Councilman Fred Lamb, president of the ""'-3, Council, presided in the absence of Mayor Elisha Large. Councilmen present were: ~ Messrs. Reid, Bond, Carlson, Farrington, Hanns, page and Koppe; absent, none. The minutes of the previous meeting, February 27, 1939, were presented and ordered filed. I The $600.00 offer of Lane County Abstract Company for client Eric E. Law- rence fur the South 66 feet of the East part of Lot 2, Block 6, not less than 70 feet, Scott's add,ition to Eugene, was presented. The Finance Committee recommended that a price of $600.00 for 60 feet be accepted and it was so ordered. I Offer of Earl Byrom in the amount of $650.00 for Lot 8, Block 8, Hollen- beck's Addition, was accepted by the Finance Committee and upon motion duly made ,2 and seconded, approved by the council. The $750.00 offer of William Jones for the South 20 feet of Lot 6, and all of Lot 7, Block 5, Cheshire's First Addition, known as 185 Jefferson Street, pay~ able on the following terms, to-wit: $30.00 down, $45.00 on April 1, 1939 and the balance to be paid at $10.00 per month beginning May I, 1939 plus interest at 6%, was presented. The Finance Committee recommended that the offer be accepted pro- vided that a down payment 'of $150.00 be made with monthly payments of $15.00 plus 3 interest and it was so ordered. I I The $1000 offer of E.H. Peterson Company on behalf of client Dorothy Linn for 1492 East 23rd Avenue with the fa llowing payments to-wit: $100.00 down and the balance at $10.00 pe~ month beginning April 15, 1939 including interest at six per cent, was presented. The $500.00 offer of F. J. Berger on behalf of client Frank D. Pierson for property located at 185 Jefferson Street-, was rejected by the Finance Committee and so ordered by the council. 5 I Offer of Frank Fletz in the amount or' $500.00 for Lot 5, Block 3, Shelton' Addition on the following terms, to-wit: $100.00 cash and the balance at $10.00 per month plus interest at 6%, was accepted by the Finance Committee and so ordered 6 by the council. I Request of Mrs. Wm. Pierce to renew the payments on her contract covering property located on Lot 9, Block 2, Hendrick's Amended Addition and LQt 6, Block 2, Hendrickls Amended Addition, was presented. The Committee recommended that the contract be brought up-to-date. Her request for a segregation of the South 120 feet of Lot 5, Block 15, Huddleston's Extended Addition,. was dealt with as follows: $500.00 be placed on the South 40 feet and $499.69 be placed on the North 80 feet /7 of the above described property and it was so ordered by the council. A. C. Farrington, Chairman of the Finance Committee, reported the follow- ing bills to the council with a recommendation that they be allowed and motion was made, seconded and carried that warrants be drawn for the sane. At that time the department would be ready to make all repairs. , Mr. Hanns, Ohairman of the Fire and Water Committee, requested that Homer Middlesworth, member of the Fire Department, who was recently i'njured in an automobile accident, be granted a year's leave of absence effective April 1, 1939 10 and it was so ordered. t The $500.00 offer of M. L. E~ickson for Lot 7, Blpck 23, 'Gross Additio and $425.00 for either one of Lots 8, 9, and 10, Block 23, Gross Addition, was de- clined by the Finance Committee and a counter-offer of the lots made as follows: $900.00 for Lot 7; $600.00 for Lot 8; $600.00 for Lot 9; and $650.00 for Lot 10. Upon motion made and secpnded, these recommendations were unanimously approved. 11 I I Mr. Hanns, Ohairman of the Fire and Water Oommittee, reported that he had received a request from Rob-Les Oil Oompany, 195 Van Buren'Street for a permit to increase their storage facilities from 280 to 1000 gallons, which Mr. Hanns re- commended be granted. Upon motion made and seconded, this request was unanimously approved. IF; / Councilman Reid requested that the city attorney be instructed to take the necessary steps to condemn and remove the trees adjoining residence at 2241 Alder Street as the roots are interfering with the sewer system and it was so or- dered by the council. 13 , I The Police Committee recoIDDlended transfer of Retail Beer Class "B" License from Joe D. Hale to F.E. and C.F. Welch, new proprietors of Lone star Joe located at 663 Willamette Street. Request of C. L. Kelly, Manager of the Miner Building, for a permit to erect 'a penthouse on the roof of the Miner Building for purposes other than those provided for in the Building Code, was presented. The Board of Appeals recoID~ended that this request be granted on the condition that proper safeguards be provided against accidents for those who might use the roof for sun-bathing purposes. This 19 recommendation was sustained by the council. I Request of Arthur Richardson for a permit to construct a duplex residence, costing approximately $4.000, on the lot at the Northwest corner of the intersection of Fifteenth Avenue and High Street, was presented. This location being just outsid the Apartment Zone, the Board of Appeals recommended that it be granted and it was 20 so ordered by the council. H. C. Skade request for a waiver of the Set-back Ordinance to permit him to build a duplex residence at the Southwest corner of the intersection of 14th Avenue and Ferry Street, was presented. As the proposed set-back is so near to