Mayor Large called the meeting to order. Councilmen present were: Lamb, Hendershott, Reid, Page, Hanns, Farrington, Bond, Carlson; absent, none. ~;t': t< , ~~ The first order of business was the appointment of a successor to A.A. Reid, councilman of the second ward, who on January 10, 1938 had submitted his resignation to the council. Upon motion of Councilman Lamb, seconded by Hendershott, Mr. Reid was appointed to succeed himself. This was met with unanimous approval. Councilm,an Reid approached the Recorder's desk and was sworn in to serve until the expiration of his term. Mayor Large reported to the council tlnt Lane County was preparing another tax foreclosure and thought it advisable for the city of Eugene to have a working program in conjunction with theirs. '3 The matter was placed in the hands of the Judiciary Committee and City Attorney. J Councilman Lamb, Chairman of the Judiciary Conmlittee, recommended -that the offer of James Rodman, rejected at the last meeting 'of the council, be now accepted on the condition -that in ad- dition to the $2000.00 payment suggested in his letter that he make his regular payment of $1000.00 plus interest on February 24, 1938 as provided under the terms of his original contract. Upon /4 motion made and duly seconded, the recommendation of the Committee was unanimously accepted. The $400.00 cash offer of B. H. Coffman for property described as "Beginning at a point in the west line of Wladison Street 81 feet south of ihe south line of Broo.dway, running thence south 80 feet, thence west 80 feet, thence north 80 feet, thence east 80 feet to the place of beginning, It was denied by the Finance Committee and a counter-offer of $1100.00 extended. Upon motion made and I 5 duly seconded, the recommendation of the Finance Committee was approved. The ~~'1300.00 cash offer of Burton B. Young fb r property described as "Beginning at the south- west corner of Lot 1, Block 5, Blair Street Addition and run north 160 feet, thence East 85 feet, thence Southeasterly along the west line of the alley 50 feet, thence west 69 feet, thence south 110 feet to the north line of Second Street, thence west along the North line of 2nd Street 50 feet to~e place of beginnlng, being part of Lot 1, Block 5, Blair Street Addition and more commonly known as 155* and 1567 West Second Street, was presented by the Finance Conuni ttee and upon motion, made and seconded, it was ordered that the same be lEld for another two weeks. Hyland for permission to make monthly payments of $10.00 on property known as "Begin 66 feet South of Southwest corner of Lot 6, Block 6, Shelton's Addition to Eugene, run West 174 feet, South 24 feet, East along line of O. and C.R.R. land to a point due South of beginning and North to beginning, in Eugene, Lane County, Oregonll, which he is contemplating pur- chasing from the heirs of J.E. Gray, deceased, was upon motion made and duly seconded, granted by the council. The $600.00 cash offer of Frank Miner for property located at the North\VBst corner of 15th and Mill Streets and more fully described "Beginning at the Southeast corner of Lot 2, Block 6, Scott's Addition, running thence North along the West line of Mill Street 115 feet, thence West to the West line of Lot 2, thence South 15 feet, thence East 15 feet, thence South 100 feet, thence east to the place of beginning", was rejected by the Finance Committee and a counter-offer of $1653.00 extended. Upon motion made and seconded, the recommendation of the Conunittee net with unanimous approval. Ralph Nissen's second offer of $400.00 cash for Lot 2, Block 1, Cherry Grove Addition, rejected by the Finance Committee and a counter-offer of $907.09 extended for consideration. motion made and seconded, the recommendation of the Conunittee was unanimously approved. was Upon The offer of Jens D. Upon motion made and duly seconded, this recommendation was accepted. Upon motion made and seconded, the council moved to accept not less than $500.00 for the property on which L.C. DeBurgh and Jack Luckey made an offer of $150.00 on December 13, 1937. James'F. Eagan's request to make payments of $10.00 per month on a principal amount of $308. and interest of $127.28 in order to acquire title to property known as Lot 8, Block 2, Kelsay's / 12 First Addition, was upon motion made and duly seconded, accepted by the council. Upon motion made and duly seconded, the council agreed to make the segregation on Irene