Council Chambers. Eugene. Oregon May 8. 1939 ~' ~ ~'t The minutes of the regular meeting of the Common ,Council held at the hour of q~30 o'clock P.M. May 8,' 1939. 'Mayor Elimha. Large presided over the meeting. Oouncilmenpresent were: Messrs. Lamb, Reid, Bond, Farrington, Hanns, Page and Koppe'; absent; Carlson. The minutes of the precious meeting, April 24, 1939 were presented and ordered filed. The meeting was herewith called to order. The Judiciary Co~nittee reported that Mr. F. L. Ohambers voluntarily agreed to remove the place known as the Yates Hotel without any legal proceedings on the part of the city. Mr. Lamb, 'Chairman of the Judiciary Committee, further reported that in regard to the proposed ordinance for a more stringent control of the operations of the second hand dealers, tha t a meeting had been held on Friday. Nay 5. and another meeting was to be held on Friday, May 12, to hear suggesti ons of the business men and second..hand dealers -and other interested parties. Mr. Calkins, City Attorney, stated that the second hand dealers had all the rights and privileges of any other business and the only form of action to take would be one of restraint. Conoerning the use of the prima-faoie evidenoe in the matter of second-hand dealers it was his, opinion t~t such a rule could not be enforced. Councilman Farrington, Chairman of the Finance Committee, recommended that the offer of Will V. Norris, for $500.00, $125.00 cash and the balance at $8.00 per month plus interest at 6% per year for Lot 24" Block 27, Fairmount Heights Addition be accepted, but that the payments be $15.00 pe~ month plus interest. Upon motion made and seconded the recommendation of the Finance Committee was approved. The acceptance of the offer of Edith F. Gardiner in behalf of her clients, Robert E. and Marcella Toner, for $500.00 for Lot.5, Block 22, Gross Addition (south side of 21st.Avenue, 150 feet from Emerald Street) with a $25.00 deposit and the balance to be paid~when.deed and insured title is ready, was reco~nended by the Finance Committee. Upon motion made and seconded the recommendation of the committee was approved. I 5 ) The acceptance of the offer of W. K. Striker for his client, Carl A. Thorne, $1250.00 j $40.00 deposit, $210.00 when 'contract is received and the balance at $15.00 per month including interest at 6%for the property at 236 Washington Street'iW9ts.recommended by the Finance Co~nittee. Upon motion made and seconded the recommendation was approved. ) A. C. Farrington, Chairman of the Finance Committee, reported the bills for the month of April, 1939, to the council with a recommendation that they be allowed and motion was made, seconded and carried that warrants be drawn for the same. Upon motion made and seconded the r.econnnendation was approved. The ayes and mys were called, Councilmen voting aye: Lamb, Reid, Farrington, Hanns, Page, and Koppe; nay: Bond; Absent: Carlson. Mr. Bond expdained his r'no" vote by reason of his belief ihat the people who wished to use the hangar could lease the ground from the city ani build the hangar themselves. ( 1 Mr. Farrington reported that Mr. Kinney in behalf of the Realty Board was asking the City of Eugene to pay the Real 'b.r Board a commission in the sa~e of a lot to Mr. lance Hart. After a discussion on the matter it was referred t 0 the Judiciary Conuni ttee ani me City Attorney to report back to the council at the next meeting. 8 1 At this time C. M. Bryan, City Recorder, reported that at the present time there was not a contract between the City of Eugene and Joseph Harrell concerning the Il),anagement of, the airport. Upon motion nnde and seconded it was agreed that the 6ity of Eugene enter into a coni:!ract wi th A Joseph Harrell on the same terms as the prl;!sent expired contract and -the contract would be dated as ~ of April 1, 1939 and run for a period of one year and itwas so ordered. Pertaining to the contract for the purchase of Spencer Butte Park instructions were issu ed that warrants be drawn for the payment of taxes, interest and principal in full to Mr. and Mrs. Robert D; Morse andthe balanoe on hand to 'Ida H. Giesy, Elizabeth Clark and Lewis G. Clark. The ayes and nays were,called, Councilmen voting aye: Lemb, Reid, Farrington, BOnd, Hanns, Page, Koppe, nay: none, absent: Carlson. " 1) Councilman Koppe, Chairman of the Health Committee reported that on Clark Street, adjacent to Skinner Butte there have been three houses constructed, said houses having no sewage oonnections or sewa.ge facilities. The matter was referred to the Sewer Connnittee for investigation with a request that they report 'ca.ck at the next meeting of the ~ounoil. - 11 Chairman Koppe further reported that the dwelling at 346 Cheshire Street ~with the sewer but sewer connections were available. Mayor Large requested that 12Jil to the Sewer Committee to see that proper conneotions were made. , , Councilman Page, Chairman of the Parks Comm ttee presented a bill to the council from Mrs. Bucknum amounting to $20.55 for repairs to the sewer located at 2241 Alder Street. Mr. Fage reported that the sewer repair was done on Mrs. Buclmum's property and she was maintaining that the damage was done by the roots of the CottoITnood trees in the parking strip a distance of thirty or thirty five feet. It was the opinion of the committee,tha~ the cottonwood trees \rere not ~ blame and payment of the bill was denied. Upon motion nade and seconded the recommendation of the Parks Comm ttee was unanimously approved. Councilman Page further reported that the Cottonwood 13 trees were being