Mayor Large called the meeting to order. Counci - men present were: Messrs. Lamb, Hendershott, Reid, Page, Hanns, Farrington and Bon j 1 absent, Mr. Carlson., . - The minutes of the previous meeting April 25, 1938 were presented and 01'- 2 dered filed. I At the request of Harry Abele, 234 ~est 7th Avenue, the Council voted to re-zone the half block covering Abele's property from Zone2to Zone 3, making it pas sible for him to erect two duplex residences at a lower fire insurance rate. Petiti n from adjacent property owners voicing their approval of such a construction, was also presented. An ordinance amending Section 2 of Ordinance #6860 entitled "An Ordinance d~claring the entire City of the City of Eugene to be a fire district and dividing the said fire district aforesaid into four fire zones to conform to the building code of the City of Eug~ne, and repealing all ordinances and parts of ordi nances in conflict herewith.", passed by the Common Council and approved by the Mayor May 14, 1928, by amending the description of Fire Zone #2, and repealing Ordi nance No. 7445 and all other ordinances and parts of ordinances in conflict herewit had its first reading, and passed to its second and third readings by title under suspension of the rule by unanimous consent of the council and was placed for final passage. The ayes and nays were called, councilmen voting aye, Lamb, Hendershott, Reid, Page, Hanns, Farrington and Bond;nay, none; absent Carlson. The ordinance wa declared passed and numbered 8537. , I 3 / Frank L. Chambers, owner of the Yates Hotel, against which condemnation proceedings are being instituted, made a plea to the council for the welfare of his tenants, whom he asserted were unable to find cheaper places of residence. He was granted two weeks' time in'which to comply with sanitation ~nd fire inspection re- quirements as stipulated by' Sam Mosher, Building Inspector. Mrs. Jennie L. Frasier, owner of Joe's Place, located at 57 6th Aven~e Eas , also subject to condemnation, was granted two weeks' time to comply with the pro- visions of the city ordinance when she pleaded for time in which to protect her in- terests in the property. Fred Lamb, member of the Street Committee, reported that Dr. F. M. Day, ha been granted a permit to cut the curb at 11th and Charnelton as follows, to-wit: 36 feet on 11th and 30 feet on Charnelton. Mr. Lamb stated that up to the present time, Dr. Day had refused to accept this grant and requested a further 15 feet. The council suggested that Dr. Day extend his property to include the driveway that iS,now adjacent thereto. No further action was taken at this time. With reference to the request of the Vermont Loan and Trust Company in re- gard to the easement between two Fairmount Boulevard properties, Mr. Lamb, chairman of the Judiciary Committee, reported that after an investigation of the situation, they have determined that the city do nothing with respect to the request. He stated that it was their belief that the city property and adjoining property were better off without such an agreement. Upon motion made and seconded, this reCOIDIDen a- 7 tion was unanimously approved. Hewitt for part of Lot 4, Block 19, Fairmount Addition, was denied by the Finance Committee and upon motion made and seconded, ~ction of the Commi ttee was smaine'd by the Council. Communication fpom the Clerk of Lane County advising the city of a: bid received by them on Lot 6, Block 2, Harris Addition against which the city has liens, was presented. The Finance Committee recommended that the 'city pay the taxe and upon motion made and seconded, this recommendation was approved. 9 I Communication from A. C. Mathews requesting redemption of his property' located at 4th and Madison Streets and known as Lot 6 and the ~est one-half of Lot 7, Block 2, Harris Addition in the amount of $1800.00, payable $200_00 cash, $300.00 August 1, 1938 and the balance at the rate of $20.00 per month, plus in- terest, corDLcencin~ June 1, 1938, was accepted on the condition that Mr. Mathews pay $500_00 cash and $25.00 per month, including interest at the rate of 6 per cent. Upon motion made and seconded, the recoIDmendation was duly approved. The $600.00 cash offer of L. Folsom for Lot 7, Block 9, Sladden's Third Addition, was l'ejected by the Pinance Committee and a counter"':offer of $9'75.00 extended. Upon motion made and seconded, the recommendation of the Committee was / 12 duly approved. /11 ~ J"'"' 80 The $450.00 offer of Eunice H. Hathaway for Lot 8. Block 5, Hollenbeck's Addition, was rejected by the Finance Committee and a counter-offer of $660.00 ex- tended. Upon motion made and seconded, the recommendation of the Finance Committee. was duly accepted. 