A. McCuistion's property located at 264 Washington Street. The south nine feet to be released with the city to receive on the assessments not less than $60.00. I ,13 /14 J 15 The Police and Fire &: Water Com.rnittees were requested to report at the next meeting their views and recommendations 'concerning the sale of fireworks during the Fourth of July celebration. The Fire and Water Committee recommended that statements be mailed to the following parties to whom services had been rendered by the Eugene Fire Department on out-of-tmv.n calls: Mrs. Mann, 1220 Grant Street, $8.00; R. C. Crow, 2650 Willamette, $5.00; Robert SChiska, Hendrick's Fark,$8.00; T.T. Parker, Route #3, $6.00; Florence Morton, 1964 Madison, $5.00. Discussion for allotment ,of funds to ,the Salvation Army for transient and non-resident famil relief was opened by Councilman Hendershott, and a letter containing the revised request of the ArIrr;f presented and noted as follows: January, 780.00; Feb 440.00; ~~r 390.00; Apr 370.00; r~y 260.00; June 90.00; July 60.00; Aug 50.00; Sept 40':00; Oct 60.00; Nov 260.00; Doc 450.00. Councilman Hen- dershott stated that the Committee felt that for the present time that the Salvation Army should be paid ~~500.00 and then work out a program of monthly payments. Major Clarence Ford stressed the poin that already they had extended relief during the months of November and December in 1937, planning on funds being available from the city vii th which ,to meet their obligations. Mayor Large expressed openly that it would be advisable to formulate a program that would 'carry Until April 1, 1938, be- cause itvvas his understanding that the Transient Relief Building in Skinner's Butte Park, was available to the Army only until that date. It was pointed out_that it would be impossible to pro- gram the full amount budgeted because of the fact that the current tax eollections 'very seldom ex- ceed eighty per cent and further that part of the relief fund should be held for other purposes. It was determined by the Finance Committee that a total sum of ,$1200.00 be paid on the following basis: January $780.00, February, $210.00 and I~rch, $210.00. Upon motion made and seconded payment of $780.00 to the Salvation Army was put to a vote and councilmen voted as follows: Aye, Lamb, Hender- shott, Reid, Page, Hanns, Farrington, Bond and Carlson; Nay, none; absent, none. Motion was carried I I 16 I Councilman Farrington, chairman of the Health Committee, stated that the residence at the southwest corner of First and Lawrence Streets had been partly burned and was n01i{ in an lIDsightly and dangerous condition. He stated that the oimer, Rev. D. M. Higby, resided at 206 East 4th Street Albany, Oregon, and requested that the office of the City Attorney communicate_with Rev. Higby and ask that the saine be removed or to authorize the city to have it removed. If the ovm,er does not agree to this, then the City Attorney is to prepare formal condewnation papers for presentation to 17 the council. This action was duly approved. / The Police Committee asked that the City Recorder be instructed to write the state Highway Commission and ask for a report on the traffic survey made in the city of Eugene. And further to request them to state,the number of traffic control signals needed in the city and their exact loca- tions. The Recorder ivaS also asked that the Commission be requested to cooperate in financing this program, and upon motion made and seconded, the recommendation of the Police Committee was unanimous y 18 approved. I ,I i: I: \191 i 20 il I II :1 21 I Councilman Bond, Chairman of,the Police Committee, stated that a complaint had been filed against A. Sorensen, 568 West 7th Street, to prevent him from polishing; cars at that location. Mr. Bond stated that the work was being done by hand and that this was Mr. Sorensen's only means of a livelihood and it was his request that he be allowed to, continue this work, and it ivaS so ordered by unanimous consent of-the council. I Mayor Large stated that Dr. F. M. Day had informed him that the_city roads leading to Hen- drick's Park were in a deplorable condition. The matter was placed in the hands of the Street Committee. City,Attorney S. M. Calkins was asked to prepare an ordinance to repeal the Iron Lung ordi- nance passed and approved by the council on September 27, 1937, and it was so ordered. Communication from Joseph Harrell, bidding for a lease of the municipal airport, providing that the lease is not avvarded to Harold Sanders, the present operator, was presented and referred t the Finance Committee. City Engineer Club, collector of airport rentals, reported that Mr. Sanders had not paid his rent for a period of eight months. It "ras finally; determined to inform Mr. Sanders that unless his rental is paid in full that the contract will be awarded to another party. Upon motion made and seconded, this action vms approved. 