Eugene~ Oregon February 28~ 1938 1 The minutes of the adjourne4 meeting of the Common Council held at the hour of 7:30 o'clock P.M.~ February 28~ 1938. Mayor Large called the meeting to order. Mrs. S. M. Dinsmore reported that when the new water main was laid in front of her property at 296 Lawrence Street that the settling of the same has caused the sidewalk to drop to one side and the driveway crossing the main is sunken and broken. She was asked to consult Mr.J.W. MoArthurt Superintendent of the Eugene Water Board~ on the matter. The reoommendation of. the Judiciary Connni ttee to not allow the $74.00 claim of Albert D. Appleg~te~ was upon motion made and duly seconded~ accepted. The $600.00 cash offer of E. B. McCall for the East 80 feet of the North 160 feet of Lot 2~ Block 28~ Fairmount Additiont was upon the recommendation of the Finance Committee~ held for further consideration and it was so ordered. The $400.00 cash offer of L. N. Lengacher for Lot 9. Block 6. Fairmount Amended Addition. was upon motion made and seconded, denied by the council and a counter-offer of $800.00 extended. . The $350.00 cash offer of Ralph M. walker for ,Lot 3, Block I, Gilmore Addition~ was upon motion made and seconded~ denied by the council and a counter-offer of $600.00 extended. The Finance Committee recommended waiver of the 10% penalty and 10% interest and in lieu thereof acoept payment of 6% 1nterest~ plus principal sum~ on property described ,as "Beginning at a point 280 feet North of the Southwest corner of Strip "A" of the Elias Stewart Addition to Eugenet Oregon and rwming thence North 140 feet. thence East 61 feet, thence South 140 feet~ thence West 61 feet to the place of beginning. all in Eugene. Lane, County~ Oregon./l This request was made by A. R. Zimmer. and upon motion made and. duly seconded, the recommendation of the Committee, was ap- proved. . The $750.00 c,ash offer ,of B. H. Coffman for property described as "Beginning at a point in the West line of Madison Street 81 feet South of the South line of Broadway. nmning thence South 80 feet. thence West 80 feet; thence North 80 feet. thence East 80 feet to the place of be- ginning" was rejected by the council and a counter-offer of $1000 extended. Mr. C. K. Talbott's $650.00 offer for the same piece of property was likewise rejected and the same counter-offer ex- tended. Connnunication from B. J. Morrow asking for council's reconsideration of hi s $185.00 offer for Lot 10. Block 26, College Hill Park Addition, was presented. The council refused to ac- oept less than $275.00 and it was so ordered. Offer of Mary W. Wright in the sum of $350.00 cash for Lot 2~ Block 10~ Hollenbeck's Addition. was rejected by the council and a counter-offer of $586.25 extended. W. C. Mclain's second offer 01'$600.00 for Lot 6~ Block 21, College Hill Park Addition~ was acoepted by the counoil. The $561.15 offer of Colin H. Macdonald for Lot 3~ Blook 26~ College Hill Park Addition~ was rejected by the council and a counter-offer of $600.00 extended. The ,$475.00 offer of G. R. Clemens for Lot 2, Block l~ Gilmore Addition, was rejeoted by the council and a counter-offer of $600.00 extended. Communication from the Clerk of Lane, County stating that they had received an offer for the South 100 feet of Lot 10~ Block 3, Whiteaker's Addition~ against whioh the city has liens~ was presented. The Mayor and Recorder were authorized to exeoute a warrant for payment of the taxes to lane County and place a value of $1800.00 upon said property and it was so ordered. The $700.00 offer of ~r. and Mrs. Theodore Forcier for the North'68 feet of Lot 5, Blook 20~ Packard ~ddition. was rejected by the council and a counter-offer of $1000 extended. Relative to the Norman F. Schneider offer, the oouncil rescinded its former aotion, and agreed to accept the $U14.:i7; offer with a payment of $10.00 per month on the condition that :Mr. Schneider clear up the taxes with Lane County, amoUnting to ,$106.51'" Tlie Mayor and Recorder were directed to enter into a oontract on behalf of Mr. Schneider and the following resolution was upon motion made anq duly seconded, adopted: RESOLUTION 'WHEREAS, the City of Eugene has acquired title to the following described property, to-wit: Lot 2~ Block 2, West 6th Street Addition to the City of Eugene and, ..... The $450.00 offer of Eunioe H. Ha'\:haway for Lot 8, Block 5, Hollenbeck's Addition, was re- jeoted by the council and a counter-offer of $600.00 extended. 