Council Chambers, Eugene, Oregon Ii November 8, 193'7 w I " 0 - - The minutes of the regular meeting of the common council held at the hour of '7:30 o'clock P.M., November 8, 1937. Mayor Large called the meeting to order; all councilmen were present. The minutes of the previous meeting were presented 1 and ordered filed as read. In conjunction with the regular meeting of the council, members of the Budget Committee together with taxpayers of the city of Eugene were present for discussion of the 1938 budget. All members of the Budget Committee were present I . except David Graham and George Bushman. The meeting of the Budget Committee was turned over for taxpayers' hearing at this time by Chairman Large. Citizen F. G. Reese strenuously objected to the adoption of the wage scale and the $3500..00 levy for the purpose of transient relier. Mr. Reese pleaded that the present salary scale is sufricient and that the taxpayers should be given some relief. Councilman Hendershott moved and Budgetman Horton seconded that the Budget Committee approve the proposed 1938 budget as it had been advertised. At this time Mr. Reese moved t at this motion be amended by reducing the proposed salary increases to the 1937 level and that the $3500.00 levy for relief be stricken out. There being no second to this motion, the Mayor asked if the committee was ready for the question. Question ~as called and all present voted "aye" except for a possible three who voted "nay." The Mayor declared the budget to be approved by the Budget Committee. at this time Mayor Large expressed appreciation to the members of the Budget Committee for their 2 fine endeavor in the preparation of the budget. /'" i: After a short recess Mayor Large called the council to order and stated that the council was now sitting as a levying board to pass upon the budget for 1938 as prepared by the annual budget committee. An ordinance levying the annual tax levy for the city of Eugene for the fiscal year of 1938 was read the first time and passed its second and third readings by title under suspension of the rule by the unanimous consent of the council and was placed upon its final passage. The ayes and nays were called: Councilmen voting aye: Lamb, Hendershott, Reid, Page, Hanns, Farrington, Bond and C2crlson; nay, none; absent, none. The ordinance was (3 declared passed and numbered 8525. I Councilman Lamb, chairman of the Judiciary Committee, stated that the re- quest of C. F. Hyde and D. F. Mains for cancellation of the deed formerly executed in favor of .Ambrose Dennis and to issue it instead to Anne Dennis had been withdraw . The title to the property is to remain in the name of Ambrose Dennis as originally 4 named. / Councilman Lamb requested that the Judiciary Committee be granted another two weeks in which to study the proposed anti-picketing ordinance as presented by Attorney S. D. Allen, representing Ralph & Stanley and A. \iT: Brumwell, proprietor f . /5 of the City Barber Shop. Mayor Large granted this request. I The $400.00 offer of C. A. Wetterstrom for lot on 12th l~venue East located 104 feet west of Alder Street 50' x 35' was denied by the Finance Committee as were the offers of Mr. Wetterstrom for the north 90 feet, Lot 6, Block 2, R. F. Scott's Addition ($400..00) and the north 80 feet of Lot 6 and the north 80 feet of the West 12.8 feet of Lot 5, Block 10, Scott's Addition ($400.00). Upon motion made and (6 duly seconded, the recommendation of the Finance Committee was approved. The request of Mrs. Nettie Duvall was rejected by the Finan~e Committee. '7 Upon motion made and seconded this action was accepted. / The $100.00 cash offer of J. D. Hudspeth for the West 85 feet of Lot 4, Block 30, Gross Addition was held by the Finance Committee until the value of the lot in the attached plat is determined. This recommendatian was unanimously ap- 8 proved by the council., I I The $100.00 offer of Ivan G. Brent for "Beginning 485 feet south of a point made by the intersection of the south line of 23rd Avenue with the west line of University' Street, if extended south, thence south 50 feet, thence west 106.25 feet, thence north 50 feet and thence east 106.25 feet to the place of beginning, all in 1 Eugene, Lane County, Oregon." $10.00 cash and $10..00 each month plus the accrued interest at 6% with the city to pay back taxes but n~t to furnish an insurable title I was denied by the council and a counter-offer of $200.00 extended with the same I 9 terms as above mentioned. This action waB approved by the council. - The $450.00 offer of N. E. Glass for part of Lot 5, Block 30, Fairmount Addition, was denied by the Finance Committee and a counter-offer of $1000.00 ex- tended. Upon motion made and duly seconded, the recommendation of the Committee 10 was unanimously approved. I The $1800.00 cash offer of Maurice S. Allen for the East 50 feet of Lots 1 and 2, Block 8, College Hill Park Addition was denied by the council. Upon motion 11 made and seconded, the recommendation of the Finance Committee was approved. ..... The $195..00 offer of Russell Fenn for Lot 1, Block 6, Riverwood Addition to Eugene at the rate of $15.00 down and $5.00 per month plus interest at 6% per year, was !;1ccepted on the condi tion that the terms be al tered to a down payment of $25.00 .~ I and $10.00 per month plus interest at 6%. -This recommendation was unanimously ap- _. 