24 I I Communication from the Civil Service Commission listing for appointment the candidates who had successfully passed the examination for sergeant in the police department, was presented. Mr. Stephen J. Hanns, being highest on the list, vvas selected by the council and his $5.00 increase in 25 'pay to become effective February 1, 1938. / CORmunication from Oregon Motor Stages in which they advise the council of their plan to dis- continue city street bus operations in some localities and commence them in others,' was referred to the Street Committee for study. 26 / Letter from Mrs~ Jennie V. Marks ,in which she states that she suffered a severe injury as a result of a sidewalk fall north of 16th Avenue West on the west side of Olive Street. She expects the city to respond in payment of damages sustained. The matter was referred to the Jud iciary Committee and City Attorney. I 27 / Communication from the Board of Appeals in which they recommend that Wilbur H. Hyland, ~~nager of Eugene Planing Mill, be granted a permit to erect a buildir..g of Type V Construction, 9100 square feet floor area, on property located on the west side of Iawren~e Street be~veen Third 28 Avenue and the S.P. railroad tracks, VffiS sustained by the council. ,- / ~ ~ 35 I I I I I Report from the Eugene Public Library for the month of December, 1937 was presented and 29 ordered filed. 30 Report of the City Engineer for the year 1937, was upon motion made and seconded, ordered ~1 ~;:; filed. Report from the City Milk and Meat Inspector showing work accomplished during the year 1937, 31 was upon motion made and duly seconded, ordered filed. J Letter from Fainmount Presbyterian Sunday School extending a vote of thanks to the council / 32 for their attitu4e on the pinballs, ,vas read and ordered filed. Petition containing the names of property owners and business people on East Eighth Street, asking that the Council reconsider the installation of stop signs on East Eighth Street, intersected by High, vms referred to the Street and Police Co.mmittees. 33 I An ordinance defining lImilkll and certain "Milk products", milk producer", ilpasteurization", etc., prohibiting the sale of adulterated and misbranded milk and milk products.......the enforcemen of this ordinance and the fixing of penalties; and repealing all ordinances and parts of ordinances in conflict herewith, and declaring an emergency/' was read the first time and passed to its second and third readings by unanimous consent of the council by title under suspension of the rules and ,ms placed for final passage. The ayes and nays were called; councilmen voting aye: Lamb, Hendershott, Reid, Page, Hanns, Farrington, Bond, and Carlson; nay, none; absent, none. The ordinance was de- 34 clared passed and numbered 8531. Application to conduct a rooming house at 862 Pearl by M. Parks, Lessee, ,vas upon motion (35 made and duly seconded, accepted by the council upon approval of the Chief of Police. Application for a skating rink license at 25 west 7th Avenue, was upon motion made and seconded, granted to Earl H. Neal, applicant, upon the written approval of Chief of Police Carl F. Snodgrass 309.&5 300.00 Resolution calling an amendment to the City Charter authorizing the Council to levy a tax of one mill on the dollar valuation upon all of the taxable property in the City for the acquisition of Spencer Butte area and the South Willamette Street area for recreation parks, was laid aside for'''-.. possible placement on the ballot at the regular primary election in May, 1938. The ayes and nays were called on the payment of ~~189.01 to the League of Oregon Cities for dues of 1938. Councilmen voting aye: Lamb, Hendershott, Reid, Page, Hanns, Farrington, Bond and Carlson; nay, none; absent, none. Payment of the same was authorized. Roy E. Morse, Chainman of the Civil Service Corrnnission, whose term of office expired January I, 1938, ,vas reappointed by the council to serve another six year term.
