M., August 22, 1938. Mayor Large pres ided over the meeting. "'\"'J Councilmen present were: Messrs. Lamo, Hendershott, Reid, Page, Hanns, Farrington, 1 and Bond; absent, Carlson. The minutes of the previous meeting, August 8, 1938, were presented and or- 2 dered filed. I Robert Prescott and other members of the Appraisal Oommittee of the Eugene Realty Board addressed the council concerning joint appraisal of city property. The Committee respectfully requested that one member of the Finance Committee or someon designated by the Council with authority to act for the Council accompany the Realt Board Committee in these appraisals so that when a price_ is fixed it would be ac- ceptable to both parties concerned. The matter was left in the hands of the Finance 3 Committee to report at the next meeting. / Communication from William G. East addressed to Fred E. Lamb, Chairman of the Judiciary Committee, relative to the Ramey Rugh matter, was 'presented by the City Recorder. It was the re'commendation of the Committee that a sum of $190.00 be paid to Mr. Rugh in full settlement of the case at issue and that Mr. Rugh look to Mrs. Edblom for the $20.00 rent due and that payment of these sums relieve both the city and Mrs. Edblom from any further responsibility. Upon motion made and seconded, the question was placed on roll and councilmen voted as follows: Aye, 4 Lamb, Hendershott, Reid, Page, Hanns, Farrington and Bond; nay, none; absent, Carlso . , The $650.00 cash offer of R. W. Leighton for the East 1/2 of Lots 11 and 12 and the East 1/2 of the North 1/2 of Lot 10~ Block 23, Gross Addition, was denied by the Finance Committee and no counter-offer extended. Upon motion made and seconded, 5 the recommendation of the Committee was unanimously approved. , The Finance Committee recommended that Mrs. Gail H. Liston be allowed to redeem her home located at 1611 Lincoln Street and known as Lot 1, Block 11, Hendric 's I Amended Addition at a price of $1234.79, down cash payment of $300.00, and $25.00 p~r month including interest at the rate of six per cent. and further to allow her to apply the $220.00 rent paid since last October on the contract which is to commen e on the first rent date. Upo~ motion made and seconded, the recommendation of the Committee was unanimously approved and the Treasurer's Office herewith instructed I 6 to proceed with the execution of the necessary papers. The '1500.00 cash offer made by Charles L. Paine, on behalf ,of a client, for Lots 5 and 6, Block 20, College Hill Park Addition, was denied by the Finance Com- mittee and a counter-offer of $2000.00 extended. Upon motion made, seconded, and 7 carried, the recommendation of the Committee was unanimouely approved. I The $600.00 cash offer of W. L. Davis for property described as follows: to-wit: "Beginning at the ,intersectioh of the South line of Broadway with the East line of Taylor Street and running thence South 168.63 feet, thence East 100 feet, thence. North 168.63 feet, thence West 100 feet to the place of beginning," was held by the Finance Committee for further consideration. Upon motion made and second~d, /8 the action of the Committee was duly approved. The $1620.00 offer of Eunice H. Hathaway for Lots 4, 5, 6, 8, Block 9 in Hollenbeck's Addition, was denied by the Finance Committee and a counter-offer of $2000.00 extended. Upon motion made and seconded, the recommendation of the Com- ,9 mittee was duly approved. . The $125.00 offer of Frank Fletz for Lot 2, Block 5, Cheshire's First Ad- 'I dition, was rejected by the Finance Committee with no counter-offer extended.-Upon I 10 motion made and seconde~, the recommendation of the Committee was duly approved. The $100.00 cash offer of J. W. Silva for the North 8.48 feet of Lot 9 and the South 8.33 feet of Lot 10, Block 24, Gross Addition, was denied by the Finance Committee and a counter-offer of $160.00 extended. Upon motion made and ~econded, III the recommendation of the Committee was duly approved by the council. . The $500.00 cash ofrer of Robert Fleming for Lot 2, Block 2, Hollenbeck's I' Addition, was approved by the Finance Committee and the Treasurer's Office was here- with instructed to proceed with the execution of the necessary papers in confirmatio of the sale as directed by the general resolution adopted by the Common Council on J 12 June 13, 1938, authorizing such action and it was so ordered. Second offer of Mrs. Harry Lyons in the amount of $150.00 for the West 75 feet of Lots 5 and 6, Block 1, Melrose Addition, was denied by the Finance Committee and a counter-offer of $191.11 with a down payment of $25.00 extended. I The offers of g.L. Smith to wreck the houses condemned by the city, was held by the Finance Committee until suit to quiet title is completed on the same and 15 this action was duly approved. I Councilman A. C. Farrington requested more time for in~estigatfton and settl e- ment of a complaint from residents near and adjacent to the New Service Laundry abou 16 soot from the stacks of that building and it was so granted. r Councilman Bond, police committee chairman, declared that the Police De- partment were cleaning out to the best of their ability the hobo jungles existing in 17 and adjacent to the city. ~' I Denied was a request made by Dr. M. Morrison, 191 Seventeenth Avenue West, 18 for a no-parking strip to be painted on the curb in front of her residence~ { ... Plans for the proposed city-county police and jail building were left in 19 the hands of the Police Commi ttee for report at the next session of the council.. I Resignation of W. L. Valentin from the Eugene