The minutes of the regular meet ing of the Common Counc i 1 he Id at the hour' of
7:30 otclock P.M., April 11, 1938. Mayor Large called the meeting to order. Council
man present were: Messrs. Lamb, Hendershott, Read, Page, Hanns, Farrington, Bond
1 and Carlson; absent, none.

The minutes of the previous meeting, March 28, 1938, were presented and

Mr. Jack Kesling, who had purchased the site at 15th and High for the purpose
of erecting a gospel hall, respectfully petitioned the council to allow him to pr~-
ceed with his building plans despite the set-back ordinance, recently enacted by the
cQuncil, inasmuch as he had invest!ga~ed in detail his rights to building on the
property prior, to the enactment and being fully illformed by the City Engineer's Of-
fice, he had completed the transaction and blueprints were ~repared for the proposed
building. He said that the building plans had been approved by the Building Inspect r
with the exception of the set-back provision. Mr. Kesling further pointed out that
within the same block a residenee is situated within eight f~et of the sidewalk and
it was their intention to erect their bUilding to conform with that set-back. The
I 3 request was referred to the Board of Appeals for study.
Leroy Peterson, requested waiver of city license for carnival to be sponsor d
by the Veterans of Foreign ~ars of the United States in Eugene on May 16 to May 21,
He pointed out that revenue derived from this enterprise would be used to satisfy
cQrtain obligations of the organization and to carryon their relief and Americaniza
tion program. The methods used by carnivals in averting payments of city licenses
were thoroughly aired by members of the coullcil. Councilmen questioned the wisdom
of continuing the policy of allowing carnivals to come into the city by way of ob-
taining backing of so~e local organization. Upon motion made and seconded, it was
/ 4 agreed that the regular license fee be waived and it was so ordered.
_ Petition presented by Dr. E. T. Helms requesting that 11th ~venue East from
~illamette to r'ranklin Boulevard be made a through street, was referred to the ~tree
and Police Committees.

Clive Stanley of Ralph and ~tanley Stores requested a change in the zoning
ordinance of the city to allow establishment of a new store at the northwest corner
of 13th and Oak Streets. City Engineer Clubb pointed out that a previous request fo
reclassification of this district had been denied by the Board of Appeals, but in-
asmuch as this is a store building and not a drive-in market, he thought the matter
should go before the Board of Appeals for consideration and it was so ordered.

Mayor Lar~e stated that he had received a communication from the ~tate Highwa
Commission wherein they agree to participate on a 50-percent basis on th~ installati n
of traffic control signals on any intersection of the state highway through the city
o( Eugene. John Beakey, state highway ~ngineer, stated that the vommission, in thei
report to the council, had recommended a total of seven installations, but that two
of these fell beyond the highway; therefore in proceeding with the installation, the
bids should be made on that basis and proportionate of costs taken care of after the
iqstallation is completed. The State Highway Commission operates upon a competitive
b~sis and they will prepare the plans and specifications. The City Engineer was in-
st.ructed to confer with Mr. Beakey and report at the next council meeting the plans
o~ installations showing respective benefits and costs. Councilman Bond suggested
that local labor be obtained for the installation of the lights. Mr. Beakey (stated
that the Commission could not make such restrictions; however, he believed that the
installation would be done by a local electrical firm.

. The Finance Committee reported the following bills to the council with a re-
commendation that they be allowed and motion was made, seconded, and carried that
warrants be drawn for the same. The ayes and nays were called, councilmen voting

feet of Lot 1 and the South 45 feet of the North 115 feet of the ~ast 44 ~/3 feet of
Lot 2, Block 4, Grand lJrairie Addition, commonly kno~n as 628 Filmore Street, was
upon recommendation of thefi'inance Committee accepted and upon motion made and duly ~
seconded, approved by the council. ' ~
The $600.00 offer of Mrs. L. B. Newby for the 00uth 45 feet of the North
115 feet of Lot 1 and the bouth 45 feet of the North 115 feet of the East 44 1/3
feet of Lot 2, Block 4, Grand rrairie Addition, was denied by the Council and the
/9 offer of W. E. Tozier, above named, accepted and it was so ordered.
Offer of L. W. Siegman for two parcels of property, to-wit: One on each
side of 9th Avenue ~est between Van Buren and Polk Streets, was presented. Mr.
Siegman has offered to pay ~285.00 for the piece on the 00uth side of the ~treet or
$500.00 for the two tracts. In either case the sum of $100~00 cash will be paid
and the balance in two years with interest at 6 per.cent. Mr. Siegman will also

