The minutes of the adjourned meeting of the Common Council held at the hour
of 7:30 o'clock P.M., May 23, 1938. Mayor Large called the meeting to order.
Councilman present were: Messrs. Lamb, Hendershott, Page, Hanns, Farrington, Bond
and Carlson; absent, Reid.

The minutes of the previous meeting, May 9, 1938, were presented and ordere

Fred Smith requested the council to grant special curb cut permit for the
Signal Oil Service station being constructed at the corner of Sixth and Olive
Streets. This was referred to the Street Committee with power to act.

Councilman Lamb, Chairman of the Judiciary Committee, stated that the Com-
mittee wished further time on the Western Union and Postal Telegraph franchises
in order that they might be informed of the costs that they must pay in conjunctio
4 with advertising said proposed franchises. Time was granted.

The $650.00 offer of C. P. Tillman for Lot 1, Block 1, Maplecroft Addition,
for which property Mr. Tillman had formerly made an offer of $400.00, which was re-
jected and a counter-offer of ~p850.00 extended, was held by the Finance Committee
5 for further consideration. Upon motion made and seconded, action Was duly approved.

The $1500.00 cash offer made by Edith F. Gardiner, on behalf
the West 100 feet of Lots 11 and 12, Block 33, Gross Addition, was
the Finance Committee for consideration. Upon motion made and duly
action was approved.

The ~1000 offer of Walter b. Jones for Lot 1 and the East 6.8 feet of Lot 2,
Block 11, Huddleston's Amended Addition, was rejected by the B'inance Committee and
upon'motion made and seconded, action approved by the council.
The $75.00 offer of E. V. Hamblen for property described as:"Beginriing at a
point 113 feet south of the south line of 16th Avenue ~est, on the west side of
Jefferson Street, thence south 16 feet, thence rest 150 feet, thence north 16 feet,
thence East 150 feet to the point of beginning", was rejected by the Finance Com-
mittee with the recommendation that the tract be held and sold with the forty feet
on the south. This action was duly approved by members of the council.
Offer of Earl W. Fox in the amount of $350.00 for property described as "Be-
ginning at the intersection of the South line of 16th Street with the rest line of
Jefferson Street and running thence South 57 feet, thence West 161 feet to the West
line of Strip "A" of Elias Stewart's Addition to Eugene, thence North 57 feet to
the South line of 16th Street and thence East 161 feet to the place of beginning,"
and in connection with this an offer of $50.00 for the hOuse located at 1706 Law-
rence Street to be wrecked and rebuilt on the tract on 16th and Jefferson, was pre-
sented. It was revealed that Mr. Fox does not want to pay any cash, but wishes to
work out the entire amount of $400.00. Upon recommendation of the Finance Committe
9 the council refused to accept Mr. Fox's proposal.

The $450.00 cash offer of Mr. and Mrs. A.W. Cole for Lot 4, Block 8, Croner'
Addition, was accepted by the Finance Committee and upon motion made and seconded,
,10 duly approved by the council.
The $500.00 offer of C.A. Coulter for Lot 23, Block 27, Fairmount Heights Ad
dition was accepted by the Finance Committee with the condition that a sewer right
of way is reserved along the north line of the lot to the east. This recommendatio
,11 was duly approved by the council.
The $250.00 cash offer of Clarence ~. Berg for the South 53 1/3 feet of Lot 0,
Block 16, Huddleston's Extended Addition, was rejected by the Finance Committee and
a counter-offer of $350.00 extended. Upon motion made and duly seconded, action of
12 the Committee was approved.

The $500.00 offer of Mrs. Helen Norr~s for Lot 7, Block 14, Huddleston's
Extended hddition, was accepted by the council upon the recommendation of the Finan e
Committee.

Councilman Hanns, Chairman of the Fire and Water Committee, reeommended that
a charge of $12.00 be billed Mr. Hershal Bendshadler, Route #1, Eu~ene, Oregon, for
services rendered him by the Eugene Fire Department and upon motion made and second
this ~ction was duly approved.
Councilman Page, Chairman of the Park Committee, stated that Clarence V. Sima,
member of the Park Board, was holding the contracts for the purchase of Spencer Butte
and would return them to the City Attorney upon his return to Eugene; further that
the City of Eugene should then be the party to the contract as a result of the election
held on May 20, 1938.

Councilman Bond, Chairman of the Police Committee, recommended that the Chief
of Police and the City Recorder be granted authority to draw on the special police
matron relief fund and it was so ordered.

