The minutes of the adjourned meeting of the common council held at the hour ,,.'., - of 7~30 o'clock P. M., October 25, 1937. The meeting was called to order by May~r:' ""l Elisha Large. All members of the council were present except Hendershott, Reid and 1 Farrington. The minutes of the previous meeting, October 11, 1937, were presented and 2 ordered filed as there were no corrections appearing. I Mr. Marvin T. Warlick, Manager of the Eugene Hospital and Clinic, requested special permission to waive the 12:"00 o'clock closing of the dance which is to be given for the benefit of the "iron-lung" fund in order that dancing may continue after midnight. Upon motion made and duly seconded, the request of Mr. Warlick was .. /3 granted. Further, Mr. Warlick asked that some action be taken to reduce traffic noise on Willamette Street adjacent to the hospital. He suggested the use of signs bearing the words "QUIET. .,HOSPITAL ZONE. tf He stated that the hospital is willing to contribute in any manner the council wishes to put some such plan into effect. /4 After considerable discussion, the matter was referred to the Police Committee to report at the next meeting. Mr. S. D. Allen, attorney representing Ralph and Stanley and the City Barbe Shop, addressed the council concerning the use of public sidewalks for the purpose of picketing. He believed that this should not be allowed particularly where there is no dispute or trouble whatsoever existing between the employee and employer. At this time M~. Allen presented a form of ordinance reading the same in full. He aske the council to consider adoption of such an ordinance. After considerable discussio determining whether to pass the ordinance or one of a like nature, the matter was re /5 ferred to the Judiciary Committee to report at the next meeting. f 6 At this time Councilman Hendershott arrived. I 7 Councilman A. C. Farrington arrived at this point. The $400.00 offer of J. R. Clark for Lot 8, Block 1, Shelton's Addition, was rejected by the Finance Committee and a counter-offer of $889.91 or a rental of $10.00 per month, beginning November 1, 1937 extended. Upon motion made and seconde , /8 the recommendation was duly approved. The offer of Kenneth T. Blanton in the amount of $150.00 for the South 40 feet of Lot 5 and the North 10 feet of Lot 6, Block 5, Hendrick's Amended ~ddition~ was rejected by the Finance Committee, and a counter-offer of $225.00 extended. /9 Upon motion made and seconded, this action was unanimously approved. Councilman Hendershott, chairman of the Finance Committee, reported that th Clerk of Lane County had received offers from outside parties on the following two , properties a~ainst which the city has liens: South 100 feet of Lot 10, Block 3, Whiteaker's addition to Eugene; Block 3, Lot 6, and 24.8 feet of Lot 7,Wallis-Dorri Addition to Eugene. Councilman Hendershott requested that the Finance Committee be empowered to act on these two offers for the best interest of the city. Upon motion /10 made and duly seconded, the request of the Committee was granted. The request of Mrs. Nettie Duvall asking that the city pay the. taxes on her property located at 317 Jefferson Street and more specifically known as part of . Lots 3,. 4 and 5, Block 1, Harris Addition, and add the amount paid to her contract on which she makes a payment of $11.33 monthly to the city, was held by the Finance /11 Committee for further consideration. I The City Recorder was asked by the chairman of the Finance Committee to ex- plain the proposed procedure to be followed in regard to the insurance covering city cars. The hecorder ~ointed out that two years ago, the city had insured their various automotive equipment as individual eCiuipments. Two years ago bids were called for and the fleet rate adopted which reduced the premium a great deal. It being the desire of the office to have the agents share justly and equitably in the city's insurance business, it was felt that the car insurance business should be passed among the three low bidders of two years ago. The Recorder called in these I three firms and a new bid was made and they agreed among themselves to handle the insurance as follows: Bryant De Bar for the year 1938; McLean and Sanders, 1939; and Emery-Beeson, 1940; each year the premium to be divided as follows: Forty per cent to the handling agency and thirty per-cent to each of the remaining two. After this arrangement had been made F. F. Brooke, another insurance agent, presented his bid, which was somewhat lower. The Recorder was informed that unless there was a special rating file at the Insurance Commissioner's Office in Salem, such a low rate would be impossible. The Insurance Commissioner was called and this office was notified that the rate would be the same. Chairman Hendershott of the Finance Committee, moved 12 that this program on insurance be adopted and it was duly epproved. Councilman Lamb of the Street Committee stated that a request had been made I' for a curb cut on Broadway and Pearl, the cut being on Pearl Street. He reported 00 that the cut would not reduce the parking space by reason of the fact that a curbi "~' :.:.. to be replaced at another cut now in existence on their own property. This was-ap- ,13 proved under the supervision of the Engineer. .; Request..'of the Scherer Motor Company for permission to maintain their mar- quise erected over the front entrance of their'building at the corner of 7th and Olive Streets for an indefinite period of time, was left in the hands of the en- gineer. Mr. Clubb reported that the erection of the marquise was contrary to the I provisions of the ordinance and that it was erected p~rely as a scheme for adver- ,14 tising. ~. Councilman P. J. Hanns, chairman of the Fire and Water