The minutes of the adjourned meeting of the Common Council held at the hour of 7Jt30 0' clock P.M., February 27, 1939. Mayor Large presided over the meetin ., Councilmen present were: Messrs. Lamb, Reid, Bond, Carlson, Farrington, Hanns, Page, and Koppe; absent, none. I .l ;.f 1 ~~ The minutes of the previous meeting, February 14, 1939, were presented ~1 and ordered filed. -.... v. Fred Lamb, Chairman of the Judiciary Committee, stated that it was the recommendation of his Committee that Mr. A. T. Hall should cease peddling and to this 3 mandate Mr. Hall nad agree? t I The $525.00. offer of F. M. Cashman on behalf of a client for Lot 5" Book 10, at the tiouthwest corner of Broadway and Van tsuren was rejected by the Finance Committee and a counter-offer of $550.00 extended. Upon motion made and seconded, 4 this recommendation was duly approyed. tClient: A,. Gordon Clarke) ..... The $550.00. offer of W. K. Striker for client for Lot 7, Block 21, Hud- dleston's Amended A~dition was accepted by the Finance Committee and approved by the council. tClient: O~in Snellstroml 5 ,{ o.ffer of Edith F. Gardiner for client in the amount of $550.0.0, $60.00 down and$15.00 per month including interest, for property at 261 Jefferson Street, was accepted on the condition that a payment of $110.00 down and $15.00 per month plus interest be made. Upon motion made and seconded, this recommendation was duly approved by the council. (Client: Ralph Vitus) . 6 Mr. Hanns, Chairman of the Fire and Water Committee, recommended the in- stallation of a street light at the corner of Fourth and Almaden Streets and it was 60 ordered by the council. 7 1 Sam Bond, chairman of the Police Committee, recommended that the request of the Oregon Motor Stages, Inc. to abandon certain bus operations and commence new 8 ones within the city of Eugene be granted and it was so ordered. They are as follow: Abandon: I , 6th street between Olive and Willamette Olive Street between 6th and 7th Street 7th Street between Olive and Willamette Franklin Boulevard between Villard and 11th 11th street between Franklin and Alder 14tp Street between University and Agate Agate Street between 14th and 15th ,street Commence: 13th st between Moss and Franklin Blvd. On 15th Street between Willamette and Kincaid On Kincaid between 15th St and 13th Street On University between 14th and 15th Street 15th Street between University and Agate. I The request of the Disabled Veterans of Foreign Wars for a beer license during their annual convention with the local unit being the applicant and responsib e r9 party, was duly approved by the Police Committee and action sustained by the council. The Mountjoy and Carmichael request for a loading zone at the rear en- trance of the building at 77 East Broadway, was disposed of as follows: That this firm and the paint company are to use the curb cut granted to the Eugene Morning 10 News on a cooperative basis. I I The application of Safeway Stores for a Class B License, was denied by, the Police Committee and upon motion made aBd seconded, recommendation approved by ill the councIl. The Police Committee recommendation that one-hour parking signs be place If in front of and on the west side of the court house, was unanimously approved. Request of L. M. Watson for a wiaver of the zoning ordinance in regard t the occupancy of a building he had commenced at 1224 Willamette street, was denied by the Board of Appeals. Exception was taken by members of the council to this deni 1. City Engineer Clubb stated that the occupancy of this building was in direct conf~ic with the zoning ordinance. An ordinance amending Zoning Ordinance #8413 to allow this particular type of occupancy for that building, was presented and had its first reading, passed to its second ~nd third readings by unanimous consent of the council bY title under suspension of the rule and was placed for final passage. The ordinance was declared passed and numbered 8592. ...... Request of Arnt Ree asking for a reclassification of a lot on,the east ~~ side of Willamette Street between 17th and 18th just.outside the multiple family ~ zone for the purpose of er.ecting a one story apartment house similar to one erected at lOth and Lincoln, was granted by the Board of Appeals,and action sustained by the council. ' 14 /' ,,,<I. 15 ( Request of Professor E.E. DeCou for a reclassification of certain lots near the whiteaker School for business purposes, was presented. The Board of Appea ,& reported that action on this request had been postponed until such time that more information could be obtained. This action was agreeable to the council. The Board of Appeals recommended that the request of Pete's Bakery, 1522 Olive Street, for installation of a neon sign at that location be denied and 16 it was so ordered by the council. ~ Request of I.G. Kjosness to be allowed the useR of certain type of con- str~ction, which does not comply with the Building Code and cites figures from building authorities in support of his request, was presented. As his project seem to be indefinite as to the number of buildings or locations, the Board of Appeals recommends that the request be denied but that he be permitted to make request on ;17 each definite project and it was so ordered by the council. Request of F. R. Gates for a we:11ver of the "Set-Backll ordinance so that he may make a twenty-two foot, addition to the west of his present store at the southwest corner of the intersection of 19th and Agate, agreeing to en~er into a contract with the city to stand the cost of removal of such portion of building necessary whep 19th Avenue should be widened, was presented. The Board recommends that this request be granted upon the filing of a proper contract and it was so ordered by the council. 