Mayor Large presided over the meeting, ~.. Councilmen present were Messrs. ~endershott, Reid, Page, Farrington, Bond, Hanns, 1 and Carlson; absent" Lamb. The minutes of the previous meeting December 12, 1938 were presented and ordered filed. Marsh H. Goodwin, local agent for the Aetna Life Insurance Company, requeste I the council to grant him the right to issue a $50,000 surety bond on behalf of A.E. Hulegaard, Treasurer-elect of the city of Eugene. There was considerable discussion and the Recorder pointed out that during the past four years there had been a very definite effort made to divide the city insurance premiums as nearly equal as possib e among the insurance agents of the city and that Mr. Goodwin had not yet called upon the Recorder on behalf of business. It was further pointed out that Mr. Goodwin had the group health and accident insurance contracts with the City. Councilmen Hanns, Farrington, Bond expressed the opinion that this contract should go to Mr. Goodwin. The Recorder stated that there was a bond on appr9val for tonight from the Maryland Casualty Company represented by Bryant DeBar for $50,000.00 and also one for approva from the National Surety Company, represented by Sigu1an-Fell Insurance Agency in the amount of $50,000. It was further pointed out that Mr. DeBar had been one of the parties writing the fleet car policies and that he had surrendered his participation on that contract upon Mr. Hulegaard requesting him to furnish the surety bQnd, and the Eugene Insurance Agency now has Bryant DeBar's position on the fleet car policy in lieu of the surety bond that Mr. DeBar was asked to write. All councilmen presen voted to grant the ~50,OOO surety bond to Agent Goodwin with the exception of Counci - 3 man Carlson who voted in the negative. I Leo Deffenbacher, proprietor of the Campus Barber Shop, presented a petition requesting enforcement of the one-hour parking on East 13th Avenue between Alder and Kincaid Streets. His request was only for the north side. The police departmen 4 was ordered to enforce the parking restrictions on both sides. I The $850.00 offer of McCully_Realty Company for a client for Lot 2, Block 14 I College Hill Park Addition on which $450.00 has already been paid on Lot 1 to apply as down payment on two lots, the balance of $400.00 to be paid in monthly payments of $10.00 or more with 6% interest per annum, was accepted by the Finance Committee and the Treasurer's Office was instructed to prepare the necessary papers in con- 5 summation of the sale and it was so ordered. / The ~1200.00 cash offer of Edith F. Gardiner on behalf of a client for Lot 1 , Block 5, Gross Addition, was denied by the Finance Committee and a counter-offer of ~1400.00 extended and upon motion made and duly seconded, the recommendation was un- 6 ani~ously approved. I The request of Dan Pavlik to cancel the contract entered into with the city for the prop~rty 10catedat261 Jeffenson Street with a further request for a re- fund on the $20.00 payment already made, was referred to the Finance Committee for 7 consideration. j Resolution authorizing the Mayor and Recorder to execute a deed on behalf of the Water Board for the South 65 feet of Lot 1, Block 1, Grand Prairie hddition, 8 was upon motion, made, seconded and duly carried, unanimously adopted: / R E SOLUTION WHEREAS, the Eugene Water Board is purchasing the South 65 feet of Lot 6, Block 3 of West Sixth Street Addition, from private owners, and itself paying off the city's liens thereon, and as a part of the purchase and I for the purpose of locating a sub-station, desires to buy the South 65 feet of Lot 1, Block 1 of Grand Prairie 4ddition to the city of Eugene to complete its sub-station, and 'Ji:HEREAS, a computation has been made of the amount of money necessary to reimburse the ci ty for its investment in the '~outh 65 feet of Lot 1, Block 1, Grand Prairie Addition, at $100.00. Therefore, I BE IT RESOLVED by the Common Council of the city of Eugene that the Mayor and Recorder be and they are hereby directed to make, execute and deliver on behalf of the city of Eugene a deed of conveyance for the South 65 feet of Lot 1, Block 1, Grand Prairie Addition, to the city of Eugene, for the use of the Eugene ~ater Board, upon payment by the Water Board of )' the sum of $100.00 to the city Treasurer. ~ : ~ 11""'- Db --- . - - "" ... .-- ..- -~ - - --- - .~-- -~ - - - .,. .-~ -' -,.