M., April 12, 1937, City Hall. Mayor Large called the meeting lOJ to order. All councilmen were present except Mr. Hanns. Q:11 I -.... ;.~,--. ~~. . The minutes of the previous meeting were presented end as there were no 2 corrections appearing, ~hey were ordered filed. Mr. Frank Bennett asked that the council request the Building Inspector's , Department to grant a permit to move the Knights of Pythias building to the south side of the premises at the corner of 11th and Olive ~treets. Leo Wray, whose property immediately adjoins the aforesaid pr~perty, protested the contemplated move at the previous meeting, claiming that the issuance of such a permit would increase his fire insurance rate. Moved by Councilman Reid and seconded by Mr. 3 hendershott, the request for issuance of a permit was granted and it was so ordered. , Russell D. Evans, addressing the council, asked that segregation of propert he purchased from the city located at 10th and v,ashington btreets be made, stating that he had sold a segregated part for ~750.00 and upon completion of the trans- action he would make that payment to the city on the whole thereof and that within the next thirty days he would pay the balance due the city. Upon motion made and seconded the request was granted. '. l C. L. Kelly, manager of the Miner Building, at this time presented a petition requesting that the parking privilege in front of the Miner Building be limited to fifteen minutes during the business hours of the day. The matter was 5 referred to the ~olice Committee for study. I John Chezem instructed to issue original addition. of the matter. addressed the council asking that the building inspector be a permit for construction of a house on Lot 5, Block 6, ~ugene The Judiciary Gommittee was asked to look into the advisability 6 Councilman Lamb, chairman of the Judiciary Gommittee, reported that an ex- tensive study had been made on bids covering liability insurance and it was the recommendation of the Committee that all bids be rejected. The recommendation was upon motion made and seconded duly approved. I '( , Councilman Lamb advised the council that the WPA would need for purposes of storage the buildings formerly occupied by the CCC in Skinner Butte Park during the construction of the Route F project. Therefore it was voted that no action for 8 vacation be taken at this time. I Councilman Hendershott, chairman of the Finance Committee, recommended that the offer of J. E. Gray to pay $15.00 cash and the balance in monthly payments of 4lilO.OO 'each wi th interest at the rate of 6% on property described as "Beginning 66 feet south of the southwest corner of Lot 5, Block 6, uhelton's First Addition and run thence Viest 174 feet, thence bouth 24 feet, thence easterly along the line of the 0 & C. R. R. to a point due south of the place of beginning, thence north to the place of beginning" on which the City has a certificate dated March 27, 1937 in 9 the sum of 1147.08 be accepted. The recommendation was unanimously approved. At the recommendation of Councilman Hendershott, chairman of the Finance Committee, the '1400.00 offer of Hobert W. I Councilman Hendershott, chairman of the Finance Committee, recommended re- jection of the $1000 offer of Latter Day Saints Church for the North ~ of Lots 1 and 2, Block 0, ~lias btewart1s ~ddition. Upon motion made and seconded rejection was sustained. The $100.00 check submitted by A. J. Burton, representing the Church, was ordered returned andlt is so authorized. . 4: I '. I . Hummel, owner of the following plot of ground: all of Lots 7 and 8 and the south 12.67 feet of Lot 9, Block 32, Gross Addition to Eugene, Oregon, petitioned the council for segregation of th1s certificate, now being held by the city under a foreclosure certificate dated November 7, 1936, making all of Lot '( ~~ independent from the balance of 'this certificate. In addition he also petitioned GO the council for a waiver of the 10% penalty and 10% interest and in lieu thereof ~ offer to pay 0% interest from November 6, 1936 to the present time. Appling 50.00 Counc,ilman Hendershott, acting chairman of the Fire and ~ater Committee, reported that the street 1 ights north of 8th Street as of last_ caturday evening were about fifty per cent burned out and further that lights were turned out too early in the evening on such busy days. Mayor Large referred the matter to the Fire and Water Committee to consult with the ~ugene ~ater Board and report /18 at the next meeting. Councilman Farrington, chairman of the Health Coamittee, introduced again the subject of a contract \f\ith H. h. Hughes for care of the city dump grounds. Mr Farrington recommended that the contract be drawn between the city and Mr. Hughes for a period covering two years and Mr. Hughes to have complete control of salvage City Attorney Calkins was instructed to draw the contract. This action was unani- mously ar:proved. . ,l~ Councilman Reid asked for additional time on proposed drainage of Amazon district. 