'n ::,0': "'(.':;,,; The minutes of the adjourned meeting of the common council held at the hour f~:of 7:30 o'clock P. M., May 2.4, 1937, City Hall. The meeting was called ~o order by IMr. Lamb, President of the Council and acting in the capaci tJ' of Mayor in the absenc 1 'Iof Mayor Large. All councilmen were in attendance. I The minutes of the previous meeting, May 10>> 1937, Wl3re presented and as 2 lithere were no corrections, they were ordered filed as presented.. ' II Mr. R., S. Bryson, representing property owners on Fifth Avenue, addressed [,the council relative to' the proposed franchise between the c:l ty of Eugene and the liOregon-Electric Railway Company.. He pointed out that the Company was employing Ithe city streets for terminal facilities; that the poles for purpose of operations lalong the streets were improperly kept; the streets were not in proper repair and, lthat the double-tracking shut off to motor vehicular traffic almost entirely one ilside of the street. Mr. Bryson cited map.y other unfavorable conditions and asked lithe counci 1 for consideration before formal adoption of the ordinance. Mr. Clinton lHurd and Clarence W. Iddings were also present to voice protests. City Attorney I!Calkins stated that Charles A. Hardy, attorney for the Company, desired some defini te liaction on the proposal for submission to the Company for the:lr final approval. i!councilman Carlson suggested that a Committee of the Council together wi th a Commi t- litee of citizens from that vicinity should confer with one another and draw; an ordi- Inance accordingly. Councilman Hendershott moved and Reid sel~onded that the third lireading of the ordinance be postponed and that the same be N~ferred to the Judiciary ..Icommittee and City Attorney to meet with Mr. Bryson to draft another ordinance at a ;3 [time convenient with him. 'fhe recommendation of the committee was unani- /7 iIDously approved. ~ The construction of a new fence around th~ deer and elk corrals was intro- ,duced to the council by Mr. Page, chairman of the/Park Committee. He stated that !;approXimately 6000 feet .of fence would be requlr~d to make it dog-tight as well. as I\deer-proor. It was estimated that the better tY,I;fe of fencing would cost about $1.93 ,Iper yard and the less expensive or rabbit and puu.ltry-type about 60~ per yard. Mr. i~age stated that fencing with the better type of material would cost around $1200..00. !lcoUnCilman Reid suggested reducing the size of the elk corral. Councilman Page istated that if this were acted upon that funds should be taken from the emergency ~und by reason of the fact that it was actually an emergency. It was moved and I~econded that the question be referred to the Park Board and City Engineer and ~hat the city recorder advertise for bids for fenCing upon request of the Park Board. (8 !iFurther, to make this a WPA project, if pOSSible and it was so ordered. ,I Councilman Page ,. chairman of the Park Gommi ttee, reported completion of work :~n parking strips at Villard and Agate, lookout in Hendrick's Park and the bear pen. ~e also mentioned the purchase of a new lawn mower for the Park Department. He I~tated the necessity of a fence around the bear cage to keep the onlookers from I~Oiing their fingers at the bears and being bit. It was moved and seconded that the !Park Board proceed with construction of this additional fence and the costs of the 9 lisame be taken from the emergency fund. / II I' ii The Recorder, at the request of Councilman Re id, chairman of the Sewer Com- !~ittee, presented a communication from Walter Zarewski 1128 Alder Street, concerning ieacking up of sewer at their residence, submitting a bill for $5.65 paid to Chase i:t'lumbing Company for labor and adjustments. It was the recommendation of the Sewer I'pommittee that this request for payment of meney be'd"enied. It was pointed out that ~he roots from the trees adjacent to the property was the source of the trouble. 10 :upon motion made and seconded, the recommendation of the cOIImittee was adopted. II / ~ 603 -- - - -- - Councilman Bond, chairman of the Police Committee, recommended denial of the request for l5-minute parking in front of the Miner Building. Upon motion made and seconded, recommendation of the Committee was unanimously approved. .- ...,'" 12 The Police Committee recommended granting of Package Store Class "B" Licens to David Asnervig (Dave's Pie and Delicatessen Shop) 128 East 11th and rejection of a like license to Jiffy Lunch (Merle Short) 575 Willamette Street. Upon motion made and seconded, the recommendation was approved. ..~ '~:"\ ""'I~ '..):' " Proposal of F. C. Walters to pay on Lot 3, and the east 15 feet of Lot 4, Block 1 of College Hill Park a yearly rate of 6% ($62.02) considered as interest and an additional 6% ($62.02) considered-as principal until the full balance of 13 $1033.62 is paid, was accepted by the council upon motion made and duly seconded. / The council sustained th~ action of the Board of Appeals in granting Louis F. Gieseke permission to move his stock of groceries from his present location at 504 Wlll,amette Street to his residence at 1408 Lawrence street, and to conduct his store in his residenc~ for a period not to exceed six months. It was pointed out that vacation of the post office alleys compelled Mr. Gieseke to seek this outlet. 114 , 115 The council sustained the action of the Board of Appeals in permitting F. L. Chambers to install two windows in the east wall of the Apartment Building located at 132 West Eighth Avenue. r-- Request of George E. Yates asking for a permit to erect a service station on the south 62 feet of Lot 5, Block 1, Osburn Addition, located at the northeast corner of the intersection of Lawrence street and 11th Avenue was denied by the 116 Board of Appeal sand sus"tained by the council. ' M~. Czarske presented to the Board of Appeals a request to build two duplex residences on the north side of 7th Avenues West between Washingto~ and Jefferson Streets setting back from the sidewalk approximately 11 feet. This is not as far back as the present residences in the block but the Board fIndS no ordinance or regulation to prevent the issuance of the permit, but feel that the matter of SET-BACK from the street line should receive some consideration from the council. Herewith the Council ordered the building inspector to issue a permit for the proposed