removed qy the City. CoUncilman Bond, Chairman of the Police Commi ttee~ reported that the State Highway Departr.len t had furnished the City Eng~eer's Office with a map of t~e City showi~g the proposed zoning markings in the regulating of traffic in the city. It is.understood that white paint is to be used for parking strips and loading zones and yellow paint for ~traffic purposes swm as safety lanes 14 and bus stops. A letter was received by the Board of A ppeals from Ralph E. Shisler asking for a waiver of the Set-Back Ordinance to allow him to rebuild his store at the Southeast corner of the inter- section of' Thirteenth Avenue and High Street. As Mr. Shisler o,~s the properties on the east and, south of the present store location, the Board feels that ,he can comply ,nth all ordinances without any inconvenience and therefor recommends the. t his request be denied. Shaw asking for,t;l.",reclassification of Lots 1 and 21 Block 31 West Sixth Street Additionl being at the southwest corner of the intersection of Almaden Street and Sixth Avenuel for the purpose of erecting a furniture shop and three multiple unit dwellings, was denied upon the recommendation of the Boara of Appeals. Upon motion made and seconded the recommendation of the Board was approved, Sam Watson addressed the council for a permit to remove his blacksmith shop from 757 Olive Street to the barn at the rear of tne,:lpt at 157 Eleventh Avenue West. Imsmuch as the Board of Appeals had not had an opportunity to" formally report on Mr. Watson's request the matter was referred to the Board of A pp9als for consideration and further report. Earle, State Fire NJarshal urgently requesting the Chief and other members of the Fire Department to attend the Annual Fire School and Conference'of'the Oregon Fire Chiefs' Association in Portland, Oregon 'on June 5,6,' and 7 was presented. After a short discussion, the matter was referred to the Fire and Water Committee for consideration. " The request of'Dora Turney asking that the Zoning Ordinance be changed to allow the property at the northwest corner of FraIL~lin Boulevard and Moss Street to be used as a business property was held for further consideration at the next meeting of tile council. Eleven applications to sell tobacco were presented to the council and approved. C. M. Bryan, City Recorder, pointed out that the total number of applications now numbered 146 with fifty five yet to be taken out. It was recommended that complaints were to be issued against those not having tobacco Ii censes and action to "be taken accordingly and it was so ordered. Bryan ~eported'that the jEugene Water Board had made a turn over of sewage disposal charges for the month of April shmving a total collection during April in the amount of $11-\.57.55/ It was reported that since January 1, 1939, the total billing for sevvage disposa.l charges amounted to ~61126.20. The total collections as of April 30, 1939, were $41822.55, leaving a balance carried forward N~y I, 1959 in the amount of $1,303.65. City Attorney Calkins stated that all users in the City of Eugene were ,paying the charge but that some outside the city limits were avoiding the paymen~s. However I proper action is being taken by the city. Upon motion made and seconded the 1hyor and the 30 City Recorder were authorized to execute the deed., 11/ Mayor Large reported that on Tuesday Yay 9# 1939# at 7:30 P;;'M. a meeting would be held ,A in the Council Chambers in the City of EUgene for ,r~presentatives of Springfield and Glenwood 31 and ~~. Kehrli to explain the proposed consoliJation to the Ci~J of Eugene. 1 1 ) 32 Mayor Large also reported that he had recei ved an invi ta tion from the State Board of Higher Education for the City of Eugene to attend the annual competitive drill between Oregon State College and the Universi~ of Oregon to be held at Corvallis on N~y 19# 1939. ) 33 3) At this time Mayor Large recommended the appointment of B. G. Smith as a member of -the Police Department in the City of Eugene to become effective on May 10# 1939. Upon motion made and seconded the recommendation was unanimously approved. Councilman Page" reported that the NYA Camp at Skinner Butte Park was offering the services o~ several men in painting the park buildings provided the city was willing to furnish the material. ) 35 At this time Mr. Charles Paine addressed the council concerning the use of the building lOcated on Olive Street being used by'the Pacific Truck Express. Mr. Paine was informed that he should obtain from the City Engineer information as to the use of the building. If there is any question on the part of the City Engineer then the council is to take acti?n. At this time Councilman Bond proposed a resolution of sympathy upon the death of the father of C. F. Bergman # Chief of the Police Department and that the same be spread upon the minutes of the city with a copy sent to Chief Bergn~n. Upon motion made and seconded the resolution was unanimously approved. 36 RESOLUTION 1 WHEREAS, Captain John Bergman passed away on l~y 6# 1939# and, vVHEREAS, he was the father of Carl F. Bergman, Chief of Police of the City of Eugene, and was held in high regard am respect by all who knew him, ,NOW# THEREFORE, Be it resolved by the Wayor and the Conunon Council of ih e City of Eugene that while we accept the decreel& of a Supreme Power, yet do wedeplore the loss of a citizen of outstanding worth. That we extend to his family our sincere sympathy and that this resolution be spread upon upon the minutes of this meeting arid a copy forwarded to the family of the departed one.
