:C[; The minutes of the :r'e,gular; meeting of the common~ounci1 held at the hour.
of 7:30 o'clock P. M. July 12,. 1937. The meeting was called to order by Mayor Large.
1 All councilmen were in attendance except Mr. Reid.
The minutes of the meeting of June 28, were presentl3d and as there were no
2 ~additions or corrections, they were ordered filed.
Donald Husband, attorney representing GeorgeM. Malos, asked that the counci
waive its usual building requirements in the matter of the (~rection of a concession
stand at the corner of 8th and vvillamette Streets. Upon motion made and seconded
3 this request was duly granted.

The employment of a sanitary inspector for Eugene .and Lane County at a cost
ii of $600.00 a year, with a s;imilar amount contriouted, by the county, was proposed by
:1 Dr. E. L. Gardner, Health "'fficer. Dr. Gardner stated that the total cost would be
Ii $2400.00 a year but that $1200.00 of this expense would oe provided for oy the feder- :.
i; al government in the event that the ci ty .andcounty paid thoir share. It was pointe ~ .,...
i: out that the county court had agreed to pay their sum and that now the matter rested
Ii in the hands of the council. Dr. France of the ~tate Enginoerts Office was intro-
: duced and he gave a brief explanation of the duties of a sa11itary inspector which
, consists of inspection of swimming pools, drinking water, rost rooms, groceries,'
. restaurants and sewage disposal. Dr. France pointed out that at the present time it
Ii was impossible for either the state department or the county and city heal th depart nt ~
~ to take care of this work as it should be and if an inspector were added he would
work directly under and with the other two groups. Mr. F. O. Rees'e, local citizen"
addressed the council, expressing the opi-nion that such an lnspector would be unnec-
essary and would merely add to the burden of the taxpayers. Further, he stated that
it was unfair for a group to come before the council and ask for appropriation of
money for such services when no money nad been provided in the budget.. Councilman
Reid, who Just.arrived, felt that the proposal was a very good one and would answe~
a long-felt need for inspection service which at the present time was not being
properly handled. Councilman Hendershott suggested that thls be referred to the I
Health Committee and Health. Board to report at the next meeting. A let"Cer fr'om

Mrs. Warren D. Smith, on behalf of expansion of recreational programs for
the city of Eugene, asked. that the council now dedicate and set aside for park
purposes the l7t acres of land located east of south willamette to Mill ~treet be-
tween 20th and 22nd. Mayor Large at this time.pointed out that there was no method
whereby this property could be so dedicated, but that the council had unanimously
gone on record as agreeing to not accept offers or sell this tract of ground until
the budget committee had an opportunity 1D levy funds for purchase of this. b. M.
Calkins, city attorney, having been called upon by Mayor Large, stated that in the
first instance if this land were dedicated and there were absolutely no monetary
connection between it and the city that in the event of an accident, there would
be no damages collected. On the other hand, if the city had a monetary interest in
the property, which it does have in the form of liens, and someone were in~ured.
then the city would be liable for aamages. lt was Mr. Calkins' opinion that there
j: should be no improvement whatsoever made on the place until it was completely di-
~ vorced from its financial positiori with the city. He further pointed out that in
;1 the matter of handling property in which there are liens that the city acts merely
Ii as a broker and that it would be a misappropriation of those lien funds if the city .

': he pointed out, and it would be necessary for the city to secure an appraisal of
Ii said property and whatever that appraisal pricet the city could sell for that amount
ii and that would be a satisfaction. He stressed the point again that there should be
il no improvement on the tract of land in the meantime. Mrs. C. A. Horton was given
I assurance that it was the intention of the council to w ai t until budget session to

Payment of claim of $11.50 to Mh~s Rosa Miles for damages to her c'ar in a ~
accident involvine a city truck, was denied by the Judiciary Committee and upon
/8 motion made and seconded, this recommendation was approved.
Request for rental of the two city lots at 13th and Monroe by private
parties for use of the same as parking spa'ce during the pageant events and returnln
to the city 25% of the intake, was denied; The Pageant Committee was given use of
/9 trre lots for free.parking.
Councilman Hendershott, chairman of the Finance Committee, reported the
following bills to the council with the recommendation that they be allowed and
motion was made and seconded that warrants be drawn. ~he ayes and nays were called
councilmen voting aye, Lamb, Hendershott, Reid, Bond, Carlson, Page, Hanns and

Councilman Carlson asked that the request of the Central Grange No. 360
for making Eleventh Avenue West a through street be referred to the Police Com-
mittee. It was the opinion o.f the council that this petition be tabled and it was
11 so ordered.

Councilman Carlson, chairman of the Street Committee, reporting on curbs '-*
that had been cut and not used, he felt that it would be impractical to get the
property owners to replace them, and too, the city was not in a position finan-
12 cially to attend to it.

It was the recommendation of the Street Committee that the Tide Water
Association Oil Company be permitted to construct an additional 10 feet to their
present cut. They were requested to place a sign on the premises indicating that
the area was for free parking; the company having the privilege of limiting the
13 time.

