I 2 The minutes of the previous meeting, February 28, 1938, were presented and ordered filed. Attorney William East addressed the council on behalf of his client, Norman D. Pohll, whose request for the reclassification of the property at the N. It was therefore his reoommendation that the lien dockets be corrected to show these olaims were all paid and said property clear of liens. Upon motion made and. duly seconded, the recommendation of the Finance Committee was unanimously approved. I 11 / The $875.00 offer of W.I. Lane for the South 80 feet of Lot 6, Block 8, Croner's Addition' with a payIOOnt of' $75.00 cash and $12.50 per month plus interest at 6%,. was accepted by the council provided the prospective purchaser agrees to make a cash doym payment o:r $175.00 and $15.00 monthly installments plus 6% interest, and it was so ordered. 13 I The $750.00 cash offer of Frank Miner for -the West 114.5 feet of Lot 6, Block 3, Kelsey's First Addition, was denied by the Finance Committee and a counter-offer of $1500.00 extended. Upon motion made and seconded, the recommendaticn of tile Finanoe_ Committee wa.s duly aocepted. The $600.00 offer of B.J. Morrow and William F. ~uske for 1.01:;8 10, 11 and 12, Block 26, College Hill Park, was accepted by the Finance Committee on, the oondi ti,on that the purohasers furnis their Olm titles to said lots. The City has agreed to pay :the back taxl3s. Upon motion made and seoonded, the reoommendation of the Finance Committee was approved. I 12 / 14 / Communication from Charles P. Poole requesting tilat he be allowed to complete the payment of $10.00 per month on Lot 6, Block 2, Tiff's Plat, now und~r oontraot -1:.0 Horner Legge, who wishes to turn his interest in the proper-tu over to Mr. Poole, was ac_cepted by the Finanoe Committee and upon motion rrade and seconded, approved by -the council. 15 I The Finance Committee recommended aoceptance of the $800.00 ,oash offer of B.H. Coffman for the property desoribed as "Beginning at a point in tile West line of Madison Street 81 feet sou-th of the South line, of Broadway, running thence South 8p feet, -thence West 80 feet, thence North 80 feet, thence East 80 feet to the' p]aoe of 1:>eginning," on the oondition that the purchaser commenoe building within a period of ni~ty days and upon motion made and duly sl9conded,' the recommendation 0 the Commi ttee, was a ppr oved . 16 / The $550.00 cash offer of Lloyd A. Payne, on behalf of his client, Dr. Edward E. Gray, f the West 55 feet of Lots 5 and 6, Block 24, Gross Addition to Eugene, was rejeoted by the Finanoe Commi ttee ani a counter-offer of $650.00 extended. Upon motion made and seconded, the recommendatio of the Committee was accepted. I 17 / Seoond offer of L.N. Lengacher in -the amount of $500.00 for Lot 9, Block 6, Fairmount Addition, was rejected by the Finance Committee, aocepting no less than $800.00, the counter-offer extended the purchaser at the counoil meeting of February 28. Upon motion made and seoonded, the recommendation of the Committee, was approved. 18 / The $52.00 offer of Alma Hastings for the East 36 feet of the South 40 feet of Lot 2, Block 18, Hendrick's Addition, was rejeotedby the Finance Committee and upon motion made and se- oonded, the recommendation of the Committee was duly approved by the council. 19 / Mayor Large stated that in a conversation with Herman Kehrli he had learned that the Lea e of Oregon Cities had reoeived an additional federal grant which would make it possible to codify the ordinances of the City of Eugene at a cost of $500.00. He further stated that should application be made , it would not be acted upon until fall or uD:til after budget time arid the oi ty would not have to continue with said application if the counoil decided to reject it in the meantime. Upon motion 20 made and seconded, application was ordered made for said project. / At this time Councilman Hendershott raised the question of constructing a sewer to certa' properties located at the south end of University Street. City, Attorney Cal~ins stated that funds for said improvement oould not be taken from the Improvement Bond Sinking Fund. No further discussi n 21 was had. / Councilman Bond, Chairman of the Police Connnittee, reported that 409 tickets had been 22 meted out to traffic violators during the month of' Febroary. / 23 J Police Committee Chairman Bond reported that Ed Kuni appoint.ed last year ,as dog catcher, was willing to serve the city again this year on the same condition and terms agreed upon the for- mer year, and recommended his appointment. He further recommended that, suitable quarters be con- structed to house the dogs picked up. Upon motion made and seconded, the recommendation of the Police Committee was duly approved by the council. An ordinance repealing Ordinance No. 8439 entitled "An ordinance regulating the use of power-speakers, callippes and other noise-making, music-making or speech-making devices upon the streets of, the City of Eugene and requiring a license therefor," was re,ad the first time and passed to its second reading. Final reading of the ordinance will be made at the next meeting of the council inasmuch as the "NO" vote of Councilman Hendershott prevented t:he repealof' the ordinance, which requires unanimous vote of the council for the emergency clause. I I 24 I Mrs. Fred Broders, representing the local