Mayor Elisha Large presided over the meeting. Councilmen present were: Messrs. Lamb, Hendershott, Reid, Page, 1 Hanns, Farrington, Bond and Carlson; absent, none. . The minutes of the previous meeting, August 22, 1938, were presented and 2 ordered filed. I The offe~ of W. E. Pool to assume the contract originally issued to Mrs. Irene A. McCuistion for tract known as 2&4 Washington Street, was approved by the 3 Finance Committee and upon motion made and duly seconded, accepted by the council. I . The $800.00 cash offer of R. w. Leighton for the East i of Lots 11 and 12, Block 23, Gross Addition, was accepted by the Finance Committee and upon motion made /4 and seconded, approved by the council. , ", The'offer of Eunice H. Hathaway to pay $400.00 each for Lots 1, 3,4,5" 6 and 8, Block 9, Hollenbeck's ,Addition, was rejected by the Finance Committee and a counter-offer of $600~00 extended. Upon motion made and seconded, this recommenda I 5 tion was duly approved by the council. The $1000 offer of F. A. Mattin for part of Lots 2 and 3, Block 1, Skinner 's Donation, located at 132 and 132i East 5th Street, was denied by the Finance Com- mittee and a counter-offer of $1500.00 extended. Upon motion made and seconded, I 6 this recommendation was duly approved by the council. The $86'~00 cash offer of J. R. Jewell for Lot 4 and the North half of Lot 5, Block 32, Gross Addition, was accepted by the Finance Committee and the Treasurer's Office authorized to execute the necessary papers in consummation of /7 the sale. Upon motion made and seconded, this recommendation was duly approved. The $700.,00 cash off er made by Edith F. Gardiner, on behalf of a client. Upon motion made and seconded, the recommendation of the I 8 Committee was duly approved by members of the council. The offer of Otto Hughes to pay $400.00 each for Lot 7, Block 11; Lot 1, , Block 12; Lot 3, Block 12; Lot 4, Block 12; Lot 5, Block 12 all in Hollenbeck's Ad- dition, was rejected by the Finance Committee and a counter-offer of $500.00 ex- tended for each lot. Upon motion made and seconded, this recommendation was duly /9 approved. Offer of Donald B. Parks to pay $200.00 cash for part of Lot 2, Block 20, Fairmount addition, said lot being 100 x 160 feet on the West side of Walnut Street, was denied bY the Finance Committee and a counter-offer of $400.00 extended. Upon ,10 motion made and seconded, the recommendation of the Committee was duly approved. The $600.00 offer of E. H. Hall for property east of R. A. Babb property on Fairmount Boulevard, being one-half of property lying east of the street running to Longview Street or about 55 feet by 160 feet, was presented. The $300.00 offer of Jack Aasterud, $50.00 down and $12.50 per month plus 0% interest per year on unpaid balance for property at the Northwest corner of 25th and .University known as 2466 University Street, was approved by the Finance Committe ,13 and .confirmed by the council. Lombard, attorney, appeared before the council, protesting that his clients, Jennie Lee and Brownell Frasie~, had not been properly served relative to the demolition of Joe's Place. Resolution cclling for another meeting for the consideration of th~ entire matter and directing that a notice be sent to the Frasier's and the Frasier Real Estate Holding and Loan Company, was herewith ,21 unanimously adopted: RES 0 L UTI 0 N WHEREAS, heretofore a proceeding has been carried forward for the demolition of the West half of Lot 8, Block 2, of Skinner's Donation to Eugene, Oregon, known as No. 57 ,6th Avenue East, and WHEREAS, a hearing has been held, at which time the Council determined that the building was a dangerous building, and WHEREAS, a subsequent notice of hearing WaS sent to the owners of the building, to-wit: Jennie Lee Frasier and Brownell Frasier, being respectively President and Secretary of the Frasier Real Estate Holding and Loan Company and constituting all of the officers and all of the stockholders of said company, and I - WHEREAS, Herbert W. Lombard representing the Frasiers appeared ber-ore the Council and claimed that they had not been properly served because notices had been directed to Jennie Lee Frasier and Brownell Frasier, as owners of the prQperty. NOW, THEREFORE, the Council hereby calls another meeting for the con- sideration of the entire matter, including the Resolution adopted by them June 13, 1938, and the Recorder is directed to CaUse to be mailed by registered mail to Jennie Lee Frasier and Brownell Frasier and The Frasier Real Estate Holding and Loan Company copies of this Resolution and of the Resolution of June 13, 1938, together with a notice directing them to appear if they wish to be heard, before the Council in the Council Chambers in the City of Eugene, Oregon at 7:30 o'clock P.M. of September 26, 1938, at which time any protests or objections to the action of the Council will be heard and considered and the Council will either modify or change its former determination or affirm the sam e . P. J. Hanns, Chairman of the Fire and Water Committee, recommended that state- ments be sent the following patrons for whom services had been rendered by the Fire Department on out-of-town calls: C. F,. 