I It was the recommendation of the Health Committee, reported by chairman
Farrington, that the two ~arns adjacent to the property of Mr. Johnson at 267
West 12th be condemned. ~he City Attorney was asked to proceed with condemnation
;.4 papers upon approval of the councilmen for such a procedure.
II The Health Committee also recommended condemnati~n of the shed in the
rear of the residence of Mrs. Allen W. Jones, 1898 James Street and a thorough I
1511 cleaning of the house on the premises. This recommendatiDn was unanimousl~ ap-
proved. The Oi ty Attorney was instructed to prepare pape.rs of condemnation.
The request of W. H. Robertson, caretaker of the rest cottage, to keep
for purposes of his own tne receipts of the toll telephone installed at the rest
116 cottage, was upon motion made and seconded, denied.
The Police Committee reported that they had issu,ad 19 tickets for trucks
17 operating with defective mufflers and all were being taken care of rapidly.

Councilman Reid stated that the sewer facilities at the fair grounds
I were not adequate. The prOblem was referred to the city engineer with power to
act. He was asked to consult with the county -court and work with them on the
18 project.

An additional staff of special police officers mlY be appointed during
the pageant celebration depending upon the number that ca;~ be obtained from the
19 state police headquarters.

Letter from Mr. Frank L. Barber asking for release of assessment on the
east. 92 feet of Lot 4, Block 26, First Addition Uhula Vista Park as soon as the
sidewalk is laid in, as this piece of property has already been assessed when the
20 sidewalk was put in on Chula Vista, was referred to the Judiciary Committee.

Request of Eugene Hospital and Clinic asking for privilege of replacing
a number of dilapidated outbuildings with a parking shed, approximately 90 feet
long, open on two sides and supported by post~ only, also to reconstruct the north
gable of the present building used to house co~nty patiemts, was granted by the
Board of Appeals provided provisions ar~ made tp meet the :~equirements of one hour
21 resistive construction, and this action was approved by the common council.

- i The request of the Genera I Petroleum .Corporat ion for a permit to remodel
their service station at 6th and Blair using tpe same typf~ of construction as in
the present building was granted by the Board of Appeals and accepted by the I
22 council.

McDonald Candy Company request to make a change :~rom the building code
for the north wall of their proposed new building to oe located between 4th and 5t
on the west side of Willamette, adjoining the Lane Hot~ ;~roperty on the south
and the Briggts property on the north. The wall in questIon is to rise abov~ and
il r~st on the Briggs' building and they ask to be allowed tl) construct this out of
I: four-inch hollow tile, anchored to the supporting framewo:~k of their own building.
The Board recommended that this request be granted providlng there is found to be
sufficient footing under the Briggs' wall to carry the additional load and this
23 action was unanimously approved by tne council. .

Request of A. E. Doyle & Associate, Portland, architects, to modernize the ~l~:<"')
U. S. National Bank, the alteration to consist of facing with marble the portion of
the building; the marble slab veneer to be used is about 3/4" thick and it will
require approximately 1/4" or 1/2" addition for lining up and setting. This. request
( 25 was unanimously approved.
Letter from the Industrial and statehood Parade of the Oregon Trail Pageant
!Association requesting .the city to participate by entering a float in the parade,
was granted by the council in that the ~ire and Street Departments are to prepare an
( 26 entry.
Petition requesting the council to have the underbrush cleared and trees
I trimmed on the parking on the boutheast corner of 5th and Monroe street, was referre
to the Park Committee and Park Board. It was pointed out in the petition that the
/27 existence of the brush was dangerous to traffic in that it obstructed the view.

Petition protesting the maintenance of an incubator factory/auto trailer
building, auto wrecking and selling of used cars in the rear of 260 west 12th Avenue
/28 was presented and referred to the Planning Commission.
Resolution directing the Mayor and Recorder to execute a contract on behalf
of the city of Eugene for property sale to D. F. Mains and C. F. Hyde, was upon
,29 motion made and seconded duly approved:

WHEREAS, the City of Eugene has caused the same to be appraised
and determined its value, and
WHEREAS, the City of EUgen~ gave an option of purchase of said
property to Charles F. Frisbee to be exercised before August 22,
! 1937, and said Frisbee has assigned the same to D. F. Mains and
I C. F. Hyde, and the said D. F. Mains and C. F. Hyde have offered

the payments thereunder shall be deposited with the City Treasurer.

Special permission was granted by memoers of the council to Russell
Brothers Circus to conduct a circus in the city of Eugene on tiunday, August 1, 1937.
The Company is traveling in 75 trucks.~nd trailers and as t.3e licensing under the
present ordinance does not cover trucks out confines itself strictly to railroad
137 cars, the city at~orney was instructed to amend the existin~5 ordinance pertaining

I .At this time S. M. Calkins, city attorney, pointed out that the Private
I Flyers Association were desirous of holding air shows in connection with the pageant.

il Mr. Ransom Miller appeared before the council and asked for special per-
mission to erect an addition to the store ouildlng at the southeast corner of 15th
I and Ferry titreets. This request was denied by the council on June 14th out at this
I time Mr. Miller was asked to get in tOUCh with Mr. Mosher, 13uilaing ~nspector, to