Mr. Bond further recommended that one-hour parking be extended on Broadway
from Pearl to High and on Oak from Sixth to Geventh streets. Upon motion made and
duly seconded, thi s rec ommer:da t ion was unanimously approved.
Mr. Bond reported that the carnival, sponsored under the auspices of the Veter ns
of Foreign ITar, had left the grounds in an unsightly condition. The Chief of Polic
was instructed to contact the ofricials of the orgaoization and see that the proper y
is properly cleaned and it was so ordered.
City Attorney Calkins was instructed to prepare an ordinance preventing use of
the parking lot adjacent to the City Hall by the general public and by the staff
and patrons of the Eugene Hospital and Clinic and it was so ordered.
Mayor Large stated that N.E. Glass, Judge of the County Court, was desirous
of maintaining the woodyard at 16th and High Streets until such a time that nego-
tiations were under waY-ll\lhereby they would have other properties tO,use for wood-
yard purposes. It was pointed out that the Lane Gounty Court had received some
very severe judgments and as a result were showing a tendency to cooperate with
the city; that we should cooperate and not put them to any undue hardship in asking
/20 them to vacate the premises at once, and it was so ordered.

21 At this time Councilman Reid arrived.

With respect to the condemnation of the Yates Hotel, City Engineer Clubb re-
ported that he could not see what repairs could be made to the building to render
it usable for its present occupancy. Mr. William East, Attorney for Frank Chambers,
proprietor of. the Hotel, requested that Mr. Chambers be given an opportunity to
put the building in proper repair to meet all health and fire hazard requirements,
or if the council saw fit not to grant this, to allow an extended period of time
in which the tenants could find other places to reside. The Health Committee re-
ported that it was their recommendation that condemnation proceedings be completed
and the City Attorney be instructed to proceed with demolition proceedings and that
the tenants,be given a period of sixty days in which to vacate the premises. It
being understood that the building should be removed from the premises within sixty
days from date hereof. Upon motion made and duly seconded, this recommendation was
approved.
The Health Committee also recommended that demolition proceedings be institute
123 against Joe's Place and the City Attorney was instructed to act in this matter.
24 At this time Councilman Carlson was excused from the meeting.
Communication from Mrs. Fred Broders, Chairman of the Garden Club, in which
she seeks $20.,00 additional for completion of work commenced in the,city-wide
clean-up campaign, was presented. Councilman Lamb stated that it was his under-
standing that the city agreed to contribute $150.00 to be used in conjunction with
other funds for the removal of trash from the City of Eugene; that it was his re-
commendation that the Eugene Garden Club receive not one cent of this $150.00 until
the work is completed. Upon motion made and seconded, it was agreed that the city
is to pay $150.00 to the Eugene Garden Club at the completion of the project and
,25 that the request for additional funds be denied, and it was so ordered.
Request from the Vestry Board of St. Mary's Episcopal Church asking for a
permit to erect their new church building at the corner of 13th Avenue and Pearl
Street, the building to be located nearer the property line on Pearl Street than
permitted by the new "setback" ordinance, was granted by the Board of Appeals and
action sustained by the council inasmuch as they felt that such a request would not
be a detriment to the residents of that block.

Request from Mrs. J. C. Knight for a permit to erect an addit~onal story on
her building at 1445 East 14th Avenue to be used as an apartment building, was
denied by the Board of Appeals on the grourids that such an addition would constitut
a fire hazard. This action was approved by the Council.
, Request of Mrs. Patricia Edwards for a permit to make certain minor alterations
to the house located at 2244 Alder Street, the house to be used for apartment pur-
poses, was granted by the Board of Appeals and action sustained by the Council.
Canvass of election returns for the Special Election held in the City of
Eugene on May 20~ 1938, was presented and ordered filed.
Statement of bills for the Eugene Public Library for the month of April, was
30 presented and ordered filed.
Councilman Hanns, Chairman of the Fire and ~ater Committee, stated thut the
request of the Eugene Hospital for permission to construct a bridge" 6-feet in widt
/ 31 across the alley south of the hospital building had been granted and permit issued.

An ordinance authorizing and directing the execution of a deed to the
Athletic Field on South Willamette street to ~chool District No.4, Lane County,
Oregon, had its first reading and passed to its second and third readings by title
under suspension of the rule by unanimous consent of the council and was placed
for final passage. The ayes and nays were called, councilmen voting aye: Lamb,
Hendershott, Reid, Page, Hanns, ~arrington and Bond; nay, none; absent, Carlson.
The ordinance was declared passed and numbered 8539.

Resolution authorizing the Mayor and Recorder to execute a lease on behalf
of the Internal Revenue Commission for leasing Room #11 ,in the City Hall building
at an annual r ental of $120.00, was upon motion Gade and duly seconded, adopted.,.
The proposal of increasing the rent, was herewith dropped when City Engineer Clubb
reported that the annual rental rate is based on 23i per square feet or $66.47 for
289 sq,. ft,., the floor. ar.ea occupied by the Commission. >::(Resol appears on Page 86).

Councilman Hendershott requested that the Playground Commission be granted
permission to use Room #9 for the Playground offices during the coming season. Upon
34 motion made and seconded, the request was unanimously granted.

