The minutes of the regular meeting of the ,Common .Council held at the hour
or 7:30 o'clock P.M., January 9, 1939. Present were Councilmen Sam Bond, Fred
Carlson and P. J. Hanns. It be&ng apparent that there was not a quorum ~esent,
upon motion duly made, seconded and carried, the meeting was adjourned to meet
again at 7:30 o'clock P.M. January 10, 1939 and it was so ordered.

The minutes of the meeting of the Common Council held at the hour of 7:30
o'clock P.M., January 10, 1939. Mayor Large presided over the meeting; Councilmen
present were Messrs. Reid, Page, Farrington, Bond, Hanns, Carlson and Koppe; absent
1 Lamb.
The minutes of the previous meeting December 27,1938, were presented and or

Mrs. Warren D. Smith presented a communication which was read,'by the City
Recorder wherein they request the council to call a special election for purpose
of voting upon a special levy for construction of a swimming pool for the city of
Emgene. Mr. Bailey, former owner of the Anchorage swimming pool, addressed the
council concerning this problem, stating that the expenses involved had been very
conservatively stated by the committee presenting the same. Mrs. Smith stated that
the annual operating expenses for the summer months would be in the neighborhood of
$2000 per season and there would have to be an additional levy every year for that
purpose. Mrs. Smith stated that the School Board would cooperate in this matter
in that they would allow the construction of the swLming pool on the 17-acre
recreational tract in return for the city's giving them other city lots of approxi-
mate value. The entire matter Was referred to the chairmen of the Park, Judiciary,
and Finance committees to report at a later meeting.
Request of Glenn Griffith, President of Consumers' Co-operative Association I
of Lane County,Inc. to cut the cu~b for a distance of twenty feet on the frontage 0
166 East 11th Avenue, was referred to the Police Committee.

At this time Bryant DeBar, local agent, addressed the council concerning the'r
rejection of the $50,000 surety bond he had written on behalf of city treasurer A.
E. Hulegaard. Mr. DeBar stated that he was a licensed arent and taxpayer and had
been for a good many years while it was his understanding that the business ~as
placed with an agent who doesn't hold a license and who is not a taxpayer. He
further stated that he had called upon the proper city officials prior to writing
the business and he was under the impression that Mr. Hulegaard had the privilege
mf placing the business wherever he wished. That he had cooperated with the City
Recorder in an attempt to have a just distribution of insurance business by volun-
tarily surrendering his participation in the fleet coverage contract. City Attorne~
Calkins in explaining the ordinance governing this, stated that at the time the or-
dinance was passed the city treasurer was required to furnish his own bond upon the
approval of the mayor. But, now, due to the very large bond requirement, the city
and the Water Board pay for the bond, therefore the council has the right to state
where the bond is to be placed. In his opinion the City Treasurer should not dicta e
where the business should be distributed. Councilman Bond felt that inasmuch as
the business had already been given to Marsh Goodwin to let the matter stand and go
on record to return the business to Mr. Bryant DeBar at the end of the year. Upon'
this recommendation, motion was made, seconded and duly carried that this be allowe
and it was so ordered.
The application of Mabel H. Chadwick to purchase property in Lot 2, Block 20, I
Fairmount against which Lane County has delinquent taxes in the sum of $163.50 and
the city an assessment of $56.59, was presented. The Judiciary Committee in a
written report recommends that Mrs. Chadwick apply to the city for the purchase of
the property. It was revealed that the City has a deed to the property. Appraisal
value is set at $1500 and the city is offering it for sale at $1000. Mrs. Chadwick
desires to purchase it for *220.09.
The dual offers of Harlow E. Hudson in the amounts of $400.00 cash or $450.0 , I
i90.00 down and the balance 20% or more per year plus 6% interest, for Lots 3,4,5, .
and 6, Block 25, College Hill Park Addition, Was denied by the Finance Committee an
no counter-offer extended. Upon motion made and seconded, this recommendation was
duly approved.
Second offer of T.J. Casey in the amount of $675.00 for the Kate Bachus prope ty
located at the Northeast corner of 8th and Polk Streets, was denied and a counter-
offer of $1100.00 extended. Upon motion made and duly seconded, this recommendation
was unanimously approved.

The orfer of Edith F. Gardiner for a'client, in the

and.a counter-offer of $550.00 each extended. Upon motion
carried, the recommendation of the Committee was approved.
The $1100 cash offer of Lance W. Hart for the lot on the Southeast corner
of 18th Avenue and University Streets, was denied by the Finance Committee and a

made and duly seconded.

