Mayor Elisha Large presided over the meeting.. Councilmen present were:' M'essrs., Lamb, Reid, Bond, Carlson, Farrington, Hanns, Page and Koppe; absent, none. ~-~,~~ - \-.!. I - , Representatives of Theta Chi fraternity addressed the council con- concerning the constructi on of a double-garage on the property of Dr. James D. Harnett located at the corner of Nineteenth and University Streets. It was pointed out that the construction of the garage was in conflict wltn the present building code and lt was requested that the Common Council enf~ce the building code and demand removal of the said buildi ng. .. Mr. Sam Mosher, Eui lding Inspector, stated that at the time permit was granted for this construction he had issued it under the proviffi ons of a former ordinance instead of the one recentl passed and that the construction was in accordance with the old ordinance. Mr~ Mosher pointed out that the buiJding was of very fine design and construction. However, after a brief discussion by member~ of the council, motion was mde and ~econded that the building code be strictly enf~ced in regard to this structure and that the garage be removed'and'it was so ordered. Mr. Fred Smith, attorney, appeared on behalf of Mr. William Riley, who is renting a bern fro m J. B. Thompson located on South Willamet,te Street between 22nd and 23rd Avenue for custom and ~ale horse purpoo es. It was reported that Dr. Helterline, Health Inspector, had issued an inspection certificate authorizing the use of the barn and that the Rec~der had not issued a license by reason of a petition filed in his office opposing the location of such an occupancy in that neighborhood. Attorney Smith pointed out that the use of the building could be in no way offensive to any of the surrounding parties. .~r. R. H. Ross, who 1s renting an apartment t'ro m Mrs. Sern Rugh, addressed the council favoring the use of the huilding for that purpose. After conSIDerable discussion and comment by citizens as well as members of the council, motion was made and seconded, that the request for a license be denied but Mr. Riley be granted a period not to exceed ninet~ days in which to dispose of his stock and close out hls business and it was so ordered. At this time Mr. Lloyd A. He~athorn, contractor employed by D~. James D. Barnett in the constructiion mf his garage at Nineteenth and University, addressed the council and asked for consid.eration. After a brief discussion, the rratter 5. was ordered closed by the Mayor. , Joe Harrell, manager of the airport, addressed the council concerning the construction of additional hangars. Councilman Farrington reported that he together with City Engineer Clubb had been working on some estirra tes and that the probable cost had not been completed. Mr., Ale xander Seavey addressed the council requesting consultation of council members with local users of the field ,6. as to type of hangars to be erected. Request of Eric Lawrence that the City deed' him 66 feet instead of 60 feet at the Northwest corner of 15th Avenue and Mill Street was accepted by the' Finance Commi ttee and upon mot ion made' and seconded, recommendation of /7. the committee was duly approved. Request~ of Pietro LaGalsi to have the deed ~ Lot 5, Block 3, Shelton's First Addition made out to him instead of Frank Fletz was accepted by the Finance Committee and upon motion made and seconded, recommendation of the committee was duly approved. 8. ! /9. 10. r 11. ( The $550.00 offer of F. J. Berger, on behalf of client Frank Pfu rson, t,o purchase pro'[:B rty located at 261 Jefferson Street was approved by the Finance Committee and upon motion made and seconded, the recommendation of the committee was sustained by the council. for 185 thereon Finance Request of William Jones to wj, thdraw his if fer rrade on March 1:3, 1939, Jefferson Street and t:o offer $550.00 for 261 Jefferson Street, applying the deposit of $30.00 made on the original offer, was rejected by the Committee and it was so ordered by the council. The $1550.00 offer of Frank Kinney on behalf of client Mr. Sol Rosenberg for eht Ncr th ~ of Lots 1 and 2 in Block 5, El ias Stewart's Addi tion, was approved by the Finance Committee and upon motion made, seconded, and duly carried, the recommendatidn of the committee was unanimously approved. ~/ ~ ,...- 184 ~~.....-- 9f,fer of Edith F. Gardiner on behalf of client George Coulsey and wife to pay $240.00 for Lots 5 and 6, Block 1, Riverwood Addition, was presented. It was the recommendation of the Finance Committee that said offer be accepted 12. upon payment of $40.00 commission and it was so ordered by the council. t~ ~.~ Councilman Carlson, Chairman of the Street Cbm~ittee, presented a Warranty ~ Deed from Elmer M. Baker and Faya Baker, his wife, for the following described C~premises, to wit: Beginning at a point on the South line of the P'ortland', Eugene .J. and Eastern Railway Company fS (Southern p'aclfic Railway Company, owner) 20 foot right of way, South 2 degrees 6 feet East from the Southwest corner of Lot 9, Block 2, Agate Plat as the same is recer ded at Page 2, volume ~, Lane County, Oaegon Plat Rec~ds and running thence South 2 degrees 6f East 216 feet more or less to the Northwest corner of Lot 1,.Block 1, Inavale Addition to Eugene, Lane County, Oregon, thence Northwesterly along the Easterly line of Inavale Street as p2tted in Onyx Plat to the intersection of the said Easterly line of Inavale Street with the said South" line of the Portland, Eugene and Eastern Rail- way Companyts right of way and thence Easterly along said right of way to the place of beginning, Be ing a IB rt": of Lot 14, Moore's .Plat in Eugene, Lane County, Oregon. Upon motion made and seconded, X~B XBEEIDmERMaXXEE WHX B~~XEXRMX and duly carried, ~ the recommendation of the Street Committee was approved. Councilman Carlson further rep~ ted that it was the recommendation of his