I ,:;, ,'....'~.~ The minutes of the adjourned meeting of the Common Council held at the "~ ....-"". hour of 7:30 o'clock P.M.., July 25, 1938. Mayor Elisha Large, presided over the -_J"" meeting. Councilmen present were: Messrs. Lamb, Hendershott, Reid, Page, Hanns, 1 Farrington, Bond and Carlson; absent, none. The minutes of the previous meeting, July 11, 1938, were presented and 2, ordered filed. I Communication from William G. East, attorney, with reference to the land sale contract executed between the City of Eugene and E. C" O'Neel and J. M. Hall (who assigned her' interest therein to Ramey W. Rugh) wherein the City agreed to sell and convey unto the purchaser's good and marketable title to Lots 7. and 8, Block 11, Eugene Hendrick's Amended Addition, was read by the City Recorder. Mr. East, being present, explained in detail the entire case from its inception to date and particu- larly pointed out that the only thing they were asking is that his client be returne to his former status. City Attorney Calkins stated that in handling the case, he had always conferred wi th the Mayor, Chairmen of the Finance and Judi ciary ,Commi ttee , and did not wish to make a public ~tatement at the c04ncil meeting and it was his opinion that the above named members of the council approved his action. It was suggested that this be referred to the Judiciary Committee and City Attorney with (3 power to make settlement with Mr. Rugh and 6'Neel and it was so ordered. Mrs. J. C. Knight addressed the council asking for a permit to raise her house at 144a East 14th Avenue three feet and adding a pitch roof instead of a flat type roof which would enable the construction of three apartments on the second star . This request had been denied on May 18th by the Board of Appeals and action sustaine by the council, due to the fact that it was within a single family residence zone. Considerable discussion was had and motion was made and seconded that this special permit be granted and Mrs. Knight construct the building under the supervision of th Building Inspector. Before question was put, makers of the motion withdrew the same and all members of the council were invited to inspect the location and find out ;4 about it before casting their final votes. I Upon the complaint of A. R. Holeman, owner of Nu-Way Cleaners, the Police Commit.tee and Police Department were asked to take the necessary steps to thoroughl clean up the hobo Jungle existing near the west end of town. It was also r~quested that the State Police, Sheriff's Office and Southern Pacific Officers assist the 5, City of Eugene in this matter. I Councilman Hendershott, Chairman of the Finance CoIilmittee, stated that in order to put the city property in proper condition for sale that certain information rad to be obtained from Lane County; that the total cost to secure this information was $200.00 and Lane County has agreed to pay fifty per cent of this cost. Mr. Hen- rershott requested approval of the council of the city standing the other fifty per cent of the costs and upon motion made and duly seconded, the request was unanimously /6- granted. ' I The $100.00 offer of Mrs. William Mills for a thirty-foot strip at 10th and ~aylor Streets, on which the City has foreclosed, was rejected by the Finance Committ e and a counter-oBfer of $400.00 extended. Upon motion made and seconded, the recom- 7 bendation of the Committee was unanimously approved. ' / The $215.00 offer of Eldred D. Ferguson, denied by the Council at the meet- ing of July 11th, was again discussed and referred to the Finance Committee for re- 8 consideration. / I ~he $450.00 cash offe~ of C. C. Henderson for Lot 10, Block 12, Gross Ad- I pitibn, was accepted by the Finance Committee and upon motion made and seconded, action sustained by the council. The Treasurer's Office was instructed to proceed ~ith the execution of the necessary papers in confirmation of the sale as directed by the general resolution adopted by the Common Council on June 13, 1938, authorizing 9 ~uch action and it was so o~dered. / ~'. The $30.00 cash offer of Frank E. Semon for part of Lots 2 and 3, Block 27, ~econd Addition to Chula Vists Park, was denied by the Finance Committee apd a counte - I pffer of $50.00 extended. Upon motion made and seconded, the recommendation of the 10 ~ommittee was duly approved. / I Second offer of Dr. A. W. Siegrist in the amount of $700.00 for Lot 2, Block 2, Maplecf'oft Addition, was denied by the Finance Committee and a counter-offer &f $719.00 plus payment of taxes, extended. Upon motion made and seconded, the re- I 11 II " . . commendation of the Committee was duly approved. I With regard to the request of Vermont Loan and Trust Company for a driveway ~t 2000 Fairmount Boulevard, the council agreed to accept $100.00 for a strip of land /12 5 feet wide, and it was so ordered. ;, .ollll - 110 - ~ ----=---- ------~-~ - - --------.