19 / Seoond offer of $800.00 from Anse Cornell (By K.K. Folgedalen) far the South 21.47 feet of Lot 2 and all of Lot 3, Block 32, Gross Addition, was upon recommendation of the Finance Committee ordered aooepted and upon motion made and seconded, it was so ordered 'by the oouncil. The oouncil's former counter-offer of $1052.25 was herewith rescinded. 20 I The $460.00 offer of Alfred W. Hanns opened discussion regarding action the city shou.ld take in the dis- position of the Jay W. Carr property and asked Charles Paine of tile Rug,h Realty Compa~ to explain the si tua tion. Mr. Paine point:ed out 1:ha. tit had been Mr. Carr's intention to redeem the property but tilat he had been unler the impression that it was tax foreclosure and not lien foreclosure and had always writ-ten the Rugh Real ty Company concerning his taxes. He further stated tha t prior to the time that the city took title to said property, Mr. Carr drew a che,ck for the amount due the ci but that check Was not presented to the city until after the city had taken title by reason of the fact that Mr. Carr is 1 iving in New York City. Mr. Paine requested the council to allow Mr. Carr to redeem his property and expJained that his client is willing to pay all assessments plus the penalty and interest as provided by law. Moved by Hanns and seconded by Reid, it was unanimously approved to allow Mr. Carr to redeem his property and it was so ordered. The $1300.00 offer of Burton B. Youngfbr '\:his property was herewith denied and the previous owner, Jay' W. Carr., given first rights. Carr has offered the City the sum of $523.08 for said property, which, according to the appraisanent is all that the property is worth. ~ ~ NOW, THEREFORE BE IT RESOLVED by the Common Council of the City of Eugene that -the Mayor and Recorder be and they are hereby directed to exeQute a bar- gain and sale deed to Jay W. Carr for the above described property, and to accept as the purchase price thereof the sum of $523.08. Councilman Hendershott stated that Mr. James A. Rodman claimed title to residences at 1104 and 1ll.t4 East 28th Avenue and to which property the city also claimed title. It was revealed that Mr. Rodman was collecting rent and it was the Finance Committee's recommendation that the City Attorney investigate the matter and report at the next council meeting and it was so ordered. Mr. Hendershott furiher stated that the city had recei wd an offer of $20.00 for all of the old tin pipes stored in the assembly room of the City Hall and recommended that the offer be ac- ,cepted and it was so ordered. Mayor Large addressed the council cOllcerning the city's disposal of ciW-owned property. Mayor Large upheld the present program but wished to refer the problem to the Finance Committee for their study and recommendation, determining whether or not a change of program is desired. Mr. Hen- dershott, Chainnan of the Finance Committee, stated that his Committee would be glad to meet at any time with such organizations as the looal Realty Board,County Court, etc., to work out any program that they deemed advisable. Mr. R. H. Parsons, Parsons Realty Company, '\YB.S invited by the Mayor to address the council. Mr. Parsons stated that he ihought improvements could be made such as having the property appraised and .prices set on the property and title made good so that a sale could be consumnated without delay. He suggested that a list of all city-owned properties with a definite price set opposite them, be filed with all Realty Companies, so that if they are in a position to make sales of the same, they can do so. He fur-ther stated that he was certain that the Realty Board would welcome -the opportunity of meeting with the Finance Committee in order to discuss the problan. Counoilman Hanns, Chairman of the Fire and Water Conunittee, reoommended that statements be mailed to the following parties to whom servioes had been rendered by the Fire Department on out-of-town calls: Ray C. Newbury, $15.00; E.C. Hall, $12.00; Jack Stuber, $5.00. This recommenda tion was duly accepted by the council. Mr. Hanns further recommended that the City Attorney be instructed to wri te all parties, whose accounts are delinquent with respect to ou~of-town calls, and further that a certified list of said delinquencies be posted in the fire department and any calls received from those listed are to be denied by reason of non-payment of bills. Upon motion made and seconded, the recommendation of the Committee was duly approved. Councilman Page, Chairnan of the Park