20 { Ii II '3AII Ii I I 211 / II I I Mr. Reid further reported that Charles Cutler, owner of a store building located at 11th and Chambers, outside of the city limits, asked for permission for sewer connection with the city, for which servi~es he is willing to pay the cost~. Police COITmittee, by chairman 0am Bond, reported that the Police Departmen had given out in excess of 400 tickets for dOUble and over-time parking and other minor traffic violations for the month of March and that fines amounting to approximately ~370.00 had been mllected. He insisted upon a continuance of traffi check-up. I i 23 I! / II At this time he ruggested the employment of a city dog catcher. One in- quirer had offered to work at the rate of ~f4.00 per day and at the same time pro- vide his own car and equipment and care for the ca~tured dogs until claimed by the owners at which time he would collect and retain a certain fee. The problem was held by the Committee to see if it were possible to secure an individual to contra th~ dogs on a commission basis. A report will be brought in at the next ffieeting. Councilman Bond, chairman of the Police Committee, recommended one-half hour parkin~ limit on Charnelton betweRn Broadway and Tenth and one-hour p~rking limit on Pearl between Eighth and Broadway. It was moved and seconded tl1st this recommendatio~ be approved. But at this point before a vote was taken, Councilman Reid introduced the question of the advisability of the city inst~ling parking me~ers. . At this t~me Mayor Large handed the Recorder a clipping from the Qan Francisco Chronicle indicating the adverse reaction to parking llieters in that city Councilman Bond expressed the opinion that tugene ~ait until })ortland had given their meters a trial. l'~r. Page suggested the establishment of parking lots. In favor of the meters was Mr. Farrington who cDuld see no reason why Eugene had to pr~long installation any longer. It was the suggestion of Councilman Carlson that a Committee be appointed to contact the variDus merchants in town to be ef~ected by the proposed installation of the meters and 8et their true reaction to the pro- blem. Councilman Lamb asked that the recommendation of reduced perking limit on Charnelton and one-hour parking on Pearl be put to a vote. An Ordinance amending section 8 and subdivision C of Section 9 of ordinanc No. 7709 entitled IlAn ordinance regulating the use, conduct and control of vehicle upon the streets and alleys of the city of ~u~ene and prescribing penalties for the violation thereof, and repealing ordinan,ces~ numbered 3890,5695,5993,6118, 6264, 6590 and 7536 and all ordinances or parts of ordinances in conflkt herewith and declaring an emergency", passed by the Comffion Council and ap0roved by the 11ayor IJec8mber 9, 1929 by addiniZ a subdi vis ion 0 to ~ection 8, providing for one hour limitation of parking on Pearl Street from ~ighth hvenue ~ast to East Broadwa and by amending uubdivision C of Section 9 so as to provide thirty minute parking li~itation on both sides if Charnelton ~treet from nest Broadway to Tenth Avenue 't.est, was rea'd the first time and passed to its second and third readlngs by title under suspension of the rule by unanimous consent of the council and was placed upon its final passage. Rodman was presented asking for a segregation of assess- ments on the E 50 feet of Lot 7 and the East 50 feet of the North 20 feet of Lot 8, Block 7, College Hill Park Addition. Engineer Clubb reported that the value of the remaining property was such that segregation was in order. The request of Mr. Rodma was granted. /' 28 Referred to the Judiciary Committee was the request of the Lane County Court, by Fred Fisk, Judge, to nullify the interest charges on assessments on sewer between uak and Pearl Streets, Mulligan's Donation and ~kinner's Donation, Public Squares. The original assessment on October 16, 1903 was ~~113.28 and the interest to April 1, 1937 is $227.41, making a total payment due of $340.69. The Court is willing to pay the original assessment of $113.28 but does not think it just and proper that they be compelled to pay the interest. . Letter 'from Frederick D. Stricker, ~tate Health Officer, requesting the in- stallation of a vacuum breaker on the flush valve on the new toilet combination in , 29 the men's rest room at the Rest Cottage, was referred to the ~ewer Committee. Letter from Henry T. Gallagher, patrolman on the city of ~ugene Police De- partment, petitioning the council for a period of one year leave of absence, without pay, commencing April 12, 1937, was presented and approved. Resolution granting the leave and authorizing the Kecorder to transmit B copy thereof to the Civil Service Commission was duly adopted. The Recorder was likewise instructed to obtain a list of eligibles from the Commission for appointment to the vacancy. Inasmuch as the topics for discussion were many it was the Recorder'& suggestion that the items be taken singly as there might be occasion for controvers on some of the points. Councilman Lamb however moved that the recommendations of the Board and the Planning Commission be approved as presented and the'motion was seconded by Mr. Farrington. Charles A. Hardy, local attorney, objected to the ad- verse recommendation of both bodies with respect to the construction of a service station at the corner of Sixth Avenue and Jefferson Street. Mr. Hardy declared tha it was very obvious that in times past exceptions were allowed and ordinances amend d to