Mayor Large presided over the meet- ing; Councilmen present were; Messrs. Hendershott, Lamb, Reid, Page, Farrington, 1 Bond, Hanns and Carlson; absent, none. . . . The minutes of the previous meeting November 14, 1938 were presented and 2 ordered filed. I Mrs. Ezra S. Swanson, 1877 Harris Street, requested the city to remove or have removed some. blackberry bushes adjacent to her property which have been a nuisance: and fire menace for a great many years. She pointed out that the bushes ar on private property and felt that as a taxpayer she was due some protection. City Attorney Calkins stated that the city is not responsible for taking care of such conditions and Mayor Large suggested that the Fire Department take proper eqUipment and burn the bushes. Mr. Calkins stated that in the event of an accident, it was his opinion that the city would not be responsible. The Fire Department, through I 3 Chairman P.J. Hanns ,. was requested that these bushes be burned and it was so ordered At this time M~. Tracy Stocker of the Castelloe and Stocker Electrical Company, addressed the council on behalf of the McDonald Theatre requesting a specia ~ermit for the erection of a new marquise and sign for the theatre. It was revealed hat very minor changes are to be made over the height and width of the present sig . Councilman Carlson stated that he had looked into the matter and believed that the permit should be granted. The Recorder was hereupon requested to read that section of the report of the Board of Appeals which pertains to this request. It was the Board's recommendation that they be required to comply with all provisions of the code. Upon motio~ of Councilman Bond, it was moved and seconded that this special request be granted and the recommendation of the Board be herewith denied and it was (l so grdered. The City Recorder presented a communication from Robert H. Lemon, Chairmam: of the Advi~ory Board of the Salvation Army, wherein it was requested that the' I $1200~OQ granted by the council. at its meeting of November 14th be paid in the following sums during the months indicated: December, 1938, $400.00; January, 1939, $350~OQ~ February, 1939, $200.00; March, 1939, $150.00; Aprilr 1939, $100.00. Upon ,5 motion made and seco~ded the foregoing procedure of payments was duly approved. Councilman Hendershott, Chairman of the Finance Committee, recommended tha . the City of Eugene pay to Lane County the delinquent taxes due on the following eigh parcels of property: 1455 West 2nd, $13a.43; 1294 West 6th, $186.72; 142 Jefferson Street, $163.63; 710 East 17th, $277.94; 1395 Orchard Street, $115.91; 402 West 2nd, $209.36; 11 North L~wrence, $95.39; 1144 West Broadway, $131.67. Upon motion made and seconded the recommendation was approved by the council and it was further or- ,6 dered that payment of said taxes be made from the Improvement Bond Sinking Fund. The $500.00 offer of T. J. Casey for the property in the name of Kate Baccus lying East of Polk Street and just North of 8th street and also to include a narrow strip lying east of his home which is also in the name of Kate Baccus, was denied by the Finance Committee and upon motion made and seconded, recommendation ,7 duly approved by the council. . /The $500.00 offer of W. Dion for the property on the west s ide of Washing'- ton Street known as Lot 7, Block 11, Hollenbeck's Addition, was accepted by the Finance Commi ttee 'and the Treasurer's Office was instructed to prepare the necessary papers in connection with the transaction. Upon motion made and seconded, the re- /8 commendation of the Committee was duly approved. I , The $1500.0Q offer of F. J. Berger for his client Maurice Vitus for the following.described property: "Beginning at the Northeast corner of L~ 2, Block 1,. Skinner's Donation, running thence West 80 feet, thence South 110 feet, thence East 20 feetT thence South 50 feet, thence East 60 feet to the Southeast corner of said Lot 3, thence North 160 feet to the place of beginning,1I was accepted by the Finance Committee and upon motion made and seconded, the recommendation of the Com- mittee was duly approved ?nd the Treasurer's Office was instructed to prepare the /9 necessary papers in connection with the transaction. I The $1800.00 offer of W. K. Striker on behalf of his client A. G. Bender, for property at 1307 West 11th Street known as Lot 4, Block 2, Chamber's Addition, / 10 was rejected by the council upon the recommendation of the Finance Committee. The $450.00 offer of H. E. Cully for client C.C. Ball for Lot 1, Block 14, College Hill Park Addition, was accepted by the Finance Committee on the condition that the client fu~nishes his own title; the city to give a bargain and sale deed only. The $450.00 cash offer of W.K. Striker for client Harry Paulus for the following described property:"Beginning at a point of the West line of Van Buren Street 101.35 feet South of the intersection of the South line of West Broadway wit the West line of Van Buren Street, running thence West 133.68 feet, thence South 60 feet, to the alley running East and West, thence East along said alley 133.68 I feet to the West line of Van Buren Street, thence North along. the said West line 60 feet to the place of beginning~ was denied by the Finance Committee and a counte - offer of $650.00 extended. Upon motion made and seconded, the recommendation of th Committee was duly approved and the client was to be so notified of the Committee's 12 action. I Councilman Farrington recow~ended that the petition requesting condemnati n of a barn located on the rear of Lot 4, Block 3, Kelsay's Addition or more commonly known as 1572 Ferry Street and owned by Dorilla Somers, be sustained. The Recorder read the communication of Mr. S.R. Mosher, Building Inspector, wherein he also re- commended condemnation of said barn. Upon motion made, seconded and carried, the City Attorney was instructed to proceed with the condemnation of said barn and it ?3 was so ordered. Councilman Bond, Chairman of the Police Committee, recommended that the request for installation of stop streets on Agate Street at 21st, 22, and 23rd, be 14 denied. Upon motion made and seconded, this recommendation was duly approved. / Mr. Bond requested further time to study the other three petitions re- questing the control of excessive speeding on the North Pacific Highway, South Wil- 15 lamette Street, and Franklin Boulevard. This