-- - --. -- - -~ --- - - - - - - -- The $750.00 offer of C. F. Hyde Realty Company on behalf of client ~azel B. Johnson for the South 20 feet of Lot 6 and all of , Lot 7, Block 5, Cheshire' First Addition on the following terms, to-wit: The sum of $5.00 down and ~45.00 I upon acceptance of title and delivery of contract and possession of premises, ~ February 10, 1939 and the balance of $700.00 payable fifteen and no/lOO per month ;~1 inelusive of interest, was accepted by the Finance Committee on the provision that a'~' payment of 20% down and ~15.00 per month is made and it was so ordered by the common' I 9 council. Councilman Hendershott reported that he had no report to make ,on the pro- /10 posed merger of the Park, Playground and Juvenile Departments of the city of Eugene. I Councilman Hendershott moved that the Police Committee be given power to, act on the renewals of beer and wine applications and this was seconded and duly 11 carried by the members of the council. f Mr. Hendershott further recommended that the transfer of General Bond Sinking Fund for payment of delinquent ImpJ'ovement Bonds be not allowed and it was I 12 so ordered. Councilman Hanns recommended the installation of a street light at Second and Jackson Streets and upon motion duly made and seconded, said recommendation was / 13 unanimously approved. Councilman Harms, Chairman of the Fire and Water Committee, recommended that if, in the event, two trucks are engaged within the city limits, no machines will leave to fight blazes elsewhere and that if their service be needed within the city while they are on a suburban call, they shall be iEmediately recalled. Also that calls shall not be made to communities which have not made the re~uired financi 1 remuneration for any previous service. Upon motion duly made and seconded, the re- I 14 commendation of the Committee was unanimously approved. The Fire and Water Committee reported that the Fire Department was engaged in fighting two blazes: one, on November 25, Paul Snook, Route #4; and Magladary School District #181 on December 9, 1938 and stated that statements had already been mailed out of the City Recorder's Office upon his instructions. This was unanimousl ,15 approved. I Councilman Hendershott recommended that the $300.00 bid of Accountant c.A. Horton be accepted for auditing the books of the City of Eugene for the year 1939 {16 and it was so ordered. Councilman Farrington, ChairLan of the Health Committee, stated that there was a residence at 2011 Alder Street, owned by R.C. Bailey now residing'at Yachats, Oregon, and in front of this place are five large poplar trees and that the property located immediately south of 2011 Alder Street, owned by L. M. Watson, is continuall having trouble with the sewer system because of interference from the roots of these trees. The matter was referred to the Park Cornmittee with power to set.' The Record r is, however, first to notify Mr. Bailey that action is contemplated and that Mr. Watson is agreeable to setting out other species of trees instead of these upon thei 117 removal. Mrs. W. H. Maxham, Secretary to the Park Board, presented the annual report of the Board for the year 1938. The S8lIle was ordered placed on file. (Mrs. Maxham 18 has the report.) / .The Po 1 ice Comrni t tee, by Sam Bond, recommended pa.s sage of Retai 1 Beer Class "CII license to Maebelle E. Findlay, The Ace Lunch, located at 48 East 10th Street by reason of the fact that this licerse merely allows the sale of bottled beer and not draft beer. The application of Oreen's Tavern for a Package Store Class B License was denied as it was entirely new license. It was reported that the Oregon I Hotel Coffee Shop had a Package store Class B License in 1937 but did not renew it in 1938 due to the fact that they believed that they were privileged to sell package wine under the Restaurant and Hotel License granted them that year. The State Com- missioner, however, told the manager that such license would be necessary before they could make any further sales. The Police Committee recommended that both 119 licenses be renewed for 1939 and it was so ordered. The police committee renuested another two weeks during which they could /20 study the proposal of parking lots for bicycles, and it was so granted. I The request for one hour parking on Willamette from 11 th to 12th, and one- hour parking between 7th and 8th Avenues on Charnelton; removal of parking restric- tions on ~est 19th Avenue between Willamette and Olive Streets, was presented and (21 held for two weeks., . As all bids to supply the city with gasoline for 1939 were the same, l6i per gallon, it was decided after some discussion to divide the business equally betw en all companies located within the city limits. The proposal of Councilman Hanns to d 81 strictly with the Associated Oil Company because they pay the most taxes to the city /22 was defeated. ..... J"'" 156 - ,-, - - --- - - - - -.... - ~.- .