The minutes of the adjourned ~eet~ng of tl:e Common Counoil held at the hour of 7:30
o'olook P:M. April 24, 1939. Mayor Large presided over the meeting. Councilmen present were:
Messrs. Lamb, Reid, Bond, Farrington, Hanna, Page and Koppe; absent, Carlson.
'!he minutes of the previous meeting, April 10, .1939, were pre sented and ordered
filed. The meeting was herewith called to order.
1~. D. Willis of Route #2, Eugene, addressed the council in behalf of a de1egation'from
Glenwood annexed to the City of Eugene. After considerable discussion by members of the council
and Mr. Willis, it was determined -that a meeting of the rouncil as a committee of the whole
would be held prior to the next meeting of the regular council meeting 1:0 hear the above proposition
by Mr. Willis. 1\fJ.r. Hernan Kehrli, Secretary of the League of Oregon Cities is to be present at .

Councilman Farrington, Chairman 0 f the Finance Committee, recommerrl ed the acceptance
of the offer of B. H. Douglass, in behalf of his client, L. N. Lengacher in the amount of $900.00
cash for Lot 9, Block, 6, Fairmount Addition. (3rd lot North of East 15th Avenue on the West

The Finance Committee recommends that the Realty 'Board be notified that the 20% down
payment on all offers be made at the time -!:he offer is turne'd in and before the offer is presented
to the council. Upon motion made and seconded the recorflmend-atioIf of the committee \vasunanimously
approved and it was so ordered.
Councilman Hanns, Chairman 0 f the Fire and Wa.ter -Connnittee reported that the Street
Light at the corner of Third and Monroe Streets was practicaily hidden by the surrounding trees
and requested that the City Recorder notify the Water Board to take ne~essary steps in securing
11 /proper~services from -the street light. Upon motion made and. seconded the request was unanimously

Councilman Koppe~ Chairman of the Health Committee reported that Wir. R. R. Hughes,
caretaker of the City Dump Grounds, had reported the burning- of a considerable' amount of planking
IV and they needed approximately one thousand feet 0 f 3x12 #2 Grade of plank. The matter was referred

Councilman Page, Chainnan of the Parks Committee,. reported to -the council that the
project for the parks in Skinner's Butte and Spencer' s, Butte were practically completed and

. Mr. Bond further recommended that the City Recorder be insttructed to have 'prepared

CouncHman Bond reported tffi t the State Higlwray Depl rtment :had prepl red a map 0 f the
City of Eugene showing the proper painting of areas for the parking of cars and trucks to assist
lI):n regulating of traffic problems. If the ~eather conditions permitted. they would install the

A report from the Chief of Police, Carl Be~n, regarding the trucking company on
West Fourth Street that was using its residence as a lce.ding and unloading place for vegetables
~and fruits. stated that he had contacted Cecil McAllister and Mr. McAllister reported he had
15 discontinued the storing of fruit and vegetables at this address. . '
In behalf of Councilman Carlson, the City Recorder presented a report requesting that
the following property be dedicated to the public for a street (between 24th and 25th Avenues on
Harris Street)
Beginning at a point 731.69 feet West and 400 feet South of the intersection
of the South line of 23ra Avenue with the West line of University Street
"and run thence West 58 feet~ thence South 146 feet. thence East 58 feet. thence
North 146 feet ~o the place of beginning.
Upon motion made and seconded the recommendation of the Street Connni ttee was approved.

A written request from Delbridge Holcomb, in behalf of his mother Minnie E. Holcomb.
asking the council to reconsider their deois ion am grant her a permit for erecting a porch and
outside steps on the side of her residence at 1190 Monroe Street was presented to the council.
After considerable disoussion and upon motion made and seconded the request was denied.

At this time W~. Roy Morse, acting as chairman for'a group of business men. appeared
before the council and reported the selling of stolen goods to operators of second-hand shops.
It was requested that the council prepare a more stringent control, of the operations of the second-
hand dealers of the City of Eugene. Mr. William Tugrran and Mr. Perry Price also addressed the
council on this subject. After a lengthy discussion concerning the aotion to be taken the
matter was left in the hands of the Judiciary Committee and the City Atto mey to meet ,'lTith the
committee of business men and seoond-hand dealers in order to bring before the next meeting of
the council a proper regulating ordinance.

Mayor Large at this time brought up"the question concerning the use of the building
located on Olive between 13th and 14th by the Pacific Truck Express and it was pointed out that
this vms a non-conforming use. Upon motion made and seconded, the City Recorder was instruoted
to communicate with the head office in POrtland. and notify them tlB. t they have fifteen days
time in which to vacate said premises or the council would be requested to take action and it
was so ordered.
At this time Mayor Elisha barge presented a letter from the Obsidians, Inc. favoring
the sewage disposal plant and urging that the project get under way at once. Tlle letter was
placed on file.