Connnittee, recommended that the city of Eugene be the sponsoring agency for the construotion of sidewalks to Hendrick's Park that are necessary to connect with the present sidewalks and park through WPA projects. This ms approved and the City Engineer instructed to make the necessary preparation for filing said applications. Mr. Page further stated that it was now necessary to secure gates for the new deer and elk pens . Mayor Large stated that this was the problem of the Park Board to take care of out of the present budget. Mr. Page stated that he ,had received innumerable complaints on trees that needed trimming in order to afford proper pedestrian traffic. The matter was referred to the Park Board to handle to the best of their ability. ~ Police Committee recommended installation of a street light in the alley looated bet- ween Alder, Kincaid, 12th and 13th Streets. The recommendation of the Conmdttee was duly approved. Mayor Large stated tbl t he and City Engineer Clubb had made a trip to Portland on February 17. to meet with the State Highway Commis sion regarding the instllation of traffic lights in the city of Eugene. He reported that the Connnission had requests from two other cities and that they had promised them that a definite report would be made at their regular March ~eting. ~or Large ex- pressed hopes 0 f securing financial aid from the Highway Commissi on in -the installation. Councl1mm Rei d raised the que stion of oarrying off water from. the Skinner Butte Park road where there is now installed a drain ti te under the road which lets the water flood the flat countyy He suggested that this be tiled to a proper carrying away point. City Engineer Clubb was illStrocted to prepare an estiDR te on the, oost of. such a project. The City Recorder was instructed to not sign and release the municipal airport contract between the City of Eugene and Harold Sanders until the rental and commissions on the 1937 contract were paid in full and it was so ordered. Letter from Graziel1a V. Q The offer of Robert C. Hall in the amount of $400.00 for property described as ~Beginning at a point 150 feet south of the Northwest corner of Lot 1, Block 22,F'airmount, running thence South 55 feet, thence East at right angles to the westerly line of Fair-mount Boulevard, thence northerly along the west line of Faimount Boulevard to a point due Eas"tand at ,right angles to the place of beginning, thence West to the place of beginning", was presented and referred to the Finane Committee for consideration. Schneider for a permit to move the house at 1562 Thirteen Avenue East to the rear of the lot and to erect a duplex resi dance on the present site of the old house. As this location is directly across the alley from the duplex erected by George Turnbull und r special permit of the council, the Board of Appeals recommended that this request be granted and thi action was sustained by the council. 37 ( 38 f Request from C. F. Goettling for permission to install a "safety metal flue" in his office located at 715 Oak Street, was denied by the Board of Appeals and action sustaimd by the council. Communication from lane County Abstract Company in connection Vl'ith "The south 55 feet of the North 110 feet of Lots 3 and 4, Block 29, Gross' Addition to Eugenc3 as the same is platted and recorded on Page 15, Volume 3, lane County Oregon Plat Records in Lane County, Oregon, was referred 51 to the City Attorney and Judiciary Committee. / Resolution to amend the charter of 1:he City of Eugene and adopting civil service for all employees of its street and sewer departments, was presented. After a thorough discussion in which the majority of councilmen expressed disapproval of the application of Civil Service in the present departments of the administration, the final vote on the proposed measure stood as follows: Aye: Lamb, Hanns and Bond; nay; Hendershott, Reid, Page and Farrington. Hence, the resolution asking tha the electorate be allowed to vote on civil service for -the employees ot' the street department, was voted down four to three. It was revealed that there was a grand total of $1707.89, which by law would be appropriated as follows: Polioe Matron $683.16; Veterans of Foreign War, $228.19; Disabled Veterans of Foreign War, $101.41; Spanish War Veterans" $190.16; AmeriCIan Legion, $498.63; Grand Army of Republic $6.34. 53 / Resolution direoting the Dayor and reoorder to transmit a word of congratulation to the newly-appointed President of the Uni versi ty of Oregon, Dom ld M.