The $300.00 offer of T. E. Davenport for Lot 6, Block 11, Hollenbeck Ad-
dition, was rejected by the Finance Committee and a counter-offer of $400.00 extende .
Upon motion made and seconded, the recommendation of the !:,'inance Committee was duly
,11 approved.
Regarding Lot 5, Block 20, College Hill Park, for which Colin H. Macdonald
had offered the council the sum of :j;:600.00, the council agreed that the former
valuation placed upon the lot, to-wit: $1000 for the full lot or $850.00 for the
112 60 x 100 feet still stand and it was so ordered.
The $600.00 offer of Frank E. Riggs for Lot 6, Block 26, College Nill Park
was approved by the t<'inance Gomrnittee and resolution authorizing the Mayor and Re-
corder to execute a contract on behalf of Mr. Higgs, was upon motion made and second d,

Hill Park Addition to ~ugene, Lane County, Uregon, and
WHEREAS, the City of Eugene has caused the saIDe to be appraised
and determined its value, and
WHEREAS, ~rank Higgs has offered the City $600.00 for said prb-
perty which, according to the appr~isement, is all that the property
is worth,
NOW, THEREFORE
BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF EUGENE that the
Mayor and Recorder be and they are hereby directed to enter into the
annexed contract on behalf of the City of Eugene and the $100.00 down
payment and all subsequent payments shall be deposited with the City
Treasurer of said City.
The $750.00 cash offer of L. Axland for the East one-half of Lot 1, Block
7, College Hill Park Addition, was rejected by the Finance Committee and the council s
14 former offer of $900.00 made to Mr. Axland, was sustained.

Offer of Dr. J. L. Hesse in the amount of $300.00 each for Lots 9, 10, 11
and 12, Block 4, Gross Addition, was rejected by the Finance Committee and a counter
offer' of $2500.00 extended. Upon motion made and seconded, the recommendation of th
115 Committee was duly approved.
The $750.00 cash offer of Robert Walden for Lot 10, Block 4, Shaw's Second
Addition and request for release of contract covering Lot 10, Block 12, Gross Addi-
tion with application of the $100.00 paid on the contract to be made on his present
offer, was rejected by the Finance Committee and a counter-offer of $1500.00 extende
for the purchase of Lot 10, Block 4, Shaw's Second Addition. The Committee would no
consider applying the ~100.00 on Lot 10, Block 12, Gross Addition. Upon motion ffiade
I 16 and seconded, the recommendation of the Finance Committee was unanimously approved.
The $750.00 cash offer of Will V. Norris for the North 80 feet of Lot 6
and the No. 80 faet of the West 12.8 feet of Lot 5, Block 10, Scott's Addition, was
rejected by the Finance Committee and a counter-offer of. $1500.00 extended. Upon
motion made and seconded, the recommendation of the Committee was unanimously ac-

The $1500.00 cash offer of Mrs. R. A. Babb for the West 171.5 feet of the
following described property: That part of Lot 3 lying within 160 feet of Fairmount
Boulevard also that part of the East 85 feet of Lot 2, lying within 160 feet of
Fairmount Boulevard, all in Block 28, Fairmount Addition, was referred to the Financ
f 18 Committee with power to act.

The $550.00 cash offer of E./ U. 1JIlagy for Lot 4, Block 8, Hollenbeck's Ad
19 dition, was ordered held by the Finance Committee and it was so approved.