12 proved by the council.. r : The request of Ethel S.Vaughn to pay the city liens on the South 55 feet of Lot 6, Block 8, Croner's Addition to Eugene in installments over a period of about five years in monthly payments of not more than $20..00 to cover the principal and interest, with an initial down payment of $100..00 was upon motion made and duly seconded, accepted by the council. The City Attorney was instructed to draw up a (13 resolution and contract on the same. I Councilman Hendershott, chairman of the Finance Committee, recommended that. a warrant in the amount of $200.00 be drawn in favor of the Salvation Army for relief purposes. The ayes and nays were called, councilmen voting aye, Lamb, 14 Hendershott, Reid, Page, Hanns, Farrington, Bond and Carlson; nay, none; absent,non . / The Finance Committee reported the following bills to the council with a re- commendation that they be allowed and motion was made, seconded and carried that warrants be drawn for the same. Councilman Hendershott was granted permission to lee.ve the council chambers 16 at this point. Councilman Farrington reported that the complaint of' an old barn located on 1 Clark Street between Madison and Monroe was not in order. City Engineer Clubb stated at this time that the barn in question was located on Lawrence Street betwee Clark and Cheshire and that this property belonged to Lane County. The Health Com- 17 mittee is to see the court about having this removed. /' It was reported that there was an old shack located directly across the aIle at 154 West 20th and the property belongs to the city. 1'he Health Commi ttee was 18 given power to act in this case~ / The Sewer Committee was granted a period of two weeks in which to consider t e request of the U.S.P.O~ for' the elevation of a new sewer of' not less than 10 inches in diameter to be constructed in the alley and to extend to the southerly side of 19 the new Post Office site, at no expense to the United States~ / . The rBquest of C. V~lentine Boyer for assignment of a patrolman to conduct traffic in the district of the university during certain hours of the day was held 20 by the Police Committee for study for another two weeks. / The request of C. A. Carlson to connect with the city sewer to serve Lots 5, 6, and 7, Block 1, Edblom's Addition, was held by the Sewer Committee for another 21 two weeks. /' At this time Mayor Large called on Mr. Carlto~, an employee of Booth-Kelly Lumber Company to put his problem before the counci 1. Mr. Carl ton a.ddressed the council stating that he wanted to build a home on Alder Street but that because I his firm was an I~E.U. plant the local Central Labor Counc~l had decided to picket . him. His contract is with independent contractors. He later read a section of his call for bids which called jor "ope~ shop" on the job. Mr. Carlton addressed the - council at great length on the picket situation and asked that som~thing be done~ Mr. Allen, attorney representing Ralph & Stanley, presented a petition bearing 88 signatures in favor of an anti-picketing ordinance. Mr. Fo G. Reese addressed the council on behalf of the ordinance and asked that action be taken now. The Mayor sated that the petition and ordinance would be left with the Jud:.ciary Committee to repor 22 on at the next meeting. ( Communication from the Board of Appeals granting pel'mission to the Gilmore Oil Company to erect a roof over their grease pit at 282 Van Buren Street, was ap- 23 proved by the council. / Communication from the Civil Service Commission namIng for permanent ap- pointment those individuals who had successfully passed the performance examination required by Civil Service was approved by the council. Johnston and Wallace C ,24 Volz to the fire department. From the certified list of applicants eligibl~ for appointment to the police department, Theodore D. Brown, highest on the list with a grade of 82, was selected . )5 by the Mayor and Common Counci 1 to replace Clair Larson. I' Upon motion made and duly seconded, Mayor Large!s request that Clair Larson, stricken with paralysis, be granted a one year leave of abGence, was approved by 26 the council. /" Reports from the Engineer, Police and Health Departments for the month of 27 October, 1937, were presented and ordered filed~ Petition for the installation of a street light at ~he alley bounded by 12th , 28 and 13th and Alder and Kincaid, was referred to the Fire and Water Committee. .1' An ordinance directing the City Recorder and the Ci~y Treasurer to deduct . ,. . from the pay check of the various employees of the city the monthly premium to be paid upon their insurance to which tne city contributes, had its fIrst reading and passed to its second and third readings by unanimous consent of the council by titl under suspension of the rule. Blanton has offered the City $225.00 for said pro- perty, which, according to the appraisement, is all that the property is worth, NOW THEREFQRE BE IT RESOLVED By the Common Gouncil of the City of Eugene that the Mayor and Recorde~ be and they are hereby directed to enter into the annexed contract on behalf of the City of Eugene, and that the $50.00 down payment and all subsequent payments shall be deposited with the City Treasurer of said City. It was reported that in consideration of the privilege of making one sewer connection, Delbert E. Johnson and Leona Johnson have granted unto the city of '. , Eugene the right to lay and construct over the following described real property, \ 32 to-wit: Lot 35, Foster's Addition to Eugene, Lane County, Oregon. This was approved. An ordinance amending Ordinance No. 7753, entitled "An ordinance prohibiting the cutting of curbs, etc.1I passed by the Common Council and approved by the Mayor , March 24, 1930, by p~rmitting ~ curb cut in excess of the prOVisions of the ordi- nance on the West side of Willamette Street between 4th and 5th Str~ets, was read I the first time and passed to its second and third readings by unanimous cohsent of the council by title under suspension of the rule. Resolution authorizing the Mayor and 'Recorder to assign to Title Abstract Company the certificate of sale of real property on foreclosure for municipal liens on Lot 6, Block 15, College Hill Park Addition on consideration of $57.87 was re- f 36 ferred to the Finance Committee. At this time bids were opened on the fence requirements for the deer and elk pens. The two received were from Babb's Hardware and Western Fence and Wire Works, Portland.
