The minutes of the regular meeting of the common council held at the "*' hour of 7~30 o'clock P. ~., October 11; 1937. The meeting was called to order by Mayor Elisha Large. All members of the council were present except Reid, Carlson 1 and Farrington. . f The minutes of the previous m~eting, September 27, 1937, were presented , , 2 and ordered filed as there were no cor~ections appear~ng. I The Judiciary Committee reco~ended payment of $15.75 to the Eugene Hos- pital and Clinic for treatments rendered Ernest H. Craig, patient brought to the hospital from the city Jail. Upon motion made and duly seconded, it was ordered ~ that this ,bill be paid together with t~e other b~lls for the month and this was i unanimously approved. ,~ The Judiciary Committee asked 'for a period of two additional weeks in which to study the request of Major James H. Tierney for repeal of two city park . ,4 ordinances, to -wi t: Nos. . 47 8 . an~ 511, and it was so granted. t, The Chairman of the Finance Committee, Arthur Hendershott, stated that he'had received bids for a program of auditing the city books monthly during the year, instead of at the end of each year and that reports be made to the council on a quarterly basis. The two bids presented by local accountants were: Percy W. . Brown, $350.00 and C. A. Horton, $390.00. It was the recommendation of the /5 Finance Committee that the bid of Mr. ~rown be accepted and it was so ordered. Mr. Cashrrran increased his bid from $4750.00 to $5500.00 and even though the city would lose $1310.81 as a result of this transaction, it was the recommendation of the Finance Committee that this offer be accepted with the condition also that the city :urnish ~nsured title. Considerable discussion followed and Mr. Cashman explainl~d that it was the plan of his company to construct 24 new homes, to layout and pare the necessary streets at their own expense. Upon motion made and seconded, th~ offer of Mr. Cashman was ;7 duly accepted. 8 At this time Councilmen Reid and Farrington arrived. The $400.00 offer of Charles E. Boyd for Block "C" Martin's Addition, known as #7 Madison Street, was rejected by the council and a counter-offer of /9 $625.00 extended. Upon motion made and seconded, this action was duly accepted. The $250.00 offer of Edward Howell for Lot 15, Block 4, Fairmount Amende Addition, was rejected by the council and a counter-offer of $750.00 extended. 10 This was unanimously approved. I / It was the recommendation of the Finance Committee that due to the fact that Mrs. A. B. Brown had not accepted the extension of one year on her contract in which to redeem property described as Lot 15, Block 4, Fairmount Addition, that the same be now rejected. Upon motion made and seconded, the recommendation of 11 the Committee was duly approved. I . Councilman P. J. Hanns, Chairman of the Fire' e,nd Water Committee, re- commended the installation of a street light at 15th ane, Kincaid and this was I 12 upon motion made, seconded, and duly carried, 'approved. / The Fire and Water Committee requested further' time to study the request of Kirstina Snow for installation of a street light at the intersection of Jackson 13 and West Second, and it was granted. ' " / j Councilman Farrington, Chairman of the Health Committee, stated that L.S /' Christofferson wished to trade a piece of ground he has adjacent to the city dump grounds for the same size piece of ground within the dlli1p grounds, and he would .; /' take care of the necessary expense in transfer of the title. It was pointed out / I / ~ ~ 3 _.---- ... ..--- .~-.-.~ .~ .-_. that this would be an advantage to the city and that the city would not sustain any loss in the way of amount of ground. Upon motion made and seconded, it was the action of the council that the transfer be made. Survey of the land was left in I 14 the hands of the City Engineer. / i )'!J. .J .: Councilman Farrington reported that there was an old building on the west ~ side of Madison between Broadway and 10th an the north side of the alley that should be condemned. He stated that after some investigation, it was learned that the city was about to acquire title and as soon as the city acquires title that /15 the building be destroyed and this was approved. Mr. Farrington brought up the question of trimming the low-hanging limbs I of trees in order to provide proper pedestrian and car traffic. It was pointed out that the c9ntrol of this situation was within the province of the Park Board. Councilman Page, Chairman of the Park Committee, stated that funds were not available for thi~ but that in the proposed budget for next year, funds would be available and the work should be done. Councilman Hanns believed that an ordinance should be enacted reqUiring the property owner to be responsible for the work and upon the negligence of the owner himself to attend to it, then the city should take steps to tri~ the trees and in turn bill the property owner for the expense. The entire /16 matter was referred to the Park Committee. Chairman of the Police Committee, Sam Bond, stated that the police depart- , /17 ment were'daily checking overtime and dOUble-parking. Reports for the month of September, 1937 were received from the following 18 city departments: City Engineer, Police and Fire and were ordered filed. The Recorder read a communication from the Postal Telegraph Company concern ing the proposed franchise. City Attorney S. M. Calkins stated that the entire matter of franchises had been thoroughly studied and the Judiciary Committee is to /19 proceed with securing franchises for both Western Union and Postal Telegraph. The Judiciary Committee reported that no disposal had been made of the clai /20 made by Miss Anne Whiteaker. The City Attorney stated that he had no report yet as to the proper action I / 21 to take in regard to condemnation proceedings of woodyard at 1791 Jefferson Street. Relative to the petition requesting cutting of underbrush