was granted. / Mayor Large requested that the Police Committee study the suggestion of 16 making 10th and Olive Streets a "No U Turn" intersection and it was so ordered. J . I Communic~tion from the Whiteaker PTA favoring the proposed municipal swim ming pool ,project and hoping.th~t it might soon become a reality, was read.and. 17 placed on file. ,/ Report of accountant P. W. Brown for the quarter ending September, 1938, was presented. Mr. Brown reported that the records are being well kept and are in 18 good condition. The report was herewith ordered placed on file. I Communication from W. B. Dillarq, County Clerk, refusing the city's ap- plication to purchase property located at 261 Jefferson due to the fact that said property has been occupied by a person drawing an Old Age Pension, was presented an 19 referred to the Judiciary Committee and City Attorney for study. I . Communication from H. L. Edmunds, president of the Eugene National Compan , wherein they offer to accept $1950.00 rather than the $2000 balance remaining unpaid, provided the city will make such payment not later than December 31, 1938. The 20 matter was held for further consideration. I Claim of Lilly Steen, presented through her attorney Reese Wingard, was presented. It was revealed that the claimant had stepped.into a trench dug across the pedestrian lane on the east side of Willamette Street at the corner of 8th and Willamette Streets and injured as a result thereof. She claims $500.00 general damages and special damages in the amount of ~p50.00. The matter was referred to the 21 Judiciary Committee and City Attorney for study. r I . The council unanimously voted to refund Mrs. L. J. Nurre the $2.00 buildin permit grant~d her on November 21st and which she later discovered she would be un- 22 able to use. I The report of the Pub~lc Library for the month of October was presented an 23 ordered placed on file. The Finance Committee was asked to consider the bids submitted by the foI- I lowing accountants for audit of the city books for. the year 1939: C. A. Horton, $300; P. W. Brown, $350; Robert Lemon, $350; George A. Stock, $420. It was revealed that Mr. Horton will render a semi-annual report, whereas Messrs. Brown and Lemon will 24 submit their reports on a 'quarterly basis. , Upon motion mad~ ~nd seconded, the Recorder was instructed to include with the December bills the $500.00 statement submitted by the League of Oregon Cities for codification of the city ordinances. Oregon, thence South 54.3 feet, thence West 18 feet, thence North 54.3 feet, thence East 18 feet to the place of beginning, all in Eugene, Lane County, Oregon WHEREAS,. The City of Eugene has caused the same to be appraised and de- termined its value and WHEREAS Franklin L. Fish and Zora Fish have offered the City of Eugene $20.12 for said property, which according to the appraisement is all. that the property is worth. NOW, THEREFORE, BE IT RESOLVED, By the Common Council of the City of Eugene; that the Mayor and Recorder be and they are hereby directed to execute . I \ . and deliver to Franklin L. Fish and Zora Fish a good and sufficient \ deed of conveyance to the above described property on behalf of I the City of Eugene. The council approved the application of Arthur Kalanquin to conduct a second- hand store at 839 Olive Street on the recommendation of Chief of Police Carl F. /27. Bergman. The Recorder was requested to communicate with the Eugene Water Board as soon as the sewage disposal project is approved so that rates can be set by the Water 28 Board for collection of the charges. I Fifteen applications from dealers who are desirous of selling tobacco,were presented and approved. Councilman Hanns recommended that warrants be issued and individuals placed under arrest for failure to have a license. Upon motion made and seconded, this action was approved by the council. It was pointed out that - , under the existing ordinance (8547) there is no penalty clause whereby the court can impose fines in the event of certain dealers failing to apply for said license. ,29 The City Attorney was instructed to prepare a new ordinance. The ayes and nays were called, councilmen voting 30 aye: Lamb, Hendershott, Reid, Hanns, Page, Bond, Farrington, Carlson; nay, none; absent, none. The ordinance was declared passed anld numbered 8560. I A request from the management of the Heilig Theatre to change the location of the ticket booth and to enlarge the foyer of the theatre, was presented by the Board of Appeals. As these changes will increase the exit facilities of the theatre 31 the Board recommends that the request be granted. Upon motion made and duly seconde , the recommendation of the Board was unanimously approved. J Request from George Chenault for a permit to erect a 12' x 32' portable house on the lot at the northwest corner of the intersection of Fifth Avenue West and Filmore Street, was presented by the Board of Appeals. I Request of L. B. Smith to be allowed to conduct a tea room and confectiona y 7~ at his home located at 1400 Willamett,e Street, was denied by the Board of Appeals i I ~~ their letter of transmittal to the council. Mr. Smith appeared in person before b: the council and stated that he was positive that there would be no complaint from the adjoining neighbors regarding the establishment of this type of business. Upon motion made, seconded and duly carried, the council rejected the recommendation of the Board of Appeals and ordered that a permit be granted providing that Mr. Smith will bring in a written approval from the adjoining neighbors. Communication from 33 Mr. Smith outlining in detail his plans, was placed on file. t Police Chairman ,Sam Bond recommended that renewal applications for 1939 I liquor licenses be granted to the following dealers and it was so ordered. Mr. Bond stated that no new applications would be accepted by the Committee for the 34 forthcoming year. This recommendation was duly approved by the council. I Ace, The Model Grocery Doc's Buffet. Fire and Water Chairman Hanns stated that it was the understanding of his Committee that any bond and/or insurance policy mus be made specifically on the basis that the city of Eugene is to be paid for any run and services performed whether, or not there was any damage. The City of Eugene is to have a certified copy on file of all riders and/or bonds before the equipment will be discharged for any call.
