The minutes of the adjourned meeting of the common council held at the ~ hour of 7 :30 0' clock P.M." January 23, 1939. Mayor Large presided over the meeting, -,.. Councilmen present were: Lamb, Reid, Bond, ~arrington, Hanns, Page and Koppe; absen , Carlson. The minutes of the previous meeting January 10, 1939 were presented and 2 ordered filed. Mr. Eli Rubenstein requested the council to rescind their previous action of condemning his property located at 530 8th Avenue west, agreeing to place this property in repair so as to comply with the city, requirements regarding building and sanitation. Councilman ~'arrington, former chairman of the Health Committee, ma e a motion that condemnation proceedings be rescinded upon the contingency that Mr. Rubenstein place said premises in complete repair according to the ouilding and sanitary code made and provided for by the city of ~ugene and this to be complied with within a period of two weeks. Motion was duly seconded and carried in favor 0 said recommendation. The ~1200.00 cash offer of Lance w. Hart for Lot 12, Block 5, Uross Ad- dition, was rejected by the Pinance uommittee and a counter-offer of $1400.00 ex- tended. upon motion duly made and seconded, the recommendation of the vommittee wa I 4 duly approved. The $550.00 offer of Harlow Hudson for Lots 3, 4, 5 and 6, Block 25, College Hill Park Addition, with payment of ~110.00 down and 20% or more of the unpaid oala ce per year plus interest at 6%, was re jected by the J:l'inance uommi ttee wi th 'the request that it be held for a new appraisal. The Finance Committee recommended that this offer be accepted, but refused to allow the $10.00 on rent for the first month for cleaning up the property and it was so ordered. Offer of Edith F. Gardiner er client Jessie M. Kinney in the amount of $500.00 each for Lots 4 and 5, Block 12, Hollenbeck Addition, to be paid $150.00 cash and $20.00 per month, $10.00 of which is to be applied on each lot and to in- clude interest~ was accepted with the provision that $10.00 plus interest be re- 8 quested and it was so ordered by the council. / The $450.00 cash offer, of E. H. Peterson for a client for the 60 feet of Lots 1 and 2, Block 3, Rugh's Addition, was denied by the Finance COI!1IDittee and a counter-offer of $500.00 extended for the South 50 feet and it was so ordered by the /9 council. /,11 / 12 I 13 10 I Offer of Albert W. Blackford in the amount of $400.00 cash for Lot 6 on the North side of alley, west side of Van Buren between Broadway and Tenth, was re- fused by the Finance Committee and a counter-offer of $475.00 extended with the city to reserve the sewer right and it was so ordered. Offer of Lane County Abstract Company on'behalf of client, David D. Gage, for lots 5 and 6, Block 7, College Hill Park, was rejected and a counter-offer of $2250.00 extended and it was so ordered. The $375.00 offer of George P. Livingston fot #230 Lawrence Street, was denied by the ~inance Committee and a counter-offer of $400.00, requiring a $100.00 cash payment, extended with monthly payments of $10.00 plus interest and it was so ordered. Offer of Sam Rugh Realty Company on behalf of client in the amount of ~1360.00 for Lot 6, Block 2, Campbell's First Addition, was approv~d by the Finance Committee and recommendation sustained by the council. 14 Offer of P. Rodman pointed out that prior to the first meeting of January, 1939, a broker in his office, ~esented an offer on behalf of Harlow Hudson for Lots 3~ 4, 5 and 6, Block 25, College Hill Park Addition. That said offer was refused b the council inasmuch as it did not meet the appraised value of the lot. The client now offers the appraised value of the lots which is $550.00. Mr. Rodman stated that inasmuch as the city had in no way notified the Eugene realtors that these lots are no longer for sale at the price posted by the city, that we should be morally bound to accept the offer at the listed price. Upon motion made and seconded, the council approved the recommendation of the Finance Committee, all voting aye with the ex- ception of Mr. Bond who voted in the negative. The Finance Committee recommended refunding $20.00 to Dan Pavlik the amount paid by him when he was planning to purchase the property located at 261 Jefferson Street, but because the City was unable to deliver title to the property, the trans- action was cancelled.", I (...~.~...., 15 I 16 / I Councilman Page, Chairman of the Special Committee appointed to investigate the possibility of constructing a swimming pool for the city of Eugene, recommended that the request be tabled and upon motion duly made, seconded, and carried his re- 17 commendation was approved. / Councilman Bond, Chairman of the Police Committee, recommended that the re- quest for a special curb cut at 166 East 11th Avenue for Consumer's Cooperative As- sociation of Lane County, Inc., be denied. Ralph Johnston, on behalf of the Associa- tion, requested that the council reconsider the Police Committee recommendation and grant the permit; upon motion made and seconded, recommendation of the committee was 18 approved. I On the various requests for one-hour parking restrictions, Councilman Bond requested further time by reason of the fact that there was an ordinance being pre- pared that would cover a great deal of area and be more complete than the various individual requests. Time was granted. S. M. Calkins reported that the city's delinquent assessments against the University of Oregon amounted to $4000 and that a statement had been mailed and legislative act prepared to place the matter before the state legislature. That the University officials have stated that the city can reasonably expect to receive this payment within due course of tlme~ Mr. Calkins further recommended that the city prOVide adequate protection for members of the fire department by reason of their out-of-town calls. Referred to the Fire and Water Committee to report, in two weeks. Request of Eugene Sand and Gravel Company to install a 1000 gallon gasoline