construction to be not less than 11 feet from the sidewalk and it was so ordered. /17 Moved by Farrington .and seconded by Bond the request of the Salvation Army for additional funds to carryon relief work was ordered tabled and it was so / 18 acted upon. Request of John Chete~ for p~rmission to build on Lot 5, Block 6~ Eugene I Original Addition, was ordered tabled on the grounds that Mr. Chezem would per- /19 sonally interview the individual councilmen. Request of Frank H. Seal for permission to make sewerage disposal through the city's system on a reasonable rental basis. It was pointed out that Mr. Seal has been doing,considerable building on West 6th or approximately 600 feet west of the Prairie Addition. The matter was referred to the City Engineer and Sewer 120 Committee. Resolution appealing to the Senators and Congressmen at Washington to use their efforts for r'epeal of limitation upon the rights of municipalities to con- tract7upon favorable terms with depository banks for a reasonable interest earning upon deposits whether for demand or time account was upon motion made and seconded, duly adopted: ,. ;l. I RESOLUTION WHEREAS, the enactment of the Federal Reserve Act, Section 19, paragraph 12, provided that "no member bank shall, directly or indirectly, by any device whatever, pay any interest on any deposit which is payable on demand:.~provided further that until the expiration of two years after the date or enactment of the banking act of 1935 this paragraph shall not apply...(2) to any deposits of public funds made by or on behalf of any state, county, school district or other sub-division or municipality, or to any deposit of trust funds if the payment of interest with respect to such deposit- of public funds or trust funds is re- qUired by state law," and WHEREAS, under the terms of this act it will become operative in the state of Oregon upon the included units and subdivisions of government after August 23, 1937, and WHEREAS, the right and practice of paying to municipalities a reasonable rate of interest upon demand deposits as well as upon time deposits has long been recognized and adhered to by banks and municipalities, and .-..1 ~ 604 .- -"^ n /i -,,:.....', ~~h :-~cj ".'rJ -I II II :1 WHEREAS; the earning power of money is an ad jun(~t of the successful operation of all bu~iness in which c:Lties con- stitute no exception a nd to deprive municipali1~ies of . this source of revenue, thereby augmenting the earnings of banks by the unremunerated use of public funds is an unjust discrimination, and WHEREAS, the enforcement of this act must result in great losses of revenue to the cities uf the state of Oregon at a time when municipalities are still struggl:lng under the burden of heavy bond and !jarrant debt and the added responsibility of bringing to'current requirement the hal ted and retarded development resulting from '~he years of the depression and diminished revenues, now '~herefore be it ' I I II II " Ii, II The Finance Committee had no recommendation to :nake relative to the re- ,22ji quest of L. RESOLVEljl, that the City of Portland, acting through its Ci ty Council, does hereby oppose and decry the I:macted legislation as vitally opposed to the financial interest and welfare of cities of Oregon, and that it most earnest- ly and urgently appeals to our Senators and Congressmen at Washington to use their utmost efforst for the repeal of any limitation upon the right of municipalitIes to con- tract upon favorable terms with deposi t<llry bank::; for a reasonable interest earning 'upon deposits, whet::1er for demand or time account, (or if repeal cannot be had, for their support in Congress of H. R. 4215, introd'.lced by Mr. Eicher, postponing the effective date of the lilnitation of interest on demand depos its to August 24, 19,42, or any similar proposal for such relief). 'I Resolution authorizing the Mayor and Recorder to deliver a good and suf- ,29 ficient deed to H. C. East was upon fuotion made, seconded and duly carried, adopted: RESOLUT.!ON . WHEREAS, the City of Eugene i~ the owner of Lot 4, Block 3, Shaw's Second Addition to Eugene, Lane County, Oregon, and WHEFEAS, the City of Eugene has heretofore entered into a lease and option of.purchase of said premises with Netta Kress Pennington, and WHEREAS, Netta Kress Pennington has assigned said lease and option to H. C. East, and WHEREAS, H. C. East has exercised said option and paid the purchase-price therein set out in full, with interest, and has complied with all the terms and conditions thereof, Now, Therefore 1 BE IT RESOLVED by the Common Council of the City of Eugene, 'that the Mayor and Recorder be and they are hereby directed to execute and deliver to H. C. East a good and sufficient deed of conveyance to the above described property, on be- half of the City of Eugene Councilman Page reported that Clyde Johnston had made request for the cutting of a large maple tree on the parking strip ~f his property at 7th and Washington Streets and that the same had been denied upon recommendation of the Park Committee. Clarence Simon, acting chairman of the Park Board, stated that all trees that had been removed in the immediate' past were done at the authorization of either Chairman Wilkins or himself. Upon motion made and seconded, the report /30 of the Park Board was duly approved. . The following resolution was upon motion made, seconded and duly carried, (31 was adopted: RES 0 L UTI 0 N i. BE IT RESOLVED that the following proclamation be issued by the president of the council acting in place of the Mayor: "May 30 has been set aside as a day on which to honor the memory of the soldiers and sailors of the United States who lost their lives while serving the country and the memory of those who in later years laid down the burdens of life. This is a great national holiday observed throughout the land. and inasmuch as this date falls upon Sunday this year and the day folloWing is usually observed as a holiday in such cases, Therefore,._ it is fitting that the citizens of Eugene lay aside:,. all business and observe.the day in a manner that will do proper honor to all dead, Therefore, as acting Mayor of the ci ty of Eugene in the absence, of Mayor Elisha Large, I call upon the people of Eugene to observe Monday, May 31 as a day on which to pay tribute to the na tion' s defenders and to decorate the grave.s of our loved ones."