and trimming of trees at the S. E. Corner of Fifth and Monroe, the Park Board is to report on this 22 at the next council meeting. I Concerning the petition for care of the center parking of Villard Street, the Park Board is to ask the property owners adjacent to these strips to take care /23 of them. Letter from the Commander of,the Commander's Council, F. C. Westerfield, requesting the Council to provide the shrubs and trees on the south slope of Skinner's Butte Park, which has been dedicated as a memorial to the deceased service men of Lane County, with water, was ordered filed inasmuch as the fall rains are / 24 here. The petition protesting the maintenance of incubator factory, auto trailer building, auto wrecking, etc by Edward McClanahan at 260 West 12th, was reported as not having been presented to the Commission for study as no meeting had been held since that date. The matter will be disposed of when the next meeting of the -' 25 Planning Commission takes place. , Resolution authorizing the Mayor and Recorder to enter into a contract on ..:$ behalf of the city of Eugene with Henry and Bessie Hatfield was upon motion made -2~ and seconded, duly adopted: I RES 0 L UTI 0 N WHEREAS, The City of Eugene has acquired 'the East 35.!Z feet of Lot 7., Block 2, Cheshire's 2nd Addition to Eugene, Lane County, Oregon, and WHEREAS, The City of Eugene has caused the same to be appraised and determined its value; and I WHEREAS, Henry Hatfield and Bessie Hatfield have offer'ed the city $400.00 for said property, which, according to the appraisement is all that the property is worth, NOW, THEREFORE BE IT RESOLVEID By the Common Council of the City of Eugene that the Mayor and Recorder be and they 'are hereby directed to enter into the annexed contract on behalf of the City of Eugene, and the $25.00 down payment and all subsequent payments shall be deposited with the City Treasurer of said City. ~ ~ ~ 4 Resolution authorizing the Mayor and Recorder to enter into a contract on behalf of the city of Eugene with Everett and Addie Alford, was upon motion made and /27 seconded, dul~' adopted:' .1, RES 0 L UTI 0 N ~. !;-. Resolution authorizing the, Mayor and Recorder to execute and deliver to K. K. Robinson and Emily A. Resolution authorizing the Mayor and Recorder to execute and deliver to Ambrose Dennis a deed of conveyance, was upon motion made and seconded, approved (31 by the council: RES 0 L UTI 0 N Whereas, The City of Eugene is the owner of the following described premises, to-wit: Commencing 100 feet south of the Northwest corner of Lot 4, Bk 23, Fairmount Addition, and run thence East 160 feet, thence South 50 feet, thence West 160 feet, and thence North 50 feet to the place of beginning, all in Eugene, Lane County, Oregon, and I WHEREAS, The City of Eugene has heretofore entered into an option of purchase of said premises with Charles F. Frisbee, and WHEREAS, Charles F. Frisbee, has assigned said option to D. F.Mains and C. F. Hyde, and D. F. Mains and C. F. Hyde have exercised said option and entered into a contract with the City of Eugene for the purchase of said property and have paid the purchase price therein set out in full, with interest, and have complied with all the terms ./ and conditions thereof, and WHEREAS, D. F. Mains and C. F. Hyde have endorsed and assigned said contract to Ambrose Dennis and requested that the deed run to him NOW, THEREFORE BE IT RESOLVED By the Common Council of the City of Eugene, that the Mayor and Recorder be and they are hereby directed to execute and deliver to Ambrose Dennis a good and suffieient deed of convey- ance, without covenants, to the above described property on behalf of the City of Eugene. An ordinance amending Ordinance No. 7753 entitled "An Ordinance prohibiting the cutting of curbs in the Oity of Eugene, Oregon, for driveway purposes, exceptin I that the City Recorder may, upon application, issue a permit for not to exceed 25 per cent of the ownership frontage and not to exceed 20 feet in anyone cut, to eac property owner making such application, declaring an emergency, and fixing a penalt for the violation of such ordinance.1I passed by the common council and approved by the Mayor March 24, 1930, by permitting a curb cut in excess of the provisions of the ordinance on the north side of 4th AVenue West between Charnel ton and Lincoln Streets, was read the first time and upon motion made for its second and third readings by title under suspension of the rules and duly seconded, the motion did not carry the unanimous consent of the council, P. J~ Hanns voting in the negative. I /32 The ordinance was therefore held for second reading at the next meeting. The Fire and Water Committee is to make arrangements to haul away the garbag ;33 from the fire department. Question raised as to limits of hours of operation of shooting galleries. /34 This is to be checked by the police chief and a report made to the council. It was pointed out at this time that J. w. McCracken had not secured special permission of the council to make an extended curb cut at Charnel ton between 5th /35 and 6th Avetlues. '\ \ , , \ \ \ ....4 ~' 6 -- - Chief of Police reported that Clair Larson, traffic officer, was in no better condition, and that Theodore D. Brown, highest on t::1e list of eligibles of 36 Civil Service Applicants, had been appointed to fill the vacancy. / I ~ The request of the reserve officers to fix up the old assembly room in the city hall for target practice for groups interested in that type of activity, was 37 referred to the Police Committee. /" The City Recorder made a: personal request for permission to use the old assembly room in the city hall for meeting quarters of his scout troop #17, after 38 approval of the Health Committee upon sanitation facilities and it was so granted. / Report was received from the WPA showing in detail the use of the $50.00 I allowance made them by the common council for the month of September, 1937.
