanimously approved. Offereof Laura M. Taylor to make payments of $20.00 per month, including interest as a means to avert foreclosure proceedings on property described as the south 53.3 feet of Lots 1, 2, 3, Block 7, Gross Addition was unanimously ap- proved on recommendation of the Finance Committee. '13 , The council authorized purchase from Ferris & Hardgrove, American Bank Building, Portland, Oregon $1000 Paving Intersection Bonds, due February 1, 1930, 4i%, at a price of ~106.50. Councilmen voting aye on the issue were Lamb, Hender- shott, Bond, Carlson, Hanns, Page, Farrington; nay, none; absent, Reid. f4 The Recorder was requested to advertise bids for a new car for the Engineer Department and the bids to be opened at the subsequent meeting and it was so ordere . / 15 }6 At this time Councilman Reid arrived. The council authorized a salary increase from $100 to $115 to Jonn Quiner, registered engineer employed in the office of-the ~ngineer. It was pointed out that the additional sum was to be drawn from the extra-help fund of that department This action was unanimously approved. The increase in salary is, to become effect- ive March 1, 1937. 17 I . The county has title to property located on the east side of Olive between II 13th and 14th (metes and bounds description known as the Overland and Fawver pro- !i perty). The total amount against this property in taxes and assessments is ap- If'I' proximately $600.00. It was the recommendation of the Finance Committee that the taxes be paid immediately.in order that the city might acquire title to protect its interest. The property is valued at $1500. Motion was seconded and the ayes and I nays were called; councilmen voting aye, Lamb, Hendershott, Reid, Bond, Carlson, 18 I Hanns, Page, Farrington; nay, none; absent, none. r I ~9 II The Fire and ~ater Committee was authorized to purchase a stove for the fire department kitchen from the regular funds. Councilman Farrington, chairman of the Health Committee, stated that the basement left unfinished at 20th and Hilyard ~ould be remedied if the city would connect the property with"a sewer at an expenae not to exceed ~15.00. Motion was seconded and unanimously approved. LaBe County, also interested in the property, is t? be asked to assist in filling in around the basement and cleaning the place. Councilman Page, chairman of the Park Committee, stated that the ~ark Board wis.hed the building and maintenance of all roadways in the ci ty parks be trans- ferred to the Street Committee. Mr. Page reported that heavy vehicles were still traveling on the roadways of the park. Mr. Sullivan was requested to resort to a chadn or cable barricade. It was believed that the ditch could be dug to a storm sewer connection and thereby relieving the condition. Mr. Reid was asked to report at the next meeting the probable expense to the city. v'1 -J ':.J::) The Police Committee recommended transfer of liquor permit from Richard C. Wynkoop, deceased, to W. R. Rearick for operation of the Dutch Mill. r ~.....~ ~.~ .~l' Fresident Boyerls request to close 13th btreet east from Kincaid to Univer- sity ~treet to all vehicular traffic was placed in the hands of the 0treet and Police Committee for consideration. ~<,;; Claim of Mrs. Mary Ann Turner in the sum of $31.00 for damages sustained to her car as a result of striking the cement block on the north side of the highway (Franklin Boulevard approaching the turn and railroad crossing where the highway connects with ~ast Broadway) was rejected. Mayor Large extended invitations to all members of the official family to attend any or all meetings of the Twelfth Annual Convention of the League of Oregon Cities to be held March 18 and 19 in Eugene. On the blank furnished by the League asking for suggestions of topics to be discussed, Councilman Bond requested that the question of parking meters and liquor and gas revenues be presented. The council sustained the action of the Board of Appeals to grant Foster- Kleiser Company, advertis.ing agency, permit for a 12' by 25' poster panel in , addition to the two panels already located on Lot ~, Block 4, Teshner's Addition at the soutneast corner of the intersection of ~illamette Street and Eighteenth Avenue. Recorder reported that Mr. C. F. Hyde, Lane County Hepresentative to the Legislature, had informed him that the resolution providing for a separate muni- cipal accounting by the State Industrial Accident Commission had been approved by the House and was now before the Senate. Monthly reports of the Police, Engineer and Fire Departments for Pebruary together with an annual report from the Engineer Department were presented and ap- proved. Petition asking that the congestion of double-parking between Broadway and Tenth on Oak be relieved was presented. Considerable discussion followed. The council was determined that double-parking and over-time parking be remedied at once. Chief Bergman reported that his officers handed in from 8 to 10 tickets daily on double-parking violations. City Recorder stated that he could not see his way clear to impose fines on 8 or 10 offenders when it was C01IlIllon knowledge that hundred were not being checked at all. The problem was left in the hands of the Request of Wills' estate for transfer of assessment overpayment from Lot 2, Block 6, Ellsworth Addition to Lot 2, Block 6, Scott's Addition was upon motion made and seconded unanimously approved. w. Draper request for refund to Home Owners' Loan Corporation of $228.64, overpayment made by them to city for assessments on the East 34.6 feet of Lot 5 and the West 13.4 feet of Lot 6, Block 3, Fairmount Heights Addition was upon motio /32 made and seconded granted. An ordinance transferring from the Park Commission of the city of Eugene the building and maintenance of all roadways in the city parks retaining to the Park Commission all other rights including regulatory rights was reDd the first time and passed to its second and third readings by unanimous consent of the council by titl under suspension of the rule and was placed on its final passage. An ordinance approving and adopting the plans and specifications of the city engineer for the construction of a sewer as follows: Commencing at the rear of the dwelling in approximately the center of Lot 1, Block 27, Chula Vista Park, Second Addition, to Eugene, Lane County, Oregon, and running thence west across .Lots 1,'2, and 3, to the alley and connecting with the main sewer, running north and south through Block 27 in the city of eugene, Oregon, and directing the city Recorder to advertise for bids for the construction of said sewer in accordance with such plans and specifications and notifying property owners when and where the bids therefor will be opened and, considered, was read the first time and passed to its second and third readings by unanimous consent of the council by title under suspension of the rule and was placed on its final passage. 11he ayes and nays were called, councilmen voting aye, Lamb, Hendershott, Reid, Bond, Carlson, Hanns, Page and Farrington; nay, none; absent, none. The ayes and nays were called, councilmen voting aye, Lamb, Hendershott, heid, Bond, Carlson, Hanns, Page and Farrington; nay, none; absent, none. The ordinance was declared passed and numbered 8506. I 35 It was pointed out that construction of the sewer could not be commenced unless the property owners affected by the proposed improvement paid cash for said 36 improvement. The City Hecorder presented the audit for the year 1936 completed by C. A. i Horton, accountant. Upon motion made and seconded and duly carried the report was 37 unanimously approved. f Councilman Hendershott recommended that the office of the City Engineer tak charge of the rentals due the city of ~ugene and upon motion made and seconded the 38 recommendat.iori was approved. .' '\:- The problem of an increase in rental from bchool District #4 whose offices ,39 are located in the city hall building was left in the hands of the Finance Committee. The City Recorder reported that Harold banders, manager of the municipal airport, was in arrears in making payments of his monthly rental and the matter was .40 referred to the !:"inance Commi ttee for consideration. No action resulted in councilman Bondis request for the possib.le employment 41 of a dog catcher for 1937. , It was moved and seconded that pin and ball licenses be issued for the 2nd quarter beginning April 1, 1937. It was made ~lear that should the btate take steps to ban the operation of such machines, that the machine owners will have no refund. Mr. Ivan Ware, distributor of pin and ball machines, stated that such an arrangement would be entirely satisfactory.
