I "0'"; "C1) The minutes of the regular meeting of the common council held at the hour ~ 1 II of 7:30 o'clock P. M., June 14, 1937, City Hall. The meeting was called to order by Mayor Large. All councilmen were present except Mr. Hendershott. The minutes of the previous meeting were presented and as there were no 2 corrections, they were ordered filed as presented. I Letter from the Salvation Army requesting a contribt,tion of $50.00 to tide them over until the fall financial campaign, was presented by the Recorder. Mr. II Roy E. Morse, Advisory Board Chairman of the organization, stated that prior to this meeting he had gone into the relief fund account of ttle city and the fact was II di sclosed that the account was overdrawn to the extent of ~;88.. 70. Mr. Morse cited the urgency of the condition existing and gave definite as~:urance that this would I be the last request until late in fall and asked if the council could see fit to I grant this request in spite of the fact that the fund is at: the present time over- II drawn. It was moved and seconded that the Mayor and Recorder issue a warrant pay- . able to the Salvation Army in the amount of ~50.00. Complete closing of Willamette Street from 8th to 11th from Ii the morning of July 19 to midnight of July 24th:. inclusive. II Referred to Street Committee. 2., Remittance of carnival license fee to the Pageant Association. II The carnival is to be featured in conjunction W:L th the t'ageant II and is to operate for a period of one week. Granted. II 3. Refused by the Council. , 11.. Permission to have horse-drawn stages to operate between depot and hotels and elsewhere if requested. Granted. I 12. Permission to hold short skits at street corners during noon ...~ .... , hours as means of advertising. Granted. ;,..t. 13. That special parking privileges be granted guests of the city. Granted. 14. Discussion relative to the subject was " o::t I opened. Mr. Charles A. Hardy, attorney for the Company, asked that the ordi- .:.';) '" nance be amended so as to permit the Company a period of two years rather than ~ ::<~l one year in which to complete the repair work necessary for the restoration of '~,".,,, ~~.... the pavement at a cost of $13,000 the first year and $11,000 the second year. He also ~sked that the annual fee of $1000.00 to b~ paid the city as compensation be stricken out and the 5% of the gross income earned by the Company from trans- portation within the city only be required, pointing out that the city of Portland operated on the latter basis and that their revenue was much less than $1000.00.. Mr. R. s. Bryson, representing 5th Avenue residents stated that the extension from one to two years fov the repair work was satisfactory. tie felt, however, that the city should receive a reasonable franchise fee. Upon motion made, seconded and . du,ly carried, the ordinance was amended to allow the two year period of time. It was moved and seconded that the franchise also carry an annual fee of $1000.00. The ayes and nays were called; councilmen voting aye, Hendershott, Heid, Hanns and Bond; nay, Lamb, Page, ~arrington and Carlson. It being a tie vote, the Mayor was reqUired to cast his vote, which was negative, the motion thereby being lost. It .' was moved and seconded that the fee be placed at $500.00 a year and it was passed by a vote of 6 to.2. Councilmen voting aye, Lamb, Hendershott, Page, Hanns, f:l'ar- /5 rington, Carlson; nay, ~eid and Bond. An ordinance granting to Oregon-Electric Railway Company, a corporation, its successors and assigns, the franchise to maintain its present railway tracks in the city of cugene and to operate trains and cars thereover, and to transport passengers, freight, mail, baggage and express thereon, and to maintain its present poles and wires in the city of ~ugene, vregon, had its third reading and was placed 16 on its final passage. The ordinance was declared passed and numbered 8514. At this time Wm. w. Harcombe, attorney, appeared before the council on behalf of Mrs. Cora J. Woods, who 1s building a residence at 734 E. 14th and is having some difficulty by reason of the fact that the neighboring garage adjacent thereto is built within two feet of the sidewalk which destroys the building line of that section. He asked that some action be taken to remedy this condition. The ,7 matter was referred to the tiealth Commi'ttee. I Mrs. Catherine Flynn, 612 East Broadway, asked that permission be granted for reclassification of her property located at the southeast corner of the inter- section at Broadway and rattersonbtreet so that she m!ght sell said property for the purpose of the erection-of a service station. Inasmuch as the council from a personal point of view expressed favoritism toward such a request, they felt that I the same could not be allowed by reason of the fact that in the past requests of a similar nature had been denied. Upon motion made, seconded and duly carried, the recommendation of the Bosrd of Appeals to deny this request was herewith sustained /8 by the council. Herbert Lombard, attorney representing Mr. L. H. Dery, Creswell, asked' for cancellation of interest in the amount of $99.84 upon payment of principal, ~p285.l1, on assessments against the north 94.5 feet of the following description: "Commencing at a point 66 feet north of the northwest corner of Block 6, Packard's Addition and running thence east 00 feet, thence north 177 feet to the south line of the right of way, thence west 60 feet, more or less, to a point due north of the beginning point, and thence south to the place of beginning all being in Eugene, /9 Lane County, Oregon. The matter was referred to the Judiciary Committee. . The $400.00 offer of Mrs. H. B. Yocom for property described as "Beginning at the NE corner of Lot 1, Block 22, Fairmount, thence_west 70 feet,' thence .south 90 feet, thence east to the west line of Fairmount Boulevard, and thence Northerly ,10 to the