vacation of the street, his client' would vacate. A short discussion fo'llowed. Upo
motion made and seconded for granting the request, .the votes were as follows,: Aye,
Hendershott and Hanns; nay, Lamb, Reid, Page, Farrington,-Eond and Carlson; absent,
I none. The request was thereby lost. Tbe petition submitt~d by Mrs. Nellie Flourno

j Mrs. Allen W. Jones, 1898 James Street, asked that a Committee be delegat d
to investigate the premises immediately to the rear of her residence, which she
, reported as being very unsanitary and a detriment to healthy living. The Health
}3!! Committee was asked to investigate.
:1 Mr. Victor P. Morris, member of the school board:, asked council's permis-
11 sian for a conference between the Finance Committees of both oodies for the dis- I
1411 cussion of the School Board's rental. Mayor Large granted this request.

taken care of in some way. Mr. Lamb felt that the city should have. more parks._
Mayor Large proposed that the council wait until the next budget" sesston-at which
time levies can be made for any park systems. Mayor Large also suggested that the
entire matter could be placed before the people at the next electlon' for a decision.
Mr. Hanns said that the ci ty should try to retain this land, as it' was the last piece
I of open park ground wi thin-the-c-l--ty limits. Mr. Carlson felt that the matter should
come before the budget committee. The question was put to a vote, councilmen
voting aye, Page and Reid; nay, Lamb, Hendershott, Hanns, Farringtorr" Bond and
Carlson.. It was moved and seconded that the city consider no offers for sale of
this property prior to the budget session and this received unanimous approval of
~15 the council.
The Park Committee was asked to contact the proper author1.ties at the
University of Oregon to make arrangements for use, of any possible equipment for
. -16 playground purposes that 'they have.
The Sewer Committee, at the request of A. A. Reid, chairman, was granted
_17 two weeks additional time to investigate the trailer prOblem in the city of Eugene.
Councilman Bond, chairman of the Police Committee, recommended. transfer of
Retai 1 Beer Class "B" License and Package store Class liB'" License-fr.om J. V. Rich
to Dean E. Dragoo, 865 willamette otreet. Upon motion made and seconded the re-
18 commendation of the Committee was unanimously approved.
The request of waldorf Paint Company for 30-minute parking in front of his
place of business located at 601:!:ast 11th street was denied by the Police Committee
/19 ! and this action was unanimously approved. ' \
An ordinance amending Sedtlon 8 of Ordinance No. <'<'09 entitled "An urdinance
regulating the use" conduct and control of vehicles upon the i::>treets and Alleys of '
the City ~f Eugene, and prescribing penalties for the violation thereof, and re-
. - pealing' Ordinances Numbered 3890, 5695, 599:3, ~n18, 6264,6590 and, 7.536, and all
I ordinances or parts of ordin.ances in conflict herewi th, and declaring' an emergency, If
passed by the Common ~ouncil and approved by the Mayor December 9, 1939, as amended
I' by Ordinance No. 7989 and 8507 and declaring an emergency, had its first readin~
and passed to its second and third. readings by unanimous co~sent of ~he council by
. I title under suspension of the rule and was placed for final passage . The ayes and
I nfilYs were called, councilmen voting aye', Lamb, HenderShott, Reid, Page, Hanns,
I Farrington, Bond; nay, none; absent, none. Councilman Carlson was dismissed from
voting as he was in conference with citizen members in the council Chambers. The
20' ordinance was declared passed and numbered 8516.
Councilman Lamb suggested that the bramiHes and grass that had overgrown
the trail leading from Pearl Street' over to Skinner Butte Park should be cleared.
He also suggested cutting the grass on the east end of the Butte as it was proving
-21 to be quite a fire hazard. The matter was left in the hands of the Park Board.
Councilman Farrington expressed sincere appreciation for the exceptionally
/22 fine condition of the park roads attended to oy the Street Committee.
" Mr. Page, chairman of the Park Committee, stated that there had been a re-
.. quest for a speaker's stand in Skinner,'s Butte Park. Ralph Schomp, manager of the
Pageant Association, said that they would be only too glad to donate the lumber
for the erection of this stand at the conclusion of the performance. This proposal )
/23 was accepted by the Mayor on behalf of t~e city.
Relative to the re-assessment of Washington Street as requested by Kaufman
and Sons, City Attorney Calkins reported the following, after a thorough investi-
gation of the situation: "tf the property owners on the West side of Washington
Street between 2nd Avenue West and the Southern Pacific Railroad wish to agree
on their property lines and file deeds of correction, the City will adjust the
assessments accordingly upon a written agreement by the property owners, filed with
the city of Eugene.lJcThis report was unanimously approved by the members of the