It was reported by the Finance Committee that the city has to start suit
to quiet title on Lots 8 and 9, Block 6, Pearl.Addition in order to get a deed for
'00 Thelmer J. Nelson who has contracted to purchase the property. These lots are in th,
Patterson estate and there are several other lots in this estate which should b~ in-
cluded in the suit. The county holds title-to the other lots and-it would be neces~
sary for the city to pay the county taxes in the sum of about $473.00. Upon motion
made and seconded, authorization was given by the council to institute the suit and
20 to pay in full the taxes due and it was eo ordered.

At the request of the Judiciary Committee, the sound-car ordinance, whic'
had been previously before the council for repeal, was ordered held for another two
21 weeks.
The councU. accepted a recommendation of itself as "a committee of the
whole" to allow Eugene's anti-picketing ordinance stand as enacted. Harry Johnson,
United Workers' LeagtE, stated that the-emergency should never have been attached to
said ordinance by reason of the fact that no emergency existed. He requested that
the present ordinance be abandoned and a new ordinance prepared with the cooperative.
efforts of organized labor, unorganized labor and business. Mr. Johnson asserted, "
believe it is a direct attempt by racketeers in the business group to force trouble
betwe~n business and labor." Charles Paddock, Jr. also vigorously opposed the ordi-
(22 nance. He implied a threat of a business-labor war if the ordinance is retained.
23 Councilman Hendershott was excused from the meeting at this point.
An ordinance amending Section 7 of Ordinance No. 8534 entitled "An ordi-
nance to regulate pickets and picketing within the city of Eugene, had its first
reading and passed to its second and third readings by unanimous consent of the
council by title under suspension of the rule and was declared prepared for final
reading. The ayes and nays were called; councilmen voting aye: Lamb, Reid, Page,
Hanns, Farrington, Bond and Carlson; nay, none; absent, Hendershott. The ordinance
24 was declared passed and numbered 8536.

Mr. A. C. Farrington, Chairman of the Health Committee, stated that he
had consulted City Attorney Calkins on the garbage disposal question brought up at
the previous meeting, and it was established that no action could be taken and that
25 the city should stand on their contract.

Regarding the request of the Eugene Hospital and Clinic, it was the re-
quest of Sam Bond, Chairman of the Police ~ommittee, that the matter be held for
26 another two weeks and it was so ordered.

Resolution enabling the street Committee and City Engineer to deal with
the Oregon-Electric Company on the type and style of poles and cross-arms to be used
27 for suspension ~ power cables, was upon motion made and duly seconded, adopted~

WHEREAS, The City of Eugene has arranged for the repair and
rebuilding of certain portions of Fifth Avenue with respect
to the structures had therein by the Oregon-Electric Railway
Company, and it is necessary and convenient that the work be
supervised on behalf of the City,
It is therefore resolved, that the Street Committee and the
City hngineer, be and they are hereby authorized to'oversee
and supervise the placing and replacing of structures and re-
pairs in Fifth Avenue by the Oregon~Electric'Railway Company,
with power to compel the Oregon Electric Company to conform
to the agreements hereinbefore had with the City of Eugene as
to the manner and character of the work and improvement to be
placed therein.

Councilman Bond stated that a woodyard was being maintained at 18th and
Jefferson. He said that in addition to the amount-of wood stored there this winte~,
they were storing wood for the coming winter and also beginning to make a lumber yar
out of the property. They.are not satisfied to maintain this business on their o~p'
property but are also using the city streets. The City Attorney and Chief of POLIce
were instructed to investigate.
Resolution authorizing the Mayor and Recorder to execute a bargain and
sale deed to the Eug~ne Bible University property>to Claude v,ashburne upon the as-
surance that the fire- insurance premiums on the fire insurance on the buildings will
be assumed and paid by the purchaser, was upon motion made and seconded, adopted by
the council:

WHEREAS, Claude Washburne has made application to the City of
Eugene for redemption of the Bible University property and has
tendered a check in payment of all of the city charges against
the property, and

WHEREAS, The Common Council referred the settlement of the
application to a committee composed of the Finance Committee
and the Judiciary Committee, and
WHEREAS, the Committee so appointed has made a report re-
commending that the city accept the amount due it from Mr.
Washburne and issue a deed upon guarantee being furnished
that the insurance premiums will be assumed and paid.