'Hyde, $15.00; Charles McCollum, $16.00; , ~rs. Lillie Hayes, $14.00; Welby Dorman, is.OO; R. S. Chamberlain, $8.00. Councilman Farrington, Chairman of the Health Committee, reported that the manager of the New Service Laundry is bringing an engineer from Portland to check I /23 Ithe furnace and as soon as the proper investigation has been made, a report will be ~ade to the council of its findings. Communication from C. C. Hockley, Regional Director for PWA, in which he points out that the deadline date for holding election regarding the construction of a sewagJ tiisposal plant is October 1, 1938 and deadline date for filing application is September 30, 1938, was presented. Mr. Reid, Chairman of the Sewer Committee, re- application be filed with the PV.'A Administration by t3eptem ber 30th and in the event I / 24 he application is rejected then application can be filed with the WPA. Sam Bond, Police Committee Chairman, recommended that H.B. Brady be allowed to ~rect a neon sign on the opposite side of the street from the Auto Camp which he is now constructing at 969 BOUlevard, providing that Mr. Brady will receive the approval / 25 ~f the State Highway Commission. The Recorder was instructed to notify the Commissio rf this action. The Police Committee recommended the apnroval of transfer of Retail Beer Class ':Blil License and Package Store Class liB" License from Emery f:,eales to N. D. Councilman Hanns reported that he would report at the next meeting of the Council concerning the installation of a light at the Railroad tracks and Pearl 28 Street. t A request of the School Board by Lloyd Payne, to place temporary barriers during school play hours on Adams between Broadway and lOth and on Madison between 12th and 13th was not granted. The City Attorney pointed out that the city might be I liable for damage if car driveTs struck barriers. The School Board withdrew the re quest and asked only that slow signs be painted on the pavement adjacent to Woodrow 29 Wilson School. I Letter from Health Officer E. L. Gardner revealing the unsanitary conditio s of the buildings located at 124 and 154 Ash Street, Eugene, and the further revelati n 30 that two other residences are bein~ planned nearby, was presented and ordered filed. I Communication from Alice A. and Elmer V. Hi ssell, r eques t ing that they be excused from paying the delinquent interest on the last half of the assessment re- lating to Lot 10, Block 7, Scott's Addition to the City of Eugene, was presented. Upon recommendation of the Judiciary Committee, therequest was upon motion made and 31 seconded, denied. I Communication from Howard L. Schon requesting permission to operate a box-ball alley at 12th and Alder Street, was granted by the council until such time 32 that the University officials recommend that the same be discontinued. I Recommendation of the Building Inspector that the house at 530 Eighth Avenue West be ordered condemned and torn down, was approved by the council and the City Attorney was instructed to proceed with condemnation of the same. It was pointed out that this property has been subject to numerous complaints and is owne 33 by Eli Rubenstein. I Request from John Durr asking for a recommendation to waive certain res- I trictions of the Building Code relative to the house at 1491 Mill Street, was denied 34 by the Board of Appeals and action sustained by the council. f Request from Kieth Fennell for a waiver of the "Set Back" requi remen ts on Lot 1, Block 4, Shaw's Second Addition, was presented. Th i s lot is located on the south side of 11th Avenue between Hilyard and Alder Streets and is in B-2 Zone. The Board recommends that this request be granted upon the filing of a proper contract to relieve the City of dam~ges in event of widening East 11th Avenue. This action 35 of the Board was duly approved by the council. / Request from R. L. Appling for a permit to erect an open covered driveway at the rear of his present garage, utilizing the retaining wall one foot inside his east lot line as a support for the posts on east side of said structure, was pre- sented. The Board recommended that this permit be granted and the council affirmed 36 this action. I Communication from the Business and Professional Women's' Club protesting the action of the council in discriminating against women in employment or public 37 position on account of their marital status, was presented and ordered filed. , Report for the month of August from the Police, Engineer and Library, was 38 presented and ordered filed. Councilman Carlson reported that the James H. Tierney request for removal 39 of poison oak from the South Willamette area had been complied with. I / Councilman Bond requested that the request of Hershel R. Taylor relating to truck traffic and speed on 13th Avenue East from Alder to University Street, be 40 tabled and it was so ordered. / The Recorder was instructed to obtain from Wholesalers names of all places in Eugene where tobacco is sold so that the Police Department could check on those 41 who have failed to apply for their licenses. I I An ordinance levying assessments for the paving of 15th Avenue East from Willamette Street to Kincaid Street in the City of Eugene, Lane County, Oregon, had its first reading, and there being no remonstrances nor objections, it passed to its second and third readings by unanimous consent of the council by title under suspension of the rule and was placed for final passage. The ayes and nays were called; councilmen-voting aye; Lamb, Hendershott, Reid, Page, Hanns, Farrington, Bon , and Carlson; nay, none; absent, none.