- == - -" ~.... Verbal request of Paul DeAutremont to the Finance Committee to redeem Lot 6 ~ Block 4, Teshner Addition, tract on which his house is located, was presented. It .........., '-' was agreed that he pay $100.00 down and the balance to be arranged on monthly payme ts l3'~ and it was so ordered. I i"" The request of Walters-Bushong Lumber Company to install a gasoline pump on the curb fronting their building, was denied by the Street Committee and action 14 sustained by the council. l Councilman Hanns, Chairman of the Fire and Water Committee, recommended tha the following bills be issued to the parties herein named for services rendered and it was so ordered: Edward Kennedy, $9.50; Chula Vista Dairy, $75.00;'P. H. Keeler, I 15 $12.50; William G. Klussman, $7.50; Arthur Richardson, $7.50. ,j Councilman Hanns stated that Assistant Fire Chief Hicks and Platoon Chief Johnson had been using their personal cars for a number of years for emergency calls and that these cars were not equipped with sirens nor covered by insurance. It was his request that he be given permission to take care of this and upon motion made and seconded, the Fire and Water Committee and the City Recorder were given pow I' 16 to act in this matter and it was so ordered. I Councilman Bond, Chairman of the Police Committee, recommended the transfer of Package Store Class "B" License and Retail Beer Class B Li6ense from L. G. Seales (deceased) to Emery Seales (Tiny Tavern) 400 Blair Street, and upon motion made and 17 duly seconded, the recommendation was duly approved. / Councilman Bond requested another two weeks' time to study the suggestions made by Herschel Taylor relative to excBssive speeding and truck "traffic on East 18 Thirteenth and it was so granted. f Another two weeks was also granted Mr. Bond to consider the proposed erect! n 19 of central police building in the city of Eugene. / Councilman Hendershott stated that the unfortunate drowning in the Willamet e River was in no way the fault of the City nor the Playground Commission; that the hours of the Playground Department are posted from 1:00 P.M. until dark and it was I 20 definitely determined that the little girl lost her life prior to 1:00 o'clock. I Communication from James H. Tierney pointing out the existence of poison oak along the edge of sidewalk and parkway on lot owned by the City between the Southwest corner of 22nd Street and Willamette, was presented. The matter was re- 21 ferrBd to the Street Department. I' Request of E. W. Hewett for a permit to erect a small cereal mill at 2543 22 Harris Street, was denied by the Board of Appeals and action sustained by the Counci . / Request from Mrs. C. L. Bessonette for a permit to install a kitchen sink on the second floor of her home at 645 16th Avenue West to be used as an apartment~., 23 was granted by the Board of Appeals and action sustained by the council. / Communication from the Eugene Realty Board wherein they named Miss Edith Gardner, Roy Baldwin and Robert W. Prescott as the appraisers from the Board to assist the appraisers from the Council in appraising the city lots given to the Boar 24 for sale, was presented and ordered filed. / Letter from the Civil Service Commission, recommending that Alva S. Turnbow and Theodore D~ Brown, be permanently employed by the Police Department, inasmuch as they had successfully passed their perrormance examination, was presented and the 25 members above named duly appointed by the council. I Statement of bills from the Eugene Public Library for the month of June,193 , I 26 was presented and ordered filed. An ordinance granting to the Western Union Telegraph Company, its successor and assigns, a franchise to place, erect, lay, maintain and operate in, upon and under the streets, alleys, avenues and public highways of the City of Eugene, poles, wires and other appliances for the transmission of telegraph messages, had its third reading. Hearing of rejections and remonstrances were called for at this time and none heard.. The ordinance was placed for final reading and the ayes and nays were called, councilmen voting aye: Lamb, Hendershott, Reid, Paget Hanns, Fa~rington, I Bond and Carlson; nay, none; absent, none. The ordinance was declared passed and 2rr numbered 8549. / Resolution of condolence to the family of Ella S. WHEREAS, Ella S. Richardson died on July 13, 1938, and ,....... WHEREAS, at the time of her death she was' and had been for many years a trusted and faithful employee of the City of Eugene, and was held in high regard and respect by all who knew her, NOW, THEREFORE, Be it resolved by the Mayor and Common I Council of the City of Eugene that while we accept the de- cree of a Supreme Power-" yet do we deplore the loss of a valued employee, a citizen of outstanding worth. That we extend to her family our sincere sympathy in their bereavement"; and that this resolution be spread upon the minutes of this meeting and a copy forwarded to the family of the deceased. ,. It was the recommendation of the Health Committee that the request of Frank Chambers be denied and demolition proceedings against Yates Hotel be in- stituted. Upon motipn made and seconded, the recommendation was put to a vote ,. and it appearing that the vote was very close, it was put upon roll call and councilmen voted as follows: Aye, Reid, Page, Farrington and Carlson; nay; Lamb, Hendershott, Hanns and Bond. It being a tie vote, the Mayor cast his vote in favor of the demolition by voting aye; thereby breaking the tie. By special permission of the Council,' Mr. Frank Chambers was given until September 1,"1938 to tear down 29 the building and it was so ordered. I Upon motion made and duly seconded, Jennie L. and Brownell Frasierr owner 30 of Joe's Place, were also given until September 1, 1938, to demolish said building. ( It was reported that Ben F. Dorris and Klysta Cornett Dorris have execute a deed on behalf of the City of Eugene for Lots 1 and 2, Block 1, Wallace Dorris I Addition to Eugene, Lane County, Oregon, upon payment to them of $10.00 and the Cit paying the delinquent taxes. Upon motion made and duly seconded, this was duly 30 approved. I City Attorney Calkins announced that steps were being taken to tear down or repair the various houses reported to him for condemnation, to-wit: 2411 Potter (owned by the City); 1432 Moss (Chief of Police has been authorized to see the owners and ask them to tear it down); 1028 Kincaid (House is in good condition, and parties are repairjng it now}; 1257 Adams (small shed - Chief of Police is tryi g . 31 to locate the owners and ask them to demolish the building.