place of beginningll was denied by the Finance Committee and it was so ordere . , I Mr. D. F. Mains' offer to pay the city the sum of $370.00, $50.00 cash and 1 I $12.50 per month with interest at 6% on deferred payments together with payment of all ~ack taxes on property being the south 50 feet of the north 150 feet of Lot I 4, Block 23, ~airmount Addition, was accepted by the council by unanimous approval. It was pointed out that Charles T. Frisbee formerly deeded this property to the cit and took a contract back to purchase it from the city, the redemption price to be /11 $349.68 with 6% interest from August 22, 1936. John Hakanson's offer to redeem Lot 4, Block 21, First Addition to City ,I Outlook at $150.00, $10~00 cash and $5.00 per month until fully paid was denied and a counter-offer of $25.00 down at the rate of $10.00 per month extended. This /12 recommendation was duly approved. Isaac N. After some discussion, the question being put that he be allowed, was lost and Dr. Helterline is to receive his salary plus * 18 gasoline expense money as in the past. I Park Committee by Councilman Page, stated that the city engineer had pre- ~ared an estimate on fencing the deer and elk pen and that the same would cost 1108.20. Mr. Page moved that this improvement be made and funds be drawn from the emergency account. The motion was seconded. Councilmen voting aye, Lamb, Hendershott, Reid, Page, Hanns, Farrington, Bond and Carlson; nay, none; absent, ;19 none. Councilman Reid in re-opening the Walter Zarewski request, recommended that the claim for damages by reason of the sewer backing up at the Zarewski residence be granted to the extent of $3.75. Councilmen voting aye, Lamb, Hendershott, Reid, 120 Page, Farrington, Bond and Carlson; nay, Hanns, Absent, none. Councilman Bond, chairman of the Police Committe~, recommended transfer of Package A and Retail Beer licenses to the Lone Star Cafe (JoeD. Hale) moving from 529 Willamette to 663 Willamette. This recommendation was unanimously ap- I 21 proved. ! The Police Commi ttee was asked to consider the transfer of Retail Be,er Class "B" License and Package store Clas~ DB" License from J. V. Rich to Dean t.. Dragoo, 22 865 Willamette Street. '7~ .L....~~leH-c..y Councilman Bond recommended the payment of $111.07~astelloe and stocker for electrical services rendered the police headquarters in their recent improve- ments. Councilmen voting aye for payment of the bill were Lamb, Hendershott, Reid, I 23 Page, Hanns, Farrington, Bond and Carlson; nay, none; absent, none. I Mr. Bond reported that a number of complaints had been received from Mr. John A. Zimmer concerning the nightly operations of the Pierce Machine ~hop. City Attorney Calkins stated that if Zimmer wished to file a complaint that he should r 24 appear at the office of the city recorder and in this way abate the nuisance. Councilman Hendershott reported that Mr. and Mrs. J. A. Renshaw, proprietors of the Smeed Hotel, complained about the usage of fire crackers and excessive noises adjacent to the hotel. The police chief said that everything was being . / 25 done to alleviate'the disturbance. Both councilmen Lamb' and Bond complained that logging trucks were making a 26 nuisance of themselves in failing to provide their vehicles with mufflers. / I Mayor,Large reported on his recent trip to California wherein he attended the Western Regional Conference of Mayors, stating that he found the meeting very interesting as enjoyable. At the conclusion of the conference he with Mrs. Large attended the celebration of the opening of the Golden Gate Bridge which was very impressive. ht this time he expressed sincere appreciation to members of the city for the fine motor robe presented them prior to their trip. Councilman Hendershott on behalf of the council expressed the opinion that the ci~y of ~ugene was pleased to have had the opportunity of delegating Mayor and Mrs. Large to California a~ /27 representatives of this city. I Request from Ransom Miller for a permit to erect an addition to the store building at the southeast corner of,15th and Ferry Streets which has been under consideration since March 19, was denied by the Board of Appeal~ and this action / 28 was sustained by the council. Green in which he tendered his resignation as ) !i chairman of the Civil Service Commission effective June l4lth was accepted by the 431\ council. Upon motion made and seconded, the council extended a vote of thanks for the services rendered by Mr. Green. I ' I ,I Ii Mr. Ralph Schomp, manager of the Pageant Association, thanked the members Ii :1 of the council for the special permissions they had so grEltefully granted and I' 441! pledged his hearty cooperation toward fulfillment of the same. I Ii I II Councilman Page reported that one of the slides at ~3kinner Butte Park was , II out of order and needed repair. Councilman hendershott, chairman of the Playgroun ,4511 Commission, stated that the necessary repairs would be inf.tituted at once. It was pointed out that ' , due to the fact that the question was'being referred to the vote of the people at I the next general election that in the'-'meantime the city.should continue its licen- ,;g: sing program. Motion was made and seconded, after a brIef discussion" that licenses,~ be increased to 110.00 per month per machine. The ordinance was read the first ~~ - ~ time and upon mot ion that the ordinance pass to its second and third r'eadlngs by unanimous consent of the council under suspension of the rules, the same was de- feated by a negative vote of councilmen riendershott and Held. The proposed ordinance I 47 will be up for second and final reading at the meeting of June 28th. Mayor Large stated that he hadrecelved a number of complaints relative to the auto trailer situation within the city,of ~ugene and herewith referred the question to the ~ewer Committee for study and report'at the subsequent council 48 I meet ing.