A request from Martin Riis asking for a permit to install a steam press in his home at
1358 East Twenty-Thira Avenue in order to conduct a clothes cleaning and pressing business was
presented. While members of the Board of Appeals felt sympathertic for Mr. Riis in his disability
they recommended -that the request be denied. Upon motion made and duly seconded the recommendation
of the Board was approved.

A letter received by the Board of Appeals from Margaret and Richard K. Guske asking
for arpermit to erect three small duplex houses on the rear of Lot 2 Block 9 University Addition
back of the' Falcon Restaurant at 1426 Onyx Street was presented. Mr. E. E. NJa rt in, member of the
Board of Appeals placed an objection on the ground of building congestion. The other members
of the Board recommended that the request be granted. Upon motion Iilade and duly seoonded
,the request ~s granted.

Communication from the NYA stating that two youthS. had been assigned to Mr. Charles
Sulli van of the Park Department in the caring for Skinner Butte Park was presented and ordered
filed.
The monthly report from the Eugene Public Library for the month of March was presented
and ordered placed on file.
A petition requesting that the Zoning Ordinance be changed to allow the property at
the Northwest corner of Franklin Boulevard and Moss Street to be used as a business property
was presented to the council by Mr. H. B, Freeland. The matter was referred by the council to
the planning Commission and Mr. Freeland to appear before the Planning Commission at its hearing.

An Ordinance re-enacting Ordinance 8583 and nade to conform with the intent of the
~oID~on Council, providing for the establishment, operation and maintenance within and vnthout
the city limits of the City of Eugene of sewage disposal plant or plants, sewers, equipment and
appurtenances necessary, useful or convenient for a complete sewer systema and disposal
plant; establishing just and equitable charges for services upon all ,vater and sewer users;
requiring the Water Board, without charge. to collect such charges from users of water from the
utility and providing for the collection from all water users; providing for the establishment
of a fund for the retirement of any outst~ding bonds and interest and for the completion and
extension of the system was presented to the oouncil for its first reading, passed to its sedond
and third readings by title under suspension of the rules by unanimous consent of the council
and was placed for,final reading. The ayes and nays were called, counoil:men voting aye: lainb
Reid, Bond, Farrington, Hanns, Page, and Koppe; nay, none; absent. Carlson, The ordinance was
declared passed and numbered 8598.

At this time Councilman Farrington requested authority for the Finance Committee to
act in the matter of laying a new floor and floor covering in the office of the City Recorder
preparatory to the installation of new office equipment. Upon motion made and duly seoonded the
request was unanimously approved.

Councilman Hanna, Chairman of the Fire and Water Committee was given authority to
continue his efforts in the 1m tter of establishing fire protection -to di stricts adjacent to the
City of Eugene, It is understood that an annual tax levy might be included in ,the regula.r property
tax for suburban fire protection.

Counoilman Farrington reported that there had'been considerable discussion ~ the
Finance Committee, the City Engineer and Joseph Harrell concerning the erection of proposed
hangars at the airport. It was revealed that the remcrlel ing of the airport dwelling plus a two
plane hangar would cost approxima tely $1100.00. The cost or the hangar would be pa id for by
rentals on a period of five years time. Mr. Frank Seales, a member of a Flying Group, addressed
the council emphasizing the need of add itional hangars at the ai rport. Counci lman Bond s~ gested
preparing a lease or leases for this or other clubs and let them build the hangar according to
the City Engineer's specifications and location and at the end of five years tina the hangar
would revert to the City. The matter was left in the hands of the Finance Committee to report
back:to the Common Council.

At this time City Recorder, C. M. B~Jan, reported tl'at Sarah L. Wright had complained
of the council's action in granting permission to Mr. Bertch to leave the trees in the parking
strip at 2223 Alder Street until fall. The recorder was instructed to canfer with Mr. Bertch and
secure from him a written guarantee that in event the sewer was blocked by the roots of the trees
prior'to this fall that he, Mr. Bertch, would stand the cost of repair. tf not, the trees must
be removed without further delay.

An Ordinance repealing ordinance No. 8571 regulating the cutting-of curbing on any
street or all~ with the City of Eugene was presented, to the council. It had its first reading
and passed to its second and third readings by title under suspension of the rules by unanimous
consent of the council and and was placed for final reading. The ayes and nays were called,
councilmen voting aye: le.mb, Reid, Boni, Farrington, Harms, Page and Koppe; nay, none; absent,
Carlson. The ordinance was declared passed and numbered 8599.

The following five curb cut applications were presented and recommendation of the City
Engineer Clubb approved: E. C. McPherson, 1069 Fourth Avenue West, No. 642, (approved); Clyde
McDougal, 1290 Charnelton, No. 643, (approved); General Petroleum Company, 310 Broad,VaY, (approved);
Arthur Gilbert, 777 Jefferson Street, No. 645, (approved); and Max Rubenstein, 2215 University,
No. 6!.~6, (approved).

The City Recorder at this time presented the annual report of Percy W. Brown for the
year of 1938. The report was referred to the Finance Committee for report at the next meeting.
Upon motion made and seconded, the meeting was herem th adjourned.