NOW, THEREFORE, BE IT RESOLVED, By the Common Council of the
City of Eugene that the Mayor and the Hecorder be and they
are hereby directed to make, execute and deliver on behalf
of the City of ~ugene a bargain and sale deed without coven-
ants to the ~ugene Bible University property, to Claude Wash-
burne and to deliver the deed to him upon assurances being
received that the fire insurance premiums on the fire insurance
on the buildings will be assumed and paid by the purchaser.
Request of the Vermont Loan and ~rust Company to renew the easement per-
mitting joint use of the driveway area on their property described as:I1Beginning at
a point in the West line of Fairmount Boulevard in the Gity of ~ugene at the N. E.
corner of the S. 35.2 feet of Lot 2, Block 22 in Fairmount, now a part,of the City
of Eugene, Lane County, Oregon, according to the original plat thereof, and running
thence West 96 feet; thence South 50 feet; thence East to the ~est line of said
Fairmount Boulevard in said City, and thence following the West line of said Fair-
mount Boulevard northerly to the place of beginning',11 and which driveway encroaches
to a small extent on the land owned by the city, was referred to the Judiciary
Committee and City Attorney.
Communication from Donald M. Erb extending his appreciation to the council
for their word of welcome to the neWly-appointed president of the University of
Oregon, was read and ordered filed.
Request of O.H. Bray to be allowed to wreck the service station and apart-
mBnt building located at the SE corner of the intersection of High Street Bnd 3rd
Avenue east and to rebuild the service station and extend the present tire repair
shop, the latter building to be frame construction with stucco walls on the east
and south, was granted by the Board of Appeals and this action: sustained by the
council.
Letter from E. C. Husby requesting permission to enlarge his service sta-
tion and grocery store located at 290 Thirteenth Avenue East, was granted by the
Board of Appeals on the condition that the construction be subject to the approval
of the ~ngineer's Department and this action was sustained by the council.
Request of Sher Khan for permission to build a temporary structure on the
north sid~ of his building located at 642 Oak Street was granted by the Board of
Appeals on the condition that the construction is approved by the Engineer's Depart
ment and the permit be limited to two years. This action was accepted by the coun-
cil.

Reports for the month of March were received from the Engineer, Police and
Fire Departments and were ordered filed.

WHEREAS, Dr. Edward E. Gray has offered the City $650.,00
for said property, which according to the appraisement is
all that the property is worth,
NOW, THEREFORE
BE IT RESOLVED, By the Common Council of the City of Eugene
that the Mayor and Recorder be and they are hereby directed
to execute a bargain and sale deed to Cr. Edward E. Gray for
the above described property and to accept in payment there-
for the sum of $650.00.

The City Recorder reported that a contract for the operation of the
municipal airport had been entered into between the City and Joseph Harrell for a te m
commencing April 1, 1938 and terminating April 1, 1939 at a rental of $15.00 per
~ month. Upon motion made and seconded this was duly approved. by all members of the
C council. The City Attorney was instructed to proceed in thE' matter of collecting
all monies due the city from Harold ~anders, former manager, up to and including
January 1, 1938, and it was so ordered.

Al G. Barnes and Sells-Floto Combined Circus was given permission to
perform in the city of Eugene on May 15, 0unday afternoon.
The matter of increasing the penalty attached to the disorderly conduct
ordinance pertaining to raising ~alse alarms, was referred to the Judiciary Committe
(401 and City Attorney.
, At this time Perry Price, juvenile officer, believed that the enforcement
of the curfew law in the city would aid materially in the rElduction of juvenile de-
linquency. The Police Committee was asked to work out the procedure to follow in
/41 placing the law into effect.
The Oi ty Attorney reported that he would immediatElly proceed wi th pre-
42 paration of the western Union and Yostal Telegraph franchisE~s.