I Request of the Tidewater Associated Oil Company for permission to construct
, a 24-foot driveway on the back half of the service station located at the corner of
Broadway and High Streets was presented. In the event the 24-foot request is denied
the Company wishes the council's recommendation for a l2-foot driveway. The matter
was referred to the Street Committee. Mayor Large's question as to the feasibility
of making a running foot charge or frontage charges per year for priVilege of having
curb cuts was referred to "the Street Committee also. Engineer Clubb stated that
if this request were granted that the Company would allow free pUblic parking: on
the proposed premises. Councilman Bond stated that in many instances where curb
A cuts had been granted, that the purpose of the cuts were no longer necessary and in

as payment in full for his part of the assessment against the south 65, feet of

The request of E. F. McBee for a permit to build a r'oom 12 I x 28' on the :
west side of the store room on his property located at 603 Nineteenth Avenue West
(30 wa~ granted by the Board of Appeals and sustained by council's action. -
Roy E. Morse's request for a permit to erect a temporary car shelter, four
upright posts and metal roof only, in the rear of The Broadway, Inc., 30 East
31 Broadway was grant'ed by the Board of Appeals and sustained by the council.

Lillian E. Brockman' and May B. Cunningham's' request for permit to move two "I
small buildings on the rear of their lot at 267 East 11th Avenue, jOining them and'
making a small residence, waiving the requirements of the Euilding Code, that of
covering the exterior with stucco, was granted by tne Board of Appeals and sustaine

entitled "An Ordinance to license, tax and regulate certain games and mechanical

1\ ing. At this time a petition signed by 52 merchants and business people was pre- "
sented'by Elmer'Roberts in which petition each and everyone of ' the signers regis-
tered a protest 'against the proposed action of the council to increase the license
fee on pin ball machines from $5.00'to $10.00 per month. Upon motion made and se-
conded that the existing ordinance calling for $5.00 per month license fee be in
effect was put to a vote and councilmen voting in favor of this motion were:- Lamb,
Hendershott, Reid, Page, Hanns, Farrington; nay, Bond and Carlson; absent, 'none.

Request for paving of the intersection at Reid and Columbia Was referred
.,/3,9 to the Street Committee for consideration.
Mr. W. .D. SteV,ens, 1,557 Hilyard Street, stated that the office of the
ci ty :engineer had requested a fee of $4.00 for permission to remove and re-
o construct t~e sidewal~ in front of his r~sidence. He ~aid he objected' to
this fee and wanted the council's reaction to the matter. Engineer Clubb
stated that. under the ordinance they were required to charge thi s amount, but,
he, himself, believed the price too much for a repair and reconstruction' jOb-
and suggested a rate of-5~ per running foot. Upon motion made and seconded,
the city engineer's office is permitted to charge 5~ ~er running. foot at all
I. /40 times in the future and this was unanimously approved.
Ralph SChomp, Pageant manager, stated that there would be an outside
decorator and wanted to know, if there was a license fee in ~onnection. with
.AI his work. He was advised that there would be no charge.
Mr. Schomp also raised the question of the return of th~ 10% fee from
airport'operations to the Pageant Asspciation. lt was immediately questioned
',-A2 and the speaker withdrew his request.
The National, Re-employment Service has requested the Finance Committee
for a cash payment in lieu of the deduction now made for rent inasmuch as'
they are moving from their present city hall quarters to a new location which
is and will be under the jurisdiction of the new state employment set-up. The
matter was referred to the Finance Committee for a recommendation at the next
/43 meeting.
