'..."'~... The minutes of the regular meeting of the Common Council held at

CC the hour of 7:30 ~'clock P.M., November 14, 1938. Mayor Large presided over the
meeting. Councilmen present were: Messrs. Hendershott, Reid, Page, Farrington,
1 Bond, Hanns and Carlson; absent, Lamb.
The minutes of the previous meeting October 24, 1938 were presented
2 and ordered filed.
Mr. Robert H. Lemon, Chairman of the Advisory Board of the Salnltion I
Army, made a written request that the Salvation Army be allowed $1200.00 out of the
Relief Fund of the City of Eugene. He stated that the Salvation Army had contacted
approximately seven hundred families in the last year. Councilman Hendershott,
reported that figuring on the basis of 80% of the budget there was about $1319.3&
left in the relief fund and moved that the request for $1200 be granted. There was
some discussion and it was suggested that this money should be allocated by the
Salvation Army not only to run through this year but also the spring of 1939 as
there would be no more money available for this. It was also suggested that this
money should be given to the Salvation Army with the understanding that if an
emergency arose between now and the first of the year, that the council could
rescind its action. City Attorney Calkins, Mayor Large and Robert Lemon were deleg ted
to meet with the Salvation Army and make an allocation as to the use of this money.
Witp these recommendations, motion made by Mr. Hendershott, was duly seconded and
carried. The ayes and nays were called, .councilmen voting aye: Hendershott, Reid,
....3 Page, Hanns, Farrington, Bond and Carlson; nay, none; absent, Lamb.
In the absence of Councilman Lamq, Chairman of the Judiciary Committe ,
City Attorney Calkins reported regarding the city picketing ordinance. He explaine
that it had been declared void by Judge Skipworth about the first of November and
the city had sixty days to make a decision regarding any proposed action and said
this would take the matter up to the first of January, 1939. He also stated that
since the ordinance had been declared void that the state picketing law had carrie
by a heavy majority and now there was talk of labor contesting this state law and
there had been suggestions already that the legislature modify the new law in some I
way. He said that an old ordinance under the former law would not be applicable to
a subsequent state law and asked that the matter be left in his hands and with the
4 Judiciary Committee, to report at a later date and it was so order'ed.

Mr. Calkins also reported on the operation of punch boards. He
stated that a certain type of punchboard had been sold to a party in Lane County
and that later the party refuse~,to pay for the same, stating that they were illega .
He said this case went to the state supreme court and it was ruled that these par-
ticular devices were legal and allowed to be operated. They are called "Checker
Problems" and the City of Portland is licensing them. Mr. Calkins requested that
this matter also be left in his hands and with the Judiciary Committee for further
/5 study, and it was so ordered.
Relative to the sidewalk injury sustained by Ida Peltier, Mr. Calkins
reported that he and the Judiciary Committee had investigated the claim, and it was
the ir recommendation that the defendant be r'emunerated in the sum of $50.00 which
would cover the services rendered by her physician. On motion made and seconded,
the question was put to a vote and councilmen voted as follows: Aye, Hendershott,
Reid, Page, Hanns, Farrington, Bond, and Carlson; nay, none; absent, Lamb. The
Recorder was instructed to prepare a warrant in said amount to be drawn from the
6, emergency_fund of the city and it was so ordered.

Mr. Calkins also reported for the Judic iary Committee on the matter'
of the city's Liens against the Emma Millis property located at 1006 Taylor Street. I
He explained that the part that the city has a lien on is only a 30-foot strip and
that it is occupied by only a small part of Mrs. Millis house. He said that after
thorough study of the matter, the Judiciary Committee recommended that the city
accept $363.10 in full settlement for the claim on the Mill's property. On motion
of Councilman Hendershott this recommendation was duly approved by al+ members of

The Finance Committee reported that Judge N. E. Glass, on 'behalf of
the County, had asked permission of the city to be allowed to wreck the old houseat, I
1601 Second Street. This property had been foreclosed by the county and has no
sanitary facilities and complaints have been received from the neighbors. On motio ,
8 this request was granted by the council.