per~it the granting of other requests. He asked that a fair and impartial hear- ing be held on this question and an ordinance brought in approving this proposed structure. Councilman Carlson did not believe it justifiable to grant special pri- vileges to one party and then deny another. Upon me request of Councilman Hender- sho4t, Messrs. La~b and Farrington withdrew their former motion and the Recorder was instructed to present the recommendations of both bodies individually. Relativ to the above, the council sustained the denial of both bodies by a vote of 5 to 2; councilmen voting aye, Lamb, Reid, Page, Farrington, Bond; nay, Hendershott, Carlso ; absent, Hanns. I 3411 , 3511 I Relative to the addition to the Service Stat'ion at 1287 Lawrence Street, the council was unanimous in its approval to sustain the action of the two Eoards to recommend granting of a permit. . 361 , Request from Bailey Mfg. Co. for a permit to erect a building at 131 ~ashing on for the purpose of installing a small vat for heating and mixing feed water softene was granted by both boards for a period of six months only and this action was ap- proved by the council. . Request from Marjorie Peterson of Creswell for permit to make minor changes and install additional plumbing fixtures at 1590 Ferry was approved by both boards and accepted by the council by unanimous vote. ,37 38 Reports for the month of March from the Engineer, Fire Department and Lane County Health Department were presented and ordered filed. The Recorder reported that the Finance Committee had authorized purchase of 1937 Chev Master ford or Sedan with built-in trunk for the Engineer Department at a cost of $716..57.. I ,39 I 40 i / i I I 4111 I 42 i II Ii II II Ii I An ordinance granting to Oregon Electric Railway Company, a corporation, its successors and assigns, the franchise or right to lay, construct, and maintain rail way tracks and to operate trains and cars thereover, and to transport passengers, freights, mail, baggage and express thereon, and to erect, construct, maintain, and operate ~ower, telephone and telegraph lines in the city of Eugene, Oregon, was rea the first time and held for further readings at forthcoming meetings. The ordinanc was referred to the Judiciary Committee for additional study and possible changes. The Recorder was instructed to advertise in accordance with the provisions of the city charter. Mr. Hardy, attorney for the Oregon-Electric company, personally guaranteed costs of publication. The Police Committee was asked to consider the liquor applications of the following dealers: Tip Top (Fred J. Adlard) Transfer; Re~ail_Beer Class IIBD License; Dave's Bakery & Delicatessen (David Asnervig) Package Store Class "B" License; Jiffy Lunch (Merle Short} Package Store Class "BD License.. Hendershott deeding said property to the City of Eugene, absolutely and unqualifiedly, that the City of Eugene hereby directs the Ci ty Recorder and Mayor to enter: into an agreement of option with the said Arthur H. Hendershott and Effie P. Hendershott with regard to Lots 12, 13, 14, 15 and 16, Block 2, Victoria Heights Replat of Blocks 3, 5, 6 and Lot 7, Block 4, of Victoria Heights ~ddition to Eugene, Lane County, Oregon. granting them until April 12, 1938 the right to purchase said property at the price set opposite the same in the contract of option, to-wit: $1952.69, together with interest thereon at 6% from May 8, 1937 until said option is excercised, and in case said option is not exercised before April 12, 1938 s'~d option shall terminate and ~l rights of said Arthur H. Hendershott and Effie P. Hendershott shall be lost. Resolution directing the Mayor and Recorder to enter into a contract on behalf of the city and Homer B. Legge was upon motion made .and seconded duly accepted: RES 0 L UTI 0 N WHEREAS, the City.of Eugene has acquired Lot 6, Block 2, Tiff's Plat, in the City of Eugene, and WHEREAS, the City of Eugene has caused the same to be appr~ised and determined its value, and WHER~AS, Homer B. Legge and Myr~na L. Legqe have offered the City $200~OO for said property, which accordin~ to the appraisement is all that the property is worth, NOW, Therefore, BE IT RESOLVED By the Common Council of ,the City of ~ugene that the Mayor and Recorder be and they are hereby directed to enter into the annexed contract on behalf of the City of Eugene, and payments made under said contract shall be de- posited with the City Treasurer of said City. Mr. Wade H. Kerr, representing the Lane County Reserve ufficers' Ass'n., stated that he had been delegated by his association to appear before the council with the request that they ext~nd an invitation to the State R. O. A. to hold their ~onvention in Eugene in 1938. The local delegation of which he is a member is to attend the convention to be held in Hood River this month and asked if a decision 0 the part of the council could be reached prior to that time. Upon rnotion~ made, seconded and duly carried, the council unanimously extended a most cordial invita- tion to the R. o. A. of the ;:jtate of Oregon, to hold the annual convention in Eugen in 1938 and the Secretary was instructed to prepBrA suitable letters for the Eu~ene delegation to transmit to the delegation in Hood River.