Resolution extending to the family of Henry ~eber the'counciI's deepest,
I 3 sympathy, was upon motion made and seconded, duly adopted:

WHEREAS, Henry H. Weber died on May 10, 1938, and
WHEREAS, at the time of his death he was and had been for many
years a trusted and faithful employee of the City of ~ugene,
and was held in high regard and respect by all who knew him,
NOW, THEREFORE, Be it resolved by the l\1ayor and Gommon Council
of the City of Eugene that while we accept the decree of a
~upreme Power, yet do we deplore the loss of a valued employee,
a citizen of outstanding worth, a courteous and kindly gentle-
man.
That we extend to his family our sincere sympathy in their be-
reavement, and that this resolution be spread upon the minutes
of this meeting and a copy forwarded to the family of the de-
ceased.

The following resolution authorizing the Mayor and Hecorder to execute an
application to withdraw the property described therein from the registration records
and change the same back to the former or recording system of the state of Oregon,

the Mayor and Recorder be and they are hereby directed to make,

property, to-wit:

Doulevard as laid out and platted in the City of
Eugene, Oregon, said point being 81.4 feet West of
the West line of Orchard Street, if extended South,
said point being the Northeast corner of a tract of
land owned by G.B. McLaren; running thence South
parallel to the West line of Orchard Street, if ex-
tended South, 160 feet; thence Easterly parallel to
the South line of said Fairmount Boulevard and 160
feet therefrom a distance of 256.20 feet to the
Westerly line of a 30-foot road as now established
on the ground, thence Northwesterly along the West-

Resolution authorizing the Mayor and Recorder to execute a lease covering
the rental of space for the installation of Radio Control Equipment at the municipa
airport, was upon motion made and seconded, adopted on the condition that the same
be not delivered until the City of Eugene has received a release for the like quar-
t 40 ter from the United Air Lines and it was so ordered:

WHEREAS, The Bureau of Air Commerce, United States Department
of Commerce proposes to install Radio Control Equipment in
the administration building at the Municipal Airport of the
City of Eugene, State of Oregon.
NOW, THhHEFORE, BE IT RESOLVED, That the Mayor and City Re-
corder are hereby authorized to execute a lease covering the
rental of space for the installation of Radio Control Equip-
ment, to be situated in the most northerly portion of the
center room, also known as the waiting room in the Administra-
tion Building at the City of Eugene, Oregon, Municipal Airport.
The terms of said lease to be substantially as follows:

The space to be leased shall contain 188.5 square reet, more
or less. The lease shall become effective July 1, 1938, and
expire June 30, 1939, with an option of renewal to extend the
period of occupancy to June 30, 1953. The consideration of
said period of occupancy to June 30, 1953. The consideration

for the period from July 1, 1938 to June 30, 1939, and One
Dollar ($1.00) per year thereafter.
An Ordinance (in revised form) amending Section 5 of Ordinance No. 8439 as
amended entitled: "An ordinance regulating the use of power-speakers, calliopes
and other noise-making, music-making or speech-making devices upon the streets of
the City of Eugene, and requiring a license therefor," had Itsfirst reading and
held for further consideration.

~he Judiciary Committee and City Attorney were asked to look into the pos-
sibility of placing a small license fee on all retailers of tobacco as a means of
preventing them from selling to minors.

Mayor Large revealed that a number of complaints had been raised due to the
sale of obscene magazines at some of the newsstands of the city. 1he Judiciary Com
mittee and City Attorney were asked to enact an ordinance preventing the sale of
such :literature in the city and it wes so ordered.

Communication from Hildo O. Rodgers requesting cancellation of city liens on

was referred to the Judiciary Committee and City Attorney.

Communication from the Salvation Army requesting funds to the extent of
$500.00 to carryon the relief among transients, needy girls and emergency aid for
none-resident families to cover the months of May, June, July and August of this yea,
was referred to the Finance Committee for consideration.

Mayor Large suggested that steps be taken to secure a flag to be placed in
the council chambers.

The Chief of Police was instructed to investigate the remodeled Pepper Pot
restaurant which is located at \~est 7th Avenue to determine whether it conforms
to city reQuirements with respect to closed booths, and it was so ordered.

The City Recorder was instructed to ask the City of The Dalles to s end us a
copy of their ordinance concerning examination of food handlers with the view in
mind of preparing a like ordinance for the City of Eugene.

the Mayor and City Recorder be and they are hereby directed to
enter into and execute a lease with the Treasury Department of
the United States Internal Hevenue bervice for the leasing of
Room #11 on the second floor of the City Hall to th~ United
States for use in its revenue service for a term commencing
July 1, 1938, and terminating June 30, 1939 at a rental of $120.00
per annum, payable at the rate of $lO~OO per month in advance.,