Mr. Hendershott reported that a Mr. Cox wants to rent a vacant lot at
8th and Monroe to put an automobile trailer on, and pay the city a dollar a month
9 for use of the same. On motion of Councilman Bond this request was denied.

The $550.00 offer of J. L. Copenhaver for his client, Earl Kast, for
Lot 7, Block la, Hendrick's Amended Addition, was denied by the council and a

council. The Treasurer's Office Was instructed to prepare the necessary papers in

The ,$1800.00 offer.. of McOully Realty company for client Arthur M.
Gilbert for the South 100 feet of Lot 10, Block 3, Whiteaker's Addition, on which
I there is an old residence, garage, woodshed, etc., was accept ed by the Finance
Committee and upon motion made and duly seconded, approved by the Oouncil. The
Treasurer's Office was instructed to prepare the necessary papers in connection wit
,12 the transaction.
The $2400.00 offer of C. F. Hyde Realty Company for client William Deo ,
for the East 50 feet of Lots 1 and 2, Block 8, College Hill Park Addition, was ap-
proved by the Finance Oommittee and upon motion made and duly seconded, accepted
by the Oouncil. The Treasurer's Office was instructed to prepare the necessary
113 papers in connection with the transaction.
The Finance Oommittee reported the following bills to the Council with
a recommendation that they be allowed and motion was made, seconded, ,and carried
that warrants be drawn for the same. The ayes and nays were called, councilmen
voting aye: Hendershott, Reid, Page, Hanns, Farrington, Bond and Carlson; nay,
14 none; absent, Lamb.

Upon motion duly made, seconded and carried, the Recorder was instructe
to advertise for bids for audit of the city books for the year 1939~ sealed bids to
15 be opened at tne me,etlng of' November 28th.

Mr. Carlson; Chairman of the Street Department, reported that a Mr.
Howard Amon was acquiring title to a triangular strip of property extending from
Willamette to Mill Street on the ,north side of twenty-third Avenue. This strip is
80 feet on Willamette Stree,t. and narrows down to about 10 feet on Mill Street.
Mr. Amon requests that the city deed to him the present 23rd Avenue east from
Willamette to Mill and he in turn will deed back to the city a strip of the same
width as the present 23rd Street. Upon motion made and seconded, this request was
granted and the Mayor ,and Recorder were instructed to sign deed for proper convey-
16 ance and it was so ordered. I
I Mr. Hanns, Chairman of the Fire and Water Committee, requested that
statements be submitted to the parties named herein for services rendered them by.
the Fire Department on calls made in the outlying districts and it was so ordered:

Councilman Page, Park Committee Chairman, stated that there were two
WPA projects on which they would like to commence work by November 22nd instead of
waiting until after the first of the year. He said one was to finish up the old
fence job that had been started in Hendrick's Park and the other was some work on
Skinnerls Butte Park. He stated that there would be no cash outlay necessary on
these until the first of 1939 and asked that this work be allqwed. On motion ma~e,
18 seconded, and duly carried, the request was granted.

The Police COlf~ittee.requested an additional two weeks to study the
matter of stop signs and other traffic regulation measures presented to his committ e
19 at the previous meeting in the form of petitions. This was allowed.

Councilman Hanns asked that the matter of an electric stop signal at
13th and Wil1amette Streets be referred to the Police Department. He ,suggested the
installation or a stop signal to halt the north and south traffic that could be
controlled from the Police Office on account of the danger of children going and
coming from school. He further suggested that this signal be used in the morning
probably from 7:30 to 9:00 and again at noon and in the afternoon when the children
are returning from school. On motion made, seconded and duly carried, this matter I
20 was so ordered.