tank at 843 Franklin Boulevard and a 6000 gallon Diesel Oil tank about 500 feet East of 843 Franklin Boulevard on the north side of Franklin Boulevard, was upon motion 22 made and dulY seconded, approved. I 19 I 20 " I 21 I The Recorder presented a statement from the League of Oregon Cities in the amount of $289.01, as follows: Dues from January 1, to D~cember 31, 1939,$189.01 and Legislative Assessment $100.00. The Mayor suggested that the council approve th amount assessed for dues but hold for further consideration the $100.00 charge, and 23 it was so ordered. f Request of N. C. Christenson for a permit to build three duplex houses and six garages on his property on the north side' of ~ixteenth Avenue between Ferry and, Patterson Streets. was presented., This location is in the R~l district and it is th Board of Appeals' recommendation that the request be denied and action is sustained 24 by the council. / 25 I Request of William H. Oakes for a permit to build on his lot at 379 Tenth Avenue ~ast waiving the "set-back" ordinance, asking for a six-foot set-back from the sidewalk, was denied by the Board of Appeals. Mr. W. H. Shields speaking on behalf of William H. Oaks requested the council to reconsider the building permit with a change to a 15-foot set back rather than the 6 feet originally requested. The matter was referred to the Board of Appeals. Request from Fred wentworth for a permit to make some changes, that of a short outside stairway, in his residence at 1571 Pearl in order to make an apartment on the second floor, wa~ granted by the Board of Appeals and action sustained by the council. I 26 / The $108.19 claim of Dr. A.H. Ross, as presented by the legal firm of Harr1 and Bryson, for reimbursement for loss sustained by him by reason of a rock having rolled from the street down to and through his house, was presented and referred to the Judiciary Committee and City Attorney. I 27 I Statement of Bills from the Eugene Public Library for the month of December 1938, was presented and ordered placed on file. The ayes and nays were called, councilmen voting aye: Lamb, Reid, Bond, Farrington, Hanns, Page and Koppe; nay, none; absent, Carlson. The ordinance ,,.., was declared passed and numbered 8587. ~.. =') ""......, ...... 1!l:~- ._"'"t\ 30 I Resolution deferring the demolition, of Yates Hotel until July 1, 1939,. was unanimously adopted upon motion made and duly seconded: WHEREAS, The Common Council has on this date passed Ordinance No. 8587 for the demolition of the Yates Hotel, and WHEREAS, It is the policy of the Gouncil to give a reasonable time for the vacation of the premises before demolition shall be commenced, THEREFORE, Be it resolved by the Common Council of the City of hugene that actual demolition of the bUilding be deferred Until July 1, 1939 and that the owner be given until that time to vacate the same and that the City Engineer be and he is hereby directed to withhold the preparation for said demolition until June 1, 1939 at which time he shall comply with the Ordinance and go forward with the demolition of the building. BE IT FURTHER RESOLVED, That the City Recorder be and he is hereby directed to mail a copy of this resolution to Frank L. and Edith K. Chambers, as owners of the building. The City recorder requested that the council designate the city official to handle the city charity account. It was recommended that inasmuch as we now have a police matron that the same be returned to her supervision and it was so ,31 ordered. 32 Mayor Large complained about the tremendous truck traffic on Sixth otreet. Councilman Bond pointed out that the State Highway Department was to post signs to direct the truck traffic elsewhere. City Recorder was instructed to write a letter respectfully requesting this action. I Councilman Lamb stated that there should be a re-routing of truck traffic between Pearl and High Streets by reason of the fact that the street is rapidly )33 being broken down. Application of Saul Paul to conduct a pawnbroker and/or second-hand dealer's business at 695 Willamette Street, was duly approved by the council upon the recom- ,34 mendation of the Chief of Police. Mayor Large announced that Richard Spies and Comet Gibson, the two highest on the Civil Service eligible list, were selected to fill the openings in the Police Department, effective January 1,1939. The appointments were duly confirmed by I 35 the council. Councilman Farrington, former chairman of the Health Committee, recommende that Dr. L. G. Helterline, Meat and Milk Inspector, be appointed to that position for the ensuing year. Motion was made that the appointment be confirmed by the cou - ell and that said officer be placed on the regular payroll of the city at the salar of $219.44 (plus $30.00 per month for gas and oil) and that the Mayor and Recorder be authorized to issue warrant in payment thereof. The motion was seconded and ,36 carried to confirm the appointment. Councilman Page announced that as yet the Park Board has not selected a chairman. /37 38 An Ordinance repealing Ordinance No. 8359 passed by the Common Council on the 11th day o,f September" 1933 and approved by the Mayor on the 15th day of Sept- ember-" 1933, and providing that no further rebondlng applicat ion shall be accepted by the City of Eugene, had its first reading and passed to its second and third readings by unanimous consent of the council by title under suspension of the rule and was placed for final passage. The ayes and nays were called, councilmen voting aye: Reid, Lamb, Bond, Farrington, Hanns, Page, and Koppe; nay, none; absent" Carlson. The ordinance was declared passed and numbered 8588'. The Council authorized the issuance of fire insurance policies to J.K. Pratt Company covering Asphalt Mixing Plant ($3000) and Tool House and Yard Equipmen 39 ($500.00).. Mr. Frank I. Kinney, being called upon by James A. Rodman, expressed himself along similar lines as Mr. Rodman on the moral obligations of the city with respe~t to the terms of the contract.