Garden Club, asked, for council cooperation in a city-wide "cle~up" early in April. A house-to-house canvass will be made to interest all resident . Arrangements will be made for hauling away of rubbish where residents plaoe it on the curb. The oos will be determined later. The oouncil offered its whole-hearted support to assist in making the 25, city more presentable. It was revealed that there was still a balance due of $20.00 on the monthly payment,basis and that there was $100.00 due the city on connnissions. Councilman Page~ member of the Finance Connnittee~ moved and it was duly seconded that Harold Sanders be instructed to make all payments due to the oity for 1937 prior to April 1, 1938~ and fUrther that a new contract be prepared embodying the features of the oontra.ct that existed between the city and Herman Hobi~ former airport manager and it was so ordered. {.....\\. <~... '.....,. ~ Request from the Eugene Neon Sign Company to allow a sign to be left standing mich was erected 'in Zone R-l before they were aware of the restriotion, was denied by the Board of Appeal and aotion sustained by the counoil. Request from H.L. Edmunds for the reolassifioation of a paroel of property on the south side of Thirteenth Avenue west between Willamette and Olive on whioh stands a small brick struoture~ and being just outside the business zone, was presented. The Board of Appeals reconnnende that the Eugene National Company,be allowed to use this as business property provided the occupanoy be approved by the Board. The council refused to accept the recommendation of the Board and the request was herewith denied. Request from Ceoil Deal for a permit to build an addition to his residenoe, store and servioe, station at 101 Van Buren Street~ was granted by the Board of Appeals and aotion sustained by the counoil. Request of R.P. Dixon~ Manager of Central Heating Company, to move one diesel oil storage tank now located on Blair near First~ and ~NO tanks now looated at the intersections of aIle bet\Areen 4th and 5th and bei;t.veen High and Ferry if the la. tter were extended north of the railroad traoks, to the property owned by Central Heating Company- fronting on Lincoln and Second Avenue~ was referred to the Fire and Water Committee for oonsideration. Connnunication from Mr. and Mrs. W.C. McLain aolmowledging the council's aoceptance of, his $600.00 offer for Lot 6, Blook 21, College Hill Park Addition, was ordered filed. Communioation from Theodore Foroier accepting t:re oounoil's counter-offer of $1000 for the North 68 feet of Lot 5~ Block 20~ Paclard Addition, was presented. The Recorder augnented the letter by adding tm t Mr. Forcier was willing to PEW the ci ty as down paymen t the amount sufficient to cover all taxes and $10.00 per month, plus 6% interest on the unpaid balanoe. The Finance Com- mittee recoII1l1'enied -that the purcmser pay the amount of back taxes ani monthly payments of $20.00~ plus interest at 6%~ and it was so ordered. The Recorder stated he doubted very much if Forcier could meet those terms. Activity reports from the Fire Department for the month of January and February; Police for the month of February; Engineer for February; Health Deptrtment for February, were pre- sented and ordered filed. The Police Committee reported the purchase of a 1938 Hudson Ccach at a cost of $340.00 for use in the Pol ice Department ~ with allwances being nade on the 1934 Plymout.l-t and 1935 Chevrolet to -the extent of $525.00. 35 lie ense. Caswell far duplicate pur cia se of dog 236 / /37 / 38 Prior to the passage of' -the pioketing ordinance, the follOW"ing sentlmnts were ex- pressed by indi vjdual nembers of the council: Mr. Bond raised a question as to the $5.00 fee and the length of time allowed for picketing. Mayor Large stated that he had nothing to do with the pre- paration or presentation of the ordinance. Messrs. Farrington and Reid declared that the ordinance should be passed as presented. Mr. Lamb felt that the 20-day period of time should be extended, as did Mr. Hanns. Mr. Farrington felt that a $5.00 fee for an organization such as a labor organization was not excessive and Hanns stated that the fee was entirely suitable and set up as necessary re- venue for the operation 0 f the proposed ordinance. Mayor Large pointed out that this ordinance was one that was prepared and being presented on behalf of the Eugene Better Business League. It was Carlson's opinion that the 20-day period of time was probably not proper and should be extended to at least 30 days or on a monthly basis and that the $5.00 fee was too much. It was his understanding th t _. this measure was not for the purpose of revenue but merely one of regulation. Hendershott moved and Lamb seconded that the period of time be extended from twenty to thirty days and with this anendment~ the ordinanoe was presented fer passage. An ordinance to regulate pickets and picketing within the City of Eugene had its first reading and passed to its secorn. and th ird readings by unanimous consent of the counoil, by title under suspension of -the rule and was placed for final passage. Forcier offer, Item #31, -the counoil rescinded its aotion, ani agreed to accept Forcier's $1000 offer with payment at the rate of $10.00 per month, plus 6% interes , 43 provided he paid down in oash the neoessary amount to cover back taxes. / C.