committee that the request of Mr. Lewis Barr be denIed by reason of the fact that the State Highway Department was contemplating the use of the land in question for a new state highway. Upon motion made and seconded, the recommendation was' 14. approved. I Councilman Koppe, Chai~illan of the Health Committee, stated that a complain had been recBived concerhing the condition of the city dump grounds and that the Comrni ttee upon investigating the same, found grounds'being' kept in as good a condition as could oe expected. Further discussion was had concerning this matter and Mr. Koppe was requested by the Mayor' to contact the State Inspector whose office 14~ is in the Public Market Building, concerning the methods of better sanitation. /' Mayor Large requested the Health Committee to investigate and rep~t at the next meeting of the council the conditions surrounding the trailer houses located in'the alley bounded by Lincoln and Charnelton, and Seventh and Eighth Streets ahd also the trailer h~use located just west of the Elk's Parking Lot. I 15. /' Councilman Page, Chairman of the Printing' and Parks Committee, requested the appropriation of $.75.00 from the emergency fund to be expended for the construc- tion of walks just outside the parks leading to.the streets. . Communication from S. R. Mosher, Building Inspector, reporting that he together with other city officials, had inspected the old garage at the rear of the premises at 754 Lincoln Street, owned by M. P. Bonnett, which had been converted into living quarters without the necessary permits reving been secured for the change of occupancy and for the making of the alterations. As this shed in no way conforms to the Building Code andis a fire hazard and menace to health, it was the recommendation of Mr. Mosher and the officials that this structure be condemmed and demolished, and this recommendation was duly sustained by the council. Mr. Mosher's further communication stated that the old barn located on the east side of Willamette Street between 22nd and 23rd Avenues, was being used for the keeping of horses and such occupancy was in direct violation with the Zoning Ordinance. No recommendation was made rega.ding this by Mr. Mosher as he wished the matter to be decided upon by the Committee. Paragraph Four 23. of the minutes gives the decision handed down by the Council relative to this. ..--- 22. t..--" Communication from Walters-Bushong Lumber Company, Inc. requesting cancellation of their franchise covered by Ordinance No. 8447, was presented. An Ordinance to repeal Ordinance No. 8447 entit'le'd': "An Ordinance granting a franchise to the Walters-Bushong Lumber Company to extend a blow pipe across High Street at the site of the company's plant, between Fourth Avenue East and Fifth Avenue East, in the City of Eugene."~ had its first reading. The ayes and nays, were called, councilmen voting aye: Lamb, Reid, Bond, Carlson, Farrington, Hanns, Page and K~ppe; nay, none; absent, none. The ordinance was declared passed and numbered 8595., C6mmunicatio~from Lee Nixon of Cottage Grove, charged with damaging a city signal light standard at the corner of Sixth and Willamette Street on January 29, 1939 at 8:30 o'clock A.M."was referred to the City Attorney who ls to communicate with M~, Nixon requesting him to inform the city as to the amount. and dates that he can arrange to pay the city for damages done and it was so 25., ordered. t 24., ~ Statement on bills for the Eugene Public Library for the month of 26. February, 1939, was presented, reviewed, and ordered filed. Statement of sewerage charges billed and collected for the month of 27. January and for the month of February were presented and ordered pJa ced on file. The City Recorder reported that a total of 135 tobacco licenses had been issued from Januaryl, 1939, up until the present time, leaving a balance of 66 licenses not yet secured. I -.... -..I. That the Lien Depart~nt of the City of Eugene be required among their other duties, the actual collection of:' 1. Principal and Interest on Liens Outstanding 2. Principal and Interest on Land Sale Contracts 3. Lien Rent That the City Recordert.s Office be the agency for receiving all other fees, licenses, rents, refunds, and any other monies payable to the City of Eugene. That the> City Treasur~r shall be the receiving agency for the following: 1. Payment to the city of Eugene for taxes collected by Lane County. 2. D_aily turnover from the following:: Engineer'and guilding Inspector Lien Department Recorder's Office I The above recommendations are made with the view of further improving the services rendered the City of Eugene by the various departments~ C. A. Horton, Auditor, was requested to meet with the Finance Committee and they were given power to place this program in effect as of April 1, 1939, and it was 29. so ordered. I The following"two curb cut applications were presented and recommendations of' City Engineer Clubb sustained: Harry Veatch, 1688 Second Avenue West 30. (approved)'; F. L. Stetson, 2140 Potter (approved). City Recorder reported that a represe~tative of the Secretary of State's office had been in to see him concerning the motor vehicle ownership records. The Reca'der further stated that he had never launched any criticism against the State Office but did feel that the Crane Direct Mill 1 Service rendered a service that was incapable of meeting the needs and, demand l:5 of the RecQ" deI" s Office. Upon motion made and seconded, the appointment was duly 32. confirmed by the council. / At this time Mayor Large announced the resignation of Miss Zona Malkas- ian in the RecQrder's office, effective April 1, 1939, and presented the name of Miss Ann Brenner to fill the position. Upon motion m~de and seconded, the appoint- ment was unanimously approved and the memoers of the council extended their very 33. best wishes to Miss Malka~ian. / 34.