The Mayor and Recorder were authorized to execute a warrant in the amount of
$300.00 out of the Improvement Bond Sinking Fund in the favor of W.B. Dillard,
County Clerk for purchase of property located at 23rd and 24th, Potter and Univer-
sity Streets.
Fred Carlson, acting chairman of the Finance Committee, reported the follow-
ing bills to the council with a recommendation that they be allowed and motion
was made, seconded, and carried that warrants be drawn for the same. The ayes and
nays were called, councilmen voting aye: Reid, Page, Hanns, Farrington, Bond,

Bill in the amount of $150.00 to A.A. .Reid for inspection of various plant
was presented for council action. It was explained that this sum was to be drawn
from the 1938 emergency fund but was not to be expended until 1939. Councilman
Bond moved that it be approved and this motion was seconded by Mr. Farrington. At
this time City Attorney Calkins was asked to determine whether or not this was a
proper emergency expenditure and it was his opinion that it was not. The motion
15 was withdrawn and the bill denied.

P.J. Hanns, Chairman of the Fire and Water Committee,'wanted to know the
position of the City of Eugene in conjunction with responsibility and liability in
the event of accidents arising from runs made by the Fire Department on out-of-town
calls. The question was referred to the Judiciary Committee and City Attorney for
16 study.

Councilman Farrington, Chairman of the health Committee, requested that th
reply from R.C. Bailey regarding the removal of the trees at 2011 Alder Street, be
read. It was revealed that Mr. Bailey understood that the trees must come out,
since they were causing so much interference with the, sewer system, and he felt that
it would not be unreasonable to expect the city to replace them with a few shade
trees. Mr. Farrington stated that the trees had caused further trouble and the
17 matter was referred to.the Committee with power to act.

Councilman Farrington stated that at a meeting held with City Attorney
Calkins and Frank Chambers, owner. of Yates Hotel, they had attempted to seCUl"'e an
agreement from Mr. Chambers to have the building demolished by October 1, 1939, but
that Mr. Chambers had flatly refused. It was the recommendation of the committee
that the City attorney be instructed to proceed with demolition proceedings. Mr.
Calkins requested that the reading of any ordinance be .held as he wished to investi-
18 gate the entire proceedings in this case and it was so ordered.

Councilman Bond, Chairman of the Police Committee, reported that Mr. N.R.
Hennessy, proprietor of Hennessy Supply Company, located at 745 Charnelton Street
had requested parking relief in front of his plsce of business. It was the recom-

Eugene, calling attention to the council of the excessive amount of interference to
radio reception and which they claim originates in or carried by the distributing
system of the local power and light utility, was referred to the Eugene Water Board

The Council approved the refund of $2.00 to B.A. Dawson for 8 building permi
which the prospective builder was unable to use.

Request of Dr. E.L. Ziillmerman for a permit to convert the residence at 751
Seventh Avenue West into a two-apartment house, was presented to the council in a
communicationfr'om the Board of Appeals. It was reported that this house is one
block outside the R-2 Zone but is so large that it is impossible to keep it rented;
it having stood vacant for the last seven months. It is the Board~s recommendation
that the request be granted provided there are no exterior changes except the in-
stallation of a new door and this recommendation was duly sustained by the council.

Blair T. Alderman's request on behalf of the Manville Brothers, owners, and
the Standard Oil Company of California, lessees, of the property on the southwest
corner of 11th and Olive, for a thirty-foot curb cut for a service station driveway
approach on both the Olive and Eleventh Street sides of the property, was referred

It appearing to the Cornmon Council that the Roman Catholic Arch-
bishop of the Diocese of Oregon has heretofore deeded for street
purposes the following described real estate to the city of
Eugene:
A strip of land 6a feet in width, being 33 feet
on either side of a right line, beginning at
the intersection of the center line of Willamette
Street and 23rd Avenue and running thence easterly
to B point 33 feet South of the Southwest corner
or Lot 6, in Block 26 in Driverton's Addition to
the City of Eu[ene in the County of Lane and State
of Oregon.

~HEREAS, the location of 23rd Avenue has been dedicated in a plat
filed as Amon and Mennes Addition to Eu~ene, Oregon, the Mayor and

as the trB-utte Bonds,lt and
WHEREAS, the city Treasurer has heretofore accepted for interest
payment and sinking fund purposes the first 93, and fraction of the
94th bond, of said issue and
WHEREAS,_ the Common Council has not heretofore formally indicated
the exact numbers of the bonds included and covered by said
$93,340.45, and ,
WHEREAS, the Eugene Water Board, for accuracy in setting up its
sinking funds and definiteness in its accounting procedure 'desires

Common Council of the City of Eugene,

Objection was raised by a water user who would in no way benefit from the
sewage disposal system and yet had to pay the necessary charges. City Attorney
-Calkins stated that such a system was for the general welfare of the city; that
/40 proper disposal would be a definite benefit to all citizens of the city.
City Recorder Bryan stated that the nine elective and/or appointive officers