14 ! Communication from'Dr. M. G. Howard, requesting permission to redeem. Lots 5 and 7, Block 10; Lot 1, Block 11, Hollenbeck'.s Lddition, which lots were foreclosed by the city for delinouent liens, by paying 6 2/3 per cent interest in- stead of 10 per cent penalty and 10 per cent interest, was accepted by the Finance Committee and upon motion made and seconded, approved by the council. The $1000 cash offer of Mrs. Chas. D. Thompson for Lot 6, Block 20, Col- lege Hill Park Addition, was rejected by the Finance Committee with no counter-offe extended. College Hill Park Addition, was accepted by the Finance Committee and upon motion made and seconded, approved by the council. The $825.00 offer of L. Axland for the East One-half of Lot 1, Block 7, College Hill Park Addition, was approved'by the-Finance Committee and upon motion made and seconded, action sustained by the council. 17 / The $831.84 cash offer of Lance Hart for Lot 12, Block 5, Gross Addition, was rejected by the Finance Committee"and a counter-offer of $1500.DO extended. Upon motion made and seconded, the recoITilllendati0n of the COllnnittee was duly approve. 18 I 19 I The request of ~dith ~. Gardiner to deed the city the south 50 feet of Lot 4~ Block l~, FairmoHnt'Addition for a release of city liens on the north 50.6 feet,-was brought up for consideration. The Finance Committee recom~ended that Mrs Gardiner be contacted and plans to issue a new contract be undertaken. Upon motion made and seconded, the recommendation of the COffiQittee was approved. Communication from the Clerk of Lane 80unty advising the City of a bid re ceived by them for the "South ID feet of Lot 7 and all of Lot 8, block 3, Mountain View Park Addition except the following: Beginning at a point 10.3 feet South of th Northeast corner of Lot #8, Block #3, Mountain View Park Addition as the same"is're corded and platted in Lane County, Oregon, thence ~est 59 feet; thence ~outh 66 fee, thence Southeasterly parallel with, the P.E. & E; Railway Right of ~ay to a point, 50 feet ~est of the Southeast co ner of Lot #8 said Block #3, Mountain View Addition, thence East 50 feet to the Goutheast corner of Lot 8, Block 3, Mountain View Park said ~dditioH, thence North to the place of beginning, in Lane County, Oregon". against which the city has liens, was presented; The Finance Committee recommended that the city pay the taxes due and upon motion"made and seconded, this recommenda- tion was approved. I 20 I Second offer of Mrs. R. A. Babb in the amount of $2000.00 for "That part of Lot 3 lying within 160 feet of Fairmount Boulevard also that part of the East 85 feet of Lot 2, lying within 160 feet or Fairmount Boulevard, all in Block 28, Fairmount Addition,1l was approved by the Finance Committee and accepted by the Council. 21 I Sam Bond, Chairman of the P01iee Committee, recommended that Eleventh Avenue East from Willamette to Franklin Boulevard be made a through street, and upo motion made aRd seconded, approved by the council. 22 I 23 J City Attorney Calkins stated that the franchises with ~estern Union and Postal Telegraph were nearing completion, and would be presented to the council for approval. , Mayor Large reported to the council the events of the convention of the League of Oregon Cities at the Dalles May 2-3 attended by himself and C. M. Bryan, City Recorder. I 24 J Communication from the Eugene Neon Sign Company requesting that the neon sign display for the Korn Baking Company be left at the present location on Orchard Street facing the railroad tracks and Franklin Boulevard, inasmuch as at the time of erection they were not aware of the fact that they were in a zone where signs we e 25 prohibited, was granted by the council upon motion duly made and seconded. / I Communication from the Eugene Hospital and Clinic requesting permission cOllstruct a 6-foot bridge across the alley south of the hospital, was referred to 26 Fire and Water Committee and City Engineer with power to act. I Communication from Henry Weber, fireman, requesting a leave of absence, without pay, for a period of one year, cow~]encing May 15, 1938, was presented, and upon motion made and seconded, the grant was "extended. It was revealed that Mra ~eber had been ill for some time and the duration of his illness was undetermined. 