An ordinance providing for service in the extinguishing of fires out-
side of the city limits of Eugene was presented for its third reading. Councilman
Hanns suggested that the ordinance be amended to read "in the penal sum of Two
Hundred Do1larstl instead of the $100.00 originally required. Upon motion made and
seconded, this amendment was duly approved and the ordinanq~ had its third readipg,
and was placed for final pas~age. The ayes and nays were called: Aye, Hendershott, I
Reid, Page, Hanns, Farrington, Bond and Carlson; nay, none; absent, Lamb. The or-
21 dinance was declared passed and numbered 8558.
Resolution requesting the, legislature to fix a maximum series of speeds
in cities, was presented and upon motion made and seconded, duly adop: ed by the

THEREFORE,
BE IT RESOLVED, By the Common Council of the City of
Eugene that the legislature be memorialized upon the sub-
ject and asked to fix a maximum series of speeds in
cities,
I AND that the League of Oregon Cities be requested to
take this matter up in its legislative program, and try
and get the matter considered at the coming legislative
session.

family dwelling on Lot 10, Block 17, Gross Addition, being on the East side of
Harris Street between 20th and 21st Avenues. Said building to be attractively
, made up and indistinguishable from a single family residence, was denied by the

the cutting of curbs in the City of Eugene, Oregon, for driveway purposes, except in
that the City Recorder may, upon application, issue a permit not to exceed 25 per
eent of the ownership frontage and not to exceed 20 feet in anyone cut, to each
property owner making such application, declaring an emergency and fixing a penalty
for the violation of such ordinance," had its first reading and passed to its secon'

The council recommended that the city extend a rental price of $40.00
I per month for Room 8 In the City Hall to be used as afield office by the U.S.
Engineers, War Department for seven months beginning December 1, 1938 and ending
25 June 30, 1939 and it was so ordered.

Request of United Air Lines to secure an extension to their present
lease agreement on a month to month basis, such extension to terminate at the time
the new range is placed in commission by the CAA which will be delayed beyond the
first of the year making it necessary for United Air Lines to operate their range
26 until the new one is commissioned, was granted by the council. (Resol on IB ge 142)

The proposed installation of an overhead flashing beacon at 6th and Blair
by the Oregon State Highway Commission was approved by the council. The council
also agreed to the installation of a new pole on the southwest corner and agreed
f~'7, to assume the $1.75 per month cost of electrical power to be consumed.
Canvaas of election returns for the Special Election held. In the City
of Eugene on November 8, 1938 was presented and the results were as follows: Sewage
Dl~posal: (Yes} 4535, (No) 22&9; Majority 230&. Extension Recorder and Treasurer's
Term of office: (Yes) 4794, (No) 1959; Majority 2835. Cost and Control of light
/2.8 and water facilities to Water Board, (Yes] 2467; (No) 5085; Majority" 2618.
The Police Committee recommended the transfer of Retail Beer Class B
License from(Weiss and Sharman) to H. H. Weiss and V. M. Hanks, the latter being
a new partner In the New Deal Bowling Alley, 962 Willamette Street. Upon motion
12,9 made and seconded, this recommendation was duly approved.
I Application of J. Earl Moore for a second-hand dealer's license for
operation at 120-144 8th Avenue West under the name of "Dinty's Trading Poot", was
,30 approved by the Council upon the recommendation of the Chief of Police.
Ten applications for tobacco dealers' license wer'e presented and approved.
Upon motion duly made and seconded, the police were instructed tO,contact the
,31 parties that had not paid their tobacco licenses.

Paragraph #26. WHEREAS., the present lease agreement between the City of
.......' Eugene and the United Air Lines Transport Company, with respect
~r to occupancy of the airport of the City expires on December 31st I

WHEREAS, it now appears that the new government radio range
being installed by the CAA will be delayed beyond the first of
the year and that it will be necessary for the United Air Lines
Transport Corporation to continue to operate the present range
until the new one is placed in commission~
Therefore I
BE IT RESOLVED by the City of Eugene by its Common Council
th~t the present lease agreement shall be extended on a month to
month basis until terminated by the United Air Lines Transport
Corporation at the time that the new range is placed in commission.
This resolution shall be attached to the original lease
and two copies forwarded to the United Air Lines Transport Cor-
poration and upon such corporation signifying its acceptance
of it"it shall be deemed a modification and extension of the
former lease agreement.
Upon motion made and duly seconded, the foregoing resolution was
duly adopted by members of the. council.