- ~- -- -- - -- - - -- - Mayor Large recommended the appointment of Mrs. Gladys L., Dohnert to the position of Polica Matron of the City of Eugene and the appointment was duly confir ed -W'9q by all members of the council with the exception of Councilman Bond who questioned I ,~ the mayor's reason for selecting Mrs. Dohnert when she was not the highest ranking le'1 applicant. Mayor Large stated that he would give his reasons in writing to the ~ Civil Service Commission. I Messrs Eugene Klink and C. M. McCoy, highest ranking candidates on the fire department eligible list, were selected by the Mayor to fill the vacancies in 24 that department, effective January 1, 1939. f Mayor Large stated that inas~uch as he had not as yet received a certified eligible list from the Civil Service Commission, he would be unable to make ap- I pointments to fill the openings in the Police Department at this time. It Was pointed out that as soon as Dr. E. L. Gardner, Health Officer, completed the medical examinations, certifications could be made and a list submitted. Mayor 251 Large would thereupon make the appointments so that the new applicants could re- sume their duties as of January 1, 1939. / The Council approved the surety bond presented by Sigman-Fell Company covering Treasurer-elect A.E. HUle~aard in the amount of $50,000 from January 1st, 1939 to December 31st, 1942. The 5000 surety bond covering John Fields, assistant Treasurer from January 1, 1939 to December 31, 1942 by Sigman-Fell Insurance Agency was rejected and said bond was granted on behalf of Br~ant DeBar and it was so 01"- 26 dered. ' '" / Mayor Large ordered the petition, presented to the council on October 10,19 8 27 relative to Pu~lic Housing, placed on file and it was so Drdered. / The Council approved the Surety Bond covering C.M. Bryan, City Recorder 28 in the amount of $1000 from January 1st, 1939 to December 31st, 1940. I Request from B.R. ~agner for a permit to waive the garage set-back required by Ordinance #2637 in the erection of his new residence and garage to be located at 2010 Agate Street, was granted by the Board of Appeals and action sustained by the 29 council. ( I A request fo~ rezoning tot 12, Block 1, Driverton Addition located at the S corner of the intersection of 17th and Hilyard for the purpose of erecting a store, was presented. It was the recommendation of the Board of Appeals that this reo.uest be referred to the Planning Commission for study, and it was so ordered by the coun 30 cil. / Request of Mrs. George McMorran for a permit to build a duplex residence on Lot 5, Block 7, Lizzie Luckey Addition, located at the northwest corner of the in- tersection of 15th and Olive, was presentect. Inasmuch as this lot is zoned as a single family residence district, the Board of Appeals recommends that a special permit be granted Mrs. McMorran and that the Planning Commission be asked to con- sider the rezoning of all of Block 7 as an R-2 district. The council sustained 3] the recommendation of the Board of Appeals. I Building Inspector Sam Mosher stated that he, in company with Fire Chief Nusbaum, had inspected the Shingle Mill at 865 Franklin Boulevard, and it was found that their method of disposing of refuse constituted a fire hazard and it was their recommendation that if the changes recommended by Mr. Mosher to abate this hazard is not complied with by February 1, that steps be taken to condemn this plant as a nuisance and fire hazard. The council heartily agreed with this action and en- )2 dorsed the proposed action of the Eoard. J Communication from Health Officer E.L. Gardner reouesting a leave of absence from January 15 to June 1, 1939, was duly approved by the council. It was revealed that Dr. Gardner wished to complete a course of stVdy at the University of Californi I in Public Health during that period of time and that in his absence Dr. Hargaret 33 Tingle had been appointed to assume his duties. J Communication from E.J. Griffith, State Administrator of the ~PA, relative to the city's granting the use of certain buildings in Skinner's Butte Park for the use of NYA pro~ram, was presented. It is their sug~estion that inasmuch as it is necessary for them to report the buildings in an unserviceable condition to the f"ederal government, that the buildings remain as the property of the government unti such time as the NYA completes its occupancy of the same at which time the ~PA will I request the transfer of the buildings to the city. The City Recorder was instructe 34 to notify Mr. Griffith of the council's acceptance of this status. 1 - Condmenation proceedings on the Yates Hotel was held until the next meeting 35 of the council. / An ordinance" providing for the establishment, operation and maintenance with 'n and without the city limits of the city of Eugene of sewage disposal plant or plants, etc., had its first readinf. and passed to its second and third readings by unanimous consent of the council by title under suspension of the rules and was placed for fin 1 passage.