the reqUired set-back, the Board' of Appeals recommended that it be granted 'and upon motion duly made, seconded, and carried, the recommendation of the Board was unani- 21 mously approved. I Request of C. F. and Violet "Wright for a waiver of the Set-back Ordinance to permit erection of a residence with an attached garage on the South 50 feet of Lots 1 and 2, Block 3, Rugh's Addition, being located on Olive Street between 23rd and 24th, was presented. The Board of Appeals recommended that this request be denied and the parties herein interested be required to observe the pro~lsions of th Set Back Ordinance. Mr. Wright appeared before the Council, and requested a reversal of the Board's action. The Council, however, refused to alter in any way the re- 22 commendation of the Board of Appeals. , J. M. Murray request for waiver of the Set-back Ordinance to permit him -to erect a new building on the East half of Lot 2, Block 19, Mulligan's Addition, being located on the South side of 11th Avenue between Oak and Pearl Streets and agreeing to enter into a contract with the city the same as one executed on a former building, was approved by the Board of Appeals and upon motion made, seconded, and ,23 carried, the recommendation was duly accepted by the council. , Request of A. L. Hawn for a waiver of the Set-back Ordinance to permit construction of a garage, to be excavated into the bank on the south side of the street at 2616 Fairmount Boulevard, was presented. The Board of Appeals recommended that Mr. Hawn be allowed to erect his garage four feet back from the curb line and 24 this was so ordered by the council upon motion duly made Bnd seconded. I Request of Wm. Keith Miller to be permitted to erect a residence in City Outlook Addition using a type of construction not provided for in the Building Code, was presented. The Board recommended ,that this request be granted on the condition that the floor girders be spaced so as to sustain load provided for in 25 the code. This recommendation was duly approved by the council. I Request of Mrs. Marie Monge asking for a waiver of Zoning Ordin~nce to permit the erection of a "Lunch Room" as an addition to her residence at 590 Tyler Street, said addition to be built within one foot of the sidewalk on both Sixth Avenue and Tyler Street, was denied by the Board of Appeals and recommendation duly ,26 sustained by the council. Communication from Oregon Motor Stages making application for extension of parking space to 40 feet on Willamette at the intersections of 7, 8,9, 10, and 11th Streets and also to paint in entirety the space allocated for the parking of ,27 their busses, was referred to the Police and ~treet Gommittees. Reports for the month of February was presented by the Police Matron, 28 Engineer and Police Departments. They were ordered placed on file. ...4 "... 182 ;. . ~ Resolution recommending that the city of Eugene, in cooperation with the Eugene School Board and Eugene Playground Commission employ a full-time Youth Welfare Director, was presented. The City Recorder recommended that the present amount budgeted for Juvenile Officer, Park and Playground be combined and the Schoo Board add to those funds a reasonable amount. That a new Committee be appointed to take place of the Playground Commission. Acting Mayor Lamb appointed Councilmen Farrington and Bond to meet with two members of the ~chool Board to try to work out a cooperative recreative and playground plan for the future and it was so ordered. N. and 0 of Section 1; and the Sub-paragraph of Section 14 providing for a permit fee for producers, ,of Ordinance No. 8531 of the City of Eugene, passed by the Common Council January 24, 1938, and approved by the Mayor January 25, 1938, had its first reading and passed to its second and third readings by unanimous consent of the council by title under sus- pension of the rule and was placed for final passage. The ayes and nays were calle, councilmen voting aye: Reid, Bond, Carlson, Farr~ngton, Page, Hanns, and ~oppe; nay none; absent, none. The ordinance was declared passed and numbered 8594. Burtis., 156 Sixth Avenue West (Hold until plans of building are submitted). The Police Committee was granted power to maKe arrangements 'to employ a dog enforcement officer for the year 1939. I 33 f 34 I City Attorney Calkins reported that the League of Oregon Cities was preparing a'model traffic control ordinance. The Recorder was instructed to secure from the heads of all departments a schedule of proposed vacations of the employees. All employees employed a year or more are entitled to two weeks vacation with pay. it was recommended that the heads of the departments prepare their own schedule giving preference to employees longest in service except in the case when an employee is directed to take time off in accordance with state or Federal rulings. The Chiefs of the Depar~ments are al- lowed to take their vac'ations when they see fi t but must report the sarne to the Recorder. Further, that all employees must take their two weeks at one time and no vacations can be held over from year to year. The Recorder was requested to prepar a m~ster schedule of vacations. In addition, all absences of employees either on account of illness or otherwise must be reported at the office of the Recorder. 35 I The meeting was herewith adjourned. C. M.