18 1 119 Request of Lewis Barr to open an alley through Lot 17, Block 35, Fairmou t or use a road now going through his property on Lot 18, the city to gravel the seme and keep up in good condition, was received. It was pointed out that this was neces- sary as the old outlet through Fairmount Boulevard is now impassable. The request was referred to the street Committee for consideration. Statement of Bills for the Eugene Public Library for the month of January, 20 was presented and ordered placed on file. Request of Sarah L. Wright to cut down the trees in the parking strip of the property adjoining their residence at 2241 Alder Street, as the roots interfered /21 with the sewer system, was referred to the Sewer Committee for investigation. Petition to remove the one-hour parking limitation on 13th between Alder 22 and Kincaid Streets was met "with unanimous denial. ] Upon motion made and duly seconded, the application of Mrs. Mary D. 123 Chambers, 958 Lawrence, to rebond delinquent assessments, was approved~ The Recorder requested that all reservations for use of the Council Chambers be made in his office so that a proper record of the meetings could be /24 ,kept. This was unanimously approved. C. V. Simon's resignation from the Park Board was presented and accepted with regrets. The council extended a vote of thanks to Mr. Simon for the excellent 25 services rendered by him on behalf of the Board. I An Ordinance repealing Ordinance No. 662 of the City of Eugene passed by the Common Council March 26, 1907, and approved by the Mayor March 29, 1907; and Ordinance No. 8478 passed by the Common Council July 13, 1936 and approved by the Mayor July 14, 1936; and discontinuing the Park Commission, had its first reading and passed to its second and third readings by title under suspension of the rule by unanimous consent of the council and was placed for final passage. The ayes and nays were called, councilmen voting aye: Lamb, Reid, Bond, Carlson,Farrington, Hann , Page, and Koppe; nay~ none; absent, none. The ordinance was declared passed and 26 numbered. 8593. The following three curb cutx reports were approved by the City Engineer and the council thereupon authorized the a~ffice of the City Recorder to issue per- mits to A. W. Fogelstrom. 543 Blair, J.W. O'Neel and J.M. Hall Lots 7 and 8, Block 11, Hendrick's Amended Addition to Eugene, Lane County, Oregon, at a purchase price of $1350.00 and WHEREAS, J. M. Hall has assigned his interest in the contract to Ramey W. Rugh and at this time Ramey W. Rugh and E.C. O~Neel and Maxia L. O'Neel, husband and wife, have applied to the city that a new cQntract be drawn from the city to E.C. O'Neel and Maxia L. O'Neel, husband and wife, an undivided one-half interest, and Ramey W. Rugh, a single person, an undivi.ded one-half interest" and have computed the amount still due on the contract at $413.53 with interest from February 4, 1939. O'Neel and Maxia L. O'Neel, husband and wife, and to Ramey W. Rugh upon their filing with the city a written application for such substitution and them- selves execu;ting the attached contract. I Resolution expressing the regrets of the council in the un- 30 timely death of Dale Cron~r, fireman, was adopted upon motion made and seconded. 1 RES 0 L UTI 0 N WHEREAS, Dale F.. Croner pi. ssed away on February 15, 1939" and W~REAS, at the time of his departure he was and had been for many years a trusted am,d faithful employee of the City of Eugene, and was held in high regard and respect by all who knew him, I NOW THEREFORE, BE it resolved by the Mayor and Common Council of the City of Eugene that while we accept the decree of a Supreme Power~ yet do we deplore the loss.of a valued employee~ a citizen of.outstanding worth. That we extend to his family our sincere sympathy and that this resolution be spread upon the minutes of this meeting and a copy forwarded to the family of the depa~ted one. Robert, A. Holland, highest in rank on the fire department eligible list; was appointed by Mayor Large to fill the vacancy created by the death of Dale Croner, effective March 15, 1939 at a salary of $100.00 per month. ;31 This appointment was duly confirmed by members of the council. I Joe Harrell's request for more hangars at the airport was,re- 'I' ferred to the Finance Committee for consideration. Mr. Harrell stated that the rent 1 fee collected for the use'of the hangars could be made to pay for the city's cost of )32; construction. Meeting was herewith adjourned. C. M.