27 I At this time Mayor Large appointed John W. Ball, highest on the Civil Service eligible list, to fill the vacancy created by the illness of Henry Weber, to takeefrect May 15, 1938 at a salary of $100.00 per month. Upon motion made and se- conded, the appointment was duly confirmed by the council. Report for the month of April were presented from the following departmenta: Engineer, Police, and Fire. The council also reviewed the quarterl~_ report, Jan- March, 1938, of the Lane County Health Department. They were all ordered filed. Q() ~~ ,..;...... '~n ( Petition requesting that the application for a permit to erect a church at the southwest corner of the intersection of Eighth Avenue West, Monroe Street and Blair Street, be denied, was presented and ordered filed. Mr. Hendershott, Chair- man of. the Finance Committee, pointed out that this was the site proposed by Jack Kesling for the erection of his church and that Mr. Kesling had been informed that the property would not be available. Presentation of a revised ordinance providing for the assurance of a pure water supply in the City of Eugene, had its first reading and referred to the Healt Committee to study with the Health Board and report at the next meeting of the I . council. City Recorder presented a bill in the amount of $1.50 fro~ Sigloh-Sawyer for damages to a street department truck by D.G. Teeter, North 7th Street, Springfield, Oregon. It was reported that Mr. Teeter had been billed for this,item and had appeared in the office of the Recorder but refused to make payment as he claimed that it was no~ 'act' of negligibility on his part. The Cit;/ Attorney was instructed to investigate. Dance Hall license to Townsend Headquarters for the year 1938, was granted by the council upon the approval of Chief of Police, Carl F. Bergman. The Recorder reported that a total of $223.25 was received since March 24, from sales of dog licenses of which a balance of $46.60 is retained by the city as profit. Resolution authorizing the Mayor and Recorder to execute a deed on behalf of George A. and Dorothy B. Metzger, was upon motion made and seconded, adopted by the council: RES 0 L UTI 0 N WHEREAS, The Ci ty of, Eugene has acquired the East 70 feet of Lot 7 and the East 70 feet of the South 1/2 of Lot 8, Block 24, Gross Addition to Eugene, Lane County, Oregon, and WHEREAS, The Ci ty of Eugene has caused, the same to be appraised and determined its value, and Y;HEREAS, George A. Metzger and Dorothy B. Metzger have offered the City $750.00 cash for said property, which, according to the ap- praisement is all that the pror~rty is worth, NOW, 'THEREFORE, BE IT RESOLVED, By the Common Council of the City of Eu~ene that the Mayor and Recorder be and they are hereby directed to execute and deliver to George A. Metzger and Doro~h~ Bi Metzger, a good and sufficient deed of conveyance to the above described property on behalf of the City of Eugene. An ordinance amending Section 3 of Ordinance #95 entitled "An ordinance con- cerning offenses and disorderly conduc t," by r ais ing the fine from five to fifteen dollars to five to one hundred dollars, had its first reading and passed to its second and third readings by title under suspension of the rule by unanimous consen of the c ounc i 1 and was placed for final passage. Proposal to lease Room #11 on the 2nd floor of the City Hall by the Internal Revenue Commission at a rental of $120.00 per year, commencing July 1, 1938 and ter minating June 30, 1939, was held for further consideration as the council felt that a rental of $10.00 per month was not sufficient for occupancy of this room.