Boxing Commission was 20 by the eouncil and the appointment of Edward Adams to succeed him approved. ( I Mr. John Beakey, Traffic Engineer for the State Highway Commission, appeare before the council and gave the estimated cost of the traffic signals to be installe by the city on the seven intersections listed herein: Willamette at 6th, 7th, 8th, Broadway, 10th and 11th and Broadway at Oak. (Estimated Cost- $9162.00) The Highwa Commission is to participate on a 50-50 basis on the installation of lights at five intersections; and the city of Eugene to stand 100 per cent on the other two. The Cit,y Attorney was instructed to prepare a contract between the State Highway Com- mission and the City of Eugene and the Mayor and Recorder Were authorized to execute 21 the same. I . Communication from the Western Unipn relegraph Company wperein they accept the terms and conditions of the franchise ordinance as submitted by the city, was 22 presented and ordered filed. I City Attorney S. M.. Calkins stated that the Postal Telegraph Company were 23 interested in executing a like ordinance and steps would ,be taken to prepare one. I Requ~st. from "Tohn Durr- asking for waiver of certain reg}.llations of the Building Code in the construction of an addition to the residence which he is erect- ing at 1491 Mill Street, was denied by the Board of Appeals and action sustained by 24 the council. I Request from Bruce McKenzie asking for permission to sel~ within the City a type of cottage erected in panel sections, was presented. It was pointed out that I this cottage in no way conforms to the requirements of the Building Code and the Board recommends that thisrequest be denied, but that prospective purchasers be allo ed to make requests for the installation of these cottages. This actJon was duly con- 25 firmed by members of the council. I Payment of Playgrounds employees' salaries from the Revolving Fund was authorized and the Mayor and Recorder instructed to execute the same. It was an- 26 nounced that Friday, August 26, terminated the playground activities for the year 19 8. f I Report from the Eugene Flying Service, Joseph Harrel, Manager, showing re- ceipt of $75.00 rent and $120.55 Commissions by the City for the period commencing Apr 11 1 to August 18, 1938, inclusive, was presented and met with very .Lavorable 27 comment. B. Bergman~ and confirmed by the council. r An ordinance vacating the following described arear to-wit~ "All of 24th Avenue West lying West of the West line of Lincoln Street and East of the East line, of Lawrence Street, etc.~, had its first reading. Callfor protests and remonstrance were made, and there being no objections, the ordinance passed to its second and I third readings by title under suspension of the rule by unanimous consent of the council, and was placed for final passage. An ordinance amending Ordinance No. 8413 of the City of Eugene, entitled:"An ordinance to create or divide the City into Districts within some of which it shall be lawful, and within others of which it shall be unlawful to erect, construct, etc. had its first reading and passed to its second and third readings by title under suspension of the rule by unanimous consent of the council and, was placed for final passage. The ayes and nays were called; councilmen voting aye: Lamb, Hendershott, Reid, Page, Hanns, Farrington and Bond; nay, none; absent~ Carlson. The ordinance 32 was declared passed and numbered 8552. An ordinance declaring the'intention of the Common Council of the City of Eugene to make a reassessment of the cost of paving 15th Avenue East from Willamette Street to Kincaid Street, etc., had its first reading and passed to its second and. third readings by title under suspension of the rule by unanimous consent of the council and was placed for final passage. The ayes and nays were called; councilmen voting aye: Lamb, Hendershott, Reid, Page, Hanns, Farrington and Bond; nay, none; 33 absent, Carlson. The ordinance was declared passed and nUIDbered 8553. I The recommendation of the Sewer Committee to file with the PWA authorities application for aid in the construction of Eugene's $150,000 sewage disposal plant, was approved by the Council. The city's share of the cost, should the application b approved, will be raised by a revenue bond issue to be placed on the ,ballot at the ,36 next general election in November. Resolution on the deposit of city treasury funds in the U. c:: National Bank u. 37 was presented and upon motion made and seconded, adopted by the council: / I RES 0 L UTI 0 N WHEREAS,. the Common Council of the City of Eugene has re.ceived from the United States National Bank of Portland, Oregon, at its Eugene Branch, written offer to accept the deposits of this body under Time Certificates of Deposit and to pay therefore interest as in said offer set forth, which said offer is in words, letters and figures, as follows: .... NOW, THEREFORE, Be It Resolved~ That the said offer be aecepted I and that the Treasurer be and he is hereby authorized and em- powered to accept the same, in writing, as provided for upon s~d written offer, and when so accepted in writing, said in- strument shall constitute a contract between the Common Council of the City of Eugene and the United States National Bank of Portland, Oregon, covering the subjects therein set forth, BE IT FURTHER RESOLVED, That the Recorder be and he is hereby authorized to ~ertify this resolution over the seal of this body and deliver the same to the said United States National Bank of Portland, Oregon. 38 Upon motion made and seconded, the meeting was adjourned.
