M. December 27~ 1937. Mayor Large ~alled the meeting to i order. All councilmen were present except A. C. Farrington. The minutes of the I I' previous meeting were presented and ordered filed. Upon recommendation of the Judiciary Committee a resolution authorizing the Mayor and Recorder to assign unto W. J. Lichty certificate Jf sale covering the West 80 feet of Lot 7~ Block 4, Christian's Addition upon payment of $122.77, was I 12 unanimously adopted by the council: RES 0 L UTI 0 N WHEREAS, heretofore the City of Eugene foreclosed a certain Judgment Lien entry appearing at Page 469 of Book 5 of the Docket of City Liens I and conducted a sale of the following property: The West Eighty (80) feet of Lot Seven (7) Block Four (4), Christian's Addition to Eugene, Lane County, Oregon. I and advertised and showed the same in said proceeding as having been J assessed to Robert W. Prescott and being owned by Alice Lynn. ~ It now appears to the Common Cpuncil that the property was actually II 6wned by IT. J. Lichty but because of a defect in the deed conveying the same to him it was not properly advertised and he did not receive II proper notice and the said W. J. Lichty has applied to the court for an assignment of the certificate of sale of said real property on !I foreclosure and the council having considered all the facts and circum- 'I I stances have determined that in the interests of justice that the I city's certificate should be assigned to the said ~. J. Lichty and I I i at the expiration of the year for redemption, that the City Treasurer II should execute a deed to hi~ for the property. I I IT IS THhREFORE RESOLYED By the Common council of the City of Eugene, that upon receipt of ~122.77 from W. J. Lichty, that the Mayor and Recorder be and they are hereby directed to assign the certificate of I sale heretofore issued by the City Treasurer to: The West Eighty (80) I Feet of Lot Seven (7), Block Four (4), Christian's Addition to Eugene, Lane County, Oregon to Y~'. J. Lichty and upon the expiration of the year of redemption that the City Treasurer shall IDske, execute and deliver a Treasurer's Deed to said W. J. Lichty, his heirs or assigns. The Finance Committee requested an additional two weeks time to consider 3 the property offer of Jack Luckey and L. C. DeBurgh. / The $941.78 offer of Melvin L. Price for th~ South 55 feet of Lot 6~ Block Croner's Addition, with a down payment of $25.00 down and S12.00 a month plus ac- , crued interest at 6% per year for six months, then $15.00 ~er month, was accepted by the council on the condition that a down payment of ~lOC.OO be made rather than ,the ~25. Upon motion made and seconded, the recommendation of the Finance Com- 4 mittee was duly accepted. / Upon recommendation of the Street Committee, the ccuncil approved repair of cement sidewalk on Franklin Boulevard east of the Lnchorage along the mill race at a cost of approximately $50.00 to $75.00 with funds to te drawn from the emergen /5 cy account. I The City Recorder was instructed to submit bills tc the following parties to whom services had been rendered by the fire department cn calls in the outlying districts: A. Kelly, West 11th, $15.00; Fred Johnson, Rooeevelt Blvd., $15.00; /6 George Wilhelm, Creswell, Oregon, $65.00; and it was so ordered. 7 At this time Councilman Farrington arrived. It was the recommendation of the Park Committee th2.t signs be posted on all temporary private roads to the effect that it was private property and permission I to pass over was revocable at any time. Upon motion made and seconded, this re- f 8 co~mendation was aprroved. The Police Committee recommended approval of the Oregon Hotel Restaurant and Hotel License and the New Deal Bowling Alley Retail Beer License with the con- dition on the latter that no minors are to be allowed within the premises. All ap- (9 plications for renewals, submitted at this meeting, were approved. At this time Councilman Lamb moved acceptance of sE'curity from the First National Bank for the payment of a lost coupon on a ~ater Board bond. Upon motion 10 made and seconded, this recommendation was approved. r , ~ I II ~ 25 -._~ -- - - --- -- -- - The Health Department and Eugene Public Library reports for the month of II November, 1937, were approved and ordered filed. I Resolution from the ~est Pomona and Lane Pomona Granges and the County ,f~ Court requesting extension of time for use of the rest cottage, waB presented and ;.,n after some discussion, upon motion made and seconded, the following hours are to be observed from now on; rest room and waitin~ room to be kept open during we,ek until 7:30-o'clock P. M..and on Saturdays and other days when the need is apparent until 112 10:30 o'clock P. M" Action was unanimously approved. Ci ty Attorney Calkins was asked to confer '1vi th the Planning Commission the petition protesting the maintenance of an incubator factory, auto trailer building, 13 auto wrecking yard in the rear of 260 ~est 12th Avenue operated by Mr. McClanahan. I ( Motion was made and Seconded that all complaints concerning the use of pro- perties coming under the zoning and building code be filed in writing to the City Recorder and automatically referred to the Police Committee with power to act. This 14 was approved by the council. I Councilman Hendershott reported that stairways were being partially blocked r 15 by use of vendors and should be investigated. The Recorder presented the matter of the ~alters-Bushong franchise for the blow pipe across High Street with a statement that the franchise fee had not been paid for the years 1936 and 1937. The City Recorder was instructed to communicate with Mr. Fred Walters and inform him that if he wished the conditions of the franchise to stand that he must pay all amounts in arrears and ~ay annually there- r16 after. Upon failure to do so, the franchise would be revoked. Resolution directing the Mayor and Recorder to execute a bargain and sale deed to Pacific Loan and Savings --Association (transaction represented by Cashman 117 and Proudfit), was upon motion made and duly seconded, adopted: RES 0 L UTI 0 N WHEREAS~ the City of Eugene is the owner of the following described property~ to-wit: I "Beginning at a stone on the East line of Eugene Avenue, and said stone set in County Survey No. 644~ 54.36 chains South of the Northwest corner of the D. R. Christian Donation Land Claim, and running thence North 83 degrees 12 minutes East 490.38 feet to the middle of the County road, thence along the middle of said road South 14 degrees 15 minutes East 62 feet, thence South 83 degrees 12 minutes West 225.6 feet, thence South parallel with the east line of said Eugene Avenue, 400 feet, thence South 87 degrees 42 minutes West 278.5 feet, thence along the east side of said Avenue 439 feet to the place of beginning, containing 3.178 acres of land in Section Six (6) Township 18 South Range 3 West, in said Lane County, Oregon" and ~HEREAS~ the City of Eugene has caused the same to be appraised and determined its value, and \NHEREAS the Pacific Loan alld Savings Association have offered the City $5500.00 for said property, which, according to the appraise- ment is all that the property is worth, NOV;, THEREFORE, I BE IT RESOLVED by the Common Council of the City of Eugene that the Mayor and Recorder be and they are hereby directed to execute and deliver to Pacific Loan and Savings Association a bargain and sale deed to the above premises, upon payment of the sum of $5500.00, the purchase price as determined by the city. Renewal of the airport contract between the city of Eugene and United Air Lines Transport Corporation, was referred to the Judiciary Committee and City Attorn y 18 with power to act. I / The City Recorder presented a statement of the city affairs for the year (19 ending December 31, 1937. The Police Committee recommended that no license fee be imposed upon pin and ball operators until after the co~rici1 meeting of January 10, 1938, at which time /20 it is believed a supreme court decision 'on the legality of the devices can be expect d. Communication from the League of Oregon Cities on codification of the city charter and ordinances, was presented. A price of $500.00 plus $60.00 for two com- I pleted copies was the amount quoted by the League.