Committee, requested- the Recorder to mail a statement to Ivan Blood, RFD #2, Eugene for services rendere 115 him by the Eugene Fire Department and it was so ordered. Councilman Page, chairman of the Park Committee, as~:ed that publ ici ty be given to the effect that property owners of the city will be held responsible for 16 trimming low-hanging tree branches to permit proper pedestI'ian and vehicular traffi . /' Further, Mr. Page served notice that residents along Agate and Villard St~ee s 17 will hereafter be responsible for the proper care of the center strips. / Councilman Bond, Chairman of the Police Committee, I'eported that' the Com- mittee could not approve of the request of the assembly room in the city hall being 18 used for target practice. Upon motion made and seconded, this action was approved~ I Councilman Bond further reported that Clair Larson, traffic officer, was in no better condition. It was the recommendation of his Comm3.ttee that Mr. Larson be paid through his vacation period with one week due from laBt year and two weeks for 1937 and the Recorder was instructed to draw a warrant co~ering this three weeks 19 period of time. Upon motion made and seconded, the recommendation was approved. I :1 Councilman Lamb reported that the repair of Fifth Avenue was under way. . He I . stated that trouble had been experienced between the city engineer and the engineer of the Oregon-Electric Company as to the proper condition of repair. It was the consensus of opinion that the Oregon-Electric Company was to raise their track to street grade and put it into proper repair and the City Engineer is hereby instruc- 20 ted to see that such state of repair is complied with. I The request of C. A. C~rlson to connect with the city sewer to serve Lots 5, 21 6, and 7, Block 1, Edblom's Addition, was referred to the fiewer Commi ttee. I Request of the Gilmore Oil Company to construct a roof over the greasing pit ~ at the service station located at 282 Van Buren Street, waB referred to the Board 0 Appeals. Upon motion made and seconded, the reouest of Richards' Brothers for permis- sion to install an indoor target range in their shop build1ng at 301 Lincoln Street 23 was unanimously granted. ( Upon motion made and seconded, the request of B. F. Smith for a lease on twenty-five feet on the west end of Lot 1 on Grand Street for the purpose of erect- 24 ing a sign, size 4 x 8 feet, was refused. / Communication from C. Valentine Boyer, President of the University of Oregon ~ asking for the assignment of a patrolman to conduct traffie in the district of the university during certain hours of the day, was referred' to the Pol ice Commi ttee. I Request of C. F. Hyde and D. F. Mains to cancel the deed issued to Ambrose Dennis and convey it instead to Anne Dennis, was referred to the Judiciary Committe 26 and City Attorney. / Reports from the Library and Health Department for the month of September,19 27 were ordered filed. Request for repeal of two city park ordinances was held for further consider - v I 28 tion. An ordinance amending Ordinance No. 7753 entitled "An Ordinance prohibiting the cutting of curbs in the city of Eugene, Oregon, etc.n had its second reading. At this time a communication from the Oregon Supply Company, petitioning the coun- cil to refuse permission to cut any more curbs than is now cut on the north side of 4th Avenue between Charnelton and Lincoln Streets, was read. Further reading of the ordinance was postponed indefinitely until the part:ies requesting the cut 29 could show cause why this should be granted. / ~ ~ 9 , ' '. ,'... ~ < ~ -- - ~ -- An ordinance amending Ordinance No. 7753 entitled "An ordinance prohibiting the cutting of curbs in the City of Eugene, Oregon, etc." on the west side of I Charnelton Street between Fifth and Sixth Avenues West for McCracken Brothers, had its first reading and passed to its second and third readings by unanimous consent of the council by title under suspension of the rule and was placed for final pas- sage. The ayes and nays were called; 'counci lmen voting aye, Lamb, Hendershott, ':',. Page, Hanns, Farrington, Bond and Carlson; nay, none; absent, .Reid. The. ordinan ce ~ 30 was declared passed and numbered 8524. I The council granted authority to cancel the following General Warrants: #32021 F. E~ Harris, January 10, 1929, $76.92; #33649 issued to C. McL~ughlin, /31 November 30, 1929, 10.00 #39927 issued to P. Veek, July 31, 1933 for $2.00. I . . Application of Merle Short to operate a rooming house known as the New York Rooms at 571 Willamette Street was approved by C. F. Bergman, Chief of Police, , 32 and this action was sustained by the council. / Application'to rebond delinquent assessment in the amount of $97.23, was upon 33 motion made and se~onded, duly approved. / - Petition from Ethel S. Vaughn requesting that she be allowed to pay the city liens on the South 55 feet of Lot 6, Block 8, Croner's A4~ition to Eugene in instal _ ments over a period of about five years in monthly payments of not more than $20~00 to cover the principal and interest, with an initial down payment of $100.00 was 134 upon motion made and seconded, referred 'to the Finance Committee for study. Councilman Page requested the a~vertisement of new bids for fencing the deer and elk corrals in Kendrick's Park. The City Recorder with the assistance of the City Engineer, was instructed to prepare the news item calling for the bids, which V35 are to be opened at the next council meeting, November 8, 1937. Upon motion made and seconded, the Health Committee was granted authority to remove the barn located on Clark Street between Madison and Monroe, which in ac- 36 cordance with the report given to Councilman Bond was in no condition .to remain on the premises.
